Gentlemen:
Herewith we request you consideration of a"Deviation Request" relative
to the insCallation of a sidewalk along the Indiana frontage of the subject
manufacturing business.
Please review the attached IIse Map which portrays the present development
along Indiana.
The development in this area is relatively low density wholesale/manufac-
turing and a large storage/warehouse facility. Indiana street is a dead
end road with a minimum of traffic either of automobile or pedestrian type.
The location and access conditions of this area, in our opinion, will limit
future use to only similar development.
Please review the following descriptions of the busineas that exist on
Indiana and how they relate to the street use, and most importantly, how
they relate to one another; which develops our request for deviating
from the sidewalk requirement.
Indiana Street North Side (Eaet to West)
Evergreen Wholesale Lumber
This location is used as a wholesale storage yard for lumber and plywood.
Access to this business is totally from Montgomery Avenue. The site is
totally fenced on Indiana. No traffic, either automobile or pedestriaa,
uses Indiana.
EverSreen Truss Company
This locatfon is used as a manufacturing and material storage yard. The
business is totally wholesale with onlq limited shipping/receiving traffic
and no pedestrian use. The employee parking is totally provided off-street.
The site is totally fenced.

ABC Storage-Warehouse
This location is used as a private storage facility. The traffic is totally
automobile, and very limited. The site ia completely fenced without occasion
for people to walk off-site or to use Indiana except when in an autombile.
Indiana Street South Side (East to West)
Freewaq Center
This portion of this development that fronts Iadiana is occupied by wholesale
tenant users. The main access to Freeway Center ia further east than the
intersection of Indiana and Montgomery. The occasion for pedestrian traffic
on Indiana is non-existant.
ABC Storage-Warehouse
This location is used the same as the facility across the street described
herein. Again totally fenced with no occasion for a person to walk outside
the enclosed area.
The street paving ends briefly beyond the west of the ABC Storage Warehouse
facility on the north of Indiana. A gravel road continues to a dead-end not
far west. The land i.n this area is basically un.developed.
We submit this information for your review and study. *It is our opinion that
sidewalk development along Indiana is not justified due to the non-existance
of pedestrian use. *The majority of the manufacturing and storage use of this
area is fenced disallowing pedestrian traffic. *The businesses are not of a
nature where people will want to walk from one to another. *There are no
sidewalks currently installed along either side of Indiana.
Please consider this, our Request for Design Deviation, and advise us of your
determination.

FINDINGS ANU ORDER
A. INTRODUCTION
Thrs matter having come before the Examiner Committee on June 21, 1979, and
the members of the Committee present being Ken Kennedy, Chairperson, Abby
6yrne and John Culler and there being the foliowing persons present who wish
to request approvai of a Zone Change; ZE-55-79 For a Zone Reclassification,
Agricufturai to Restricted Industriai for the purpose of warehouse and industrial
buildings.
B. FINDINGS OF FACT
1. That the existing land use in the area is residential, warehouses, and
vacant.
z. That the Comprehensive Plan designates this area as appropriate for
industrial development.
3. That the existing zoning of the property described in the apptlcation is E
Agricuitural.
4. That the provisions of RCW 43.21C (The State Environmenta! Palicy Act)
have been complied with.
5. That the proper legal requirements for advertisement of the Agenda item

C. ORDER
The Hearing Examiner Committee, pursuant to the aforementioned, finds that the
application of Lloyd A. Lynch/Walter A. Miller for a Zone Reciassiftcation as
described in the application should be approved.
Special conditions or contingencies applred to motion:
a County Engineer's Office:
The County Engineer's Office has requested fihe following be considered if
the rezone is approved:
NOTE: All required improvements shall be built to meet or exceed
minrmum County construction standards.
1. Applicant shail dedicate 15 feet on Indiana Avenue for right-of-way.
2. Appticant shali construct cement concrete curb and 30 foot pavement
on Indiana or be a willing participant in any future LID, RID, or CRP
as directed by the County Engineer.
3. Applicant shall obtain approval for on and off-site drainage plans and
access permits before issuance of building permits.
4. Applicant shall construct cement concrete curb and pave to existing
pavement on Montgomery Avenue.

b. Spokane County Heaith Dlstrict:
The applicant shall comply with rules and regulations of the Health District
in providing for adequate sewage djsposal. All necessary Heaith District
permits shall be obtained prror to buiiding permit issuance.
Approval of sewage disposal facllities by the Spokane County Health
District.
c. County Fire Marshal's Office: Fire District #1
i nstal lation of fi re hydrants to be in accordance with the requi rements of
the Spokane County Fire Marshal.
Access and circulation plans for emergency vehicles to be approved prior to
building permit issuance.
d. Water Purveyor: IRWIN WATER OISTRICT #6
We are able to supply this proposal with adequate water.
e. Compliance with all requests stated under Reviewing Agency Comments
above.
f. The appiicant shall develop subject property generally in accordance within
the concept presented ta the Hearing Examiner Committee. Minor variations
when approved by the Zoning Administrator will be perrinitted, including,
but not limited to the foilowing changes. 6uiiding location, building
materials, landscape plans, and general ailowable uses of the permitted
zone. All variations must conform to regulations set forth in the Spokane
County Zoning Ordinance. The original intent of the deveiopment plans
shall be maintained.
g A landscape plan showing specific detail and accompanied by a performance
bond shall be approved by the County Zoning Administrator prior to
building permit issuance.

h. That the provisions of SEPA's Notice of Action pursuant to 43.21c.080 RCW
be accompiished by the applicant within thirfiy (30) days of formal action by
the Zoning Nearing Examiner Committee as instructed by the Planning
Depa rtmen t staff.

i. Interior driveways and parking areas shall be paved.
j. Direct light from any exterior area iighting fixture shail not extend over
the property boundary.
k. That the Hearing Examiner Committee after hearing all testimony and a
review of the staff anaiysis adopts the proposed declaration of non-signifi-
cance and directs the chairman of the committee to sign the final declaration
of non-significance.
