THIS MATTER, an application for subdivision of land, from Ken and LeAnn 1*Pffd~6e~it:<";~~ y
received and decided upon, pursuant to Spokane County Subdivisioa regulations, on the
day of March, 1994.
FINDINGS OF FACT AND CONCLUSIONS
1. The i.ndividual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide approximately 1.52 acres into 31ots far 1 existing single family
residence and 2 additional residential lots and those uses pernutted in the underlying zone.
3. The proposal is generally located southwest of the intersection of Burns Road and 12th
Avenue and approximately 140 feet narth of 14th Avenue, in the SE 1/4 of Section 23,
Township 25 North, Range 44 E.W.M. Spokane County, Washington.
4. The existing zoning of the property described in the application is Urban Residential-3.5 ([JR-
3.5), previously established as Agricultural (A) (file # 60-42) zoning in 1942 and redesignated
to UR-3.5 on January 1, 1991, pursuant to the Program to Implement the Spokane Counry
Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform to the requirements of
the existing UR-3.5 zone.
5. The Spokane County Comprehensive Plan designates ttus area as Urban. The development
and uses proposed are generally in accord with this category.
6. Surrounding uses are primarily single family residences on mixed urban size lots and open
space. Adams Elementary School, Central Va11ey High School and Evergreen Junior High
School are located within approxirnately 1/8 miie radius from the site.
7. The requir+ed public notice was provided for this proposai and agencies having a potenrial
interest in the project were notifie.d and recommendations solicited.
8. No written cotnments were received from any adjoining property owners.
9. The site is located within the Public Transportation Benefit Area (PTBA). The Spokane
Trdnsit Authority (STA) Valley/24th Avenue Route # 21 and Valley/32nd Avenue Route # 22
provides connecting services to the site.
10. The proposed short plat will be served by a public water system. Waste water disposal will be
as authorized by the Director of Utilities.
11. The Spokane County Parks Department has commented on the proposed short plat. Tbe
Parlcs Department has requested a voluntary agreement be completed between the Parks
Department and the property owner to midgate impacts to the Caunty Park system. County
legai counsel has ind.icated such agreements may be required. The Spokane County Planning
Department recommends the pmperty owner negotiate with the Spokane County Parks
Department to provide for appropriate capital facilities as required by the Revised Code of
Washington (RCW) 58.17.110. Approval of this shart plat should include condirions
requiring that provisions far appropnate facilities be in place prior to recording this final plat in
the form of a w+ritten agreement between the owner and the Spokane County Parks Department
12. The Central Valley School District No. 356 has commented on the pmposed Short Plat. The
Disdrict has indicated that existing school facilicies are inadequate to serve the proposed short
plat and wishes to negotiate with the owner to pmvide adequate capital facilities as reqnired by
the Revised Code of Washington (RCV) 58.17.110. Review by County legal counsel
indicates the condition requested by the School District can be requu-ed for developments.
Approval of this short plat should include conditions requiring that provisions for appropriate
facilities be in place pnor to recording the final short plat in the form of a written agreement
between the owner and the school d.istricL
13. The proposed short plat has direct access to public right of way at 12th Avenue. Thirteenth
Avenue will be extended to the east of a private Tract "X" road to provide access to 21ots. No
sidewalks were requested by the Counry Engineer reganding this proposal.

