Include the following language on the plat dedication for the above named plat(s).
1. The praperty owners within this Plat shall be held responsible for keeping open and
ma.intaining the surface path of natural or man-made drainage flow over and across their
respective properties. 1
2. Any building that is constructed on a lot in this Plat shall be set at such an elevation so
as to provide positive drainage away from any drainage entry point to the building
(including but not limited to a window well, a window unprotected by a window well,
or a doorway). Said positive drainage shall consist of a minimum slope of 3% away from
the building for a distance of at least 10 feet from the building. The lots shall be graded
so that either a) all runoff is routed away from the building, and conveyed over the lot
to a natural drainage swale or approved drainage facility, or b) drainage interceptei on
the lot is disposed of on the lot in an approved drainage facility. The approved drainage
facility shall be constructed in accordance with the approved plans on file at the County
Engineer's Office. Any revisions to the approved drainage plans must be approved by
the County Engineer's Office prior to construction of said revisions.

been received and decided upon, pursuant to Spokane County Subdivision regulatioas, on the
J5.,'A day of February, 1994.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has been progearly delegated the responsibility for rendering the
decision by the Spokane County I?irectior of Planaing.
2. The proposal is to divide appruximately 2.9 acres into three lots for one existing home and
two addidonal residential lots for those uses permitted in the underlying zone.
3. The proposal is generally located at the southeast corner of the Long Road/Allci Avenue
intersection in the SE 1/4 of Section 18, Township 25 North, Range 44 E.W.M. Spokane
Counry, Washington.
4. The existing zoning of the property described in the application is Urban Residential-3.5 (UR-
3.5), previously established as Agricultural (A) zoning in 1957 (ZE-86-57) and redesignated
to UR-3.5 on January 1, 1991 consistent with the Program to Implement the Spokane County
Zoning Code. Pursuant to RCW 58.17.195 the proposal dces conform to the requirements of
the existing UR-3.5 zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The development
and uses pmposed are generally ia accord with this category.
6. The site contains an existing single family residence and accessory structures. It appears that
large animal keeping may have occuaed on the site in the pasG Any nonconfomting rights for
large animal keeping should expire upon finalization of this short plat. Surrounding uses are
primarily siagle family residences on urban sized lots. Some nonconfonmiag agricultural uses
are present in the surrounding area.
7. The requined public notice was provided for this proposal and agencies having a potential
interest in the project were notified and recomtnendadons solicited.
8. No written comments were received from any adjaining property owner.
9. The site is located within the Public Transit Benefit Area (PTBA). Route #18, Broa.dway
Feeder, provides service to downtown Spokane.
10. The Spokane County Arterial Road Plan dces not specify an arterial road classification for
adjacent public reads. The Spokane County Engineer has requested dedicadon of 5 feet of
additional right ef way on Alki Avenue. By adopted county standar+ds sidewallcs are not
required for this proposal.
11. The proposed short plat will be served by a public water system Waste water d.isposal will be
as authorized by the Director of Utilides.
12. The site is located outside the Washington State Board of Health F.xelnption Boundary which
took effect on January 1, 1994. The application was received prior to the change in the
exemption boundary and must meet all health regulations in effect at the rime the application
was accepted by the Spokane County Planning DeparnmenL
13. The Central Valley School District (No. 356 ) has commented on the proposed short plat.
The I?istrict has indicated that existing school facilities are inadequate to serve the proposed
short plat and has requested the applicant negotiate with the District to pruvide appropriate
capital facilities as required by the Revised Code of Washington (RCVV) 58.17.110.
Approval of tbis short plat should include conditions requiring that provisions for appropriate
facilities be in place prior to necording this final pIat in the form of a written agreement
between the property owner and the school district.
14. The Sgokane County Parks Departtnent has commented on the proposed shart plat, The
Parks Departrnent has requested a voluntary agreement be completed between the Parks

