NORTON GRAVEL PIT APPLICATI021 J Mr. Hawley: This request for a special permit for the operation and main- tenance ot a gravel pit and rock crusher was filed wi.th the Commission on August 18, and a public hearing held on August 29 to consider the same. No decision was reached by the Corimission at that hearing, and considera- tion of thv applioation postponed until October 17, at which time discus- ~ sion was had both at open meeting and executive session on the merits of • the applice►tion. The Coimnission postponed decision with the request that a committee, conposed of Messrs. Chaffins, Rich.ardson, and Hawley, report to the Commission at the November meeting relative to the wording'and the suaount of a bond to be posted by Mr. Norton for the faithful per£ormance of his permit. The committee reconnmends the following wording to be writ- ten on the bond : "Fxcavation will not be made below an eleve►tion thet is 5 feet below the base rail of the C. M. & St. P. Rye and exca.vation wil2 not be ma.de closer than 100 feot from the northern boundary of the tract where thQ site of the proposed pit is located. Rejects or by-products will not be pormitted to aecumulate. Provisions to Rccomodate the efflu- ent fram dewatering of washod grave2 will be provided so as not to be harm£ul to lort►er adjacent propcrty. A bond in the st,IIn of $5,000 to be re- newed and kept in force and effect as long as said gra:vel pit is used e.nd oparated." Mr. Cornelius: This matter was discussed pretty fully at the last meet- ing. Mr. Norton is perf.eotly willing to abide by the speci£icationa that Qre set forth in the report of the committee. He is willing to do as is stated and will furnish the bond. Mr. Rutter: That is what put it over. Tir. Cornerius: The eammittee is justified in requiring a bond. I feel that the requirements are well within reason. Mr. Hawley: Mr. Richa.rdson is here. Dr. Richardson: If a bond were written similar to that, it seems it rrould = the purpose. All formalities o£ advertising and posting have been duplicated for this hearing and 16 owners of adjacent property have been ' notified by mail of the tine and place of the hearing. Fosseen and Hienz and Conuaissioner Lockwood had previously visited the site. His proposal novr is to ezcavate not closer than 100 feet froin his own property line. He wfll make that 100 fQRt into lots or use it f'or agri- cultural purposes so that nobody will owm property closer than 130 feet f'rom the excavation at any time. He is a►illing to conform to all regula- tions of the Countv Engineer or Planning Board as to the depth end manrier he should keep his slopes; he is willing to sign an agreement. He is also willing to protect the excavation by a fence or YrhQtever manner you might suggest so it will not be dangerous to anybody who might be around there. I know that a man will not spend several thou- sand dollars developing around Q gravel pit. Mr. Corr_elius : I notice Mr. Lay is in favor of it; practically most of the petition opposed to it is no longer valid. There isn't any question at all abolit a21 af Spokane Valley being taken for gravel pits. Most of it is not suitable f'or gra.vei pits as it doesn't have the railroad. Mr. Norton: There is no dust from our plan of operations. Mr. Murch: There is one other matter I would like to bring up. I am =y in favor of industrial development, but I don't believe the.t a min- ing developrient is e, proper industrial development. It is something dif- ferent from industry. I balieve a great amount of consideration should be given to that pofnt. Mr. Cornelius: With reference to a gravel pit, as ?dr. Murch said, the • City of Spokane is trying to get them vut of the city. But you have to • have gravel pits sor.Lewhere in order to build houses Qnd you can't get ~ theM 100 milas from thore.