14. Recognizing the recornmended conditions and Spokane County development standards, the
proposed short subdivision makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision
regulations, promoting the public health, safety and general welfare in accordance with
standards established by the state and Spokane County. The Pianning Department has
considered the provision of adequate public facilities as cited in RCW 58.17.110 (2). More
specif cally:
a. open spaces
b. drainage ways
c. public andJor private rights-of-way
d. transit
e. potable water
f. sanitary waste disposal
g. parks and recreation facilities
h . playgrounds
i. schools and schoolgrovnds
j. sidewalks
15. An Enviranmental Checklist was submitted by the sponsor and was reviewed by the County
Planning Department. The review considered the specifics of the proposal, other available
information, County ordinances, other regulations and laws, possible standard Condirions of
Approval, the Generalized Comprehensive Plan, and other County policies and guidelines.
The Planning Deparnnent has determined that "No probable significant adverse impacts"
would result from the proposal being developed and has issued aDggrmin&ion of
blon i ce, ("DNS
The "DNS" was cinculated to 9 other agencies of jurisdicrion and other agenciesldepartments
affected by the future development for review and comment The "DNS" comment period
ends March 3, 1994 and was advertised 15 calendar days before said date in the newspaper,
by letter to adjacent property owners. The Planning Department has not received additional
conunents.
16. The following facts are also relevant:
a. The proposed Short Plat is a replat of Lot "B" of Short Plat 82-214, which was recorded
as a finai plat on Deceniber 14, 1982.
b. One storage structure, detached, private, is pemaitted inside the Urban Impact Area (UTA)
boundary, limited in area to 1,500 square feet and provided setbacks and maximum
buildi.ag coverage standards are met.
c. Subdivision of property should not allow the crearion of nonconforming setbacks for
existing structures. Compliance with setback standards in the UR-3.5 zone may require
either an adjustment of che property lines or removal of the potenrial nonconfomung
structure.
d. The Urban Residentia]-3.5 (UR-3.5) zone does allow duplexes for lots which are twice
the minimum lot size required for single family units or 20,000 square feet. Tract "C"
does has the potential for a duplex.
DECISION
Based upon the above noted Find.ings of Fact and Conclusions, Short Plat Application SP-911-93
is hereby APPROVED until April 1, 1997, subject to canditions noted below. Most of the
conditions of approval shall be accomplished by the applicant and/or sponsor prior to finalization
of the short subdivxsion. This decision is final unless appealed in writing, consistent with adopted
appeal procedures.
CUUNTY PLANNING DEPARTMENT CONDITIONS
1. All conditions imposed by the Planning Departmeat shall be binding on the "Applicant",
which tetm shall include the owner or owners of the property, heirs, assigns and successors.
2. The proposal shall comply with the Urban Residendal-3.5 (UR-3.5) zone as amended.

13. No building permit wil1 be issued for any Iot vvithin t.he final plat until certified by a
Wasbington state 1icensed eagineer that "the water system has been installed pursuant to the
appraved Water- Plan for the fin.al plat" including a signed li.eense stamp. The cer tif"ication, may
be in the form of a letter, but is prefersed w be c+ertified on a copy of the W atex Plan as a
schematic map showi.ng the "as-buiit" water system.
14. The Water Plan and the above four (4) conditians of approval regarding the Water Plan may
be waived by the Planning Director/designee upan receipt of letters from the appropriate water
puxveyor and fire protectian district stating that simple connections to an existing, aPFroved
water system will provide adequate domesdc and fire protection water to ensuTe the public
health, safety and general welfare.
15. The awner shaU negotiate with the County parks Department and submit a recorded copy of a
valuntary agreement maldng proviszons far public parks pricyr to finalization and recorcii,ng of
the plat The agreement shall prQVide a written descnption af the subject praperty to which the
agreement applies and also state the daliar amount and any other agreed to midgating
measures.

The owrier shall also notify any potential pwrchasers who have made an agreement to purchase
property within said plat pursuant to the Revised Code of Washington (RCVV) 58.17.205, that
adequate provisions for park facilities must be made conditioned on a future agreement
between the platt4r and Spokane County Parks DepartmenL
Voluntary agreements between the owner and Spokane County Parks Department shall
confarna to the requirements of RCW Chapter 82.02.
16. The owner shall negoriate with Centrai Valley School District and submit a recorded copy of a
voluntary agreement making provisions for public schools prior to finaiization and recording
of the plat. The agreement shall provide a written description of the subject property to which
the agreement applies and also state the dollar amount and any other agreed to mitigating
measures.
The owner shall also notify any potendal purchasers who have made an agreement to purchase
property within said plat pursuant to the Revised Code of Washington (RCVV) 58.17.205, that
adequate provisions for school facilities must be made conditioned on a futare agreement
between the plattor and school district.
Voluntary agreements between the owner and school district shall conform to the requirements
of RCW Chapter 82.02.
17. A survey is required prior to the filing of a final plat.
18. Prior to filing of the final plat, each tract shall be addressed in accordance with RCW
58.17.280.
COUNTY DIVISION OF ENGINEERING AND ROADS CONDITIONS
1. The conditional approval of the plat i.s given by the County Engineer subject to dedicarion of
right-of-way and approval of the road system as indicated in the preliminary plat of record.
2. Plans, profiles, and cross-sections as designed to County standards showing proposed street
centerline and curb grades shall be submitted to the County Engineer for approval prior to
construction and/or the filing of each finai plat; road plans to be prepared under the d.irection of
a licensed Professional Civil Engineer.
3. Drainage plans and design calculations showing the alignment of drainage facilities shall be
submitted to the County Engineer for approval prior to construction and/or the filing of the
final plat Drainage plans to be prepar+ed under the direction of a licensed Professional Civil
Engineer.
4. No construction work is to be performed within the existing or proposed public righi of-way
until a peraiit has been issued by the Counry Engineer. All work is subject to inspection and
approval by the County Engineer.
5. Individual driveway access permits are required prior to issuance of a building pernut for
driveway approaches to the county road. system.
6. Existing county roads providing direct access to the plat shall be paved and/or curbed 'to
Spokane County standards.
7. The word "applicant" shall include the owner or owners of the property, his heirs, assigns and
successors.
8. To construct the road improvements stated herein, the applicant may, with the approval of the
Counry Engineer, join in and be a willing participant in any petition or resolution which
purpose is the foanation of a Road Improvement District (RID) for said improvements,
pursuant to RCW 36.88, as ammended. At such dme as an RID is created or any Road
Iinprovement Praject is sanctioned by Spokane County, the improvements required (curb,
sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the
undersigned owner(s), their heirs, graatees and assigns. This provision is applicable to
Twelfth Avenue.
9. As an alteznative method of constructing the road improvements stated herein, the applicant
may, with the approval of the County Engineer, accomplish the road improvements stated
herein by joining and participating in a County Road Project (CRP) to the extent of the

