Provisions common to lots in Corbin Addition to Greenacres imposed
prior to February 15, 1950, as follows:
1. That all buildings built on Lots 17 to 34 inclusive in Block
12, and Lot 24 to 46 inclusive in Block 15, shall be constructed of
brick or fire-proof material.
2. No property sold in Corbin Addition to Greenacres shall be used
for business purposes of any kind prior to January 1, 1929, except
the property specified in paragraph one preceding and except Lot 1
to 10 inclusive in Block 12, Lots 1 to 10 inclusive in Block 15 and
Lots 1 to 23 inclusive in Block 23, provided however, that this
shall not prevent the owner of any tract of land in said Addition
form selling the products raised by such owner on said tract.
3. No dwelling shall be erected or permitted to remain on said
land of less cost than $1,500.00; however a temporary house may be
built and used for not to exceed two years. All buildings must be
painted or stained. At least one-half of said land shall be
improved within two years from date of purchase.

Short Plat # 913
1. The property owners within this Plat shall be held responsible for keeping open and
maintaining the surface path of natural or man-made drainage flow over and across their
respective properties.
2. Any building that is constructed on a lot in this Plat shall be set at such an elevation so
as to provide positive drainage away from any drainage entry point to the building
(including but not limited to a window well, a window unprotected by a window well,
or a doorway). Said positive drainage shall consist of a minimum slope of 3% away from
the build.ing for a distance of at least 10 feet from the building. The lots shall be graded
so that either a) all runoff is routed away from the building, and conveyed over the lot
to a natural drainage swale or approved drainage facility, or b) drainage intercepted on
the lot is disposed of on the Iot in an approved drainage facility. The approved drainage
facility shall be constructed in accordance with the approved plans on file at the Caunty
Engineer's Office. Any revisions to ihe approved drainage plans must be approved by
the County Engineer's Office prior to construction of said revisions.

Short Plat # 913
1. The property owners within this Plat shall be held responsible for keeping open and
maintaining the surface path of natural or man-made drainage flow over and across their
respective properties.
2. Any build.ing that is constructed on a lot in this Plat shall be set at such an elevation so
as to provide positive drainage away from any drainage entry point to the building
(including but not limited to a window well, a window unprotected by a window well,
or a doorway). Said positive drainage shall consist of a minimum slope of 3% away from
the building for a distance of at least 10 feet from the building. The lots shall be graded
so that either a) all runoff is routed away from the building, and conveyed over the lot
to a natural drainage swale or approved drainage facility, or b) drainage intercepted on
the lot is disposed of on the lot in an approved drainage facility. The approved drainage
facility shall be constructed in accordance with the approved plans on file at the County
Engineer's Office. Any revisions to the approved drainage plans must be approved by
the County Engineer's Office prior to construction of said revisions.

A review of the above referenced project has been accomplished. A problem was
found with your assumption regarding the street runoff in the post-developed
condition.
The post-developed condition needs to include the street. It is not known when or
even if improvements will be made to the streets. Keep the areas the same in both
situations, pre- and post-development. Revise the calculations to show this. My
calculations show a slight increase.
Qlo = 1.16 CFS developed vs Q,o = 1.11 CFS pre-developed
This small increase is acceptable for this situation and no improvements would be
necessary.
The drainage language enclosed should be acceptable if you agree with the conclusion
ot improvements not being necessary. Please make the necessary revisions to the
drainage report and resubmit to this office. Return the enclosed report marked
"Original" with your submittal.

