1. Reimburse Spokane County for project review and inspection
fees as specified in Board of County Commissioner's
Resolution 80-1592 attachment C, as amended. The fees will
be based on actual salary costs incurred by Spokane County
for project reviews and / or inspections plus a ten percent
administrative charge, and will be billed monthly as
accrued.
2. The undersigned agrees that these fees are due and payable
upon receipt of the billing as specified above. The
monthly billing should be sent to the attention of:

The County Engineering Department has completed a review of
the above referenced project. The following information must be
provided in order for us to proceed with our review.
A) A drainage plan for the site which has been prepared in
compliance with Spokane County "Guidelines for Stormwater
Management". At a minimum the plan must contain:-
1. Drainage calculations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
• 4. Finished grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of the 208 swale.
6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
. B) The subject property is affected by the "Findings and
Order" and the "Conditions of Approval" for the following
land use action:
1. Spokane County Zone Change No. ZE-82-84
2. Short Plat No. 85-394
C) The following improvements within adjacent Right of Way
are required prior to the release of a building permit:
1. You must submit road and drainage plans for street
improvements. These must be prepared by an
engineer. Plans must be prepared for the following
streets:
. a. Park Road: Continue the existing sidewalk and
curbing.
All required construction (sidewalk/curbing/pavement) within
the Public Road Right of Way is to be completed prior to the
release of a building permit or a financial guaranty in an amount
estimated by the County Engineer to cover the cost of
construction or improvements shall be filed with the County
Engineer. Required plans are to be submitted prior to estimating
the amount of the f inancial guaranty or permit release.

D) Insufficient information was submitted with the proposal.
We are unable to proceed with our review. We will need
the following before we can proceed:
l. Site Plan.
2. Drainage plan as specified.
3. Other information:
a. Repair of existing 208 Swale on Indiana Lane.
b. A parking and traffic circulation plan must be
. submitted.
c. Paving will be required on all surfaces which
are to be occupied or traveled by vehicles.
E) Utility Condition: Permittee is responsible for arranging
for all necessary utility adjustments or relocation as
required for completion of the improvement.
F) The owner of the property or the authorized
representative must complete and sign Spokane County
Engineers "Agreement to Pay Fees". This document must be
returned to the County Engineers Office. Plan review will
not be completed until this document is executed. This
document is attached to these comments. Please return
the completed Agreement to your contact person at the
Engineers Department.
Only after all the information and requirements listed above
are supplied or completed and the necessary review has been
accomplished will your building permit be released.

CALL TO ORDER: The meeting was called to order at approximately
10:00 a.m. by the Division of Buildings Plans Examiner, Tom
Postlewait, with the following in attendance.

SCOPE/PROJECT DESCRIPTION:
I. General Overview - The owner, Jim Miller, is proposing to
construct a 2,000 square foot addition that will be used as an auto
body repair shop. There will also be a 560 square foot paint booth
constructed. The owner plans on aggregating the two parcels into
one so that the building can be on one piece of property.
SUMMARY OF DEPARTMENTAL REOUIREMENTS:
I. Planning Department (456-2205)
A. Discussion/Requirements
1. The proposed is located in an I-2 zone and the use is
permitted.
2. Please submit a revised site plan illustrating
detailed landscaping, the required six inch protective
curbing around all landscaping and indicate the specific
uses and square footage and usages of the proposed and
existing structures.

3. A Certificate of Exemption must be submitted to the
Planning department to aggregate the two parcels. Forms
were given to the applicant during the meeting.
4. Fifteen parking stalls are required for the proposed.
Please submit a revised site plan illustrating the
required parkinq stalls. The current site plan shows only
ten parking stalls.
5. A minimum of 10% of the parking area is to be
landscaped. Also all parking stalls are to be located
within 60 feet of a landscape feature consisting of 32
square feet in area.
6. The applicant was concerned about the parking and
traffic circulation on the western portion of the site.
B. Permit Release Requirements
1. An estimate from a nursery including size, type, and
quantity of landscaping, itemized cost of the irrigation
system, and the cost of labor along with a promissory
letter from the owner stating the landscaping will be
installed shall be submitted.
2. Please submit a revised site plan as described above
for review and approval.
3. A Certificate of Exemption must be submitted to the
Planning department to aggregate the two parcels.
4. The applicant needs an additional five parking stalls
indicated on the revised site plan.
II. Division of Engineering & Roads (456-3600)
A. Discussion/Requirement
1. Comments were given to the applicant and the Division
of Buildings by Bob Turner.
2. The applicant needs to improve the existing 1208'
swale that is located adjacent to Indiana Lane.
3. Please submit road and drainage plans prepared by an
engineer for road improvements to Park Road. All required
construction within the county right of way must be
completed prior to the issuance of the building permit or
a bond in an amount estimated by the County Engineer to

