The County Engineering Department has completed a review of
the above referenced project. The followinq information must be
provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainaqe plan
for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
1. Drainage calculations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of the 208 swale.
6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
C) The following improvements within adjacent Right of Way
are required prior to the release of a buildinq permit:
1. You must submit road and drainage plans for street
improvements. These must be prepared by an
engineer. Plans must be prepared for the following
streets:
a. University
Al1 required construction (sidewalk/curbing/pavement) within
the Public Road Right of Way is to be completed prior to the
release of a building permit or a financial guaranty in an amount
estimated by the County Engineer to cover the cost of
construction or improvements shall be filed with the County
Engineer. Required plans are to be submitted prior to estimatinq
the amount of the financial guaranty or permit release.
5. Approach permits must be obtained from the County
Engineering Department for driveway approaches to
the following streets:

curnently located in the existing building and move it outside on a concx+ete pad and build a
1,092 square foot pole buildicig arouad the paint booth to protect it from the weather.

new manufacturing bwlding was to be bwlL Consequently, many of the plan review
comments were not applicable. The applicant was advised to submit arevised site plan
detailing curnent and pmposed site information.

I. Planning Degartment (456-2205)
e A. Discussion/Requinements
1. The zoning vodes stipulates that the building height be a maximum of 40 feet
above grade.
2. Please submit a revised site pl,an illusaating setbacks, property lines, the
square footage and use,s of proposed and existing buildings, exisang and pro-
posed paved areas.
3. All traveled surfaces are required to be paved.
4. It was stated in a Pre-Construction Confemtae held on Apri19 1990 for a
~ strora~ge building (built at the subject site) that a~te of Fxemptioa had
been obtain for the subject p:roperty.
B. Permit Release Requirements
1. Please submit a revised site plan as described above for review and approval.

II. Division of Engineering & Roads (456-3600)
A. Discussion/Requirement
1. The Division of Engineering & Roads was not present at ihe Pre-Construc-
tion Conference. Written comments were given ta the applicant and the Division
of Buildings.
2. The comments submitted indicate that the Division of Engineering and Roads
is under the impression that a new building is to be built, and therefore is
requiring maad improvements. The apglicant will need to contact Bob Turner at
the Division of Engineering & Roads and inform them of what is aciually being
proposed.
3. For any new hand surfaced areas, for an asphaltic roof, or a roof containing
BVAC rnachineay, a drauna,ge plan for the site shall be prepared in complianice
with Spokane Counfiy Guidelines for Stormwater N1anagerne,nt.
4. An Agreement to Pay Fees was givea to the applicaat during the meeting.
The agreement is to be signed by the owner aad returned to the Division of
Engmeering & Raa,ds. Plan review will not be caompleted untii this document is
executed.
B. Permit Release Requiremeats

III. Health Distdct (456-6040)
A. Discussion/Requirements
1. Please submit a critical materials for the entirre site to the Division of Build-
ings. If it is determinod that the propased is a critical nmteaals user the owner
will be req.uired to sign a Sampliag Agnoement The agreement allows the
Health Distnct to sample the effluent of the septic tank on aa annual basis. All
cost for sample retdeval and analysis shall be paid by the owner.
2. The owner was askecl to give consideration to ext,erior ground clean up.
3. All construction debris is to be taken to a lioensed landfill.
B. Permit Release Requirements
1. If the proposed is not a critical materials user the Healih District is ready to
release their portion of the building penmit. If the proposeid is a critical materials
, user a Sampling Agreeanent must be signal by the awner. Sampling Agreement
can be obtained from the County Heaith Distnct.

