The site is situated north of Val1ey Way in the A1,W. sl~ of the S.E. %a of Sectian 13, TawnshiF 25 N., Range 44 E. W.M., Spokane Caunt}►, Please refer to Attachment 1 for a lacatian map. Site Descripfion The geueral area atound the proposed developmer3t is quite flat with anly a stight slope to the north toward Iaterstate 90 and the Spokane River. The topagraphy of the plat area itself has slopes ranging ffom zera to two percent. Based att the soils survey of Spokane Gaunty prepared by the Soif CQnservation Service, the sails underlyxng the project area are clsssified as Garrison Gravetly Loam (0 to 5 percent slopes) (GgA). Please refer to Attachment 2. This sail is a deep, coarse texturcd, cxcessively drailYed soiI consYSting of sand, cobblestvnes and boulders. This type of soil has a high permeability (aver 10" per hour) but since the slopes are fla# there is only a slight hazard of water erosivn. Hydrolagic ajtd Hydraulic Culculartians fihe major improvement to the site that is eovered in this drainage study is the 12' W1C~~ graVel access road that will enter the property as shown an the site improvement p1an. 'T'he typical section of the access road will aflow rainwater to drain to grassy roadside dztehes that will callect the runoff and allow it ta percoiate into the highly permeable soil matrix. Since the ro8d is grave1, it allows percalatiori and therefore no '208 swale areas are reyuired. An arialysis was condveted comparing the pre-dewelopment and post-dewelapment runoff rates to determiae if drywells were requixed. The pre-develaged runaff caefficient is 0.25 which conespands to cultivateci land an gravelly soils. The past-development runaff coefficient was calculated based on the combined gravel sccess area (C=0.50) and the overall developed C value based on 3 Iots on 2.97 acres (C=0.20). The post-developed combined runaff coeffieient was calcuIated to be 0.21 which is less that the pre-developed conditian. As a result of the project, the #irne of concentration wiil nat decrease so the peak rainfall iniensity will remain equal to the pre4develaFed value. 7`herefore, the net 10 ym runoff rate and volume wilf decrease as a result of the project. This is mainly due to the planting of yards in the postWdeveloped conditian. 5ince the peak rate of runoff wi!l not increase as a result of ihe project, no drywells are required. Based on a site review, no offsite areas drain onto #he site because Valiey Way intercepts flow fram the south. IXPIRES Project Description 7'he proposed Fliflet Short Plat (PN SP-916-93) is a 3 lot, single family residentiat plat to he constructed on approximately 2.97 acres in Spokane County. The site is situated north of Vallcy Way in the N.W.'/, of the S.E.Y. of Section 13, Township 25 N., Range 44 E. W.M., Spokane County. Please refer to Attachment l for a location mAp. Site Descripiion The general area araund the proposed development is quite flat with only a slight slopc to the north toward Interstate 90 and the Spokane River. The topography of the plat area itself has slopes ranging from zero to two percent. Based on the soils survey of Spokane County prepared by the Soil CanservatiAn Service, the soils underlying the project area are classified as Garrison Gravelly Loam (0 to 5 percent slopes) (GgA). Please refer to Attachment 2. This soil is a deep, coatse textured, excessively drained soil consisting of sand, cobblestones and boulders. This type af soil has a high permeability (over 10" per hour) but since the slopes are flat diere is only a slight hazard of water erosion. Hydrologic and Hydraulic Calculatiot:s ~'he majar improvement to the site that is covered in this drainage study is the 12' wide gravel access road that will enter the property as shown on the site improvement pian. The typical Section of the access road wi11 a11ow rainwater to drain ta grassy roadside ditches that will collect the runoff and allow it to percolate into the highly pernneable soil matrix. Since the road is gravel, it allows percolation and therefore no '208 swale areas are required. An analySis was conducted comparing the pre-development and past-development runoff ratcs ta determine if drywells were required. The pre-develaped runoff coefficient is 0.25 which eorresponds ta eultivated land on gravelly sails. The post-develapment runoff coefficient was calculated based an the combined gravel access area (C=O.SQ) and the overall devetaped C valuc based on 3 lots on 2.97 acres (C--0.20). The post-developed combined runoff coefficient was calculated to be 0.21 which is less that the pre-developed conditian. As a result of the praject, the time c►f concentration will not decrease so the peak rainfall intensity will temain equal to the pre-developed value. Therefore, the net 10 year runoff rate and volume will decrcase as a result of the project. This is mainly due to the planting of yards in the post-develaped condition. Since the peak rate of runoff will not increase as a result of the project, no drywells are required. I3ased on a site review, no affsite areas drain onto the site hecause Valley Way intercepts flow from the south. Moreover, 1he soil is so pervious and slopes so small that the adjacent ground can absorb a vast amount of rainfall. SP-916-93 ) DECISION THIS MATTER, a request for a change of design of an approved preliminary short plat has been received from David ' et and decided upon, pursuant to Spokane County Subdivision regulations, on the _'~a day of August, 1994. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the deci.sion by the Spokane County Director of Planning. 2. This proposal is for a change of design and updated coaditions to the original preliminary short plat approved by the Planning Department's F'ind.ings of Fact, Conclusions and Decision dated February 22,1994. 3. The applicant has requested a change of design to divide approxirnately 2.97 into 3 Iots for 1 existing single family residence and 2 new additional residentiallots, whereas the original preliminary plat proposed division of apgmximately 3.1 acres into 21ots for 1 exristing single family residence and 1 additional residentialloG 4. TMe proposal is genezally located north of and adjacent to Valley Way, appmximately 320 feet east of Conklin Road in the SE 1/4 of Section 13, Township 25 North, Range 44 E.W.M. Spokane Covnty, Washington. 5. The existing zoning of the property described in the applicadon is Urban Residential-3.5 (UR-3.5', previously established as Agricultural (A) (file # 60-42) zoaing in 1942 and redesignated to UR-3.5 on January 1,1991 pursuant to the Program to Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform to the requirements of the existing UR-3.5 zone. 6. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses proposed are generally in accord with this category. 7. Suaounding uses are primarily single family residences on mixed urban size lots and open space. 8. The required public notice was provided for this proposal and agencies having a potential interest in the project were notified and recommendations solicited. 9. No written comments were received from any adjoiaing property owners regarding this proposed revision. However, written comments were received from an adjoining property owner whose opposidon to the origi.nal proposal was addressed in the original preliminary plat's condidons of approval. 10. The Spokane County Arterial Road Plan identifies Valley Way as a Collector Arterial with a fnture right of way width of 70 feeG The existing nght of way width is 40 feet. In order oD inaplement the Arterial Road Plan, the County Engineer has requested that a strip of property S feet in width along the Valley VVay frontage be set aside as a Future Acquisition Area. In addition, the County Engineer has required 10 feet of new dedicadon along VaUey Way. 11. The site is located within the Public Tran.sportation Benefit Area (PTBA). The Spokane Transit Authority (STA) East Sprague Route # 9 and Broadway Route # 18, provides connecting serrvices to the site. 12. The proposed short plat will be served by a public water system. Waste water disposal will be as autliorized by the Director of Utilities. 13. The Spokane County Parks Department has cominented on the proposed short plat. The Parks Department has requested a voluntary agr+eement be completed between the ~ FINDINGS AND DECISION SP-916-93 Page 2 Parks Department and the property owner to mitigate impacts to the County Park system County legal counsel has indicated such agreements may be required. The Spokane County Planning Department reconznae,nds the pmperty owner negoriate with the Spokane County Parks Department to provide for appmopriate capital facilities as required by the Revised Code of Washington (RCW) 58.17.110. Approval of this short plat should include condidons requiring that provisions for appropriate facilities be in place prior to recor+di.ng this final plat in the form of a written agreement between the owner and the Spokane County Parks Department 14. The Central Valley School I?istrict No. 356 has commented on the proposed Short Plat The District has indicated that existing school facilities are inadequate oo serve the proposed short plat and wishes to negotiate with the owner to provide adequate capital facilities as required by the Revised Code of Washington (RCV) 58.17.110. Review by Counry legal counsel indicates the condidon requested by the School District can be required for developments. Approval of this short plat should include conditioas requiring that provisions for appropriate facilities be in place prior to recording the final shart plat in the foran of a written agr+eement between the owner and the school district. 15. The proposed short plat has direct aocess to public right of way at Valley Way. Sidewalks are required along Valley Way. 16. Recognizing the recommended conditions and Spokane County development standards, the proposed short subd.ivision makes appropriate provisions for the public health, safety and general welfare and tbat the public use and interest will be served by platting the subdivision. The subdivision groposal is generaUy consistent with RCW 58.17 and the County subd.ivision regularions, promoting the public health, safety and general welfare in accordance with standards established by the state and Sgokane County. The Planning Department has considered the provisioa of adequate public facilides as cited in RCW 58.17.110 (2). More specifically: a. open spaces b. draiunage ways c. public and/or private rights-of-way d. transit e. potable water f. sanitary waste disposal g, parks and recreation fa,ciliries h. playgronnds • i. schools and schoolgrounds J ' • sidewalks 17. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197- I 1-800 (6) (a). 