required road unprovements. At such time as an RID is created or any Road Impr+ovement
Project is sanctioaed by Spokane County, the improvements required (curb, sidewalk,
drainage control and paving to existing pavcment) will be at the sole expense of the
undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to
Twelfth Avenue.
10. The following statement shall be placed in the plat dedicarion:
"The owner(s) or successor(s) in interest agree to authorize the County to place their name(s)
on a petition for the formation of a Road Improvement District (RID) by the petition method
pursuant to Chapter 36.8$ RCW, which petirion includes the owner(s)' property, and fiu-ther
not to object, by the signing of a ballot, to the forniation of an RID by the resolution method
pursuant to Chapter 36.88 RCW, which resolution includes the owner(s)' property. If an
RID is formed by either the petition or resolution method as provided for in Chapter 36.88
RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) or conscrucdon contemplated within the proposed RID is
feasible;
(b) that the benefits to be derived from the foimation of the RID by the praperty included
therein, together with the amount of any County participation, exceed the cost and expense of
formation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as authorized under
RCW 36.88.090, to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the farmation of an RID by either petition or
resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court the
decision of the Board of County Commissioners affirming the final assessment roll.
It is further agreed that at such time as an RID is created or any Road Improvement Project is
sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control
and paving) will be at the sole expense of the undersigned owner(s), their heirs, grantees and
assigns without parcicipation by Spakane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the date of

development. This will require the addidon of approxirnately 7-9 feet of asphalt along the
frontage of the development The construction of curbing is also required.
12. The proposed private road(s) as shown on the prelinrinary plat serving 21ots with extension to
senre 8 or fewer lots is approved by the County Engineer.
13. Private road(s) shall be improved to Spokane County standard for a urban private road
standard serving 31ots, and are subject to approval under Section 10.207 of the Spokane
County Fire Code.
14. All vested owners shall sign and record private road documents as prescribed by the Spokane
County Engineer. These documents shall be reviewed and approved by the Spokane County
Eagineer prior to recording with the Spokane County Auditor. Recording numbers shall be
referenced in the dedicatory language of the plat.
15. The following statement shall be placed in the plat dedication:
"VVARNING: Spokane County has no responsibility to build, improve, maintain or otherwise
service the private roads contained within or providing service to the property described in this

