FINDINGS OF FACT AND CUNCLUSIONS
1. 'I'he individual signing belaw has furilier been properly delegateci ttie responsibility for
rendering the decision by the Spokanc: Counry Direccor of Planning.
2. The prnposal is to divide approximately 1.5 acres into 21ots for duplexes and those uses
permitted in the underlying zone.
3. The proposal is generally located 135 feet north of Sprague Road, approxirnately 300 feec
west of Barker Road in the SE 1J4 of Section 18, Township 25 iVorth, Range 45 E.W.M.
Spokane County, Washington.
4. The existing zoning of the property described in the application is Urban Residential-3.5
(UR-3.5), previously established as Agricultural (A) (f ilc # 376-58) zoning in 195$ and
redesignated to UR-3.5 on January 1, 1991 pursuant to the Pmgram to Implemcnt the
Spokane County Zoning Code. Pursuant to RCW 58.17.195 the propasal does conform
to the requirements of the existing UR-3.5 zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed are generally in accord with this category.
6. Surrounding uses :irc primarily single and nlultifamily residences on mixed urbdn size locs
and open space. Industrial and conu-nercial uses are located north of the sice.
7. Thc: required public noace was prnvided for chis propasal aricl agencies having a potenrial
interest in the pro,ject were notified and recommendalions solicited..
Wriuen comments were received from an adjoining property owner who opposes the
proposed plat. The property owner contend that the density of the proposed plat shoulci be
kept at vr below the existing 3.5 dwelling units per acre. In addition, the owner contend
that thzre is no direct access to the proposed plat and is concerned about the unpact of
additional traffic this nroposal will have on the neighborhood.
Response to the above comment regarding the issue of density are adrlressed by the Goals
and Objecuves of the Urban Category of the Comprehensive Plan, which encourages fill-
in development withi.n escablished development areas where utilities, arterials, schools and
community facilities are exisung. The Urban Category also encourages a variety of
housing types and densities, a4nd discourages development that does not provide a healthy
and pleasing environment to the County's residential areas.
The applicant has indicated that access to Lots A and B will each be served by a 30 foot
wide private road (easement). The Counry Division of Engineering and Roads will
address the issue of a-affic in the area.
9. The site is located within the Public Transportation BLnefit Area (PTBA). The Spokane
Transit Authority (STA) East Sprague Route # 9 provides connecting services to the site.
lU. The propQSed short plat will be served by a public; water system. Waste water disposal
will be as authorized by the Director of Utilities.
11. The Spokane County Parks Department has commented on the proposed short plac. The
Parks Depardment has requested a voluntary agreement be completed between the Parks
Department and the propercy owner to mitigate impacts to the County Park system.
County legal counsel has indicated such agreements may be required. The Spokane
Counry Planning Departiment recommcnds the property owner negotiate with the Spokanc;
County Parks Department to provide tor appropriate capital facilities as required by the
Revised Code of Washington (RCW) 58.17.110. Approval of this short plat shouid
include conditions requiring that provisions for appropriate facilities be in place prior to
record.ing this #'inal plat in the fotm of a written agreement between the owner and the

12. The Central Vallley School District No. 356 has commented on the proposed Short Plat.
The Discricc has indicated that exisdng school facilities are inadequate to serve the
proposed short plat and wishes to negotiate with the owner to provide adequate capital
faciliaes as required by the Revised Code of Washington (RCW) 58.17.110. Review by
County legal counsel ind.icates the cond.ition requested by Lhe School District ean be
required for developments. Approval of this short plat should include conditions requiring
that provisions for appropriate facilities be in place prior to recording the final short plac in
Lhe form of a written agreement between the owner and Lhe schnol district.
13. The proposed short plat has direct acCess to public right af way at Sprague Avenue. Na
sidewalks were required by the County Engineer regarding chis propasal.
14. Recognizing the recommended coriditions and Spokane Counry development standards,
the proposed short subdivision makes appropriate provisions for the public health, safety
and general welfare and that the public use and interest will be serveti by platting the
subdivision.
The subdivision proposal is generally consistent with RCW 5$.17 and the Counry
subdivision regulations, promoting Lhe public: health, safety and general welfare in
accordance with standards escablished by the state and Spokane County. 1fie Planning
Department has considered the pravision of adequate public faciliaes as cited in RCW
58.17.110 (2). More specifically:
a. open spaces
b . drainage ways
c. public and/ar private rights-of-way
d. transit
e. potable water
f. sanitary waste disposal
g. parks and recreadon faciliries
h. playgrounds
i. schools and schoolgrnunds
j. sidewalks
15. The project is exempt from environmental review under the State Environmental Poiicy
Act pursuant to WAC 197-11-500 (b) (a).
16. The following facts are also relevant:
a. The Urban Residential-3.5 (UR-3.5) zone does allow duplexes for lots which are
twice the minimum lot size required for single family units or 20,000 square feeL
The applicant has proposed duplexes on Lots A and B.
b. This proposal was received by t11e Planning Deparnnent prior to January 1, 1994 and
the implementation of new Washington State Board of Health regulations on the use
af on-sice sewage disposal systems.
DECISIQN
Based upon che above noted Findings of Fact and Conclusions, Short Plat Applicarion SP-910-
93 is hereby APPROVED until February I, 1997, subjeet to conditions noted below. Most
of the conditions of approval shall be aecomplished by the applicant and/or sponsor priar to
f nalization of the short subdivision. This decision is final -unless appealed in writing,
consistenc wich adopte,d dppea.l pra;e,dures.
COUNTY PLANNING DEPART11sIENT CONDITIUNS
1. All condiaons iniposed by Lhe Planning Department shall be binding on the "Applicant",
which cerm shall include the owner or owners of the property, heirs, assigns and
sucCeSSOrs.
2. The proposal shall comply with the'Jrban Residential-3.5 (UR-3.5) zone as amended.
3. The final plat shall be desigoed substantially in confonnance with the preliminary plat of
record. No increase of density or number of lots shall occur without a change of condiuan
application submittal and approval.