18. The following facts are also relevant: a. The Urban Residential-3.5 (UR-3.5) zone does allow duplexes for lots which are twice the minunum lot size requir+ed for single family units or 20,000 square feet. b. The original preliminary plat was received prior to January 1,1994 and the implemeatation of new Washington State Board of Health (WSBH) regvladons on the use of an-site sewage disposal systems. This proposed change of design was received by the Planning Deparinent after January 1, 1994 and may be required t,o comply with the new WSBH regulations. c. Additional conditions have been re,commended by the various reviewing agencies and deparmaents, including the Spokane County Planning Departrnent, the Spokane County Division of Engineering and Roads and Spokane Fire District No. 1. DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Applic,ation SP-916-93 is bereby APPROVED until September 1,1997, subject to condidons as per Findings dated February 22, 1994 as ma.y be nlodified herein noted taelow. Most of the J / FINDINGS AND DECISION SP-916-93 Page 3 cond.iaons of approval shall be accomplished by the applicant and/or sponsor prior to finalization of the short subdivision. This decision is final unless appealed in wridng, consistent with adopted appeal procedures. COUNTY PLANNING DEPARTMENT CONDITIONS (UPDATED) 1. All conditions imposed by the Planning Department shall be binding on the "Applicant", which tenn shall include the owner or owners of the property, heirs, assigns and successors. 2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone as amended. 3. The final plat shall be designed substandally in conformance with the preliminary plat of record No increase of density or number of lots shall occur witbout a change of condition application submittal and approvaL 4. The Planaing Director/designee shall review any ptoposed final plat to ensure compliance with these Findings and Condidons of Approval. 5. The preliminary plat is given condidonal approval for three (3) years, specifically to September 1,1997. The applicant may request an extension of rime by submitting a written request approxunately forty-five (45) days prior to the above expiration date. 6. Three (3) cucrent certificates of title shall be fumished to the Planning Department prior tio filing the final plaL 7. Appropriate utility easements shall be indicated on copies of the proposed final plaL Writtien approval of utility easements by appropriate utility companies shall be received with the submittal of the final plat. 8. Prior to filing of the final plat, the appropriate road aame(s) and smeet address(es) shall be indicated. 9. The final plat map shall indicace by a clear, dashed line the required yard setbacks from all private, "Tract X" or public roads. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made• d. The future acquisition area, until acquir+ed, shall be private property and may be used as allowed in the zone, except that any unprovements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall be considered interim uses. e. To construct the road improvements stated herein, the applicant may, with the approvat of the County Engineer, join in and be a willing participant in any peddon or resoiudon which pwrpose is the formation of a Road Improvement District (RID) for said impravements, pursnant to RCW 36.88, as amended. At such dme as an RID is created or any Road Improvement Project is sanctioned by Spoka.ne County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the soie expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Valley Way. 11. As an alternadve method of constructing the road unproveraents stated herein, the applicant may, with the approval of the County Engineer, accomplish the road impro►vements stated herein by joining and participating in a County Road Project (CRP) to the extent of the reqwred road unprovements. At such tinne as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Valley Way. 12. The following statement shall be placed ia the ptat dedication: "The owner(s) or successor(s) in interest agree tio authorize the County to place their nazne(s) on a petition for the formadon of a Road Irnprovement I?iscrict (RID) by the petition aaethod pursuant to Chapter 36.88 RCW, wh2ch petition includes the owner(s)' propefty, and further not to object, by the signing of a ballot, tio the formation of an RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution includes the owner(s)' property. If an RID is formed by either the pedtion or resolution method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree• . (a) that the impmvecnent(s) ar construction contemplated within the pnoposed RID is feasible; (b) that the benefits to be derived from the fomnation of the RID by the property included thereui, together with the amount of any County pamcipaaon, exceed the cost and expense of formation of the RID; and (c) that the property within the proposed RID is sufficiendy developed. Provided further that the owne,r(s) or suceessor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the formadon of an RID by either petition or Tesolution method under Chapter 36.88 RCW, and to appeal to the Superior Court the decision of the Board of County Commissioners aiffinning the final assessment roll. It is further agreed that at such time as an RID is created or any Road Imgrovement Project is sancdoned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns without participaaon by Spokane