A. INTRODUCTION
ThiB mstter having come before the 2oning Hearing Examiner Committee on
January 3, 1985, and the members of the Committee present being Jane E. Myers, Chairperson, F. Lynn Tennican and Richard L. Skalstad.

B. PROPOSAL
The sponeore, Randy and Jayn Courchaine, are requesting approval of a zone
recleasif ication, File No. ZE-75-84, Agricultural to Residential
Manufactured Home, for the purpo6e of developing a Manufactured Hame
Park. Also, a request for a Variance, VE-100-84, to allow a Manufactured
8ome Park on less than 5 Acres as required by Section 4.05A.050-(b)-(le)
of the Spokane County Zoning Ordinance, (Approximately 3.5 Acres).
C. FINDINGS OF FACT
1. That the exieting land use in the area is residential, manufactured
home subdivieions and cul[ivated.
2. That the Compreheneive Plan designates this area as appropriate for
Urban developIDent.
3. That the existing zoning of the property described in the application
is Agricultural.
4. That the provisions of RCW 43.21C (The State Envirotimental Policy
Act) have been complied with, and the Coamiittee concurs with the
Declaration of Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda
Item have been fulfilled.
6. That the land in this area is suitable for the proposed use, or
uses within the proposed Zone Classitication. That Residential
Manufactured Home zoning existe to the south of the proposal, and the
issue of individual lot ownership was not brought up by property
owners at the public hearing.

C. FINDINGS OF FACT (continued)
7. That the applicant has demonstrated that conditions have
substantially changed since the original zoning of this area and
accordingly, the proposed rezone is justified.
8. That the proposed use is compatible with existing uses in the
area.
9. That the owners of ad3acent lands expressed neither approval nor
disapproval of the proposed use.
10. The Hearing Examiner Committee finds the proposed use to be in
harmony with the general purpose and will not be otherwise
detrimental [o the public health, safety, and welfare.
11. The following are additional f indinge of fact considered by the
Hearing Examiner Committee:
a) That the proposed manufactured home park wfll be compatible with
the existing environment and neighborhood land use of
manufactured homes ia the immedfate area.
b) That the Zoning Administrator give consideration to the
landecaping which is planaed for the property for that portion
of the site with frontage on Buckeye Avenue. Landscaping in
this area should be designed in a"stepped" concept similar to
that existing to the south of this site. Landscaping shall be
consistent with the "Clear-View Triangle" requirementa.
D. CONDITIONS OR CONTINGENCIES APPLIED TO TH19 APPROVAL
(Al.l Conditione imposed by the Zoning Hearing Examiner Committee shall be
binding on the "Applicant", which term shall include the owner or ownere
of the property, heirs, assigns, and successors.) a) COUNTY PLANNING DEPARTMENT
1. That a 6-foot sight-obscuring fence be provided along the north,
west, and east property lines. Also, that an eaergreen hedge,
maintained in compliance with the "Clear-View Trisngle"
provisions, be provided along the south property line.
2. The 2oning Administrator ehall approve a specific exterior
lighting plan for the approved area prior tv installation of
such lighting. (Such plan shall attempt to confine ill,umination
to the area with full consideration to adjacent properties).

3. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spolcane County Zoning
Administrator ehall be eubmitted with a performance boad for the
project prior to release of building permits. Landscaping shall
be installed and maintained such that sight distance at access
points is not obscured or impaired.
4. The applicant shall develop subject property generally iD
accordance within the concept presented to the Hearing Examiner
Committee. Variations when approved by the Zoning Administrator
will be permitted, including, but not limited to the following
changes: Buildiag location, landecape plans, and geAeral
allowable uees of the permitted zone. All variatione must
conform to regulations set forth in the Spokane County Zoning
Ordinance. The original intent of the development plans ehall
be maintained.
5. The specif ic development plan will be submitted for Planning
Department review and approval prior to issuance of building
permits.
6. Al1 current standards of the Residential Manufactured Home Zone,
as amended, shall be complied with in the development of this
site.
7. That the project is subject to Section 4.16A.050, the Aquifer
Sensitive Area Overlay Zone of the Spokane County Zoning
Ordinance, which sets forth various measures for Aquifer
protection; specif ically, measures dealing with wastewater
dlsposal, spill protection measures, and stormwater runoff.
8. Any division of land for the purpose of sale, lease or transfer,
shall comply with RCW 58-17 and the Spokane County Platting
Ordlnances prior to issuance of building pe naits.
,
9. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County
Commissioners Resolution #77-1392 be initiated by the project
applicant within thirty (30) days of final disposition of this
applicatior, and prior to any on-site improvements.
10. That prior to release of building permits, ehe sponsor shall
submiti a final Manufactured Nome Park design plan to the
Plannins Department which demonstrates compliance with the
Itesidential Manufaceured Home Zone, Development Standarde of
Section 4.05A.050-(b-1-9), and all Hearing Fxaminer Committee
conditiAns of approval.

