The Hearing Examiner Commlttee, pursuant to the aforementioned, finds that the
appltcation of William G. Wagstaff for a Zone Reclasstfication as described In the
appltcation should be approved.

Background Analysis - (ZE-77-73
On May 29, 1979, the Spokane County Commissioners approved a zone change to
the south of this site for Restricted I ndustrial . The intent of this request is to
develop the site In conjunction with the adjacent southern stte.
a) COUNTY FIRE MARSHAL
1. The site is located In Fire Oistrict #1.
2. Mains and hydrants need ta be instalted. Access plans for fire
fighting equlpment around the building shali be approved prior to
building permit issuance.
b) COUNTY ENGINEER
1. Applicant shall dedicate 10 feet on Flora Road, 15 feet on Tschtrley,
40 feet for the new road between Flora and Tschirley, and 20 foot
radii for atl of the corners.
2. Access permits shaif be obtained from the Spokane County Engineer's
Office prior to issuance of building permits.

3. Appilcant must be a willing participant in any future Local Improve-
ment Distrtct ( L 1 D), Road I mprovement Dtstrict ( R I D), or County Road
Project (CRP) for Tschirley Road.
4. An appropriate on-site drainage disposal system shall be approved by
the Spokane County Engineer's Office prior to the issuance of bullding
permits for the project.
5. The new road between Flora Road and Tschirley Road shall be
constructed to Spokane County Standards by the developer when so
dlrected by the Spokane County Engineer.
c) WATER PURVEYOR
1. Purveyor is CONSOIIDATED IRRIGATION DISTRICT and will supply
the site with adequate water for domestlc fire and irrigaticn uses.

That the provisions of SEPA's Notice of Action pursuant to 43.21C.080 RCW

The request has proven to be environmentally non-significant. Therefore,
a final declaration of non-significance shall be signed by the Chairman of
the Hearing Examiner Committee.
f) ZONING
1. Approval by the Zoning Administrator of a specific lighting and
signing plan for the described property prior to the release of any
building permits.

2. A specific landscepe plan, pianting schedule and provisions for
maintenence acceptable to the Spokane County Zoning Admintstrator
shall be submitted with a performance bond for the project prior to
release of buitding permits.
3. The applicant shall develop subject property generally in accordance
wlthln the concept presented to the Mearing Examiner Committee.
Minor variations when approved by the Zoning Administrator wiil be
permitted, including, but not limited to the following changes:
E3u11ding location, landscape plans, and general allowable uses of the
perm(tted zone. A{I variations must conform to regulations set forth in
the Spokane County Zoning Ordinance. The original intent of the
development plans shall be maintained.
4. Direct light from any exterior erea lighting fixture shall not extend
over the property boundary.
g) That the Hearing Examiner Committee after hearing al I testimony and a
review of the staff analysis adopts the proposed declaration of non-signifi-
cance and directs the chairman of the comrnittee to sign the final declaration

NOTB: The Applicant in cooperation with the adiacent property owners

A. REASONS
1. The Comprehensive Plan indicates that the subject property is appropriatc
for light industrial uses.
2. The Planning Commission has been approving requests for Restricted
Industrial zoning :vithin the industrial corridor which lies between the
Spokane International tracks and Trent Road and letween Flora and
8arker Roads. On November lU, 1972, the Commission approved a
similar request on the northeast corner of Flora and Dalton.
3. The Restricted Industrial zone contains re strictiona which wou ld prc,hibit
industriai pollution, heavy manufacturing activities, and extractive
operations. The stafi is of the opinion that the performance stand-urds
of the Restricted Inciusuial zone i:ill ariequately protect adjoining
residential properties.