Department and the property owner to nudgate impacts to the County Pazk system. The
Spokane County Planning Depmtmnt recommends the property owner negotiate with the
Spokane County Parks Department to provide for appropriate capital facilities as requured by
the Revised Code of Washington (RCW) 58.17.110. Approval of this short ptat should
include condidons requiriag that provisions for appropriate facilities be in place prior to
recording this final plat in the form of a wricten agr+~eement between the owner and the Spokane
County Parks DepartmenL
15. Recognizing the recommended oonditions aad Spokane County development standards, the
propossd short subdivision makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be serverl by platting the proposed
short subd.ivision.
The subd.ivision proposal is generally consistent with RCW 58.17 and the County subdivision
regulations, promoting the public health, safety and general welfare in accardance with
standards established by the state and Spokane County. The Planning Department has
considered the provision of public facilities as cited io RCW 58.17.110 (2). More
specificaUY:
a. open spaces
b. drainage ways
c. public and/or private rights-of-way
d. transit
e. potable water
f, sanitary waste disposal
g. parks and recreation facilities
h. playgrounds
i. schools and schoolgrounds
j. sidewalks
16. The project is exempt fr+om environmental review under the State Environmeatal Policy Act
pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted. Findings of Fact and Conclusions, Short Plat Application SP-918-93
is hereby APPROVED until March 1,1997, subject to conditions noted below. Most of the
conditions of appr+oval shall be accomplished by the applicant and/or sponsor prior to finalization
of the short subdivision. This decision is final unless appealed in writing, consistent with adopted
aPPeal Procedures.
PLANNING DEPARTMENT CONDITIONS
1. All conditions imposed by the Planning Department shall be binding on the "Applicant",
which term shall include the owner or owners of the property, heirs, assigns and successors.
2. The proposal shall comply with the Urban Residential-3.5 zone as amended. Any
nonconfonning rights far large anunal keeping which may exist shall eupire upon finalization
of this short plaL
3. The fmal plat shall be designed substantially in conformance with the preliminary plat of
recard. No increase in density or number of lots shall occur without a change of condition
application submittal and approval.
4. The Planning Directsor/designee shall review any proposed final plat to ensure compliance with
these Find.ings and Condiaons of Approval.
5. Appropriate road name(s) shall be indicated.
6. The preliminary plat is given condidonal approval for three (3) years, specifically to March 1,
1997. The applicant may request an extension of time by submitting a written request
approximately forty-five (45) days prior to the above expiration date.
7. Appropriate utility easements shall be indicated on copies of the proposed final plaL Written
approval of utility easements by appropriate urility companies shall be received with the
submittal of the final plat

8. Three (3) current certificates of title shall be finnished to the Planning Department prior to
filing the final plat
9. Ile final plat map shall indicate by a clear, dashed line the requirad yard setbacks from all
private, "Tract X" or public roads. Ile dedication shall contain the followiag statemenG
"Side yard and rear yard setbacks shall be detelmined at the dme building penmits are
requested unless these setbacks are specifically drafted on this final plaL Ile setbacks
indicated on this plat may be varied fmm if proper zoning approvals are obtained."
10. No water plan is required, and a simple tap is needed at the time of building permit release.
11. A survey is nequired prior to the filing of a final plat.
12. Ile owner shall negotiate with the Centml Valley School District and the Spokane County
Parks Department and submit a r+ecorded capy of the agreement(s) making appropriate
provisions for public schools and parks prior to finalization and recording of this short plat.
The agreement(s) shall provide a written description of the subject properiy to which the
agreement(s) apply(ies) and also state t6e dollar amount per lot and any other agreed to
midgating measure(s).
Ile Owner shall also norify any potendal purchasers who have made an agreement to
purchase property within said shart plat pursuant to the Revised Code of Washington
(58.17.205), that adequate provisions for school facilities aad parks must be made
conditioned on a future agreement(s) between the plattor, school district, and County Pazks.
Voluntary agreements betweea the Owner, School District and County Pazks shall confoan to
the requirements of the Revised Code of Washington Chapter 82.02.
13. Ile final plat shall be addressed in accordance with RCW 58.17.280 and local ordinance.
COUNTY ENGINEER'S DEPARTMENT CONDTTIONS
1. Ile conditional approval of the plat is given by the County Engineer subject to dedicatioa of
right-of-way and approval of the road system as indicated in the pneliminary plat of record.
2. Drainage plans and design calculations showing the alignment of drainage facilides shall be
submitted to the County Engineer for approval prior to constrnction and/or the filing of the
Snal plaL Drainage plans to be pnegared under the direccion of a licensed Professional Civil
Engineer.
3. No construction work is to be performed within the existing or proposed public right-af-way
until a pemait has been issued by the Counry Engineer. All work is subject to inspection and
appruval by the County Engineer.
4. Individual driveway access permits are required prior to issuance of a building pemut for
driveway approaches to the county road system.
5. Dedication of 5 feet of additional right-of-way along Alki Avenue is requ,ired.
6. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standands.
7. The word "applicant" shall include the owner or owners of the property, his heus, assigns and
successors.
8. To constrnct the road improvements stated herein, the applicant may, with the approval of the
County Engineer, jain in and be a willing garticipant in any pedtioo or resolutioa which
purpose is the fonnation of a Road Improvement District (RID) for said improvements,
- pursuant to RCW 36.88, as unended. At such dme as an RID is created ar any Road
Improvement Project is sanctioned by Spokane County, the improvements reqnired (curb,
sidewalk, drainage control and paving to exisdng pavement) will be at the sole expense of the
undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Allci
Avenue and Long Road.
9. As an altemative method of constructing tfie mad improvements stated herein, the applicant
may, with the approval of the County Engineer, accomplish tbe road improvements stated
herein by joining and participating in a County Road Project (CRP) to the extent of the
required road impravemena. At such time as aa RID is created or any Road Improvement

