Dear Sir:
The construction plans for your proposed garage call for walls 12 feet in height. According to
Table R602.3(5) of the 2006 International Residential Code IRC),the maximum height of
laterally unsupported studs is 10 feet. Footnote (a) of that table states, "Listed heights are
distances between points of lateral support placed perpendicular to the plane of the wall.
Increases in unsupported height are permitted where justified by analysis. " The Code and
Commentary Volume 1 of the 2006 International Residential Code further explains, "This table
provides the allowed stud spacing in bearing walls up to 10 feet(3048 mm) high as stated in
Section R602.3.1 As described in Note a increases in unsupported height are permitted where
justified by an engineering analysis. The "unsupported height" of a stud is really the distance
between points of lateral support, which generally occurs at each floor level.
According to the 2006 IRC Section R602.1 Identification. Load-bearing dimension lumber for
studs,plates and headers shall be identified by a grade mark of a lumber grading or inspection
agency that has been approved by an accreditation body that complies with DOCPS 20. In Lieu
of a grade mark, a certification of inspection issued by a lumber grading or inspection agency
meeting the requirements of this section shall be accepted.
According to the 2006 IRC Section R602.1.1 End jointed lumber.Approved end jointed lumber
identified by a grade mark conforming to Section R602.1 may be used interchangeably with
solid-sawn members of the same species and grade.
Since end jointed lumber is also referred to as finger jointed lumber,the use of finger jointed
studs is permitted in load bearing walls. The use of finger jointed or any other dimensional-sawn
studs is allowed for a maximum of 10 feet height without lateral support. Engineering analysis is
required for any stud above that height if not laterally supported by a floor, etc. This means that a
structural engineer must calculate the load bearing lateral support required, design a detail and
stamp the plans. One plan with an original engineer's stamp is required for submittal. Additional

On Tuesday May 6, 2008 at approximately 1:40 pm, Stan Sloan spoke with me at the
Building Department counter at 11703 E. Sprague Avenue, Suite B3, Spokane Valley,
WA 99206. He stated that he was going to pick up the finger jointed studs he had
delivered to the job site of Jim Lambert, because Mr. Lambert no longer wanted them in
his construction project. Mr. Sloan said he was then going to submit a bill to the City of
Spokane Valley and sue the City for those studs. I asked Mr. Sloan the reason. Mr. Sloan
stated that the city building inspector had told Mr. Lambert,that if Mr. Lambert used
those studs, he (the inspector)was going to tear them out. I asked for a card to contact
Mr. Lambert, and Mr. Sloan gave me that card. Mr. Sloan then left in his truck,before I
could contact Mr. Lambert.
I telephoned Mr. Lambert at his place of business (Northwest Tire&Automotive) at the
telephone number(509) 922-2006 at approximately 1:45 pm on May 6, 2008. Mr.
Lambert answered the telephone and identified himself as Jim. I spoke with Mr. Lambert
for approximately 5 minutes. The conversation is as follows:
I told Mr. Lambert that Stan Sloan had just left the Building Department and was going
to pick up the studs and take them away from the construction site (15515 E. 14th Ave.,
Spokane Valley, WA 99037). I told Mr. Lambert that the forger jointed studs were
approved for construction,but Mr. Lambert stated he did not want them anyway. I asked
him the reason. He stated that his construction friends had told him they had never used
finger-jointed studs and would not use them in their construction. Mr. Lambert went on to
say that the cost of the finger jointed studs compared to regular studs was negligible. He
had only bought the fmger-jointed studs because Stan Sloan had said he could make Mr.
Lambert a good deal on the studs and would trade for some work on his(Mr. Sloan's)
motor home.
I asked Mr. Lambert regarding any statements made by the city building inspector about
the finger jointed studs. Mr. Lambert said he had conversed with the city building
inspector about several aspects of the project including the foundation walls. He said that
when he asked the inspector about the studs,the inspector had said he didn't know if they
were approved and if they were approved it might be only every other stud. I asked Mr.
Lambert about Mr. Sloan's statement that if Mr. Lambert used the studs the inspector was
going to tear them out. Mr. Lambert replied that statement was not accurate. Mr. Lambert
said that the inspector had, during the course of the previously mentioned conversation,
said that if any of the construction was not according to code it would have to be
removed.
Mr. Lambert apologized for Mr. Sloan dragging the city into this situation. He went on
to say that he only had a couple of weekends in which his friends could help him build
the structure, and he did not want any problems especially with his friends. He said that
Mr. Sloan was only involved because of the purchase of the finger-jointed studs. He also
stated that it would be he (Mr. Lambert)who would be obtaining an engineer to do the
analysis.

