Dear Ms. Lassey:
In response to your complaint- egarding the requirement for a 10 foot side yard set back
along the east property line . 5617 E 19th/venue the following observations are made:
1. The home, b •efi • ' n of the zoning code, is a single-story dwelling with
daylight basement. The basement space does not meet the definition of a
story in Chapter 14.300 (see attached).
2. Side yards in the UR 3.5 zoning district are required to be five (5) feet per
story. The required side yard setback; therefore, being five (5) feet. The
actual setback to the cantilevered main floor appears to be seven (7) feet
and is; therefore, adequate. (See attached Section 14.616 of Zoning Code)
Hopefully, the intrusion you are feeling can be managed through the voluntary addition of
landscape features and fencing by you and your new neighbors.

Specified Sexual Activities: Human genitals in a state of sexual stimulation or arousal; acts
of human masturbation, sexual intercourse or sodomy; fondling or other erotic touching of
human genitals, pubic region, buttock or female breast.
Story: That portion of a building included between the upper surface of any floor and the
upper surface of the floor next above, except that the topmost story shall be that portion of
a building included between the upper surface of a topmost floor and the ceiling or roof
above. If the finished floor level directly above a usable or unused under-floor space is.
more than six (6)feet above grade as defined herein for more than fifty percent(50%) of
the total perimeter or is more than twelve(12)feet above grade as defined herein at any
point, such usable or unused under-floor space shall be considered as a story.
Street.Public (Private): A public thoroughfare or private thoroughfare the legal description
of which is recorded with the County Auditor either of which affords primary means of
access to abutting property. A recorded private thoroughfare may be a recorded easement
for ingress or egress or a platted street designed as a private thoroughfare for access of
abutting property but for which the County assumes no responsibility or ownership and is
available for use in the abutting property owners only. The private road easements shall
meet the requirements of the Spokane County Road Standards for private roads. The
easements and associated maintenance agreement shall be reviewed and approved by the
County Engineer prior to recording with the County Auditor.
Street.Flanking: One of the two streets abutting a corner lot which is not parallel with the
• lot front line.
Street.Local Access: Street classification per the Spokane County Road Standards.
Structure: Any object constructed or erected which requires location on or in the ground or
is attached to something having a location on the ground(including towers, smokestacks,
overhead transmission lines,captive balloons, etc.)but not including fences or walls used
as fences less than six (6)feet in height. Excluded from this definition are accessory
storage structures for the sole purpose of the owner or occupant less than one hundred
twenty (120) square feet in area not specifically permitted or prohibited by this Title or
written interpretation thereto. Also excluded are docks and piers,but which may still be
governed by the County's Shoreline Program.
Subdivision: Within this Code,includes both short subdivisions and long subdivisions
defined within the Spokane County Short Plat Ordinance and the Spokane County
Subdivision Ordinance.
Temporary Use: A use approved for location on a lot by the Department for a period not to
exceed six (6)months with the intent to discontinue such use after the time period expires.
Tire Salvage Yard: Any area, lot,land,parcel, building, structure or part thereof where
waste, discarded or salvaged tires are exchanged, handled, bought, sold, stored,chipped,
shredded or dumped. Outdoor storage of up to eight hundred(800) tires and the storage of
up to eighteen hundred(1800) tires inside an enclosed building or semitrailer, as an
accessory use to a permitted business use, shall not be considered a Tire Salvage Yard.
Title Notice:
A document recorded with the County Auditor for the purpose of disclosure of important
information, special conditions,restrictions, and/or circumstances that affect the property to
a purchaser, lender and others.

1. Those conditions or safeguards as deemed necessary by the Hearing Body for the
. protection and assurance of the health, safety and welfare of the nearby residences.
14.616.300 Development Standards
Prior to the issuance of a building permit,evidence of compliance with provisions of
Sections 14.616.305 thru 14.616.355 shall be provided to the Department.
14.616.305 Density
The maximum density of dwelling units in the UR-3.5 zone shall be three and one-half
(3-1/2) dwelling units per acre.
34.616.310 Minimum Lot Area
The minimum lot area for residential units in the UR-3.5 zone shall be ten thousand
(10,000) square feet per unit unless otherwise specified or unless units are clustered in a
PUD overlay zone, in which case the minimum lot area shall be six thousand (6,000)
square feet per residential unit provided that the overall density for the site shall not exceed
three and one-half(3-1/2)residential units per acre or unless the residential units are solar
structures as defined in which case the minimum lot area, if approved, shall be seven
thousand(7,000) square feet and the overall density for development shall not exceed four
and one-half(4-1/2)residential units per acre.
14.616.315 Minimum Frontage
The minimum frontage for residential units in the UR-3.5 zone shall be eighty(80) feet on
® a public road or street unless units are clustered in a P.U.D. overlay zone in which case the
minimum frontage shall be fifty (50) feet on a public road or street or unless the residential
units are solar structures as defined in which case the minimum frontage,if approved,may
be as low as forty (40)feet on a public road or street. The minimum frontage for all other
permitted uses that have a principal structure on site shall be eighty (80)feet on a public
road or street. There is no minimum frontage for permitted uses that do not have a
structure on site.
14.616.325 Minimum Yards
The minimum yards and setbacks for permitted and accessory uses in the UR-3.5 zone
shall be as follows:
A. All Uses Except Accessory Uses and Solar Structures
1. Front Yard: A minimum fifty-five(55)-foot setback the centerline of all
roadway rights-of-way or twenty-five(25)-foot setback from the lot front
line, whichever provides the greater setback from the centerline of the
roadway right-of-way.
2. Side Yard: Each lot shall have side yard(s)of at least five(5)feet for each
story of building.
3. Flanking Street Yard: A minimum fifty-five(55)-foot setback from the
centerline of all roadway rights-of-way or twenty-five(25)-foot setback from
the existing property line, whichever provides the greater setback from the
centerline of the roadway right-of-way.
