In response to your complai egarding the r-2uirement for a 10 foot side yard set back
along the east property line . 5617 E 19th • venue the following observations are made:
1. The home, b •efi ' '•n of the zoning code, is a single-story dwelling with
daylight basement. The basement space does not meet the definition of a
story in Chapter 14.300 (see attached).
2. Side yards in the UR 3.5 zoning district are required to be five (5) feet per
story. The required side yard setback; therefore, being five (5) feet. The
actual setback to the cantilevered main floor appears to be seven (7) feet
and is; therefore, adequate. (See attached Section 14.616 of Zoning Code)
Hopefully, the intrusion you are feeling can be managed through the voluntary addition of
landscape features and fencing by you and your new neighbors.
