THIS MATTER, an application for administrative approval of an exception to the minimum
public street frontage from William L. Kannall has been received and decided,hpon. pursuant to
Section 14.506.020 (6. c.) of the Spokane County Zoning Code on the 5. '1 day of July. 1996.

FINDINGS OF FACT AND CONCLUSIONS •
1 . The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Building and Planning.
2. The property is located in the Spokane Valley, north of and adjacent to the intersection of
14th Avenue and Woodard Street in the SW 1/4 of Section 21, Township 25 N.. Range 44
E.W.M. Spokane County, Washington.
3. The property is tax parcel 45213.9224. The parcel is approximately 0.77 acre, which
complies with the minimum lot size for the UR-3.5 Zone, but does not comply with the
required 80 foot minimum frontage.
4. In 1971. parcels 45213.9224 and 45213.9223 were created with a tax segregation of
45213.9101. Tax parcels 45213.9224 with a 25 foot wide "pan handle" abutting 14th
Avenue was created before 1978, which was zoned Agricultural (A) that required at least
65 feet of frontage. Parcel parcels 45213.9224 was just recently purchased by the
applicant who was unaware of any frontage problem.
5. The creation of tax parcel parcels 45213.9224 for tax purposes did not violate State and
local subdivision laws until the property was sold. State and local subdivision laws
requires property to be formally subdivided with the recording of a Final Subdivision. or a
Final Short Plat before the property is sold, leased or transferred to another party. The
applicant indicates that he was not aware of any violation of these subdivision laws and
appears he could qualify as "innocent purchasers" under the provisions of RCW
58. 17.210.
6. Spokane County Short Plat Ordinance has an exception to the subdivision laws if the
property was created before March 23, 1978. The applicant has applied for a Certificate of
Exemption (CE) under the provisions of 3.?,B 1 (prior to March 13, 1978) of the Short Plat
Ordinance. The CE application was granted July 30, 1996, in conjunction with this
14.506.020 (6. c.) administrative exception.
7. Section 14.506.020 (6. c.) of the Spokane County Zoning Code, allows for administrative
exceptions pursuant administrative criteria. As of November 28, 1995, with the Board of
County Commissioner's Resolution No. 95-1306, public notice to adjacent property
owners is no longer required. Anyone aware of such administrative decision has 20 days
from the date of the decision to appeal it.
8. The current zoning of the property is Urban Residential-3.5 (UR-3.5). The road frontage
for the tax parcel 45213.9224 is 25 feet, N.'hich is 55 feet (68%) less than the UR-3.5
required minimum frontage of 80 feet. The tax parcels 45213.9224 does not "squeeze out"
another parcel by having less than the required road frontage, because the parcel has existed
since 1971. If the parcel did not include the 25 foot strip of land as ownership and instead
had a 25 foot access easement, it would not need this administrative exception.
9. The Spokane County Comprehensive Plan designates this area as URBAN. Parcel
45213.9224 complies with the URBAN designation of the Comprehensive Plan and
supports "fill-in" development.
10. This application is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (13) (a).
11. The approval of this administrative exception for a 30 foot frontage will not adversely affect
the adjacent properties, nor adversely affect the general health, safety and welfare of the
public.
DECISION
Based upon the above noted Findings of Fact and Conclusions, this Administrative Exception
AEE-50-96 is hereby APPROVED, subject to conditions noted below. This decision is final
unless appealed in writing, consistent with adopted appeal procedures.
CONDITIONS OF APPROVAL
1. This administrative determination shall apply to the subject property and may be transferred
to future owners, heirs or any successor in interest to the property subject to the conditions
of approval herein.
2. All Spokane County development standards, as amended, must be complied with when
developing this parcel.
