The County Engineering Department has completed a review of
the above referenced project. The following information must be
provided in order for us to proceed with our review.

A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainage plan
for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
1. Drainage calculations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
~V/ the 208 swale.
5. A typical cross section of the 208 swale.
6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
8. Copy of the proposed landscape plan.
B) The subject property is affected by the "Findings and
Order" and the "Conditions of Approval" for the following
land use action:
1. Spokane County Variance No. VE-16-91
2. Conditional Use No. CUE-13-91
C) The following improvements within adjacent Right of Way
are required prior to the release of a building permit:
1. You must submit road and drainage plans for street
improvements. These must be prepared by an
engineer. Plans must be prepared for the following
streets:
a. Sullivan, Typical Roadway Section No. 1,
Collector standard
All required construction (sidewalk/curbing/pavement) within
the Public Road Right of Way is to be completed prior to the
release of a building permit or a financial guaranty in an amount
estimated by the County Engineer to cover the cost of
construction or improvements shall be filed with the County
Engineer.. Required plans are to be submitted prior to estimating
the amount of the financial guaranty or permit release.

F) The owner of the property or the authorized
representative must complete and sign Spokane County
Engineers "Agreement to Pay Fees". This document must be
returned to the County Engineers Office. Plan review will
not be completed until this document is execute,d. This
document is attached to these comments. Please return
the completed Agreement to your contact person at the
Engineers Department.
Only'after all the information and requirements listed above
are supplied or completed and the necessary review has been
accomplished will your building permit be released.

SCOPFJPROJEGT DESCRIP'I'ION:
I. General Overview - The owner, LDS Church, is proposing to locate a portable classroom
on the site for a length of time that has yet to be determined. The proposed structure has been
in use at another site, and was recently purchased by the owner, though the delivery date was
not known by dpose present. The proposed will be used for supplementary religious training
as a specializ,ed training school. The width of the portable classroom structure was not exactly
known by the architect, though he felt that it was 24 feet wide. There will be no food service
or overnight use of the building. The contractor would like to begin site development work as
soon as possible. It was decided that a permit would be applied for at the conclusion of the
conference.

1. Planning Department (456-2205)
A. Discussion/Requirements
1. The proposed is located in a B-1 zone. The proposed use is allowed in the
zone.
2. The proposed is located on parcel number 01542-9054.
3. The site is effected by:
a. Zone Change (ZE 435-55) for which there are no conditions
b. Certificate of Exemption (CE 202-91 A-C)
c. Variance (VE 16-91) regarding parking limitations
d. Administrative Variance (AE-3-91) regarding specialized training
designation
e. Conditional Use Permit (CUE 13-91)

4. The Conditional Use Permit states that the proposed struchlre may not be less
than 24 feet wide. The site plan shows the proposed as 12 feet wide. Contact
Tom Mosier at the Plarining Department regarding this. Proposed must meet the
standards for appearance enumerated in Section 14.808.060 #1-4 of the Zoning
Code.
5. Parking requirements for the proposeci have been met.
6. Please submit a revised landscaping plan for the proposed. A twenty (20)
foot wridc stnp of vcgaaaon is requirzd to cxtend the cntire lcngth of the eastcrn

B. Permit Release Requircments
1. Please submit an estimate from a nursery including size, type, and quantity of
landscaping along with a promissory letter from the owner stating the landscap-
ing will be installed.
2. Please submit a revised site plan illustrating the size of the proposed struc-
ture, landscaping, and setbacks for review and approval.
II. Division of Engineering & Roads (456-3600)
A. Di:scussion/Requirements
1
1. Comments were given by Bob Turner to the Department of Buildings prior to
the conference since the Engineer's Office was not represented at the conference.
2. Tom Davis presented the Engineer's comments to the applicant.
3. Please submit a drainage plan for the site that is in compliance with Spokane
County Guidelines for Stormwater Management.
a. Drainage calculations for stormwater volumes generated on site.
b. Calculations for total impervious surfaces contained within the site.
c. Finished grade elevations for structures to be constructed on site.
d. Finished grade elevations at the top and bottom of the 208 swaie.
e. A typical cross section of the 208 swale.
f. Calculations to justify the number and type of drywells proposed.
g. Elevation of drywell inlets where applicable.
h. Copy of the proposed landscape plan.
The applicant felt that the submitted plans already complies with this require-
ment. Tom Davis did try to contact Scott Englehard of the Engineer's Office
regarding this matter, but he did not receive an answer prior to the adjournment
of the con ference.
4. Please submit road and drainage plans prepared by an engineer for road
improvements to Sullivan Road. All requireti construction within the county
right of way must be completed prior to the issuance of the building permit or a