cover the cost of construction shall be submitted to the
Division of Engineering & Roads.
4. Please submit a traffic and circulation plan of the
site for review and approval.
5. All new traveled surfaces are required to be paved.
6. An Agreement to Pay Fees was given to the applicant
during the meeting. The agreement is to be signed by the
owner and returned to the Division of Engineering & Roads.
Plan review will not be completed until this document is
executed.
B. Permit Release Requirements
1. The applicant needs to improve the existing 1208'
swale that is located adjacent to Indiana Lane.
2. Please submit a traffic and circulation plan of the
site for review and approval.
3. Please submit Road & Drainage Plans prepared by an
engineer for road improvements to park road.
4. Please submit a copy of the Agreement to Pay Fees
signed by the owner.
III. Health District (456-6040)
A. Discussion/Requirements
1. The Health Department was not present during the
meeting.
2. The proposed site is connected to the public sewer
system.
B. Permit Release Requirements
1. The Health District is ready to release their portion
of the permit.
IV. Fire District No. 1(928-2462)
A. Discussion/Requirements
1. Fire flow for the proposed is 3,000 G.P.M.

2. The existing hydrants located on the site are
adequate.
3. A lock (Knox) box entry system for fire department
personnel access is required to be installed.
4. A fire-extinguishing system shall be installed in
Group H, Division 4 Occupancies having a floor area of
more than 3000 square feet. (An alternative discussed in
the meeting was constructinq a two hour area separation
wal l )
5. Sprinkler system drawings for the paint spray booth
shall be submitted to the fire district and Division of
Buildings for review.
V. Division of Buildings (456-3675)
A. Discussion/Requirements
1. Plan review has been completed on the site plan only
and a letter dated August 14, 1991 was sent to the-
applicant by Tom Postlewait.
2. Previous records indicate that the building
construction is Type V One-hour and a Group H, Division 4
Occupancy. Proposed construction will down grade the
entire structura to a Type V-N construction and records
will be required to be changed from V One-hour to V-N.
3. A fire-extinguishing system shall be installed in
Group H, Division 4 Occupancies having a floor area of
more than 3000 square feet. (An alternative discussed in
the meeting was constructing a 2 hour area separation
wall )
4. Please verify the existing shop exterior exit doors
for review.
5. Please submit floor plans and specifications of the
proposed pre-manufactured paint booth for review to verify
the two exits, ventilation requirements, lighting
requirements and other code requirements. For exterior
locations the proposed paint booth shall be designed for a
30 psf snow load, 70 mph wind and Seismic Zone 2B loading.
6. Please verify that the removal of the existing fan
does not reduce the minimum ventilation requirements of
the Uniform Building Code Section 905 for existing shop

area. Please show location of 3,000 cfm fan and 24" by
24" exhaust grille for review on elevations.
7. Please submit a revised critical materials list and a
clean-up procedure program for review.
8. Please submit specifications from the manufacturer
for paint room exhaust unit and filters for review.
9. Drawings shall be directly stamped by the architect.
B. Permit Release Requirements
1. Two complete revised sets of plans addressing the
items discussed during and after the meeting and other
items from the plan review letter needs to be submitted
for review and approval.
APPLICANT'S COMMENTS/ACRNOWLEDGEMENT:
The applicant acknowledged that all comments/requirements were
understood and had no further questions at this time regarding
permit requirements.
CORRECTIONS:
To minutes or changes from what appears in the minutes, we should be
notified within one day of your receipt of these minutes.
To site plans as required by any or all of the above-listed
departments shall be submitted to the Division of Buildings who will
then distribute accordingly to those departments.
ADJOIIRNMENT: There being no further business, Tom Postlewait
thanked the applicant and the departments for their participation
and reminded all that he should be contacted if there are any
unforeseen problems which may arise.

