insr.alling, operating and maintaining drainage swales and drainage facilities, as conditions
of plat approval. are hereby granted to the public.
? Spokane County and its authorized agents are hereby jranted the right of ingress and
egress to, over, and from said easements for the purpose of inspection and emercrency
maintenance of water quality treatment swales ("208 swales") and other drainage
facllities, if not properly maintalned by the property owner. Spokane County does not
accept the responsibility to inspect or maintain the drainage easements or drainage
swaies, nor does the County accept any liabiliry for any failure by the lot owner(s) to
properly maintain such areas.

The properry owners within this Plat shall be held responsible for keeping open and

~ maintalning the surface path of natural or man-made drainage flow over and across their
respective properties.
4. The propern, owners within this Plat shall maintain all wacer guality treatment swales
("208 swales and drainage ditches situated on thelr respective properties, and any
ponlon of a?OS swale situated in the public right-of-way adjacent to thelr respective
properties, with a permanent ground cover as specified on the current approved plans on
file at the County Engineer's Office. The property owners may insrzll approved
shrubbery and/or trees which do not obstruct the tlow and percolacion of storm drainage
water in the 208 swale and drainage ditches, as indicated by the current approved plans
on file with the County Engineer's Office.
5. The property uwner or his representatrve shall inform each succeeding purchaser of all
drainage easements on the property and of his responsibiliry for maintaining surface
drainage paths and swales wlthin said easements.
6. Spokane County does not accept the responsibility of maintaining the drainage course on
private lots wtthin drainage easements or floodplaln areas, nor the responsibility for any
damage whatsoever, including, but not limited to, inverse condemnation to any propertles
due to deficient construction and or maintenance of drainage courses in drainage
easements on private property.

7. If the property owner fails to maintain the surface path of natural or man-made drainage
flow, or the drainage swale, a notice of such failure may be given to the properry owner.
If not corrected within the period indicated on sald notice, Spokane County has the right
to correct the maintenance failure, or have it corrected, at the expense of the properry
owner.
~ Any building that is constructed on a lot in this Plat shall be set at such an elevation so
as to provide positive drainage away from any draunage entry point to the building
(including but not limited to a window,well, a window unprotected by a window well,
or a doorway). Said positive drainage shall consist of a minimum slope of 3% away from
the building for a distance of at least 10 feet from the building. The lots shall be crraded
so that either a) all runoff is routed away from the building, and conveyed over the lot
to a narural drainage swale or approved drainage facility, or b) drainage intercepted on
the lot is disposed of on the lot ln an approved drainage facility. The approved drainage
factliry shall be constructed in accordance with the approved plans on file at the County
Engineer's Office. Any revisions to the approved drainage plans must be approved by
the Counry Engineer's Office prior to consnvction of said revisions.
If there are continuous swales for water quality treatment (208 strip swales) on the Parcel:
9. Driveway access permits for driveway approaches to the County road system are required
prior to issuance of a building permit. This approach shail be constructed in accordance
with the approved plan on file in the Counry Engineer's Office.
If a floodpia.in occurs on the Parcel:
10. Development within this Plat shall conform the requirements of the National Flood
Insurance Program, and Chapter 3.20 of the Spokane Counry Code. The lowest floor,
including basement tZoor, for any scructure shall be constructed in accordance with the
requirements of the Spokane Counry Flood Zone Rea' ulations in effect at the time a
building permit is issued. Purchasers of propeny in this subdivision are warned of
possible flooding or ponding and the of the pocential requirement to purchase Flood
Insurance. Thls warning shall be carried in each and every deed to transfer ownership
of any and all propeny within this plat in the Area of Special Flood Hazard.
11. An approved grading plan exists for Lot(s) , , of Block . Grading _
must conform to sald plan on file in the County Engyneer's Office.
12. Spokane County does not accept any responsibility whatsoever to establish or maintain
ingress or egress across the flood plain area.

2. The undersigned agrees that these fees are due and payable upon receipt of (lie billing as

3. Any invoices not paid within 30 days of (lie invoice date will be considered delinquent.
lf any outstanding balance on the accaunt for this pruject is not paicl within 30 days of
the invoice date, no fiirther reviews of lhe project clocuinents will be conducted until the
entire account balance is paid. Any balance on the account for this project not paid
within 65 clays of (lie invoice date may result in legal aetion or the initiation of otlier
collection procedures, including referral to a collection agency. The Spansor will be