bond in an amovnt estimated by the County Engineer to cover the cost of con-
struction shall be submitted to the Division of Engineering & Roads.
As an alternative to the above requiremeat, the applicant may record a RID/CRP
Agreement, 'Notiac to thc Public No. 6' far Sullivan Rned. Please submit a
coPY of the reoarded pnVerty deed to the Divisiaa of Fngineering & Roads so
thai the agreemeat can be prepared.

III. Health District (456-6040)
A. Discussion/Requirements
1. The water purveyor for the proposed is Trentwood Irrigation District No. 3
(922-7532). Please contact the water purveyor to review requirements for back
flow preventers.
2. Proposed has applied for an on site sewage disposal permit. The Health
District is ready to release this permit as soon as the applicant has applied for a
building permit for the proposed.
3. Please submit a critical materials list to the Department of Buildings for
review.
4. All construction debris shall be taken to a licensed landfill.
5. No on-site burning or burial of debris will be allowed.
B. Permit Release Requirements
1. The Health District is ready to release their portion of the building permit as
soon as the applicant applies for a building permit.
IV. Fire District No. 1(928-2462)
A. Discussion/Requirements
1. Fire flow for the proposed has been calculated for 1,500 G.P.M..

on the west of the driveway curb cut, approximatzly 5-10 feet from the street.
The fire hydrant shall be installed as per an approved water plan. Prior to the
preparation of the wat.er plan, the applicant shall contact Trentwood Irrigation
Distnct No. 3 at (922-7532) as soon as possible co obtain the purv---yor rcquire-

1. The order form for the lock (Knox) box entry system shall be submitted co the
Fire District prior to release of the building permit.
V. Department of Buildings (456-3675)
A. Discussion/Requirements
1. Plan review has been completed on the site plan only by Tom Postlewait.
2. ' Handouts were given to the applicant regarding special inspections, cold
weather placement of concrete, and a critical materials list.
3. If construction specifications require concrete with a design strength over
2,500 p.s.i., high strength bolting, or structural welding, special inspections will
be requued on the proposed. Please indicate the name of the testing laboratory
and submit copies of the inspection reports to the Department of Buildings for
review. Applicant were also advised to properly place conerete in cold weather.
4. The proposed shall meet the minimum requirement of the Regulations for
Barrier-Free Facilities. Please verify the landing size at the entrance of the
building. The handicap parking stall needs to be 12'-6" wide verses the 12'
indicated on the site plan.
5. Please submit an updated critical materials list for review.
6. Please verify that the portable classroom has been inspected by the state and
that it has a state seal affixed to it.
7. Please submit a floor plan for the portable classroom, identifying restrooms,
locations of fire extinguishers, landing sizes, number of employees, etc..
8. Please submit a footing/foundation plan for review and approval.

9. Cross connection devices shall be installed on equipment that may cause
pollution of the domestic water supply.

APPLICATION DESCRIPTION: The applicant proposes to establish a specialized
learning•school for religious training and instruction. Sections 14.623.020. and
14.624.240.3. of the Zoning Code of Spokane County allows this use upon issuance of a
conditional use pernut pursuant to section 14.404.100. Authority to consider such a request
exists pursuant to secrion 14.404.101 the Zoning Code for Spokane County and Spokane
County Board of County Commissioners resolution No. 89 0708, as may be amended. A. variance from the parking standards for a specialized training/learning school
is also sought and is dealt with by separately written decision VE-16-91.
PROJECT LOCATIOr1: Located in east central Spokane County, on the southeast corner

of Wellesley Avenue and Sullivan Road in the NW 1/4 of Section 1, Township 25N, Range
44EWM.