c) COUNTY UTILITIES DEPARTMENT
l. Pursuent to Board of County Commiseioners Resolution No.
80-0418, the use of on-site sewer disposal syeteme is hereby
authorized. This authorization is conditioned on compliance
with all rules and regulations of the Spokane County Health
Dietrict end ie further conditioned and subject to specific
application approval and iseuance of permits by the Health
District.
2. The owner(s) or Successor(s) in interest agree to suthorize the
County to place their name(s) on a petition for the formation of
a ULID by petition method pursuant to RCW 36.94 which [he
petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formation of a ULID by resolution method pursuant to RCW Chapter
36.94 whlch includes the Owner(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Succeseor(s) from
objection to any assessment(s) on the property as a result of
improvemente called for in conjunction with the formation of a
ULID bq either petition or resolution method under RCW Chapter
36.94.
3. Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County, as amended.
4. Each dwelling unit ehall be double-plumbed for coanection to
future areawide collection systems.
5. Plans and specifications for the double plumbing are to be
reviewed and approved by the Utilitfes Department prior to
construction.
d) COONTY HEALTH DISTRICT
.
1. A combined surface water and sewage disposal detailed plan shall
be approved by the County Engineer and the Health District prior
to the issuance of any building permit for this project.
2. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
3. Subject to epecific applicati.on approval and issuance of permita
by the Aealth Officer, the use of an indieidual on-site sewage
system may be authorized.

4. Water service shall be coordin8ted througb the Director of
Utilities, Spokane County.
5. Water service shall be by an exieting public water eupply when
approved by the Regional Engineer (Spokane), State Department of
Social aad 8ealth Services.
6. Use of private wells and water sqstems is prohibited.
7. Disposal of sewage effluent beneeth paved surfaces is currently
prohibited.
e) COUNTY BUILDING AND SAFETY DEPARTMENT
1. The site is located in Fire District U 1.
2. Approved numbers or addresses shall be placed on all new and
existing buildings in such a position as to be plaiti].y visible
and legible from the street or road f ronting the property. Said
numbers ehall contrast with their background.
3. Trash enclosures shall not be located adjacent to combustible
construction or underneath windows or nonprotected eaves.
4. A land uee permit will be required for each structure.
5. Each structure shall be accessible to Fire Department apparatus
by way of access roadways with all-weather drfving surface
capable of supporting the imposed loads of fire apparatus. The
minimum paved roadWay width, iaside curb face ro inside curb
face, shall be 24 feet with no parking. Parallel parking is
petmitted on one side with road widths of minimum 30 feet.
Parallel parking is permitted on both sides with road widths of
minimum 36 feet. Signs nating such is required for fire lane.
The turning radius of private roadways and drive aisles shall be
a minimum of 20 f eet inside and a minitaum 45 f eet outside to
curb face. Cul de sacs more than 600 feet from the center line
of the nearest cross street shall have a minimum radius of 37
feet, 6 inches (75 feet diameter).

e) COUNTY BUILDING AND SAFETY DEPARTMENT (continued)
6. Installation of fire hydrante are required to be inetalled and
eerviceable in accordance with the Spokane County Department of
Building and Sefety prior to development. The water plan ehall
show each fire hydrant and be in complience with the provisions
in Chapter 10.04 of the 1979 edition of the Uniform Fire Code.
The present design requires a minimum fire flow of 500 g.p.m.
for 30 minutes. The water plan shall specify the gallons per
minute for each f ire hydrant at a residual pressure of no lese
than 20 p.s.i. (minimum pressure).
7. Where it is desired to have access control gates in residential
developments, the following shall apply:
The minimum width of roadway, iaside of access gate, shall be
twelve feet (12'). There shall be at least two (2) sach drive
approaches where the gates are located. One may be used for
vehicles exitfng. Tire flatting spikes shall not be used uuless
the entrance is a minimum of twenty feet (201) wide. The gates
shall be provided with an approved method of emergency operation
in accordance with the fire department standards. Where each

1. Air pollution regulations require that duet emissioos during
demolition, excavation and construction projects be controlled.
Thie may require use of water sprays, tarps, eprinklers, or
suspension of activity during certain weather conditions. Haul
roads should be treated and emissions from the transfer of
earthen material must be controlled as well as emissions from
all other constructioa related acLivities.
2. Measures must be taken to avoid the deposition of dirt and mud
from unpaved eurfaces onto paved surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
immediaeely to clean these surfaces.

1. That at the public Hearing Examiner Committee's hearing, no
testimony was presented which Would ind icate benef its would

Ordinance.
2. No public concerns were raised regarding the existing 3.5-Acre
parcel which is contemplated for development of the proposed