Project is sanctioned by Spokane County, the improvements required (curb, sidewalk,
drainage control and paving to existing pavemeat) will be at the sole expense of the
undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Alki
Avenue and Long Road.
10. The following statement shaU be placed in the plat dedicadoe:
"The owner(s) or successor(s) in interest agree to authorize the County to place their name(s)
on a pedtion for the formation of a Road Impravement I?istrict (RID) by the petition method
pursuant to Chapter 36.88 RCW, which petition includes the owner(s)' property, and further
not to object, by the signing of a ballot, to the formation of an RID by the resolutioa method
pursuant to Chapter 36.88 RCW, which resolution includes the owner(s)' property. If an
RID is farmed by either the petition or nesolution method as provided for in Chapter 36.88
RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) or construction contemplated within the proposed RID is
feasible;
(b) that the benefits to be derived from the fonnation of the RID by [he property included
therein, together with the amount of any County participation, exceed the cost and expense
of formation of the RID; actd
(c) that the property within the proposed RID is sufficiendy developed.
Provided further that the owner(s) or successor(s) shall retain the right, as authorized under
RCW 36.88.090, to object to any assessment(s) on dhe property as a result of the
improvements called for in conjunction with the fozmation of an RID by either petition or
resolution method under Chapter 36.88 RCW, and io appeal to the Superior Court the
decision of the Board of County Commissioners affirming the final assessment roll.
It is fnrther agreed that at such time as an RID is created or any Road Improvement Project is
sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control
and paving) will be at the sole expense of the undersigned owner(s), their heirs, grantees and
assigns without participation by Spokane County.
The RID waiver contained in this agneement shall expire after ten (10) years frvm the date of
execution below. However, the owner(s) or successor(s) agree that if said RID waiver
expires withoui construction of the required improvements, the owner(s) or successor(s) agree
to construct the required improvements at their own expense, pay to Spokane County the then
estimated cost of the required improvements co enable the County to complete the same, or
furnish a bond or other secure method suitable to the County (which may include the
execution of another RID waiver agreement) providing for or securing to the County the actual
construction of the improvements.
All of the requirements of this agreement shall run with the land and shall be binding upon the
owner(s), their successor(s) or assign(s)." This pmvision is applicable to Alki Avenue and
Long Road.
11. The County Engineer has designated Typical Roadway Section Number Two, Local Access
standani for the improvement of Alki Avenue, which is adjacent to the proposed development.
This will require the addition of approximately 8-10 feet of asphalt along the frontage of the
development. The construction af curbing is also raquired.
12. The County Engineer has designated Typical Roadway Section Number Two, Local Access
standard for the improvement of Long Road, which is adjacent to the proposed developmeat.
This will require the addition of approximately 10-12 feet of asphalt along the frontage of the
development The construcdon of curbing is also required.
13 The proposed subdivision shall be improved to the standards set forth in Spokane County
Board of Commissioners Resoludon No. 80-1592, as amended, which resolution establishes
regulations for roads, approaches, drainage and fees in new construction.
14 The County Engineer has examined ttus development proposal and has detennined that the
impact of this proposal upoa the existing county road system wanants the dedicaeon of
additional right-of-way and the roadway improvements herein specified.
15. The applicant shall dedicate the applicable radius on Alki Avenue and Long Road.
16. There may exist utilities, either undergrouad or overhead, affecting the subject property,
including property to be deciicated or set aside for future avquisidon. Spokane County