provide drainage or snow removal on a private road. This requirement is and shall run with
the land and shaU be binding upon the owner(s), tbeir heirs, successors or assigns, including
the obligation to participate in the maintenance of tbe private road as prnvided herein."
16. The proposed plat shall be unproved to the standards set forth in Spokane County Board of
Commissioners Resolution No. 80-1592, as amended, which resolution establishes
regulations for roads, approaches, drainage and fees in new construction.
17. The County Engineer has examined this development proposal and has determined that the
impact of this proposal upon the existing county road system wanants the dedication of
additional right-of-way and the roadway improvements herein specified.
18. The following statement shall be placed in the final plat detiication: "The private road as
shown hereon is an easement which provides a means of ingress and egress for thASe lots
within the subdivision having frontage thereon."
19. There may exist utilities, either undeFground or overhead, affecring the subject property,
including property to be dedicated or set aside for future acquisition. Spokane County
assumes no financial obligaaon for adjusanents or relocation regarding these utilities.
Applicant(s) should check with che applicable utility purveyor and the Spokane County
Engineer to determine whether applicant(s) or the utility is responsible for adjustment or
relocation costs and ta make anangements for any necessary work.
20. The applicant shall provide documentation to the satisfaction of the County Engineer that the
local fire disorict will approve a turnaround for the preliminary plat. The County Engineer
shall also review and approve the proposed turnaround.
21. The applicant shall construct a paved private road along the frontage of the plat within the
Tract "X" easement. Paving shall extend to edge of pavement on 13th Avenue. Road and
drainage plans shalll be reviewed and approved by the County Engineer.
22. The applicant shall sign and record a Spokane Counry Notice to the Public No. 1.
23. The applicant shall provide documentation to the satisfaction of the County Engineer that they
have obtained the necessary easements for ingress and egress to 13th Avenue.
24. Prior to finalization of the plat the applicant shall make application for the removal of the 1 foot
strip of property, known as Lot 5 Block 2, located at the terminus of 13th Avenue.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plaz of r+ecord for
distribution by the Planning Deparnnent to the utility companies, Spokane County Engineer
and the Spokane Counry Health District. Written approval of the easements by the utility
companies must be reteived prior to thc submittal of the final plaL
3. Sewage disposal method shall be as authorized by che Director of Utilities, Spokane County.
4. Waier service shall be coordinated through the Director of Utilities, Spokane County.
5. Water seivice shall be by an existing public water supply when apprnved by the Regional
Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrace to the satisfaction of the Spokane
County Health District rhat an adequate and potable water supply is available to each tract of
the plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the
recorded service azea of the water systecn proposed to serve the plat.

8. Prior to filing the final plat, the sponsor shall demonstiate to the satisfaction of the Spokane
County Health District that suitable sites for on-site sewage disposal systems are available on

9. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane
County Health District that the existing on-site sewage disposal system serving the residence
located on Tract "A" is wholly located within the boundaries of the tracL
10. Subject to specific application approval and issuance of permits by the Health Officer, the use
of ind.ividual on-site sewage disposal systems may be authorized.
11. The dedicatory language of the plat will state: "Subject to speci.fic application approval and
issuance of pemuts by the Health Officer, the use of individual on-site sewage systems may
be authorized.to
12. The dedicatory language on the plat shall state: "Use of private wells and water systems is

COUNTY DIVISION OF UTILITIES CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-site
sewer disposai systems is hereby authorized. This authorization is condirioned on compliance
with all rules and regulations of the Spokane County Health District and is further conditioned
and subject to specific application approval and issuance of permits by the Health DistriCL

The followinq "Conditfcna of Approval" for the above referenced sub8iviaion
are submitted to tbe Spokane County Pianninq Department for inclusion in the
"Fiadinqs an8 order" shouid the short plat be approvea.
E 1 That conditional approval of the plat by the County Engineer is given
subject to approval of the road system as indicated in the preliminary
plat of record.
E 6 No construction work is to be performed within the existing or proposed
Public Right-of-Way until a permit has been issued by the County
Engineer. All work is suhject to inspection and approval by the County
Engineer.
E12 The applicant should be advised that individual driveway access permits
are required prior to issuance of a building permit for driveway
approaches to the County road system.
E16 Existing County roads providing direct access to the plat shall be paved
and/or curbed to Spokane County standarrds.
E19 The word "applicant" shall include the owner(s) of the property, his/her
heirs, assigns and successors.
E20 To construct the road improvements stated herein, the applicant may,
with the approval of the County Engineer, join in and be a willinq
participant in ariy petition or resolution which purposes is the
formation of a Road Improvement District (RID) for said improvements
pursuant to RCW 36.88, as amended. At 'such time as an RID is created or
any Rodd Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned owner,
their heirs, grantees and assigns. This provision is applicable to
Twel f th Avenue.
E21 As an alternative method of constructing the road improvement stated
herein, the applicant may, with the 4pproval of the Courty Engineer,
accomplish the road improvements stated herein by joining and
participating in a County Road Project (CRP) to the extent of the
required road improvement. At such time as an RID is created or any
Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainaqe control and paving to
existing pavement) will be at the sole expense of the undersigned owner,
their heirs, grantees and assigns. This provision is applicable to
Twelfth Avenue.
E22 That the following statement shall appear within the dedicatory language
of the f inal plat :
The owner(s) or successor(s) in interest agree to authorize Spokane
County to place their name(s) on a petition for the formation of a
Road Improvement District (RID) by the petition method pursuant to
Chapter 36.88 RCW, which petition includes the owner(s) property, and
further not to object, by the signing of a ballot, the formation of
a RID by the resolution method pursuant to Chapter 36.88 RCW, which
resolution includes the owner(s) property. If a RID is formed by
either the petition or resolution method, as provided for in Chapter
36.88 RCW, the owner(s) or successor(s) further agree: (1) that the
improvements or construction contemplated within the proposed RID is
feasible, (2) That the benefits to be derived from the formation of

