SUBJECT: Status of second (original) dwelling unit located at 10517 East 14th
Avenue/1314 South Oberlin Road
Dear Mr. D'Angelo:
The Spokane County Division of Utilities inquired with the City's Planning Division
about allowance of a second sewer connection for the original dwelling unit located at
10517 East 14th Avenue/1314 South Oberlin Road. Upon investigation into the matter,
we have identified an issue that must be resolved.
In 1994, Spokane County issued a building permit to locate a new manufactured home
on the parcel in question. At that time, Spokane County's zoning regulations did not
allow two separate dwelling units on a single parcel. In order to allow the setting of the
manufactured home the original dwelling was required to either be removed or
converted to a storage structure.
Spokane County issued a permit to convert the original dwelling unit to a 20' x 30'
storage shed, thus bringing the property into compliance with the zoning code. It is not
clear if the dwelling unit was ever converted to a storage unit. We understand that the
original unit which was supposed to be converted to storage is once again being used as
a dwelling unit. The City has no permitting records of any improvements or
conversions back to a residence associated with the original dwelling unit in question.
Further, it appears that the original dwelling unit has been expanded and remodeled.
The City's zoning regulations, similar to the County's, prohibits two primary dwelling
units on a single parcel. At this time the property must be brought into compliance with
the City's zoning code, per the following options:
1. Obtain a building permit and finalize construction to convert the original
dwelling unit to a storage building.

2. Obtain necessary building permits and finalize construction to convert the
original dwelling unit to an accessory dwelling unit (ADU), if the following
criteria are met. See Section 19.40.100 of the Spokane Valley Municipal Code
(SVMC) for full requirements and process.
a. The ADU may not exceed 50% of the habitable square footage of the
primary dwelling unit.
b. One paved off-street parking space shall be required, separate from the main
residence.
c. The ADU shall not have more than two bedrooms.
We will allow until May 31, 2011, for you to obtain a building permit and bring the
property into compliance with the City's zoning regulations.