4. The Planning Director/designee shall review any proposed final plat to ensure compliance
with these Findings and Conditions of Approval.
5. The preliminary plat is given conditional approval for three (3) years, specifically to
February I, 1997. The applicant may request an extension of time by submitting a written
request approximutety forty-five (45) days prior to the dbove expirauon date.
6. Three (3) current certificates of utle shall be furnished to the Planning Department prior
to filing the final plat.
7. Appropriate uLiiiry easements shall be indicated on copies of the proposed fnal plat.
Written approval of utility easements by appropriate uality companies shall be received
with the subnvttal of the final plat,
8. Appropriate rorad name(s) shaU be indicated.
9. The final plat map shall indicate by a clear, dashed line the reyuired yard setbacks from all
private, "Tract X" or public roads. The dedication shall Contain che following statement:
"Side yard and rear yard setbacks shall be determined at the time building pernucs arf:
requesced unless these setbacks arc specifically drafted on this final plat. The setbacks
indicated on this plat may be v:uied from if proper zoning approvals are obtained."
10. No water plan is required, and a simple tap is needed at the rime of building pernvt release.
11. The owner shall negotiate with the County Parks Department ana submit a recorded copy
of a voluntary agreement making provisions for publie parks prior to finalization and
recording of the plat. The agreement shall provide a written desGription of the subject
praperty to which the agreement applies and also state the dollar amount and any other
agreed to mitigating measures.
The owner shall also notify any pocential purchasers who have made an agreement to
purchase property within said plat pursuant to the Revised Code of Washington (RCW)
5$.17.205, that adequate provisions for park facilides must be made cand.itioned on a
future agreemcnt between the plattor and Spokane Counry Parks Department.
Voluntary agreements between the owner and Spokane County Parks Deparement sha11
conform to the requirements of RCW Chapter 82.02.
12. The owner shdll negoaate with Central Valley School Districc and submit a recorded copy
of a voluncary agreement making provisions for public schools prior to finalization and
recording of the plat. The agreement shall proNride a written desenpaon of the subjec:c
proPerty to which che agreement applies and also state the dollar amount and any other

The owner shall also notify any potendal purchasers who have ma.de an agreement to
purchase property within said plat pursuant to the Revised Code of Wdshington (RCW)
58.17.205, that adequate provislons for sehool facilities must be made conditioned on a
fucure agreement between the plattor and school district.
Voluntary agreements between the owner 1nd school distriet shall conform to the
requirements of RCW Chapter 82.02.
13. A survey is reyuired prior to the filing of 3 final plat.
COUNTY DIVISION OF ENGINEERING AND RUADS CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to dedicaaon
of right-of-way and approval of the road system as indicated in the preliminary plat of
record.

be submitted to the County Engineer for approval prior to construccion andlor the filing of