N. Air Pollution (456-4727)
1. Air Pollution was not at the Pre-Construction Conference however, comments
were submitted prior to the meeting and are as follows.
2. Air pollutian regulations require that dust emissions during demolition,
construction, and excavation projects be controlled.
3. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
immediate measures must be taken to clean these surfaces.
4. All travelled surfaces must be paved and kept clean.
5. Debris generated as a result of this project must be d.isposed of by mean.s
other than burning.
6. SCAPCA Regula~ion I, Article V. requires that a Notice of Construction and
Application for Approval be submitted to and approved by our ageacy prior to
the construction, installation, or e.stablishment of an air gollution source. This
iacludes paint booths.
7. The Air Pollution Control Authority wishes to confer with the applicant.
V. Fire District No. 1(928-2462)
A. Discussioa/Requiremeants
1. Please submit a copy of the plans for the dry chemical system to be installai
in the paint booth.
2. Acoess to the hydrant located to the west is not accessible. Either the hydrant
or the fence must be moved to pravide access. IF the fence is to be moved, a
muumum of three foot clearance between the hydrant and fence must be
provided. Also a 8 to 10 foot wide gate shall be installed to provide aocess to the
site for fire apgaratus.
3. A lock (Knox) box entry system for fine department personnel aaxss is
required to be installed. Also, a 'ox) pa ~dlock for the gate located nar the
bydrant is requined. Forms for Wering was gnren to the applican~ The com-
gle~ed forms are to be returned to the fire districLInstallation shall be made Prior
to issuanoe of the Cerbificatie of Occupancy.
4. Clyde Wisenor release the District's portion of the building permit.
VI. Division of Buildings (456-3675)
A. Discussion/Requirements
1. Plan review has been completed on preliminary plans by Jun Mascardo.
2. Please submit a revised site plan illustrating PropertY line,s and existing
buildings.
3. Please submit a complete set of engineered plaa for the proposed pole
buildings as well as a detail for oonaection of the pole building to the existing
building.

FINDlNGS AND ORDER
A. INTROOUCTION
This matter having come before the Zoning Hearing Examiner Committee on
February 4, 1982, and the members of the Committee present being
Ron McVicker, Chairman, Kathleen Carstens and Jerry Williams.
B. PROPOSAL
The sponsor, John W. Gillingham, is requesting approval of a change of
conditions, Fite No. ZE-141A-76, Restricted Industrial Zone, for the purpose of
reviewing a modified site pian and obtaining approval for deletion of a portion of
the County Engineer's Condition which prohibits vehicular access to Montgomery
Drive.
C. FINDINGS OF FACT
1. That the existing land use in the area is commercial, manufacturing,
residential, and vacant.
2. That the Comprehensive Plan designates this area as appropriate for
I ndustrial development.
3. That the existing zoning of the property described in the application is
Restricted I ndustrial .
4. That the provisions of RCW 43.21C (The State Environmenta! Poticy Act)
have been complied with, and the Committee concurs with the Declaration of
Non-Significance.

5. That the proper legal requirements for advertisement of the Agenda item
have been fulfilled.
6. That the land in this area is suitable for the proposed use, or uses within
the proposed Zone C{assification.
7. That the applicant has demonstrated that conditions have substarttially
changed since the original zoning of this area and accordingly, the pro-
posed rezone is justified.
8. That the proposed use is compatible with existing uses in the area.
9. That the owners of ad jacent lands expressed neither approval nor
disapproval of the proposed use.
10. The Hearing Examiner Committee finds the proposed use to be in harmony
with the generaf purpose and wi11 not be otherwise detrimental to the public
health, safety, and welfare.

D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL

a) COUNTY PLANN I NG DEPARTMENT
1. Amend original Condition #2 to read: "Approvai of access to subject
property by the Spokane County Engineer's Office.
note: Vehicular access to Oberlin Drive shall be prohibited."
2. Amend originai Candition #3-b to read • "A specific landscape plan,
planting schedule and provisions for maintenance acceptable to the
Spokane County Zoning Administrator shall be submitted with a
performance bond for the proJect prior to release of building permits."
3. All ather conditions of the originat zone change shall be adhered
to in the development of this site.
4. AIl current standards of the Restricted I ndustrial Zone, as
amended, shall be compiied with fn the development of this site.
5. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane Caunty
Commissioners Resolution #77-1332 be initiated by the project
applicant within thirty (30) days of finai disposition of this
appiication, and prior to any on-site improvements.
6. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA
Guidelines (WAC 197-10) and the Spokane County Environmentai
Ordinance (SCEO), a proposed declaration of non-significance
has been issued at least fjfteen (15) days prior to this date; the
official file, written comments and/or pubiic testimony contain
information regarding assessment of the proposal's adverse
impacts to the physical environment; a finding is hereby made
that no potentially significant adverse impacts upon the physical
environment are anticipated as a resu{t of the project; and a
finai deciaration of non-significance is hereby to be issued.
b) CQUNTY ENGI NEER I NG DEPARTMENT
1. Applicant shall dedicate a 20 foot radius on Oberlin and Montgomery
Drive prior to any use of the praperty.
2. Access pernnits shall be obtained from the Spokane County Engineer
prior to the issuance of a butlding permit or any use of the property.
3. Access to Montgomery Drive is hereby allowed, subject to issuance of
approach permits by the Spokane County Engineer.
4. Applicant shall pave 30 feet on Oberlin Road (applies to entire length
of property).
5. Applicant shall construct cement concrete curb and sidewalk adjacent
to the property on Oberlin Road.