My analysis of the conversation with Mr. Lambert was that Mr. Lambert did not believe
the finger-jointed studs were a great bargain compared with regular studs, and his
construction friends were not enamored with finger jointed studs. He especially did not
want to alienate his friends,who were helping to build the structure.

Dear Stan,
I spoke with Tom Melborne with the Spokane Valley Planning Commission, and
per our conversation all walls over 10' require lateral bracing. Building plans need to be
engineered for a 12' wall with lateral bracing. Trumark fmger jointed studs are
acceptable,but must be used with lateral bracing at this wall height. Lateral bracing is
required on 10' and above walls,regardless of whether solid studs or finger jointed studs
are used.

Stan Sloan constructed a 40'x 60' for us about ten years ago at our property on Argonne
Road.
The studs which were used were supplied by Trumark Industries located at 4020 E Main
Ave. in Spokane, Washington. These finger glued studs are 2"x 6"and are 10 feet long
and are true as they were the day they were installed..

I am in receipt of your letter of May 6, 2008 directed to Jim Lambert in which you indicate that ANY
stud wall in excess of 10 feet requires the approval of an engineer regardless of the material used.
I have furnished 12-foot finger jointed studs to Mr. Lambert to be used in his 40x60 building at E.
15515 14th Ave. On more than one occasion Mr. Lambert informed me that your building inspector told
him that the finger jointed studs were unacceptable. As a result Mr. Lambert told me to pick up and
remove the defective finger jointed studs that I delivered to his construction site.
I possess a degree in Building Construction Management from Washington State University, which
encompasses 2 years of architectural engineering.
Having been in the building business over 50 years I've used finger jointed studs repeatedly with NO
complaints from anyone including but not limited to the building inspectors of Spokane County.
I trust this matter can be resolved. Mr. Lambert can and will provide you with an engineers approval.

RE: Lateral Design of new shop building
Mr. Lambert
Per your request, and subsequent to our conversations with Tom at the Building
Department, we have performed a lateral analysis of the new shop as depicted in the
sketches you provided, per IBC 2006 for both an 85MPH Exposure B wind and a Seismic
Design Category C event. These analyses show the structure's walls as depicted will
meet or exceed the IBC lateral design code requirements if all of the following
specifications are strictly adhered to.
1. Use Douglas Fir(DF)#2 (S4S) or better for all wall studs, plates, and headers. All
framing members to have a"dry" rated moisture content (<19%). Sill plates in direct
contact with concrete: California Foundation Grade Redwood or Species Group B
Pressure Treated Lumber.
2. Structural wall sheathing- Wall Sheathing- 7/16" APA Exposure 1. Structurally
sheath all framed exteriors prior to siding. Block all panel edges and nail with
common 8d nails @4"oc edge and 12"oc field.
3. Provide Simpson HD8A holddown anchors in 7/8" anchor bolts bolted to 4x6 panel
end members with three 7/8" machine bolts per the Simpson literature in the
following 6 locations- at each end of each 4'0" shear panel between the garage doors
and between the garage doors and the corners.
4. Nailing, blocking, and all other construction details per IBC unless noted otherwise.