PUBLIC HEARING AIVD DECISION: After considerarion of all available inforrnarion
. on file, exhibits submitted and testimony received during the course of the Qublic hearing held
on July 9, 1991, the Zoning Adjustor rendered a written decision on July 59L`7 , 1991 to
APPROVE the application; but does not pass judge herein on the variance request of VE-16-91. -
FINDINGS OF °FAC'T AND CONCLUSIONS
1. The proposal is described above and detaiied in documents contained in the file.
2. The adopted Spokane County Comprehensive Plan designates the area of the
proposal as Urban. 1'he proposal is generally consistent with Urban category of the
Comprehensive Plan and complies with RCW 36.70.450. The County Arterial Road Plan
designates both Sullivan and Wellesley as Principal Arterials with future 100 feet widths.

3. The site is zoned Neighborhood Business (B-1), which allows the proposed use
upon approval of this application.
4. The existing land uses in the area of the proposal include East Valley Jr. and Sr.
High Schools, to the north and northwest, single family residences to the east, vacant land to
the south and 4 plex apartments to the west. Typically, uses listed as a conditional use are
assumed as permitted in the underlying zone, subject to the listed conditions and any other
conditions need to assure compatibility in the given instance. But, pursuant to 14. 404.1011

the requested conditional use permit may be denied if the Hearing Body cannot find that the
requested use will be compatible with other permitted uses. Section 14.624 240.3 lists no
specific conditions or standards to achieve compaability, except parking standards of 1 car parking space per each 100 feet of building (from which the applicant seeks relief through
variance VE-16-91). The Hearing Body may exercise nominal d.iscretion to achieve the overall
intent of compatibility with surrounding properties. Clearly, 14.404.102 allows the Hearing
Body to impose any and all manner of additional conditions and requirements in an effort to
achieve maximum comparibility. In the instant situation enough land should be available in any
approval to fulfill parking needs for full expansion (phase 2) of the seminary and for a typical
B-1- use in the event the seminary use is not continued. Design compatibility with the
surrounding area, both in the temporary building as well as the permanent structures, is
needed. Vehicular and student pedestrian safety must also be addressed.
6. Pursuant to the State Environmental Policy Act, the environmental checklist and
other data have been reviewed and the project has been found to not have any probable
significant adverse impacts to the physical environment. A Detem-iination of Nonsignificance
(DNS) was issued on June 14, 1991 and sent to 6 agencies of jurisdiction. The agencies
reviewing the checklist neither indicated that a more detailed environmental review should be
provided nor comrnented that the DNS should be reconsidered. Comments regarding the
environmental matters were not made at the public helring. There was not sufficient evidence
presented pursuant to WAC 197-11-340(3)(a) to withdraw the DNS. .
7. The applicant has been made aware of the recommendations of various County agencies reviewing this project and has indicated those recommendations are generally
acceptable. The County Division of Engineering and Roads requests certain roadway
. ded.ications through CE-202-91A. The CE to crea(e the subject parcel was issued contingent
upon dedication and the establishment of certain future acquisition reserve areas pursuant to the
. County's Arterial Road Plan. Building setbacks are established from those reserve areas. The
CE was not appealed. . 8. The proper legal requirements for advertising of the hearing before the Zoning Adjustor of Spokane County have been met. -
9. Adverse testimony and written comments were received regarding the proposal.
Comments were received in writing from Geraldine 1Vlull; wherein, she felt that to deviate from
the parlang standards would create a situarion of on-street parking and a resulting driving
hazard. A letter and verbal testimony was received from James W. Roe, Director of the
Present-day Saints Ministry. Mr. Roe attempted to enter into the record numerous comments
regarding the theological philosophy and practice of the Church of Jesus Christ of Latter Day
Sa.ints, which comments were not considered by the Zoning Adjustor in rendering this
decision.