FINDINCsS UF FACT AND CONCLUSIONS
1. The individual signing below has been properly delegated the responsibility for rendering
the decision by the Spokane C.ounty Director of Planning.
2. The proposal is to divide approximately 1.46 acres into four lots for residential uses and
thnse uses permitted in the underIying zone, which may include duplexes.
3. The proposal is generally loc:3ted ac the northeast corner of the Greenacres RoadlFourth
Avenue intersecaon approximately in the NE 1/4 of Secuon 19, Township 25 North,
Range 45 E.W.M. Spokane Councy, Washington.
4. The existing zoning of the property described in the application is L'rban Residential-3.5
(UR-3.5), previously established as Agricultural (A) zoning in 1958 (ZE-376-58) and
redesignaeeci to Urban Resicitntial-3.5 (UR-3.5) on January 1, 1991 consistent with the
Program to Tmplement the Spokane County Zoning Code. Pursuant to RCW 58.17.195
the pmposal does conform to the requirements of the existing Urbaui Residential-3.5 (UR-
3
1.5) zone. The Urban Residential-3.5 (UR-3.5) zone does allaw duplexes for lots which
are twice the minimum lot size required for single family unics, or 20,000 square feet. The ,
applicant has not proposed dupleYes.
5. 1'he Spokane County Comprehensive Plan designates this area as L.3rban. The development
and uses proposed are generally in accord wich this category.
6. 1`he site cantains existing nonresidenaal structures which are to be removed. Surnounding
uses are primarily residential with some existing, nonconforming, agricultural uses.
Existing on-site nonconfornvng agricultural uses should expire upon finalization of this
short plat.
7. The reyuired public notice was provided for this proPosnl and agencies having a potentia]
interest in the project were notified and recommendadons solicited.
8. Written comments were received from adjoining propert}r owners. Concerns were
expressed over incompatibilicv of the proposed residential uses with che existing
neighborliood.
9. The site is located within the Public Transit Benefic Area (PTBA) but will not be directly
sc:rveci hy public transit. Carlx-)oling or use of park and ridc lots wotild bt available to
potential residents.
10. The Spokane County Arterial Raad Plan does not specify an arterial, roarl classification for
adjacent public roads. The Spokane County Engineer has requested dedication of 5 feet of
addirional right of way on Fourth Avenue and Greenacres Road. Sidewalks are required
along Fourth Avenue.
11. The proposed short plat will be served by a public water system. Waste water disposal will
bc as authorized by the I?irector of Utilities.
12. The Central ValIey School Distriet (No. 356 ) has commented on the proposed short plac.
T'he Di$trict has indicated that existing school facilities are inadequate to serve the proposed
short plat and ha,S requested the applicant negobate with the Districc eo provide appropriate
cagital facilities as reyuired by the Revised Code of Washington (RGW) 58.17. I 1Q.
Approval of chis short plat should include conditions requiring that provisions for
appropriate facilities be in pl,jce priar to recording chis final plat in the form oF a written
ageement hetween the prapeny owner and the school district.
13. The Spokane Gounty Parks Department has commentEd on the proposed short plat. The
Parks Deparmient has requested avoiuntary agreement be completec.i between the Parks
Department and the prapertv cawner to mitigate impacts ta the Countv Park System. The

14. The site is located outside chN Washington State Board of Health Exemption Boundary
which took effect on January 1, 1994. The apptication was received prior to the change in
the exemption boundary musc meet all health regulauon in effect at the dme the applicadon
was accepted by the Spokane Counry Planning Department.
15. Recognizi.ng the recoranmencieti conditions and Spokane County development standards, the
proposed short subdivision nz:ikes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the proposed
short subdivision.
The subdivision pmposal is renerallv consistent with RCW 5$.17 and the County

conditions af approval shaU be aecomplished by the applicanc and/or sponsor prior to finalization
of the short subdivisian. This decision is final unless appealed in writing, consistent with adopted
appzal procedures.
PLANNING DEPARTMENT C()NDITIqNS
1. All condidons imposeci by che Planning Department sha.ll be binding on the "Applicant",
which term shall include the (iwner or owners of the property, heirs, assigns and
successors.
2. The proposal shall comply wi th the Urban Residenrial zone as amended. Any
nonconforming agricultural u>e rights which may of exist for the parcel expire upon
finalization of the short plac. `I'he owner/applica.nt shall submit a detailed site plan to veri.fy
that the existing structures are not bisected by property lines or provide documentation that
the structures have been removed.
3. Thz final plac shall be designed substantially in conformance wi.th the preliminary plat of
record. No increase in densitv or number of lots shall occur without a change of condition
applicaaon submittal and approval. 4. The Planning Director/designee shall review any proposed final plat to ensure compliance

purpose is the fonnauon of a Road Improvement District (RID) for said improvements,
pursuant to RCW 36.88, as :irnendeti. At such time as an RID is created or any Road
Improvement Projecc is sanrcianeri by Spokane County, the improvements required (curb,
sidewalk, dra.inage control ~~id paving to existing pavement) wi.ll be at the sole expense of
the undersigned owner(s), tticir heirs, grantees and assigns. This provision is applicable to
Greenacres Raad and Fourtll Avenue.
11. As an alternative method of onstructing the road improvements stateci herein, the applicant '
may, with the approval of the Counry Engineer, accomplish the roaci improvements stated
herein by joining and particileating in a County Road Project (CRP) to the extent of the
required road improvements. At such time as an RID is created or any Road Improvement
Project is sanctioned by Sp6:ane County, the improvements required (curb, sidewalk,
drainage control and paving t►) existing pavement) will be at the sole expense of the
undersignzd owner(s), their l;eirs, grantees and assigns. This provision ls applicable to
Greenacres Road and Faurti. Avenue.