assuaies no financial obligation for adjustments or relocation regarding these utilities.
Applicant(s) should check with the applicable utility purveyor and the Spokane County
Engineer to detenmine whether applicant(s) or the utility is itsponsible for adjustment or
relocation costs aad to make anangements for any necessary work.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shaU be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shaU be indicated on copies of the pre hminary plat of record far
distribution by the Planning Department to the utility companies, Spokane County Engineer
and the Spokane County Health Di,strict Written approval of the easements by the utility
companies must be received prior to the submittal of the final plat
3. Sewage disposal method shaU be as authorized by the Director of Utilities, Spokane County.
4. Water service shall be coordinated through the Director of Utilities, Spokane County.
5. Water senrice shall be by an existing public water supply when approved by the Regional
Eagineer (Spokane), State Deparmnent of Health.
6. Prior to filing the final plat, the sponsor shaU demonstrate to the sadsfaction of the Spokane
County Health I?istrict that an adequate and potable water sUpply is available to each tract of
the plat.
7. Prior to filing the final plat, the sponsar shall present evidence that the plat lies within the
recorded service area of the water system proposed to serve the plat.
8. Prior to filing the final plat, the sponsor shall demonstiate to the satisfaction of the Spokane
County Health District that a suitable sites for on-site sewage disposal systems areavailable on
tracts B and C.
9. Subject to specific application approval and issuance of pernuts by the health officer, the use
of individual on-site sewage d.isposal systems may be authorized.
10. The dedicatory language of the plat will state: "Subject to s~Pecific application approval and
issuance of permits by the Health Officer, the use of individual on-site sewage systems may
be authoriz,ed."
11. The dedicatory language on the plat shall state: "Use of private wells and water systems is
prohibited. "
12. 1'he final plat dedication shaU contain the foUowing statemenr. "The public water system,
pursuant to the water plan approved by county and state health autharities, the local fire
protecdon district, County Building and Safety Department, and water purveyor, shaU be
installed within this subdivision and the applicant shaU provide for individual domestic water

Tbe followinq "Conditions of epproval" for the above referenced subdivisioa
are submitted to the 8pokane County Planninq Department for inalusion ia the
"Fiadfaqs and Order" shoul8 the short plat be approved.
E 1 That conditional approval of the plat by the County Engineer is given
subject to dedication of Right-of-Way and approval of the road system as
indicated in the preliminary plat of record.
E 3 That drainage plans and design calculations showing the aligntaent of
drainage facilities be submitted to the County Engineer for approval
prior to construction and/or the filing of the final plat. Drainage
plans to be prepared under the direction of a licensed Professional
Civil Engineer.
E 6 No construction work is to be performed within the existing or proposed
Public Right-of-Way until a permit has been issued by the County
Engineer. All work is subject to inspection and approval by the County
Engineer.
E12 The applicant should be advised that individual driveway access permits
are required prior to issuance of a building permit for driveway
approaches to the County road system.
E13 Dedication of 5 feet of additional Right-of-Way along Alki Avenue.
E16 Existing County roads providing direct access to the plat shall be paved
and/or curbed to Spokane County standards.
E19 The word "applicant" shall include the owner(s) of the property, his/her

E20 To consti•uct the road improvements stated herein, the applicant may,
with the approval of the County Engineer, join in and be a willing
participant in any petition or resolution which purposes is the
formation of a Road Improvement District (RID) for said improvements
pursuant to RCW 36.88, as amended. At such time as an RID is created or
any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned owner,
their heirs, grantees and assigns. This provision is applicable to Alki
Avenue and Lonq Road.
E21 As an alternative method of constructing the road improvement stated
herein, the applicant may, with the approval of the County Engineer,
accomplish the road improvements stated herein by joining and
participating in a County Road Project (CR.P) to the extent of the
required road improvement. At such time as an RID is created or any
Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existinq pavement) will be at the sole expense of the undersigned owner,
their heirs, grantees and assigns. This provision is applicable to Alki

or successor,(s) aqr-ee that if said RID waiver expires without
construct-ion of the required improvements, the owner(s) or
zuccessor-(s) agree to constr-uct the required improvements at their own
.expense; pay to Spokane County-the then estimated cost of the required
improvements to enable th-e County to complete the same; or furnish a
, bond or other -secure method - su'itable to -the County (which may include
the execution of another RID waiver agreement), providing for or securing to the County the actual construction of the improvements.

to the proposed development. This will require the addition of
approximately 10-12 feet of asphalt along the frontage of the
development. The construction of curb'ing is also required.
E32 The praposed plat shall be improved.to the standards set forth in
Spokane County Board of Conuriissioners Resolution No. 8,0-1592, as
ainended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
E33 The County Engineer has examined this .development proposa-1 and bas
'deter-mined that the impact of this proposal upon the existing County