That the Spokane County Comprehensive Plan indicates this site to be

That the uses and lot sizes proposed by the plat sponsor appear to be
consi stent wi th the Industri al Category of the Comprehensi ve Pl an.
III.
That the existing zoning for this site is Restricted Industrial and
Aquifer Sensitive Area Overlay Zone.
IV.
That when the zoning for this site was changed from Residential Office to
Restricted Industrial (ZE-82-84) in September of 1984, certain conditions were
placed upon any development of this land.
V.
That proper legal notification was given for this proposal.
VI.
That the owners of ad,jacent lands expressed neither approval nor
di sapproval of thi s proposed use.
YII.
That appropriate provisions have been made for sewage disposal, water
supply, storm water control, ci rcul ati on, fi re protecti on and other necessary

establishes regulations for roads, approaches, drainage, and f ees in new

within the proposed plat, the applicant must comply with the Conditions

COUNTY HEALTH OI STRICT
l. A combined surf ace water and sewage disposal detailed plan shall be
approved by the County Engineer and the Spokane County Nealth District
pri or to the i ssuance of any bui 1 di ng permi t for thi s project.
2. The dedi catory 1 anguage of the pl at wi 11 state that: "Subject to speci fi c
application approval and issuance of permits by the Nealth Officer, the
use of individual on-site sewage systems may be authorizedu.
3. Water service shall be by an existing public water supply when approved
by the Regional Engineer (Spokane), State Department of Social & Health
Services.
4. Prior to filing the final plat, the sponsor shall present evidence that
the pl at 1 i es wi thi n the recorded servi ce a rea of the water system
proposed to serve the plat. The dedicatory language on the plat shall
state: "Use of private wells and water systems is prohibited."
5. The plat dedication wi11 contain a statment to the effect that: "The
public water system as approved by County and State health authorities
and the local fire district and purveyor will be installed within this
pl at, and the subdi vi der wi 11 provi de for i ndi vi dual domesti c water
service as well as fire protection to each lot prior to sale of each lot."
6. Disposal of sewage effluent beneath paved surfaces is currently
prohibited.
7. Prior to filing the final plat, the sponsor shall dernonstrate to the
satisfaction of the Spokane County Health Oistrict that suitable sites
for on-site sewage disposal systems are available on all lots.
COUNTY UTILI7IES DEPARTI+IENT
1. The owner(s) or Successor(s) in interest agree to authorize the County to
pl ace thei r name(s) on a peti ti on for the formation of a ULID by peti tion
method pursuant to RCW 36.94 which the petition includes the Owner(s)
property and further not to object by the si gni ng of a protest peti ti on
against the form ation of a ULID by resolution method pursuant to RCW
Chapter 36.94 whi ch i ncl udes the Owner(s) property. PROVIDED, thi s

NEARING EXAMINER COh1MITTEE
FINDINGS AND ORDER A. INTRODUCTION
This matter having come before the Zoning Hearing Examiner Committee on
September 6, 1984, and the members of the Committee present being
Kenneth Kennedy, Chairman, Kathleen M. Carstens and F. Lynn Tennican.
B. PROPOSAL
The sponsor, Brian T. Butler, is requesting approval of a zone
reclassification, File No. ZE-82-84, Residential Office to Restricted
Industrial, for the purpose of developing General Industrial Uses (No Site
Plan).
C. FINDINGS OF FACT
1. That the existing land use in the area is residential, commercial,
grain storage, railroad tracks, and vacant.
2. That the Comprehensive Plan designates this area as appropriate for
Industrial development.
3. That the existing zoning of the property described in the application
is Residential Office.
4. That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with, and the Committee concurs with the
Declaration of Non-Significance.
5. That the proper legal requirements f or advertisement of the Agenda
Item have been fulfilled. .
6. That the land in this area, especially along the west side of Park
Road, is suitable for the proposed use, or uses within the proposed
Zone Classification, but is not necessarily compatible with the
adjoining residences east of Park Road.
7. That the applicant has not demonstrated that conditions have
substantially changed since the original zoning of Residential Office
in 1973 of this area and can only be justified with site specific
mitigating measures.
8. That the proposed use can be made compatib1e with existing uses in
the area, if adequate buffering techniques are imposed.

