PROJECT DESCRIPTION: The Harris Subdivision is a 3.3 acre tract of land located generally south of Wellesly and we;t of Sullivan Road between Woodla«-n Road on the west and \icDonald Road on the east, just north of Rich Avenue within the Northwest quarter of Section 3, Township 24 N., Rancre 44 E, WM, Spokane County, Washington. The property is located within the Urban category and is within the Aquifer Sensitive Area (ASA) Overlay zone. This is the second phase of a two phase project. This report was sabmitted as part of Phase I. The type "B" drywell specified in this report for drainage basin ;:1 \vas handled in the Phase I construction plan. The '208' basin associated with Phase I, Basin -1 will be enlarQed as part of the Phase II project. The soil in this area is classified as GLYA (Garrison) based on She~c 66 of the Soil Survey of - Spokane Couyity, Washington. A copy of this sheet is attached in the appendix. The GQA soil is excessively drained and has maderately rapid permeabili:v. Based on the Spokane County Guidelines for Stormwater lVanagement, this soil type aiiows the use of tne County ~ standard concrete drywells, either type "A" or "B". ~ The project is divided into two drainage basins defined by proposled topoaraphy and roadway desiQn. A map which defines thesz basins is included in the appenui.~c. PROJECT PURPOSE: . . . In accordance with the Planning Department report dated 1/21 j93, (PE-1683-92) this project - lies within the ASA Overlay zone and is subject to '208' requirements. To assure that these requirements are met, a storrnwater drainage plan is required. This drainage plan will determine the storm water facilities requized to adequately handle the runoff from a ten year design storm in post development condition. -In accordance with the Guidelines for Stormwater Management, the "rational method" will be used to determine the peak discharges and runoff volumes for the various basins. This . method is considered adequate for basins less than 10 acres in size. Numerous graphs and ' charts which appear in this publication will also be used and referenced accordingly. ~ : - ~ i f CALCULATIONS: T}ie total basin area and the impervious basin areas used in the followinj calculations are summarized below. Using the # of lots divided by the total basin area, Table 1 in the Guidelines was used to determine the runoff coefficient. These drywells are utilized in combination with the '208' basins to adequazel\dispose ~ ~ of the Stormwater runoff. ~ The c,-pe "B" drywell and '208' basin will be locaced, based on the Phase I construction plans, at the northeast corner of the Rich Avenue & Harris Court intersection. A curb opening or inlet will be used to allow the runoff to flow into the '208' ponds and drywells. Drainage Basin #1 has the greatest amount of flow at 1.60 cfs. Assurne that at Sta 2+47, approximately 50% of design flow has been accumulated. This makes the design flow for a curb opening at Sta 2+47, 0.80 cfs. With Figure 17 of the Guidelines (next page entering the nomograph with an inlet height of 8" and a flow depth of 1.68", the length of curb opening required is 0.80/0.16=5.0 feet for Sta 2+47 (conservative estimate for Basin #2 as well). This means that a 5.0' curb i.nlet will handle 0.80 cfs on basin #1. The remaining 0.80 cfs can be handled similarly in another 5.0' curb inlet at Sta 0+80.89. All four curb inlets shall be sized to 5.0' in length. The property owners within this Plat shall be held responsible for keeping open and maintaining the surface path of natural or man-made drainage flow over and across their respective properties. 2. Any building that is constructed on a lot in this Plat shall be set at such an elevation so as to provide positive drainage away from any drainage entry point to the building (including but not limited to a window well, a window unprotected by a window well, or a doorway). Said positive drainage shaU consist of a minimum slope of 3% away from the building for a distance of at least 10 feet from the building. SP-938-93 ) CONCLUSIONS AND MAR 0 3 1994 ) DECISION 5POKANE COUNTI' ENGINEER THIS MATTER, an application for subdivision of land, from Michael Harris has been received and decided upon, pursuant to Spokane County Subdivision regulations, on the L4 day of March, 1994. , FINDINGS OF FACT AND CONCLUSIONS 1. The xndividual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning. 2. The proposal is to divide approximately 1 acre into 3 residential lots and those uses permitted in the underl}►ing zone. 3. The proposal is generally located northwest of the intersection of McDonald Road and Rich Avenue, in the NW 1/4 of, Section 3, Township 25 North, Range 44 E.W.M. Spokane County, Washington. 4. The existing zoning of the property described in the application is Urban Residential-3.5 (UR- 3.5), previously esta.blished as Agricultura] (A) (f~le # 4-24-42) zoning in 1942 and redesignated to UR-3.5 on January 1, 1991, pursuant to the Program to Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform to the requirements of the existing UR-3.5 zone. 5. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses proposed are generally in accord with this category. 6. Surrounding uses are primarily single family residences on mixed urban size lots and open space. 7. The required public notice was provided for this proposal and agencies having a potential ' interest in the project were notified and recommendations solicited. 8. No written cornuments were received from any adjoining property owners. 9. The Spokane County Arteria] Road Plan identifies McDonald Road as a Collector Arterial with a future right of way width of 70 feet. The existing right of way width is 50 feet. In order to implement the Arterial Road Plan, the County Engineer has requested that a strip of property 5 feet in width along the McDonald Road frontage be set aside as a Futuxe Acquisition Area. In addition, the County Engineer has required 5 feet of new dedicated along McDonald Road. 10. The site is located within the Public Transportation $enefit Area (PTBA). The nearest transit service is the Spokane Transit Authority (STA) Valley/I'rentwood Route # 201ocated approximately 1/2 mile east of the site. 11. The proposed short plat will be served by a public water system. Waste water disposal will be as authorized by the Director of Utilities. 12. The Spokane County Parks Department has commented on the proposed short plat. The Parks Department has requested a voluntary agreement be completed between the Parks Department and the property owner to mitigate impacts to the County Park system. County legal counsel has indicated such agreements may be required. The Spokane County Planning Departnzent recommends the property owner negotiate with the Spokane County Parks Department to provide for appropriate capital facilities as required by the Revised Code of Washington (RCW) 58.17.110. Approval of this short plat should include conditions requii-ing that provYsions for appropriate facilities be in place prior to recording this final plat in the form of a written agreement between the owner and the Spokane Counry Parks Department 13. The proposed short plat has direct access to public right of way at McDonald Road. Sidewalks were required by the County Engi.neer regarding this proposal. 14. Recognizing the recommended conditions and Spokane County development standards, the proposed short subdivision makes appropriate provisions for the public health, safety and general welfare and that the public use and interest will be served by platting the subdivision. The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision regulations, promoting the public health, safety and general welfare in accordance with standards established by the state and Spokane County. The Planning Department has . ~ FINDINGS AND DECISION SP-938-93 Page 2 considered the provision of adequate public facilities as cited in RCW 58.17.110 (2). More specifically: , a. open spaces b . drainage ways c. public and/or private rights-of-way d . transit e. potable water f. sanitary waste disposal g. parks and recreation facilities h . playgrounds i. schools and schoolgrounds j . sidewallcs 15. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). 16. The following facts are also relevant: a. The proposed Short Plat is a replat of Lot l, Block 1, of Harris Subdivision Phase One (PE-1683-92), which was recorded as a final plat on December 22, 1993. b. This proposal was received by the Planning Department prior to January 1, 1994 and the implementation of new Washington State Board of Health regulations on the use of on- site sewage disposal systems. DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-938-93 is hereby APPROVED until March 1, 1997, subject to conditions noted below. Most of the conditions of approval shall be accomplished by the applicant and/or sponsor prior to finalization of the short subdivision. This decision is final unless appealed in writing, consistent with adopted appeal procedures. COUNTY PLANNING DEPARTMENT CONDITIONS 1. All conditions imposed by the Planning Department shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns and successors. 2. The proposal shall comply with the Urban Residenrial-3.5 (UR-3.5) zone as amended. 3. The final plat shall be designed substanrially in confomlance with the preliminary plat of record. No increase of density or number of lots shall occur without a change of condition application submittal and approval. 4. The Planning Director/designee shall review any proposed final plat to ensure compliance with these Findings and Conditions of Approval. 5. The preliminary plat is given conditional approval for three (3) years, specifically to March 1, 1997. The applicant may request an extension of time by submitting a written request approximately forty-five (45) days prior to the above expiration date. 6. Three (3) current certificates of ritle shall be furnished to the Planning Department prior to filing the final plat. 7. Appropriate utility easements shall be indicated on copies of the proposed final plat. Written approval of utility easements by appropriate utility companies shall be received with the submittal of the final plat. 8. Appropriate road name(s) shall be indicated. 