the RID by the property included therein, together with the amount
of any County participation, exceeds the cost and expense of formation
of the RID, and (3) that the property within the proposed RID is
sufficiently developed. Provided, further, the owner(s) or
successor(s) shall retain the right, as authorized under RCW
36.88.090, to object to any assessment (s) on the property as a result
of the improvements called for in conjunction with the formation of
a RID by either petition or resolution method under Chapter 36.88 RCW,
and to appeal to the Superior Court the decision of the Board of
County Commissioners affirminq the final assessment roll. It is
further agreed that at such time as an RID is created or any Road
Improvement project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainaqe control and paving) will be at the
sole expense of the undersigned owner, their heirs, grantees and
assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten
(10) years from the date of execution below. However, the owner(s)
or successor(s) agree that if said RID waiver eacpires without
construction of the required improvements, the owner(s) or
successor(s) agree to construct the required improvements at their own
expense; pay to Spokane County the then estimated cost of the required
improvements to enable the County to complete the same; or furnish a
bond or other secure method suitable to the County (which may include
the execution of another RID waiver agreement), providing for or
securing to the County the actual construction of the improvements.
All of the requirements of this agreement shall run with the land and
shall be binding upon the owner(s), their successor(s) or assign(s).
This provision is applicable to Twelfth Avenue.
E24 The County Engineer has designated Typical Roadway Section Number Twoi
Local Aacess Standard for the improvement of Twelfth Avenue which is
adjacent to the proposed development. This will require the addition of
approximately 7-9 feet of asphalt along the frontage of the development.
The construction of curbing is also required.
E26 The proposed private road(s) as shown on the preliminary plat serving
Tract "B" is approved by the County Engineer.
E29 A statement shall be placed in the plat dedication that the Tract "X"
private road(s) contained within this plat is/are for the sole use of
parcels within the plat until such time as the roadway is improved and
established as a public road.
E30 All vested owners shall sign and record private road documents as
prescribed by the Spokane County Engineer. These documents shall be
reviewed and approved by the Spokane County Enqineer prior to recording
with the Spokane County Auditor. Recording numbers shall be referenced
in the dedicatory language of the plat.
E31 That the following statement be placed in the plat dedication: WARNING:
Spokane County has no responsibility to build, improve, maintain or
other wise service the private roads contained within or providing
service to the property described in this plat. By accepting this plat
or subsequently by allowing a building permit to be issued on property
on a private road, Spokane County assumes no obligation for said private
road and the owners hereby acknowledge that the County has no
obligation of any kind or nature whatsoever to establish, examine,
survey, construct, alter, repair, improve, maintain, provide drainage or
snow removal on a private road. This requirement is and shall run with
the land and shall be binding upon the owner, their heirs, successors or
assigns including the obligation to participate in the maintenance of
the private road as provided herein.
E32 The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 80-1592, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.

E33 The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the dedication of additional Right of Way and the
roadway improvements herein specified.
E90 The applicant should be advised that there may exist utilities either
underground or overhead affecting the applicants property, including
property to be dedicated or set aside for future acquisition. Spokane
County will assume no financial obligation for adjustments or relocation
regarding these utilities. The applicant should check with the
applicable utilities and Spokane County Engineer to determine whether
the applicant or utility is responsible for adjustment or relocation
costs and to make arrangements for any necessary work.
SPECIAL CONDITION:
The applicant shall provide documentation to the satisfaction of the
County Enqineer that a driveway easement can be located on Tract "A" to
provide access to Tract "B" until such time that a connection to
Thirteenth Avenue can be made. The proposed driveway location shall be
located on the final plat map.
SPECIAL CONDITION:
The driveway easement shall serve only Tract "B". If any other lot uses
the easement, than it shall become a private road and be constructed to
Spokane County Private Road Standards within a 30 foot private road
easement.