County. The RID waiver contained in this agreement shall expire after ten (10) years from the date of execution below. However, the owner(s) or successor(s) agree that if said RID waiver expires witbout construcrion of the required improvements, the owner(s) or successor(s) agree to canstruct the required improvements at their own expense, pay to Spokane County the then estimated cost of the requined improvements to enable the County to compiete the same, or furnish a bond or other secur+e method suitable to the Caunty (which may include the execution of another RID waiver agreement) providing for or securing tio the County the actual construction of the improvements. This provision is applicable to Valley Way. \ SHORT PLAT: # 916 / FLIFLET, DAVID 2 E22 That the following statement shall appear within the dedicatory language of the f inal plat : The owner(s) or successor(s) in interest agree to authorize Spokane County to place their name (s) on a petition for the formation of a Road Improvement District (RID) by the petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s) property, and further not to object, by the signing of a ballot, the formation of a RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution includes the owner(s) property. If a RID is formed by either the petition or resolution method, as provided for in Chapter 36.88 RCW, the owner ( s) or successor ( s) f urther agree :(1) that the improvements or construction contemplated within the proposed RID is feasible, (2) That the benefits to be derived from the formation of the RID by the property included therein, toqether with the amount of any County participation, exceeds the cost and expense of formation of the RID, and (3) that the property within the proposed RID is suff iciently developed. E24 The County Engineer has designated Typical Roadway Section Number Two, Collector Arterial Standard for the improvement of Vallev Wav which is adjacent to the proposed development. E26 The pronosed private road as shown on the preliminary plat serving 2 lots with no extension possible is approved by the County Engineer. E27 That private road be improved to Spokane County standard for a urban private road serving 2 lots. E30 All vested owners shall sign and record private road documents as prescribed by the Spokane County Engineer. These documents shall be reviewed and approved by the Spokane County Engineer prior to recording with the Spokane County Auditor. E33 The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing County Road System warrants the dedication of additional Right of Way and the roadway improvements herein specified. E61 The County Arterial Road plan identifies Valley Way as a Collector arteriai. The existing right of way width of 40 feet is not consistent with that specif ied in The Plan. In order to implement the Arterial Road Plan it is recommended that in addition to the required right of way dedication, a strip of property 5 feet in width along the Valley Way frontage be set aside in reserve. This property may be acquired by Spokane County at the time when Arterial Improvements are made to Valley Way. E90 The applicant should be advised that there may exist utilities either underground or overhead affecting the applicants property, including property to be dedicated or set aside for future acquisition. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signi.ng below has further been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning. 2. The proposal is to divide approximately 3.47 acre into 2 lots for 1 existing single family residence and 1 additional residential lot and those uses permitted in the underlying zone. 3. The proposal is generally located north of and adjacent to Valley Way, approximately 320 feet east of Conklin Road in the SE 1/4 of Section 13, Township 25 North, Range 44 E.W.M. Spokane Counry, Washington. 4. The existing zoning of the property described in the applicadon is Urban Residential- 3.5 (LJR-3.5), previously established as Agricultural (A) (file # 60-42) zoning in 1942 and redesignated co UR-3.5 on January 1, 1991 pursuant to the Program to Implement the Spokane County Zoning Code. Pwsuant to RCW 58.17.195 the proposal does conform to the requirements of the existing UR-3.5 zone. 5. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses proposed are generally in accord with this category. 6. Sturounding uses are primarily single family residences on mixed urban size lots and open space. 7. The requined public notice was provided for this proposal and agencies having a potendal interest in the project were notified and recommendations solicited. 8. Written comments were received from an adjoining property owner who opposes the proposed short plat The property owner contends that development of any addidonal homes in the area will adversely effect the water quality, police and fire protection, and cause overcrowding in the schools. Responses to the above comments will be addressed by the Spokane County Health District, the Spokane County Fire District No. 1, and the Central Valley School District through che attached condidons of approval. 