Mr. Keto laid the house out on the lot - it didn't `work'. Although, the appropriate step at that point would have been to refund project 99007518, our recommendation was to move the house to 15108 E. 18`h Avenue, where he also intended to build, and a new permit, 99007520, was issued to 15122 E. 18th Avenue (see letter dated March 22, 2000). Mr. Keto assumed moving the permit was the option to pursue given our advice. On February 2, 2000 Mr. Keto requested and received an extension on this permit/project (15122 East 8th Avenue) and based on my discussion with Mr. Keto it appears he had a buyer at that point who wished to build a different style/custom house on the lot. Instead of providing Mr. Keto information on refunds and canceling the project we extended the permit. Mr. Keto knew he would be building a different house than permitted under 99007518 but assumed, based on prior actions, that he could either transfer the permit or get a refund. Mr. Keto on March 21, 2000 requested to modify his original permit number 99007518. He was informed that given the proposal was for an entirely new residence and given our inability to credit fees already paid, a new permit would be required and a request for a refund on the original should be submitted. Mr. Keto subsequently obtained an additional permit on March 23, 2000 to build the custom house, which effectively left two active permits for that lot (15122 East 8th Avenue) and he is now requesting a refund on the initial permit. I feel that base on the above a refund should be granted. The Uniform Building Code provides that every permit shall expire by limitation if the work authorized by the permit is not commenced within 180 days from the date of such permit. Section 107.6 of the UBC states that"The building official may authorize refunding of not more than 80 percent of the permit fee paid when no work has been done under a permit issued in accordance with this code." Without your request for extension of the referenced permit, prior to work being commenced, a new permit would have to be obtained, with the fee being one half the amount required for a new permit, provided no changes have been or will be made in the original plans. Your request kept the status of the referenced permit active without having to pay additional fees prior to work being commenced. Because there were changes in the original plan, and due to the fact that the request was received more than 180 days after fee payment, we are unable to refund fees for this project. Veradale, WA 99037 To whom it may concern: On 8/18/99 I paid Spokane County $1 ,572.00 for a building permit for 15122 E. 18th Ct. After staking out the lot for the house I felt the position on the lot would not be good for speculation. I then drew up another set of plans and resubmitted to the department for review and was told my permit fee would be discounted by 20% unless I transferred the plans and permit to an ajoining lot which I owned at 15108 E. 18th Ct. I then paid Spokane County another fee in the amount of $1 ,692.90 for the new plan which I have built. I am a small contractor and cannot afford to have 2 speculative houses sitting on todays market so I decided not to start construction at 15108 E. 18th Ct. until the house sold next door or when I could find a custom buyer. A prospect did come along and after we went through the bank qualifing process and having plans drawn up, we are now ready to begin construction at 15108 E. 18th Ct. Plans have been submitted for review and an application has been filled out. Approximately 1 month ago I called in a request for an extention from staff and she said the request would be entered in the file.