Civil Engineer.
4. Na construction work is to be perfornied widlin the existing or proposed public right-of-
way until a permit has been issued by the County Engincer. All work is subject to
inspection and approval by the County Engineer.
5. individual driveway access permits are rcquired prior to issuance of a building pezmit for
driveway approaches to the county road syscem.
6. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County smndards.
7. The word "applicant" shall include the owner or owners of the prnperty, his heirs, assigns
and sucCessors.
8. The following statement shall be placed in the plat dedication:
"'I'he owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a pedtion for the formacion of a Road Improvement District (RID) by the
petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s)'
propercy, and further not to object, by the signing of a ballot, to the formation of an RID
by the resolution method pursuant to Chapter 36.88 RCW, which resolution includes the
owner(s)' properry. ,If an RID is formed by either the perition or resolution method as
provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree:
(a) chat the improvement(s) or construction tontemplated within the proposed RID is
feasible;
(b) that the benefits to be derived from t}ie fomiation Qf the RID by the property included
therein, together with the amount of any County participation, exceed the cost and
expense of formation of thc RID; and
(e) that the propercy within the proNosed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall reta.in the right, as authorizeci
under RCW 36.88.090, to object to any assessment(s) on the property as a result of
the improvements called for in conjuncrion with the formation of an RID by either
petition or resolution method under Chapter 36.88 RCW, and to appeal to the
Superior Court the decision of the Board of County Commissioners affuming the
final assessment roll.
It is further agreed that at such time as an KID is created or any Road Improvement
Project is sanctioned by Spokane County, the improvennents required (curb,
sidewalk, drainage control and paving) will be at the sole expense of the undersigned
owner(s), their heirs, grantees and assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) vears from the
date of execution below. However, the owner(s) or successor(s) agree that if said
RID waiver expires without construction of the required improvements, the owner(s)
or successor(s) agree to construct the required improvements at their own expense,
pay to Spokane County the then estimated cost of the requ.i.red impravements to
enable the County to complete the same, or furnish a bond or other secure method
suitable to the County (which may include tlie execution of another RID waiver
agreement) providing for or securing to the County the actual construction of the
improvcments.
All oF the reyuirements of ctlis agreemetit shall run with the land and shall be binding
upon the owner(x), their successor(s) or assign(s)." I'his provision is applicable to
Sprague Avenue.
9. The proposed private road(s) as shown on the preliminary plat serving cwo Iots with
extension to serve eight (8) or fewer lots is approved by the County Engineer.
10. Private road(s) shall be improved to Spnkane County standard for a Urban private road
standard serving two lots.
11. All vesteci owners shall sign xnd record pcivate road documents as prescribed by the
Spokane County Engineer. These documents shall be reviewed and approved by the

Spokane County Engineer prior to recording with tlic Spokane County Auditor.
Record.ing numbers shall be rcferenced in the dedicatory language of the plat.
12. The follnwing scatement shall be placed in the plat tiedication:
"WARNING: Spokane Councy has no responsibiliry to build, improve, maintain or
otlierwise service the private roads contained within or providing service to the property
described in this plat. By accepting this plat or subsequently by allowing a bulld.ing permit
to be issued on property on a private road, Spokane County assumes na obligadon for
said private road, and the owners hercby acknowlecige that the County has no obligaLion
nf any kind or nacure whatsoever to establish, examine, survey, construct, alter, repair,
improve, maintain or provide drainage or snow removal on a private road. This
requirement is and shall run with the land and shall be binding upon the owner(s), their
heirs, successors or assigns, including the obligarion to participate in the maintenance of
the private road as provided herein."
13. The proposed plac shall be improved to the standards set forth in Spokane County Board
of Commissioners Resolution No. 80-1592, as amende.d, which resolution establishes
regularions for roads, approaches, drainage and fees in new construction.
14. The County Engineer has examinei this development proposal dnd has detenni.ned chat the
impact of this proposal upon the existing county road system warrants the dedication of
additional right-of-way and the roadway improvements hereiii specified.
15. The following statement shall be placed in the final plat dedication: "The private road as
shown hereon is an easement which provides a means of ingress and egress for thase Iots

2. Appropriate utility easements shall be indicated on copies of the preliminary plat of record
for distribution by the Planning Department to the utility companies, Spokane Couney
Engineer and the Spokane County Health Discrict. Wricten approval of the easemencs by
the utility compaliies must be received prior to the submittal of the final plat.
3. Sewage clisposal mechod shalt be as autliorized by the Direc:tor of Utilities, Spokane
County.
4. Water service shall be coordinated tluough the Director of Utilities, Spokane County.
5. Water service shall be by an existing public water supgly when approved by the Regional
Engineer (Spokane), State Departinent of Health.
6. Yrior to Filing the final plat, the sponsor shall demonstrate tn the satisfaction of the
Spokane County IIealth District that an adequate and potable water supply is available co
each tract of the plat.
7. Frior to filing the final plat, the sponsor stiall present evidence tliat tlie plat lics witliin the
recorded service area of the water syscem proposed to serve the plat.

8. Prior to filing the final plac, the sponsor shall demonstrate to thc satisfaction of the
Spokane County Health District that suitable sites for on-site sewage disposal systems are
available on both cracts.
9. Subject to specific application approval and issuance of perniits by the Health Officer, the
use of individual on-site sewage disposal systems may be authorized.
10. I he dedicatory language of rhe plat will scate: "S ubject to specific applicadan approval and
issuance of permits by the Health Officer, the use of individual on-site sewage syscems
may be authorized."
11. The dedicatory language on the piat shall state: "Use of private wells and water systems is
pzohibited."
12. The plat dedicaaon shall contain a statement to the effect that: "The public water system,
pursuant to the Water Plan approved by county and state health auchorides, the local fire
procection district, water purveyor and Counry Division of Buildings, shall be installed
within this plat, and the applicant shall provide for individual domestic water service as
well as fire protecuon to each tract prior to sale of each tract and prior co issuance of a
building pemvt for each tract."
CUUNTY DIVISION OF UTILITIES CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-
site sewer disposal systems is hereby authorized. This authorizadon is conditioned on
complia.nce with all rules and regulations of the Spoknne County Health District and is
