property, and further not to object, by the signing of a ballot, to the forrna*ion of
a RID by che resolution method pursuant tA Chapter 36 88 RCW, whicb re-nlution
includes the owner(s) property If a RID is formed by either the petition or
resolution wethod, as provided for in Chapter 36 88 RCW, the ownp-(s) or
successor(s) further agree (1) that the improvements or construction contpnplated
within the proposed RID are feasible, (2) that the benefits to be derived ~'rom the
formation of the RID by the property included therein, together with the amount of
any County parricipation, exceeds the cost and expense of formation of the RID, and
(3) that the property within the proposed RID is sufficiently developed. Provided,
further, the owner(s) or svccessor(s) ahall *-etaia the right, as authorized under
RCW 36 8$ 090, to object to any assessment(s) on the property as a reetalt of the

storage building presently under construction
SUMMARY OF DEPARTMENTAL REQIIIREMENTS:
I Planning Department (456-2205)
A Discussion/Requirements
1 A copy of landscaping and parking requirements were
given to the applicant during the meeting
2 The amount of parking as illustrated on the site plan
is adequate.
3 Parking for the proposed building is to be paved
4 Please submit a letter from Spokane County Air
Pollution Control Authority stating they approve of the
dust palliative method being used to control dust
emissions from portions of the site not required to be
paved

A Discussion/Requirements
1. A sewage system permit has been applied for. The
maximwn capacity for the system is 250 persons per day.
2 Flease verify with the Department of Health that the
the domestic water system is an approved system. Please
Note The water purveyor for the domestic water system is
Maribu Park, the water purveyor for fire protection is
Consolidated Irrigation District
3. The new and existing drainfields must be barricaded in
such a manner that no vehicular traffic may pass over it

1. The Health District is ready to release their portion
of the building permit once the water system is verified
with the Department of Health.
IV Fire District No 1(928-2462)
A Discussion/Requirements
1 Two fire hydrants are required for the proposed

gaaility. We are under ext.rame time pressure because pacific
Sofeiioe Centex needs to coannence se~ting up ite exhibit on
March 19, and has demanded a$50,000 liquidated damaqes c2suse in
the event a Certificate ot OccupancX has not been obtained by
March l. (It i$ possible that this clause is not enforceable,
sinoe it was negotiated in a serfes of letters and telephone calls
and was not inoluded in the doaument that I gsent them for signa-
ture, but they may yet insist on it or they may stiiil be able to
eriforoo it even it it is not in that doaument.) This exhibit is
very zmportant tor the Zoo, because Pacigie safence Center
estintates it Will attraot 80,000 visitors (it attracted over
100,Q00 whan it initfally appeared at the Interstate Fair Gxoundg
in a much poorer faaility a!ew years aqo), whiah is more than our
average annual attendance af about 60,000 per year ovar the last
several years.

monitoring these types of things, and Clyde acknowledged that he
thought the one on the northwestern corner had preexisted the
initial, 1972 permit in favor of the Zoo. Clyde wanted me to ta1k
to you to find out if = should talk to Todd Edmondg or someone else
about definirg who should be responsible for monitoring encroach--
ments, and how to re9olve these twc pxobleme that we know about.
In Any avenC, I offer the fol,lowing sugqestion$ on these
two known encroachments.

Center will be showing its Dinosaur exhibit at the facility After
that, there are no firm bookinqs for the facility, and we certainly
don't expect it to regularly generate nearly as much traffic as we
hope the Dinosaur exhibit does
We hope to attract 80,000 visitors during this six-week period
However, the vast majority of these would be school groups aominq
in buses that hold approximately 35 students each Using an
average of anly 20 visitors per vehicle, we would anticipate a peak
usage in April/May, 1990, of 4,000 vehicles during the
approximately 40 day viewing period, or 100 vehicles per day Even
if the average vehicle contained only 14 persons, this would only
be 200 vehicles per day This is insuf f iciertt to justify widen ing
Euclid Avenue
2 THE WIDTH AND CIIRB REQUIREMENTS DO NOT M[AKE SENSE. There
is anticipated to be no pedestrian traffic to the zoo or exhibit
facility, and because the improvement is about 1/4 mile distance
from the public road, no parking is anticipated on Euclid Avenue
The 40 foot curb-to-curb requirement assumes that there will
be parkinq available along the curb These requirements assume a
normal type of commercial strip development Here, however, the
intprovement is not even visible from the public road, and is a
least 1/4 mile distant (see attached map) There is currently no
pedestrian or bicycle traffic to the zoo, and we don't expect that
to chanqe (except perhaps through the Centennial Trail) Thus, no
sidewalks would be of any use on Euclid Avenue Moreover, there's
no reason anyone would ever park on Euclid Avenue, except in the
event of an emergency or car breakdown In any event, they could
use the existing shoulder of the road
3 THE COST WOULD BE PROHIBITIVE Here, the exhlbit facility
itself will cost $85,040 to $90,000 Kowever, assuming that this
stretch of Euclid Avenue is about 1/ 2 mile in length, and using the
current bonding rates of $5 25 per linear foot for curbs and $8 50
for sidewallcs, the costs of curbs and sidewalks alone would be
about $35,000 The cost of plans, surveys, drainage, and paving
the road itself would cause the cost of this type of road
improvement to far exceed the cost of the building itself
4 THE 244 ACRE PARCEL OYJ WHICH THE ZOO SITS IS LIKELY TO BE
DIVIDED IN THE VERY ATEAR FUTURE, SO IT DOES NOT MAKE SENSE TO
ENCUMBER ALL OF THE PROPERTY THROIIGH THE WAIVER A trust owns the
244 area parcel and allaws the zoo to use it through a"use permit"
that is similar to a lease This parcel includes most of the
frantage on the south side of Euclid that is east of Pines, and