b) COUNTY ENGINEERING DEPARTMENT (continued)
6. Applicant shall construct cement concrete curb and sidewalk and pave
to the existing pavement adjacent to the property on Montgomery.
7. Applicant shall submit for approval by the Spokane County
Engineer road, drainage, and access plans prior to the issuance
of a building permit on the property.
8. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
comained on-site sewage system plan and surface water disposal
plan for the entire project prior to the issuance of any
building permit on the property.
9. A parking plan and traffic circulation pian shall be submitted
and approved by the Spokane County Engineer prior to the
issuance of a building permit on the property. The design,
location, and arrangement of parking stalls shall be in accord-
ance with standard traffic engineering practices. Paving or sur-
facing as approved by the County Engineer, will be required for
any portion of the project which is to be occupied or traveled by
vehicles.
10. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors. (Applies to
Oberlin Road only. )
11. To construct the road improvements stated herein, the applicant
may, with the approval of the County Engineer, join in and be a
willing participant in any petition or resolution which purpose is
the formation of a Road I mp rovement Di strict (R I D) for said
improvement pursuant to RCW 36.88, as amended. Spokane
County will not participate in the cost of these improvements.
(Applies to Obertin Road only. )
12. As an alternative method of constructing the road improvement
stated herein, the applicant may, with the approval of the
County Engineer, accomplish the road improvements stated herein
by joining and participating in a County Road Project (CRP) to
the extent of the required road improvement. Spokane County
will not participate in the cost of these improvements. (Applies
to 4berlin Road only. )
13. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.
14. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge
Construction, and other applicable county standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless other-
wise approved by the County Engineer.

1. Pursuant to Board of County Commissioners Reso{ution No. 80-04181
the use of on-site sewer disposal systems is hereby authorized. Thjs
authorization is conditioned on compfiance with all rules and regulations
of the Spokane County Heaith District and is further conditroned and
subJect to specifit application approval and issuance of permits by the
Heaith District.
2. The owner, his heirs or successors shall join and participate in
any petition or resotution which purpose is the formation of a
utiiity local improvement djstrict (ULID) pursuant to RCW,
Chapter 36.94, as amended. The owner, his heirs and suc-
cessors shall further agree not to oppose or protest any legal
assessments for any utility tocal improvement district (ULID)
established pursuant to RCW Chapter 36.94, as amended.
3. Any water service for this project shall be provided in accord-
ance with the Coordinated Water System Ptan for Spokane
Cou rtty .
4. Each unit shall be dauble plumbed fior connection to future area-
wi de col iection system.
d) COUNTY HEALTH DISTRICT
1. A combined surface water and sewage disposai detailed pian shaii be
approved by the County Engineer and the Heaith District prior to the
issuance of any buiiding permit for this project.

2. Subject to specific application approval and issuance of permits
by the Health Officer, the use of an individual on-site sewage
system may be authorized.
3. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department
of Social and Health Services.
4. Use of private wells and water systems is prohibited.
5. Disposal of sewage effluent beneath paved surfaces is currently
proh i bited .
e) COUNTY BU I LDI NG AND SAFETY DEPARTMENT
1. The site is located in Fire District #1
2. Adequate water for fire protection and distribution of such water is
required. A water plan is required to be submitted for approval prior to any land devetopment.