10. The Zoning Adjustor may require such conditions of approval as necessary and
appropriate to make the project most compatible with the public interest and general welfare.
11. Various performance standards and criteria are additionally needed to make the use
compatible with other permitted activities in the same vicinity and zone and to ensure against
imposing excessive demands upon public utilities, and these shall be addressed as conditions
of approval.

12. Students coming and going to and from this facility and the East Valley High
School are at risk if they do not cross at a marked crosswalk; presently only existing at Wellesley Avenue and Sullivan Road.
13. The proposal is listed in the Zoning Code of Spokane County as a conditional use
allowed in the Business-1 (B-1) zone, and the proposal does meet the established and
applicable criteria described for that conditional use. NOTE: Pursuant to
14.624.240.3.b., instruction is limited to 20 students at a time. Expansion to
phase 2 may likely require application for and granting of a variance from this
standardo
. 14.The proposal will not be detrimental to-surrounding properties. DECISION
From the foregoing Findings and Conclusions, the Zoning Adjustor APPROVES
the conditional use subject to compliance with the following: . CONI)ITIONS OF APPROVAL
. I. GENERAL 1. The fol]owing condirions shall apply to the applicant, owner and successors in
interest and shall run with the land.
2. Failure to comply with any of the conditions of approval contained in this decision, -
except as may be relieved by the Zoning Adjustor, shall consritute a violation of the Zoning
Code for Spokane County and be subject to such enforcement as is appropriate.
3. The Zoning Adjustor may administratively make minor adjustments to site plans or
the conditions of approval as may be judged by the Zoning Adjustor to be within the context of
the original decision. 4. The approval of a conditional use permit is linked to VE-16-91. If
. this conditional use permit is voided or the land usc changes to other than a seminary use, the variance is voided.
IIe PLANNING DEPARTMENT 1. This parcel shall noc be further subdivided unless consistent with RCW 58.17,
the various county subdivision regulations and the Spokane County Comprehensive Plan for
the area. Addirionally, as long as this conditional use penZiit is valid, the land shall not be
subdivided due to the possible need for additional parking if the pernlit is voided and a new use
occupies the building.

2. The proposal shall comply with all applicable standards of section 14.624.240.3. of
the Zoning Code of Spokane County unless deviations, variances or exceptions have been lawfully granted. (See VE-16-91)
3. This pernut is granted in perpetuity, subject to the revocarion or suspension of
provision of 14.404.102.3. of the Zoning Code.
4. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Director/designee shall be submitted (including both a temporary and
permanent stnucture) with a performance bond (or other financial guarantee) for the project
prior to release of building permits. Landscaping shall be installed and maintained so that sight
distance at access points is not obscured or impaired.
5. The Planning Director/designee shall approve a specific exterior lighting plan prior
to installarion of such lighring. The plan shall attempt to confine illumination to the area with
full consideration to adjacent properties. .
6. A new specific development plan shall be submitted for Planning
Department review and approval prior to issuance of building permits. Since there are literally
two building schemes proposed for this site, it will be necessary for two site plans to •
, eventually be approved. First, site plan approval is necessary as associated with the phase 1
pre-fab "mobile-home" type structure as designated on the preliminary site plan submitted for
the hearing. A second site plan must be necessarily approved prior to the construcrion of a
permanent building and the removal of the pre-fab structure. The following requirements
applies respectively to the site plan approval for the pre-fab building and the later site plan
approval for the permanent structure. In each case, a substantial portion of the site is going to
be dedicated and committed on the west and the north sides to roadway dedication and future
acquisition area reserve. In light of this requirement, an entirely new site plan and building
orientation , complete with utilization of the entire site may be submitted to the Planning
Department. Construcrion must be judged as proceeding according to the approved plan or
constitute a zoning violarion. The plans (both for the pre-fab and permanent structures)
submitted and ultimately to be approved shall conform to the following: a. The underlying provisions of all B-1 scandards except as relieved by this permit or any variance granted. •
b. Minimally a sidewalk shall be provided on Wellesley;one on Sullivan is
recommended. c. Required roadway dedications, display of required future acquisition areas
(FAA) and yard setbacks 25 feet from the FAA, landscaping (with a financial
guarantee based upon an estimated cost of installation, including irrigation),
required paved parking, etc.
d. A sight obscuring fence four feet tall along the east property line from the
newly established property line southward to the south property line.