would therefore be burdened with most of the cost of a road
unprovement district, at least for the south portion of Eualid
Avenue
However, the property owners and the zoo are in the midst of
negotiating an arrangement wherein part of the parcel would
presentably be transferred t4 the zoo, and the remainder of the
parcel would be removed from the terms of the permit, and waivered
to the property owners It seems unfair ta "encumber" the portion
that would revert to the property owners with this waiver
SUNIIMARY An exhibit facility is shown on the attached map as the
shaded area adjoining the southwest aorner of the parking lot It
will have perlodic use, and is intended to appeal primarily to
school groups Probably the most intensive during the Dinosaur
exhibit scheduled for April 1, throuqh May 23 Even that use
should qenerate only a minimwn amount of additional traffic on
Euclid, from the standpoint af requiring road improvements
The zoo is under extreme time pressure because of the lease
arrangement with Pacif ic Science Center Pacif ia Science Center is
scheduled to commence ocaupancy in setting up its exhibits on March
19 A representative will be in Spokane to inspect the building on
March 8, and we will have to inform them of the status of the
certif icate of occupancy at that time Pacif ic Science Center has
undertaken consideraEble expense in advertising this exhibit It
already had more than $13,000 children signed up as of about
February 20
In view of the unique circumstances of this project, including the
low amount of traffic, the distance of the improvement from the
public road, the lack of pedestrian traffic, and the lack of need
for public, roadside parkinq, we do not believe this project should
require plans for road approach and drainage, or the waiver of any
objection to the formatxon of an RID

Immediate resolution of this building permit issue is neGesgary
because the Pacifio ScienCo Center is spending about $50,000
pramoting the dinosaur exhibit, and has dezaarided a liquidated
damages clause for that amount a.n the event we do not have a
Certifioate of oaaupancy by March 1.

faaility We are under extrecte time pressure because Pacific
8oierice Cettter needs to commence setting up its exhibit on
March 19, and has demanded a$50,000 liquidated damages clause in
the event a Certificate oF Occupancy hae not been abtained by
March 16 (It ias possible that thss clause is not enforceabls,
since ~t was neqotiated in a series of letters and telephone calls
and was not inaluded in the document that zsent them for signa-
ture, but they may It et insist on it or they ma~' e~till be able to
enforae it sven if iQ not in ti.hat document ) This exhibit is
very important for the Zoo, becausa Pacif iG Saienae Center
estimates it will attract 80,000 visitors (it attractec9 over
100,040 when 3,t initially appeared at the Interstate Fair Gxaunds
in a much poorer facility a few years ago), Whioh is more than our
average annual attendaMCe of about 60,000 per year over the last
severai years.
=n any event, I think the buflding perYnit probiem can be solved in
~ one of two ways Either somep relativaly minor zodifiaations could
be made to t.he Form Na. 6, or yau aould do a ssgregatiQn of ti.he
property The former wou1Q be simpler, provided you thinlt the
modificatidno adequately addreas the eoncerns you expxegsed in your

to any assessment.
It fe coneeivable that the RID could be as long as the
entire length of Eualid Avenue, or as short as a few feat

require the formation of an RID.
Hawever, yeur conaern is that your clients could be
assessed wit.h a relatively high percentage af the total cogt
if there were to be a large RID, because of the Fact that your
clients own a C4t1Siderable atnount of frantage along Eualid
Avenue The important point to keep in mind, that perhaps
wasn'ti clsar from the Form No 6, is that yau retain the right
to object to the method for assessing the property owners
Fax exampZe, if a large RID is impose8 six years from
now, and is predominantly afitributable tv impxovements on the
n2zth eide pf Euclfd, you oan appeal that the narth side
property owners ehould pay 90-95 pexcent of the total cost
rather than ebaring it 50/50 with the south side praperty
owners (as the formula would provide in the absence of an
appeal). These types of adjustments are quite cc=on, accord-
ing to Jerry Sims.
This waivar only provides that the owners will nat objeat
to ths Pormatig,~,i of an RxD. The last sentenae of the first
paragraph specifically acknowledqes that they or their suaces-
sers retain the gtatutory right ta objeGt te any assessment

classif ication of road, and the cqmmitment We would be getting

monitoring these types oF thingS, and Clyae acknowledged that he
thougbt the orie on the northwestern cerner had preaxisted the
initiai, 1972 permit in favor of the zoc. Clyde wanted me to talk
te yau to f#.nd out if I should talk to Todd Edaonds or someone else
about defining who shauld be responsible for n►onitoring encroaCh-
menta, and how to resolve these twa pzoblems that we know about

B Mobile Home/Trailar in the Southwqgt "Bo Bab Burke,
who is president of our Hoard of Regents, spoke last week witb tha
woman who owns the five-acre parcel to the earmt of the "boat, "