9. The final plat map shall indicate by a clear, dashed line the required yard setbacks from all . private, "Tract X" or public roads. The dedication shall contain the following statement: "Side yard and rear yard setbacks shall be detenmined at the time builcling permits are requested unless these setbacks are specifically drafted on tlis final plat. The setbacks indicated on this plat may be varied from if proper zoning approvals are obtained." ~ i FINDINGS AND DECISION SP-938-93 Page 3 10. The Spokane County Planning Department shall prepare and record with the County Auditor a Title Notice specifying a future land acquisition area for road right-of-way and utilities. The reserved future acquisition area Tit1e Notice shall be released, in full or in part, by the . Planning Department. The notice should be recorded within the same time frame as an appeal and shall provide the following: a. At least S feet of reserved future acquisition area for road right-of-way and utilities, in addition to the existing and/or newly dedicated right-of-way along McDonald Road. NOTE: The County Engineer has required 5 feet of new dedication. b. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisition area. c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be located within the future acquisition area for road right-of-way and urilities. If any of the above improvements are nzade within this area, they shall be relocated at the applicant's expense when roadway improvements are made. d. The future acquisition area, until acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall be considered interim uses. e. The property owner shall be responsible for relocating such "interim" improvements at the time Spokane County makes roadway improvements after acquiring said future acquisition area. 11. A plan for water facilities adequate for domestic service and fire protection shall be approved by the water purveyor, appropriate fire protection district, County Division of Buildings and County Health District. The agencies will certify on the Water Plan, prior to the filing of a final plat, that the plan is in conformance with their respective needs and regularions. The Water Plan and certification shall be drafted on a transparency suitable for reproduction and be signed by the plat sponsor. 12. The water purveyor shall certify that appropriate contractual arrangements and schedule of improvements have been made with the plat sponsor for construction of the water system in accordance with the approved Water Plan. The time schedule shall provide for completion of the water system and inspectio❑ by the appropriate hea.lth authorities prior to application for building pern~.its within the final plat. The arrangements or agreements shall include a provision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a building pernut due to the failure of the subdivision sponsor to satisfactorily complete the approved water system. 13. The final plat dedication shall contain the following statement: "The public water system, pursuant to the Water Plan approved by county and state health authorities, the local fire protection district, water purveyor and Spokane County Division of Buildings, shall be installed within this subdivision, and the applicant shall provide for individual domestic water service as well as fire protection to each tract prior to sale of each tract and prior to issuance of a building permit for each tract." 14. No building permit will be issued for any lot within the final plat until certified by a Washi.ngton state-licensed engineer that "the water system has been installed pursuant to the approved Water Plan for the final plat" including a signed license stamp. The certification may be i.n the form of a letter, but is preferred to be certified on a copy of the Water Plan as a schematic map showing the "as-built" water system. 15. The Water Plan and the above four (4) conditions of approval regard.ing the Water Plan may be waived by the Planning Director/designee upon receipt of letters from the appropriate water purve,yor and fire protection distr'ict stating that simple connections to an existing, approved water system wi.ll provide adequate domestic and fire protection water to ensure the public healrh, safety and general welfare. 16. The owner shall negoriate with the County Parks Department and submit a recorded copy of a voluntary agreement malang provisions for public parks prior to finalization and recording of the plat. The agreement shall provide a written description of the subject property to which the agreement applies and also state the dollar amount and any other agreed to mitigating measures. FZNDINGS AND DECISION SP-938-93 Page 4 The owner shall also notify any potential purchasers who have made an agreement to purchase property within said plat pursuant to the Revised Code of Washington (RCV) 58.17.205, that adequate provisions for park facilities must be made condirioned on a fiiture agreement between the plattor and Spokane County Parks Department. Voluntary agreements between the owner and Spokane County Parks Department shall confonn to the requi.rements of RCW Chapter 82.02. . 