9. The Spokane County Arterial Road Plan identifies Valley Way as a Collector Arterial with a future right of way width of 70 feet. The existing right of way width is 40 feet. In erder to implement the Arterial Road Plan, the County Engineer has requested that a strip of property 5 feet in width along the Valiey Way frontage be set aside as a Future Acquisition Area. In addition, the County Engineer has reyuued 10 feet of new dedication along Valley Way. 10. The site is located within the Public Transportation Benefit Area (PTBA). The Spokane Transit Authority (STA) East Sprague Route # 9 and Broadway Route # 18, provides connecting services to the site. 11. The proposed short plat will be served by a pubtic water system. Waste water disposal will be as authorized by the Director of Utilities. 12. The Spokane County Parks Department has commented on the proposed short plat. The Parks Departnent has requested a voluntary agreement be completed between the Parks Deparament and the property owner to midgate impacts to the County Park system. County legal counsel has indicated such agreements may be required. The Spokane County Planning Department reconunends the property owner negodate with the Spokane Counry Parks Department to provide for apprppriate capital facilities as required by the Revised Code of Washington (RCW) 58.17. ].10. Approval of this short plat should include conditions requiring that provisions for appropriate faciliaes • FINDINGS AND DECISION SP-916-93 Page 2 be in place prior to recording this final plat in the form of a written agreement between the owner and the Spokane Counry Parks Department 13. The Central Valley School District No. 356 has commented on the proposed Short Plat. The District ha.S indicated that existing school facilities are inadequate to cerve thc proposed short plat and wishes to negotiate with the owner to provide adequate capital facilities as required by the Revised Code of Washington (RCW) 58.17.110. Review by County legal counsel indicates the condition requested by the School District can be required for developments. Approval of this short plat should include condirions requiring that provisions for appropriate facilities be in place prior to recording the final short plat in the fonn of a written agreement between the owner and the school district. 14. The proposed short plat has direct access to public right of way at Valley Way. Sidewalks are required along Valley Way. 15. Recognizing the recommended conditions and Spokane Counry development standards, the proposed short subdivision makes appropriate provisions for the public health, safety and general welfare and that the public use and interest wiU be served by platting the subdivision. The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision regulations, promoting the public health, safery and general welfare in aGCOrdance with standards established by the state and Spokane County. The Planning Department has considered the provision of adequate public facilities as cited in RCW 58.17.110 (2). More specifically: a. open spaces b. drainage ways c. public and/or private rights-of-way d. transit e. potable water f. sanitary waste disposal g. parks and recreation faciliries h . playgrounds i. schools and schoolgrounds j . sidewalks 16. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). 17. The following facts are also relevant: a. The Urban Residential-3.5 (UR-3.5) zone does allow duplexes for lots which are twice the minimum lot size required for single family units or 20,000 squaze feet. b. This proposal was received by the Planning Department prior to January 1, 1994 and the implementation of new Washington State Board of Health regulations on the use of on-site sewage disposal systems. DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-916- 93 is hereby APPROVED until March 1, 1997, subject to conditions noted below. Most of the conditions of approval shall be accomplished by the applicant andlor sponsor prior to finalization of the short subdivision. This decision is final unless appealed in writing, consistent with adopted appeal procedures. COUNTY PLANNING DEPARTMENT CONDITIONS 1. All condidons imposed by the Planning Department shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns and successors. 2. At least 5 feet of reserved future acquisition area for road right-of-way and utilides, in addition to the existing and/or newly dedicated right-of-way along Valley Way. NOTE: The County Engineer has required lO feet of new dedication. b. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisition area. c. No required landscaping, pazking, '208' areas, drainfield or allowed signs should be located within the future acquisition area for road right-of-way and urilities. If any of the above improvements are made within this area, they shall be relocated at the applicanl's expense when roadway improvements are made. d. The future acquisition area, until acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall be considered interim uses. e. The property owner shall be responsible for relocating such "interim" improvements at the time Spokane County makes roadway improvements after acquiring said future acquisition area. 11. No water plan is required, and a simple tap is needed at the time of build.ing permit release. 12. The owner shall negotiate with the County Parks Department and submit a recorded copy of a voluntary agreement maldng provisions for public parks prior to finalization and recording of the plat. The agreement shall provide a written description of the subject property to which the agreement applies and also state the dollar amount and any other agreed to mitigavng measures.
