agree to the following•
1. Re'unburse Spokane County far project review and inspection fees as QpeciGed in Chapter 9 14 of the Spokane County Ccxle The fees will be based on actual salary casis incurreci
by Spokane Cvunty for pro,ject reviews and / or inspectivns plus a ten percent
administrative charge, and will be billed monthly as accrued Any billing amounts due,
including any expenses incurced in the collection of an overdue accnunt, must bE paid
prior to the County's acceptance of the project for filing lf a proSect is approved and/or
filed with a balance s1i11 owing, the unpaid balance shal1 be paid within 30 days of the
invoice date
2 The undersigned agrees that these fees are due and payatale upon receipt of the billing as
specified above
3 Any invoices not paid witliin 30 days of tfte invoice date will be cansidered delinquent
If any outstanding balance on the aceount far this project is nat paid within 30 days of
the invvice date, na futtlter reviews af the praject documents will be cflnducted until lhe
entire acconnt balance is paid Any balance on the account for this project not paid
within 65 days Af the invoice date may result in tegal action ar t11e initiation of odier
collection procedures, including referral to a collectien agency T'lie Spansor will be

SHORT PLAT NO. BSP-16-87 ) CONCLUSION AND DECISION
THIS MATTER, an applicetion from William Wagstaff bas been received and
decided upoa, purauant to Spokane County Subdivision regulations, on the 23rd
day of October, 1987.
The Lndividual signing below has further been properly delegated the
responsibility for readering the deciaion by the Spokaae County Director of
planning.
FINDINGS OF F'ACT AND CONCLUSION
:
1. The proposal i8 to divide 27.5 acres iato 27 lots for the development of
iadustrial tracts.
2. The proposal is located adjacent to and north of Montgomery Aveaue south
of the Burlington Northera Railroad tracks and adjacent to the Unioa
PaciEic tracks in Section 8, Tovnahip 25 North, Range 44 E.W.M., Spokane
Couaty, Washington.
3. The current zoning of the property is Restricted Industrial. The
proposed lot sizes, frontage and intended uses are allowed within this
zone.
4. The Spokane Couaty Comprehensive Plan designates this area as
Iadustrial. The development and usea proposed are geoerally in accord
with this planning category.
5. The required SEPA notLCe was provided foc [his proposal aad ageacies
having a potential inteceat in the project were aotified and asked for
recommendations.
6. That in conaideration of the recommeaded conditions and Spokane Couaty
development standards, the proposal is aot detriraental to the public
health, safety and general welfare.
7. That the project is not exempt from enviroameatal review under the State
Environmental Policy Act. (A Declaration of Non-Significance was iesued
on July 1th, 1987 and circulated to 12 agencies for reviev and comment.
There has not been a recommendatioa for a more detailed environmenCal
review).
8. That the approval of the einding Site Plan still requires individual lot
owners to comply With the underlying zoning.
DECISION
Based upon the above noted Findings of Fact, Binding Site Plan
Application BSP-16-87 is hereby APPROYED subject to conditions which ehall be
complied with by the applicant and/or sponsor prior to Fiaalization of the
binding site plan.

PLANNING DEPARTMENT
1. That the below listed conditions of all Departments and Agencies are
binding upon the applicaat, owner(s) of the propecty, heira, euccessors
or asslgns as well as the zoning requirementa on the property.
2. The preliminary Binding Site Plaa of cecord approval is for the propecty
Legally devcTibed in the application for this proposal.
3. That the Final Binding Site PIaA be deaigned substantially in
coDfotmance with the preliminary plat of record as legally described and
advertiaed. No increase of deasity or lot number shall occur wiChout a
nev applicatioa submittal and apptoval.
4. The Spokane CounCy Subdivision Administrator shall revieW any proposed
Final Binding Site Plan to insure compliance with the Findings and
Conditions of Approval.
5. That a Final Binding Site Plan number be indicated before the final plat
is filed; such numbec to be appcoved by the County Aeseseor and the
Planning staff.
6. That appropriate road names be indicated.