9. That the owners of adjacent lands expressed strong disapproval of the
proposed use.
10. The Hearing Examiner Committee finds the proposed use may be in
harmony with the general purpose and will not be otherwise
detrimental to the public health, safety, and welfare, if
appropriately conditioned.
11. The following are additional findings of fact considered by the
Nearing Examiner Committee:
a) That this parcel serves as an unique transitional buffer between
existing industrial uses west of Park Road and residential areas
to the east of Park Road. The residential area is we11
established and predates most industrial development in the
area; including the several rezone attempts on this site.
Testimony f rom the applicant's representative indicated that
extensive buffering techniques and mitigating measures could be
very expensive in terms of material and loss of developable
land. However, the Comprehensive Plan, past land use actions,
and public testimony indicated the need to protect the
residential area f rom encroaching industrial development.
Approval of the zone change f rom Residential Office to
Restricted Industrial can only be justifiable if all mitigating
measures, as recommended by Staff, are imposed on the property.
D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVaL

binding on the "applicant", which term shall include the owner or owners
of the property, heirs, a'ssigns, and successors.)

1. Approval by the Zoning Administrator of a specific lighting and
signing plan for the described property prior to the release of
any bui 1 di ng permi ts.
2. A specific landscape p1an, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
administrator shall be submitted with a performance bond for the
project prior to release of building permits. Landscaping shall
be installed and maintained such that sight distance at access
points is not obscured or impaired.

Ordinance, which sets forth various measures for Aquifer
protection; specifically, measures dealing with wastewater
disposal, spill protection measures, and stormwater runoff.
- 7. That the present proposal is not detailed enough to determine
whether or not the use of or materials stored on the site are in
compliance with Chapter 4.16A (Aquifer Sensitive Area Overlay
Zone) of the Spokane County Zoning Ordinance. Accordingly, as a
condition of approval, the sponsorlapplicant shall be required
to file with the Spokane County Auditor, within thirty (30) days
of the signing of Findings and Order of the final decision in
this matter, a"Notice to the Public" which shall provide in
materi al as fol l ows:

CERTIFICATE OF OCCUPANCY FOR ANY BUILDING OR ANY USE
ON THE PROPERTY DESCRIBED HEREINAFTER, THE APPLICANT

OF SPOKANE COUNTY ZONING ORDINANCE CHAPTER 4.16A (AQUIFER SENSITIVE AREA OVERLAY ZONE). THE PROPERTY
WHICH IS THE SUBJECT OF THIS NOTICE IS h10RE PARTICULARLY
DESCRIBED AS FOLLOWS:....".
8, applicant shall comply with '208' recommendations concerning
stormwater runoff and provide necessary 1andscaping for runoff.
~ 9. Any division of land for the purpose of sale, lease or transfer,
shall comply with RCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of building permits.

10. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County
Commissioners Resolution #77-1392 be initiated by the project
applicant within thirty (30) days of final dis'position of this
application, and prior to any on-site improvements, or file
appropriate documents to the effect that the tJOTICE OF ACTION is
waived in accordance with Spokane County Commissioners'
Resolution #82-0458 dated May 4, 1982.
11. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA
Guide1ines (WAC 197-10) and the Spokane County Environmental
Ordinance (SCEO), a proposed declaration of non-significance has
been issued at least fifteen (15) days prior to this date; the
official file, written comments and/or public testimony contain
information regarding assessment of the proposal's likely
significant adverse impacts to the physical environment; a
finding is hereby made that no probable significant adverse
impacts upon the physical environ ment are anticipated as a
result of the project; and a final declaration of
non-significance is hereby to be issued.
12. That all areas within the front yard setback off Park Road be
planted and maintained in dense landscaping, except access
point, as approved by the Zoning Administrator.
13. That no parking, storage, or loading dock be allowed on the Park
Road (eastern) portion of the site. Also, that a11 traffic and
activity be oriented to the western portions of the site.
14. That only one access point be allowed f rom the site to Park
Road, to be as approved by the Zoning Administrator and the
County Engi neer.
b) COUNTY ENGINEERING OEPARTMENT
Prior To The Issuance Of A Building Permit:
1. Access permits fior approaches to the County Road System shall be
obtained f rom the Spokane County Engineer.
2. Other specific improvements: Applicant shall construct
Portland Cement concrete sidewalk along Park Road per Spokane
County standards.