17. A survey is requized prior to the filing of a final plat. COUNTY DIVISION OF ENGINEERING AND ROADS CONDITIONS 1. The conditional approval of the plat is given by the County Engineer subject to dedication of right-of-way and approval of the road system as indicated in the preliminary plat of record. S;1submitted Drainage plans and design calculations showing the alignment of*drainage facilities shall be to the County Eng-ineer for approval prior to construcrion and/or the filing of the final plat. Drainage plans to be prepared under the direction of a licensed Professional Civil Enguleer. 3. No construction work is to be perfornled within the existing or proposed public right-of-way until a permit has been issued by the County Engineer. Al.l work is subject to inspection and appxoval by the County Engineer. 4. Individual driveway access permits are required prior to issuance of a building permit for driveway approaches to the county road system. 5. Ded.ication of 5 of adclirional right-of-way along McDonald Road is requized. 6. Existing county roads providing direct access to the plat shall be paved and/or curbed to Spokane County standards. 7. Sidewalks are required along the arterial(s) on McDonald Road. 8. The word "applicant" shall include the owner or owners of the property, his heirs, assigns and successors. 9. To construct the road unprovements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolurion which purpose is the formation of a Road Improvement District (RID) for said improvements, pursuant to RCW 36:88, as amended. At such time as an R]D is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to e;cisting pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to McDonald Road and Rich Avenue. 10. As an alternative rnethod of constructing the road improvements stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Froject (CRP) to the extent of the requixed road improvements. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to McDonald Road and Rich Avenue. 10. The following statement shall be placed i.n the plat dedication: "The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formarion of a Road Improvement District (RID) by the petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s)' property, and further not to object, by the signing of a ballot, to the formation of an RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution includes the owner(s)' property. If an RID is formed by either the petition or resoludon method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: (a) that the improvement(s) or construction contemplated within the proposed RID is t, feasible; , - FINDINGS AND DECISION SP-938-93 Page 5 (b) tnat the benefits to be derived from the formation of the RITD by the property included therein, together with the amount of any County. participation, exceed the cost and expense of forrnarion of the RiD; and (c) that the property within the proposed RID is sufficiently developed. Provided further that the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the formation of an RID by either petition or . resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court the decision of the Board of County Commissioners affirnung the final assessment roll. It is further agreed that at such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving) will be at the sole expense of the undersigned owner(s), theu heirs, grantees and assigns without participation by Spokane County. The RID waiver contained in this agreement shall expire after ten (10) years from the date of execution below. However, the owner(s) or successor(s) agree that i.f said RID waiver expires without construction of the required impzovements, the owner(s) or successor(s) agree to construct the required improvements at their own expense, pay to Spokane County the then estimated cost of the required improvements to enable the County to complete the same, or furnish a bond or other secure method suitable to the County (which may include the execution of another RID waiver agreement) providing for or securing to the County the actual construction of the improvements. All of the requirements of this agreemetit shall run with the land and shall be binding upon the owner(s), their successor(s) or assign(s)." This provision is applicable to McDonald Road and Rich Avenue. 12. T'he County Engineer has designated Typical Roadway Secrion Number Two, Collector Arterial Standard for the improvement of McDonald Road, which is adjacent to the proposed development. This will require the addition of approximately 10-12 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. 13. The County Engineer has designated Typical Roadway Section Number Two, Local Access Standard for the improvement of Rich Avenue, which is adjacent to the proposed development. This will require the addition of approximately 5-7 feet of asphalt along the frontage of the development. The construction of curbing is also required. 14. The proposed plat shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80-1592, as amended, which resolution establishes regulations for roads, approaches, drainage and fees in new construction. 