Department prior to filing the final binding site plan.
9. The specific and detailed development plan will be submitted for
Planning Department review and approval ae part of the building permit
and prior to isauance oE building permits. The developmeat must be
conaistsnt vith the approved zoning.
10. That a plaa Eor water facilities adequate for domeatic eervice and fire
protection be appcoved by the water eupplier, Fire protection diatrict,
Spokane County Building b Safety Department and County health
authoritiea. The agenciea will certify on the WATER PLAN, prior to the
filing of the final plat or any phase of the preliminary plat that the
plan ia in coaformance with their respectlve needs and regulations. The
WATER PLAN and certification will be drafted on a transparency auitable
for ceproduction.
The purveyor will also certiFy Chat appropriate contractual arrangements
and schedule of improvementa have been made with the plat sponsor for
construction oF the water sysCem in eccordence with the approved WATER
PLAN. The time schedule will provfde for completion of the water system
aad iospection by the appcoprLate health authorities prior to
application for building permits within the final plat. The
artangements or agreements will include a provision holding Spokane
County and the purveyor harmleas from claims by any loC purchaser
refused a building permit due to the failure of the plat aponeor to
satiafactorily complete the approved wetet syatem.
The plat sponsor ehall also sign the WATER PLAN to confirtn the

1. That prior to the fi 1 ing of the Blnding Site Plan the appl icant shal l:
A. Submit to the County Engineer for review and approval plans,
proflles and cross sections as deslgned to County Standards showing the
proposed street centerline and curb grades. These plans shall be
submitted for Montgomery Drive and tfie proposed prlvate roads within the
development. These plans shall be prepared by a Licensed Professional
Civil Engineer.

Spokane County Road Standards indicate that when developments have the
potential to generate more than 200 trips per day, the development
street system should have at least two accesses. The Institute of
Traffic Engineers Trip Generation Manual indicates industrial property
can be expected to generate between 15.6 and 59.9 trips per acre,
depending on land use. Using these numb s, this property would
generate between 420 and 1600 trips er ac . Therefore. Phase I(the
area indicated by lots 1 through 7 an ots 21 through 25) can be
developed with only one access. Any further development beyond Phase I
(the area indicated by lots 8 through 20) shall provide a second access
by extending the private road to Buckeye.
2. That the Binding Site Plan Document shall:
A. Provide for an additional 10' foot setback for bulldings constructed
on lots adjacent to Montgomery Drive which is designated as a Ma3or t~B~R/w
(Principal) Arterlal street. This setback will facilitate the
acquisition of road right of way should it become necessary to wlden
Montgomery Drive in the future.
B. Contaln language which prohibits access to tlontgomery Drive from lot
number one.
C. Contain the following statement:
WARNING: Spokane County has no responsibility to build, improve,
rnaintain or otherwise service the private roads contained within or
providing service to the property described in this Binding Site Plan.

Spokane County assumes no obligation for sa9d private road and the
owners hereby acknowledge that the County has no obligation of any kind
or nature whatsoever to establish, examine, survey, construct, alter,

B. No construction work is to be performed within the existing public
road right of way until a permit has been issued by the Couaty

E. The proposed private road shall be constructed to Buckeye Avenue
prior to the reLease of building permits on the area represented by Lots

regulations of the Spokane County Health pistrict and is further
coaditioned and subject to specific applicaton approval and ieauaace of
permits by the Nealth Diatrict.

agree to authorize the County to place their name(s) on a petition for
the formation of ULID by petition method pursuaat to RCW 36.94 wbich the
petition includes the Owaer(s) property and furCher aot to object by the
signing of a protest petition against the formation of a ULID by
resolution method purauant to RCW Chapter 36.94 which iacludes the
Owner(s) property. PROVIDED, this coadition shall not prohibit the

4. The Department of Building and Safety vill require the applicant to

5. Fire hydrants ahall be located so as to be accessible to fire apparatua

visibility impaired for a diatance of fifty feet ia the direction of
vehicular approach to the hydraat.
6. Specific location of hydrante shall be determined by the Fire Dietrict.
7. The applicant shail provide vecification from the Fire District to the
Department of Building and Safety that provisions have beea made for
adequate f ire protection Qriar to the Yeleaee of building permite.
DBPARTMBNT OF ECOLOGY CONDITIONS:
1. The applicant should be aware that discharge of commercial/indusCrial
wastewater to on-szte syatems is under the jurisdiction of the
Department of Ecology. Such diacharges are generasly prohibited.