7. Planning Department shall file a Title Notice in the Spokane County Auditor's
Office which establishes that the number of parking stalls associated with this structure is tied
to the conditional use pernut for the seminary• activity and stadng that if the building or property
is put to any other use, it is likely that additional parking requirements must be mee.
8. The Spokane County Planning Department shall prepare and record with the
County Auditor a Title Notice specifying a future land acquisition area for road right-of-way
and uriliticso The reserved future acquisition area Title Notice shall be released, in full or in
part, by the Planning Department. The notice should be recorded within the same time frame
as an appeal and shall provide the following:
a. At least 20 feet of reserved future acquisifion area for road right-of-way and
utilities, in addition to the existing and/or newly dedicated right-of-way along
Wellesley Avenue. NOTE: The County Engineer has required 0 feet of new
ded.ication.
b. Future build.ing and other setbacks required by the Spokane County Zorung Code
shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs should
be located within the future acquisifion area for road right-of-way and utilities. If •
any of the above improvements are made within this area, they shall be xelocateci
at the applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as landscaping,
parlang, surface drainage, drainfield, signs or others) shall be considered interim
uses. 9. The Spokane County Planning Department shall prepare and record with the County Auditor a Title Norice specifying a future land acquisifion area for road right-of-way and utilities. The reserved future acquisition area Title Notice shall be released, in full or in
part, by the Planning Department. The notice should be recorded within the same time frame
as an appeal and shall provide the following: -
a. At least 16 feet of reserved future acquisition area for road right-of-way and
utilities, in addition to the existing and/or newly dedicated right-of-way along
Sullivan Road. NOTE: The County Engineer has required 4 feet of new
dedication.
b. Future building and other setbacks required by the Spokane County Zoning Code
shall be measured from the reserved future acquisition area.
c. No required landscaping, parkinb, '208' areas, drainfield or allowed signs should
be located within the future acquisifion area for road right-of-way. and utilities. If
any of the above improvements are made within this area, they shall be relocated
at the applicant's expense when roadway improvements are made.

10. The Planning Department shall prepare and record with the Spokane County
Auditor a Title Notice noting that the property in question is subject to a variety of special
conditions imposed as a result of approval of a land use action. This Title Notice shall serve as

released, in full or in part, by the Planning Department. The Title Notice.shall generally

11. The phase 1 pre-fab "mobile-home" type structure identified in the site plan of April
19, 1991, shall meet the spirit and intent, if not the letter, of section 14.808.060.1-4, of the •
Zoning Code, which section addresses appearance. 12. The subject parcel shall not be further subdivided; but, shall remain intact, allowing
for the future possibility of the abandonment of the seminary use in the building and the
necessity to construct additional parking in order to satisfy the parking requirements in the B-1
Z.one. 13. The applicant/operator of the seminary facility shall do everything within its power
to see to it that students from the nearby East Valley High School use ttie controlled intersection
at Wellesley Avenue and Sullivan Road. This may include having each student commit to this
principal by signing a contract that addresses their understanding of the necessity to cross at
Wellesley and Sullivan. This is similar to the commitment described by the sponsors, wherein
the students make a commitment not to drive their cars to the site. The situarion could also be
improved at this location if the applicants were able to convince the County Division of
Engineering and Roads to strip an official cross walk at the westerly side of Tolford Road
intersection and Wellesley, Avenue, across Wellesley Avenue. However, the striping of
Wellesley at Tolford Road is neither a requirement of this permit nor a substitute for preferred
crossing at Wellesley and Sullivan. .
14. The hours of operation shall be equivalent to the days of operation of East Valley
High School, except that the seminary may generally operate 1 hour before school officially
commences and 1 hour after school officially ends.
15. The present permit limits the ftinction to 20 students since no
variance was sought with respect to a deviation from the standards for a
specialized training/learning school wh;cti limits the ntimber of students to 20.