15. The County Engi.neer has examined this development proposal and has determined that the impact of this proposal upon the existing county road system warrants the dedication of addirional right-of-way and the roadway improvements herein specified. 16. The applicant shall ded.icate the applicable radius on McDonald Road and Rich Avenue. 17. The County Arterial Road Plan idenrifies McDonald Road as a Collector Arterial. The existing right-of-way width of 50 feet is not consistent with that specified in the Plan. In order to unplement the Arterial Road Plan, in addition to the required right-of-way dedication, a strip of property 5 feet in width along the McDonald Road frontage shall be set aside in reserve. This property may be acquired by Spokane County at the time when arterial improvements are nlade to McDonald Road. 1$. There may exist utilities, either underground or overhead, affecting the subject properry, including property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligation for adjustments or relocation regarding these utilities. Applicant(s) should check with the applicable utility purveyor and the Spokane County Engineer to deterrnine whether applicant(s) or the utility is responsible for adjustment or relocation costs and to make arrangements for any necessary work. COUNTY HEALTH DISTRICT CONDITIONS „ _ 1. The final plat shall be designed as indicated on the preliminary plat of record and/or any attached sheets as noted. FINDINGS AND DECISION SP-938-93 Page 6 2. Appropriate utility easements shall be indicated on copies of the preliminary plat of record for distribution by the Planning Deparrment to the urility companies, Spokane County Engineer and the Spokane County Health District. Written approval of the easements by the utility companies must be received prior to the submittal of the final plat. 3. Sewage disposal method shall be as authoTZZed by the Director of Uti.lities, Spokane County. 4. Water service shall be coordinated through the Director of Utilities, Spokane County. 5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that an adequate and pota.ble water supply is available to each tract of the plat. . 7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. Subject to specific application approval and issuance of permits by the Health Officer, the use of individual on-site sewage disposal systems may be authorized. Note: Special construction requirements may be necessary for the installation of on-site sewage disposal systems. 9. The ded.icatory language of the plat will state: "Subject to specific application approval and issuance of perm.its by the Health Officer, the use of individual on-site sewage systems may be authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2. The dedication shall state: "The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petirion for the forniation of ULID by petition method pursuant to RCW 36.94, which petition includes the owner(s)' property; and further not to object by the signing of a protest petition agai.nst the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)' property. The following "Conditions of Approval" for.the above referenced subdivision are submitted to the spokane County Planninq Department for inclusion in the "Findings and Order" should the short plat be approved. E 1 That conditional approval of the plat by the County Engineer is given subject to dedication of kight-of-Way and approval of the road system as indicated in the preliminary plat of record. E 3 That drainage plans and design calculations showing the alignment of drainage facilities be submitted to the County Engineer for approval prior to construction and/or the filing of the final plat. Provided, further, the owner(s) or successor(s) shall retain the riqht, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the formation of a RID by either petition or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court the decision of the Board of County Commissioners affirming the final assessment roll. However, the owner(s) or successor(s) agree that if said RID waiver expires without construction of the required improvements, the owner(s) or successor(s) agree to construct the required improvements at their own expense; pay to Spokane County the then estimated cost of the required improvements to enable the County to complete the same; or furnish a bond or other secure method suitable to the County (which may include the execution of another RID waiver agreement), providing for or securing to the County the actual construction of the improvements. All of the requirements of this agreement shall run with the land and shall be binding upon the owner(s), their successor(s) or assign(s). This provision is applicable to McDonald Road and Rich Avenue. E24 The County Engineer has designated Typical Roadway Section Number Twot Collector Arterial Standard for the improvement of McDonald Road which is adjacent to the proposed development. This will require the addition of approximately 10-12 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required.