13. The County Engineer has dt,;ignated Typical Roadway Secaon Number Two, Local
Access standard far the imprr•vement of Greenacres Road, which is adjaeent to the

proposed development. ''I'hi~ will require the addition of approximately 9-11 feet of asphalt
along the frontage af the dc~ clopment. The construction of curbing is also required.
14. The County Engineer has designated Typical Roadway Section Number Two, Local
Access standard for the improvement of Fourth Avenue, which is adjacent to the proposed
development. This will require the addition of approximately 10-12 feet of asphalt along
the froncage of the developnient. The construction of curbing and sidewalk is also
required.
15. The propased subdivisian s}iall be improved to the standards set fonh in Spokane County
Board of Com.missioners Rc;tialution No. 80-1592, as amended, which resolurion
escablishes regulations for roads, appraaches, drainage and fees in new conswction.
16. The County Engineer has exarnined this development proposal and has deternuned that the
impact of this proposal upon the exisring county road system warra.nts the dedication of
addiaonal right-of-way and the roadway improvements herein specified. 17. The applicant shall deriicate a the applicable radius on Greenacres Road and Fourth
Avenue.
18. There may exist utilities, eicfic:r underground or overhead, affecting the subject property,
including property to be detlicated or set aside for future acquisition. Spokane County
assumes no financial obligation far adjusmients orrelocauon regarding these utilides.

COUNTY HEALTH DISTRI(:T GONDITIQNS
1. The final plat shall be designed as indicated on the preliminary plat of record andlor any
actached sheets as noted.
2. Appropriate utility easemencs shall be indicate-d on copies of the preliminary plat of record

Engineer and the Spokane C'Ounty Health District. Written approval of the easements by

4. Water service shall be ccacard,nated through the Director of Utilities. Spokane County.
5. Water service shall be by an existing public water supply when approved by the Regional
Engineer (Spokane), State Deparanent of Health.

The followinq "Conditions of Approval" for the above referenced subdivision
are submitted to tbe Spokane County Planninq Department for iaclusion in the
"FiIIdiAgA and Order" shoul8 the short plat be approved.
E 1 That conditional approval of the plat by the County Engineer is given
subj ect to dedication of Riqht-of -Way and approval of the road system as
indicated in the preliminary plat of record.
E 3 That drainage plans and design calculations showing the alignment of
drainage facilities be submitted to the County Engineer for approval
prior t4 construction and/or the filing of the final plat. Drainage
plans to be prepared under the direction of a licensed Professional
Civil Enqineer.
E 6 No construction work is to be performed within the existing or proposed
Public Riqht-of-Way until a permit has been issued by the County
Engineer. All work is subject to inspection and approval by the County
Enqineer.
E12 The applicant should be advised that individual driveway access permits
are required prior to issuance of a building permit for driveway
approaches to the County road system.
E13 Dedication of 5 feet of additional Right-of-Way along 4th Avenue.

any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned owner,
their heirs, grantees and assigns. This provision is applicable to
Greenacres Road and Fourth Avenue.
E21 As an alternative method of constructing the road improvement stated
herein, the applicant may, with the approval of the County Engineer,
accomplish the road improvements stated herein by joining and
participating in a County Road Project (CRP) to the extent of the
required road improvement. At such time as an RID is created or any
Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned owner,
their heirs, grantees and assigns. This provision is applicable to
Greenaares Road and Fourth Avenue,.