III. DIVISION OF BUILDINGS
1. The issuance of a building pernut by the Division of Buildings is required.
2. Requirements of Fire District No. 1 need to be satisfied during the building or
occupancy permit process.
3. The applicant shall contact the Department of Building and Safery at the earliest
possible stage of design/development in order to be informed of code requirements
administered/enforced by the department, e.g., State Building Code Act regulations, such as
requirements for fire hydrant/flow, fire apparatus access roads, street address assignment,
barrier-free regulations, energy code regulations and general coordination with other aspects of
project implementation.
IV. DIVISION OF UTILITIES
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use
of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on
compliance with all rules and regulations of the Spokane County Health District and is further
conditioned and subject to specific applicarion approval and issuance of permits by the Health
s District. •

systerris. V. SPOKANE COUNTY I-IEALTI-I DISTRICT
1. Sewage disposal method shall be as atithorized by the Director of Utilities, Spokane
County.
2. Water service shall be coordinated through the Director of Utilities, Spokane
County.
3. Water service shall be by a new/an exjsting public water supply when approved by
the Regional Engineer (Spokane), State Department of Health.

4. Subject to specific application approval and issuance of permits by the health
officer, the use of an individual on-site-sewage disposal system may be authorized.
5. Disposal of sewage effluent beneath paved surfaces is currently prohibited.
VI. DIVISION OF ENGINEERING AND ROADS
1. An approach permit shall be obtained from the County Engineering Department
prior to the construction of any new driveway approaches. This shall be done prior to the
release of a building permit, change of use pernut or certificate of occupancy.
2. The applicant shall contact Fire District No.l to assure that fire district access
standards and the provisions of the Fire Code are being met.
3. Applicant shall sign and record Spokane County Notice to the Public No. 6 which
specifies the following:
The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on
a petition for the fonnation of a Road Improvement District (RID) by the petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s) property, and further •
not to object, by the signing of a ballot, the formation of a RTD by the resolution method
pursuant to Chapter 36.88 RCW, which resolution incltides the owner(s) property. If an RID
is formed by either the petition or resolution method, as provided for in Chapter 36.88 RCW,
the owner(s) or successor(s) further agree: (a) that the improvement or construction contemplated within the proposed RID is
- feasible; ' .
(b) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceeds
the cost and expense of formarion of the RID; and .
(c) that the property within the proposed RID is sufficiently developed.
4. Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment on the property as a result of
the improvements called for in conjunction with the foimation of the RID by either perition or
resolution method under Chapter 36.88 RCW.
This requirement applies to Sullivan Road, from which the subject parcel takes access.
5. The County Arterial Road Plan identifies Sullivan Road as a Principal Arterial. The
existing right-of-way width of 60 feet is not consistent with thlt specified in the Plan. In order
to implement the Arterial Road Plan, in addiaon to the required right-of-way dedication, a strip
of property 16 feet in width along the Sullivan Road frantage shall be set aside in reserve. This
property may be acquired by Spokane County at the time wlien arterial improvements are made
to S ullivan Road. .

on July 9, 1991, the Zoning Adjustor rendered a written decision on July , 1991 to
APPROVE the application as set forth in -the file documents and as conditioned below, the
approval of the variance is linked to the conditional use permit for a daily seminary for 20 or fewer (at a time) walk in studenis form East Valley High School.
FINDIr1GS OF FACT AND CONCLUSIONS 1. The proposal is described above and detailed in documents contained in the file.
2. In compliance with RCW 36.70.450, the Planning Department determined that this
proposal is generally consistent, as condirioned, with the Urban category of the
Comprehensive Plan.
3. The site is zoned Neighborhood Business (B-1), which allows the proposed use
upon approval of this application.
4. The existing land uses in the area of -the proposal include East Valley Jr. and Sr.
High Schools, to the north and northwest, single family residences to the east, vacant land to
. the south and 4 plex apartments to the west, all of which are compatible with the proposal.

