SUBJECT: Adult Family Homes-Zoning Ordinance/Code Determination
QUESTION:
With regard to adult family homes, the question has been raised in which zones,how they are
• allowed and whether or not there should be any standards appropriated with them.
RESPONSE:
During the 51st Legislative Session,Substitute House Bill 1968 and Senate Bill 6152 were
adopted and signed by the Governor. Sections 16-34 in Substitute House Bill 1968 dealt with
adult family home licensing,and Section 815 in Senate Bill 6152 dealt with adult family
homes. These laws took affect this summer. Adult family home is defined in the law "as a
regular family abode of a person or persons who are providing personal care,room and board,
to more than one but not more than four adults who are not related by blood or marriage to the
person or persons providing services;except a maximum of six adults may be permitted as the
department determines that the home is of adequate-size and that home and provider are capable
of meeting standards and qualifications as provided for in this Act,"and will be outright
permitted without standards in the following zones:

Because the definition includes regular family abode, we feel that in those zones that do not
permit residential development (i.e.,most commercial and business zones)we would not allow
an adult family home,unless the regular family abode already exists. The reason for this is that
a new building permit is required to create a residence, and the residence would be prohibited
in those zones. The standards that do apply for adult family homes are those minimum
standards such as lot area, number of parking stalls required for the use where the adult family
home is (which probably will be single-family residence),duplex, triplex,apartment,and/or
condominium. If additional kitchen facilities are needed for the adult family home,make sure
that the definition of primary use, such as single family residence, is not changed as a use
(such as duplex)which may not allowed in the zone;i.e.the number of kitchens are regulated
by the penmited density of the underlying zone.
JUS 11HCATION/SUMMARY
The justification is that,basically,State Law now allows adult family homes in a regular family
abode in areas that are zoned Residential and Commercial. State law supercedes Spokane
County's Zoning Ordinance and Code. We will probably use this interpretation until
challenged or until we have time to appropriately amend the Zoning Ordinance and Zoning
Code.