The owner(s) or successor(s) in interest agree to authorize Spokane

Chapter 36.88 RCW, which petition includes the owner(s) property, and

either the petition or resolution method, as provided for in Chapter

of any County participation, exceeds the cost and expense of formation
of the RID, and (3) that the property within the proposed RID is

successor(s) shall retain the right, as authorized under RCW
36. 88. 090, to object to any assessment (s) on the property as a result
of the improvements called for in conjunction with the formation of
a RID by either petition or resolution method under Chapter 36.88 RCW,
and to appeal to the Superior Court the decision of the Board of
County Commissioners affirming the final assessment roll. It is
further agreed that at such time as an RID is created or any Road
Improvement project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving) will be at the
sole expense of the undersigned owner, their heirs, grantees and
assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten
(10) years from the date of execution below. However, the owner(s)
or successor(s) agree that if said RID waiver expires without
construction of the required improvements, the owner(s) or
successor (s) agree to construct the r•equired improvements at their own
expense; pay to Spokane County the then estimated cost of the required
improvements to enable the County to complete the same; or furnish a
bond or other secure method suitable to the County (which may include
the execution of another RID waiver agreement), providing for or
securing to the County the actual construction of the improvements.
All of the requirements of this agreement shall run with the land and
shall be binding upon the owner(s), their successor(s) or assign(s).
This provision is apglicable to Greenacres Road and Fourth Avenue.
E24 The County Engineer has designated Typical Roadway Section Number Two,
Local Access Standard for the improvement of areenacres Rosd which is
adjacent to the proposed development. This will require the addition of
approximately 9-11 feet of asphalt along the frontage of the
development. The construction of curbing is also required.
E24 The County Engineer has designated Typical Roadway Section Number Two,
Local Acceas Standard for the improvement of Fourth Avenue which is
adjacent to the proposed development. This will require the addition of
approximately 10-12 feet of asphalt along the frontage of the
development. The construction of curbing and sidewalk is also required.
E32 The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 80-1592, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
E33 The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the dedication of additional Right of Way and the
roadway improvements herein specified.
E38 Applicant shall dedicate the appliaable radius on Greenacres Road and

Regards to Short Plat Application SP-913-93
The above planned development is on the corner of 4th. and Greenacres Road.
Greenacres Road is very narrow in this area. The roads are used by school buses
and parents taking children to Greenacres Elementary School.
We are strongly opposed to this development if the roads are not widened.
Developments north on Greenacres Road of Moen 3rd. Addition (ist.) and Windy
Addition (3rd.) were both required to have road enlargement with curbing and
paving. This allows the homeowners to be able to park in front of their houses
without being in the road. Without this requirement of the above short plat,
the road would be too narrow and restrict the added traffic and safety of the
neighborhood and school students.
Even though this is a short plat, I think the planning board should require
the same as that of a full plat. There is more road frontage on this plat
(over 500ft) than was on Moen 3rd. and Windy Addition just up the street.
It is not okay just to require that in the future that they pave and curb, that
could take 20 years like the sewer. This needs to be done before the first new
family moves into one of those new lots.
Also, I do not understand why duplexes are being considered now? This is
inconsistent with the area. Previous plats such as Moen 2nd. Addition and Moen
3rd. and Windy Addtions were not allowed duplexes. Is this consistent to the
over all plan? We are not in favor of duplexes in this area.

lJ PRELIMINARY SHORT PLAT
/ MAPS
S ubmit 9 blueline copies of the preliminary short plat map with written legal description
prepared by a licensed land surveyor. The prelimuiary short plat map shall illustrate:
a. The property to be subd.ivided and the location of che property lines for the proposed
lots (one copy signed by the County Engineer, County Utilities and County Health
District).
b. Existing buildings and other improvements; indicate which ones aze to remain, which
ones are to be removed.
c. Location of existing and proposed easements providing access to the preliminary plat.
d . Septic systems.
e. Existing and abandoned well sites.
f. Natural features such as wooded areas, stteams, drainage ways, ridgelines, hillcops and
wetlands.
g. Topographic information, if any slopes exceed 10 perccnt.
The proposed Iots shall show:
a. Applicable setbacks as reyuire;d by the existing zone or proposcd roiie.
b. The Iocation of any easements exisdng and praposed (access for urilities, power,
phone, water, sewer, other).
c. The location of the nearest fire hydrant (if applicable).
The design of the preliminary map must conform to the apgroved plat format standards in the
Spokane County Short Plat Ordinance.
❑ ENVIRONMENTAL CHECKLIST
A completed environmental checklist is required for all zone changes, planned unit
developments and subdivision requests. Short plats, binding site plans and other land use
applicadons may require a checklist under SEPA rules unless exempted by WAC 197-11-
800. Note: If przvious environmental checklist exists for the property, it may be adequate to
address environmental issues.

The County Engineer, County Health Distirict and Counry Division of Utilities typically
charge fees in conjunetion wiih your proposal. Please contact these deparanents for their