Policy Act, Chapter 43.21C RCW pursuant to WAC 197-11-800 (b) (b).
6. The applicant has been made aware of the recommendations of various County
agencies reviewing this project and has indicated those recommendations are generally ,
acceptable. The County Division of Engineering and Roads requests certain roadway ded.ications through CE-202-91A. The CE to create the subject parcel was issued contingent upon dedication and the establishment of certain future acquisition reserve areas pursuant to the
County's Arterial Road Plan. Building setbacks are established from those reserve areas. The
CE was not appealed. . . 7. The proper legal requirements for advertising of the hearing before the Zoning

8. Adverse testimony and written comments 'were received regarding the -proposal. Comments were received in writing from Geraldine Mull;-wherein, she felt.that to deviate from
the parldng standards would create a situation of on-street parldng and -a resulting driving : hazard. A letter and verbal testimony was; received from 3ames W. Rce, Director;of the Present-day Saints Ministry. Mr. Roe attempted.to enter into the record numerous comments
regarding the theological philosophy and practice of the Church of Jesus Christ of Latter Day
Saints, which comments were not considered by the Zoning Adjustor in rendering this •

9. The Zoning Adjustor may require such conditions of approval as necessary and
appropriate to make the project anost compatible with the public in_terest and general welfare. .
10. Various performance standards and criteria are additionally needed to make the use
compatible with other permitted activities in the same vicinity and zone and to ensure against -
imposing excessive demands upon public utilities, and these shall be addressed as conditi.ons

. . , 11. The variance will not authorize a use otherwise prohibited in the zone.
12. There are special circumstances applicable to the property which, when cornbined
with the standards of the Zoning Code, create practical difficulties for the use of the property
and/or deprive the property of rights and privileges common to other properties in the vicinity
and similar zone classifications. The standards in the Zoning Code refer to the parldng
requirements for a specialized training and learning schools in Chapter 14.802. of the Zoning
Code. Section 14.802.040.16. describes 1 parldng space per 100 gross square feet of
build.ing. For a 24 foot by 70 foot (for example) pre-fab unit, 17 parldng stalls would be
required. For a permanent building of 2600 square feet (the outline shown on the site plan), 26
.parking stalls will be needed. However, it was clarified by the applicant in the hearing that a
2600 square foot building would be for two classrooms. That in itself would take a
mod.ification of the conditional use pemut and this variance, as enrollment is restricted ta 20
pupils under the standards of the conditional use permit; and no variance from that standard is
sought. It is reasonable to expect that approximately 20 parking spaces would necessarily be
provided under the standards as they exist naw. The applicant requests 5 parking stalls on the
basis that this specialized tra.ining/learning school is to serve students who will walk and not .
drive, from East Valley High School. Five parking stalls would provide for a paid instructor

or administrator and 1 or 2 volunteers. Therefore, the applicant seeks relief from the standard
and also notes that the standard for a high school is 5 parking spaces per teaching station.
Either approach to jusdfying the 5 parlang spaces is supportive of special circumstances. The
insistence upon 1 parking space per hundred square feet of gross floor azea is noted to be
associated with a specialized school with examples stated as dance, gymnastics, martial arts,
etc. These types of special schools are typically associated with high traffic volumes as parents
of children and adults themselves come and go on a frequent basis, most usually arriving and
departing by automobile. .

13. Granting the variance will be neither materially detrimental to the public welfare nor
injurious to property or improveinents in the vicinity and zone.
14: Strict application of the zoning standards does create an unreasonable burden in .
