RELAXATION OF FLANKING STREET SETBACK ) DEGISION ANO
REQUIREMENT - T b D PROPERTIES ) CONDITIONS
THIS MATTER, Being the consideration by the Zoning Adjustor of Spokane
County, approvinq in part the appl i cation (VE-80-83), for the purpose of
establishing a flanking street setback of 5' from the property line for a
commerci al structure, hereinafter referred to as the "Proposal", and the
Zoning Adjustor of Spokane County having hel d a publ ic hearing on August
31, 1983 and having fully consi dered all testimony presented thereat, and
further having visited the site and vicinity in question, and havinq
rendered a decision on the 9th day of September, 1983, aprovinq in part
sai d proposal, does he reby make the fol 1 owing:
` FINDINGS OF FACT
1. That the proposal is generally located at the northeast corner of
Argonne Road an d Knox Avenue i n Section 8-25-44. Parcel #08543-0207, 02089
0209, an d 0210.
2. That the proposal consists of reducing the flanking street setback
from the required 50' from the centerline of Knox Avenue to 29.5 feet. The
Knox Avenue right-of-way i s currently 49' wide. The total requested vari ance
is 20.5 feet.
3. That the adopted Snokane County General ized Comprehensi ve Land Use
Plan indicates commercial usage of the area encompassed by the proposal.
4. That the site is zoned Commercial.
5. That the existing land uses in the area of proposal include a fast
food restaurant to the south on Knox Avenue, multi-family and vacant land
to the east, commercial uses qenerally to the north and west.
6. That the Burger King di rectly across Knox Avenue from the si te appears
to meet the flanking street setback requirement, however, the setback is able
to be uti 1 i ze d as a dri ve th ru wi n dow area in the ope rati on of the bus i ness .
7. That the existing duplex setback along the north side of Knox Avenue
i s app roxi mately 37 feet f rom the cente rl i ne of Knox Aven ue.
8. That an agent fo r the appl i cant i n di cated that othe r uses i n the area
general ly woul d not be detrimeqal ly affected th irough granting the proposal
in the Knox Avenue is not a through street and has very 1 i ttle traffi c.

9. That the agent indicated that recently enacted stormwater drainage
requi rements make i t more di ffi cul t to iiieet al 1 setback requi rements and
sti 11 provide adequate vi si bi1 i ty fo r comme}•ci al cl i ents.
10. Nearby owners of property on Knox Avenue appeared and went on record
as neutral parties regarding the project. The chief concern was that future
J commerci al development of othe r l and on Knox not be adversely affected by the
Zoning Adjustor action on this application.

11. That the original development plan for this site is contained in
Planning Department File ZE-215-79. Th1s plan shows development tivith a 50'
setback and access to the site being available from Knox at the easterly end
of the development. If such access is provi ded, i t i s necessary to provi de
adequate setbacks to allow traffic to safely enter and exit the site.
12. That Knox Avenue in this area is currently paved and has sidewalks
an d cu rbs .
13. That maintaining resonable setbacks promotes the safe movement of
traffi c, permits aestheti c development of commerci al centers and is harmonious
with other nearby commercial /resi denti al properties.

14. That the proposal othewise meets all current standards of the Spokane
County Zoning Ordinance for this use.
• 15. That the proper legal requirements for advertisinq of the hearing be-
fore the Zoning Adaustor of Spokane County have been met.
CONCLUSION
1. That the proposal merits some reduction in flanking street setback
requi rements i n keepi ng wi th the character of present devel opment, potenti al
future i mp rovements , an d o n gi nal si te p1 an wi th zone change fi 1 e ZE-215- 79.
2. That the proposal is not detrimental or otherwise harmful to the
publ i c heal th, safety and wel fare.
DEGISION

VE-80-83, testimony at the public hearing, and a site visit, the Zoning
Adj usto r he reby i n approvi nq i n pa rt the p ropos al to al 1 ow appl i cants
structure to 1 ocate 34. 5' f rom the centerl i ne of Knox Avenue whi ch i s 10' f rom
the property line as shown on Exhibit "A" of this file. This decision grants
a 15.5' vari ance rather than the requested 20.5 feet.
A. COUNTY PLANNING DEPARTMENT

2) That thesite be developed in general conformance with the approved
zoni ng site pl an an d conditions attached by the Spokane County Heari ng

B. DEPARTMENT OF BUILDING AND SAFETY

ment of Building and Safety.
C. UTILITIES DEPARTP1ENT
1) Pursuant to the Board of County Commissioners Resolution No. 80-0419,
the use of on-site sewer disposal systems is hereby authorized. This
authori zati on i s condi tioned on compl i ance wi th al 1 rules and regul a- •
ti ons of the Spokane County Heal th Di stri ct and i s fu rthe r con di ti oned
and subject to speci fi c appl i cation approval and i ssuance of permits
by the Health Distri ct.
2) The Owner(s) or Succes*or(s) in interest agree to authorize the County
to place their name(s) on a petition fvr the formation of a ULID by
peti tion method pursuant to RCIJ 36.94 which the peti ti on incl udes the
Otivner(s) property and further not to object by the signing af a pro-
test petition against the formation of a ULID by resolution method
pursuant to RC4! 36.94 whi ch incl udes the Owner(s ) property. PR0IJIDED
this condi ti ons shal l not prohi bi t the Owner(s ) or Successor(s ) f rorn objection to any assessment(s) on the property as a result of improve-
ments called for in con,junction with the forniation of a ULID by either
petition or resolution under RCW Chapter 36.94.

3) Any water service for this project shall be provided in accordance
with the Coordinated Water System Plan for Spokane County, as amended.