3. Applicant shall submit for approval by the Spokane County
Engineer road, drainage, and access plans prior to the issuance
of a building permit on the property.
4. The applicant shall submit for approval by the Spokane County
" Engineer and the Spokane County Health Uistrict a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project prior to the issuance of any
building permit on the property.
5. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer prior to the
issuance of a building permit on the property. The design,
location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
or surfacing as approved by the County Engineer, will be
required for any portion of the project which is to be occupied
or traveled by vehicles. 6. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors.
7. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.
8. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge
Construction, and other applicable County standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless
otherwise approved by the County Engineer.
9. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners'
Resolution No. 80-1592 as amended.

c) COUNTY UTILITIES DEPARTMENT
l. The owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of
a ULID by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formati on of a ULID by resol uti on method pursuant to RCW Chapter
36.94 which includes the Owner(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from
obj ecti on to any assessment(s) on the property as a resul t of
improvements called for in conjunction with the formation of a
ULID by either petition or resolution method under RCW Chapter
36.94. 2. Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County, as amended.
3. Each unit shall be double-plumbed for connection to future
areawide collection systems.
4. This action be conditioned with the performance-criteria of
Section 4.16A.050* for all future uses.
* Aquifer Sensitive Area Overlay Zone.
d) COUNTY HEALTH DISTRICT
l. A combined surface water and sewage disposal detailed plan shall
be approved by the County Engineer and the Health District prior
to the issuance of any building permit for this project.
2. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
3. Subject to specific application approval and issuance of permits
by the Health Officer, the use of an individual on-site sewage
system may be authori zed.
4. Water service shall be coordinated through the-Director of
Utilities, Spokane County.

5. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Health Services.
6. Use of private wells and water systems is prohibited.
7. Disposal of sewage effluent beneath paved surfaces is currently
prohibited.
e) COUNTY BUILDING AND SAFETY DEPART14ENT
1. The site is located in Fire District # l.
2. Fire hydrants which meet the fire flow are required to be
installed prior to construction. These hydrants shall be placed
so that no portion of the building exterior is more than 175
feet from the hydrant. The bottom of the 1 owest outl et of the
hydrant shall be no less than 18 inches above grade. A water
plan showing each fire hydrant (specifying the gallons per
mi nute for each f i re hydrant ) and meeti ng the re-qui rements i n
Chapter 10.04 of the Uniform Fire Code is required prior to
construction of the water service.
3. Approved numbers or addresses shall be placed on all new and
existing buildings in such a position as to be plainly visible
and legible f rom the street or road fronting the property. Said
numbers shall contrast with their background.
4. Trash enclosures shall not be located adjacent to combustible
construction or underneath windows or nonprotected eaves.
f) WATER PURVEYOR
l. Water Purveyor is Spokane Suburban Water Company, and they will
. supply the site with adequate water for domestic, fire and
irrigation uses.

g) COUNTY AIR POLLUTION CONTROL AUTHORITY
1. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled.
This may require use of water sprays, tarps, sprinklers, or
suspension of activity during certain weather conditions. Haul
roads should be treated and emissions from the transfer of
earthen material must be controlled as well as emissions from
all other construction related activities.
2. Measures must be taken to avoid the deposition of dirt and mud
f rom unpaved surfaces onto paved surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
immedi ately to cl ean these surfaces.
3. All travelled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean.
4. Some objectionable odors will likely result during the
construction phase of a project and f rom motor vehicles using
the site following completion of the project and from occupants
of the proposed project.
5. SCAPCA Regulation I, Article IY requires registration with this
Agency.
6. SCAPCA Regulation I, Article V requires that a Notice of
Construction and Application for Approval be submitted to and
approved by our Agency prior to the construction, installation
or establishment of an air pollution source.
7. SCAPCA Regulation I, Article VI and SCAPCA Regulation II,
Article IV addresses emission standards. All emission standards
must be met. 8. All air pollution regulations must be met.

The Hearing Examiner Committee, pursuant to the aforementioned, finds that
the application of Brian T. Butler for a zone reclassification as
described in the application should be APPROVED.

1. Drainage calculations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of.the 208 swale.
6. Calcu].ations to justify the number and type of
drywells pzoposed.

EnginePrs "Agreement to Pay Fees". This document must he
returned to the County Engineers Office. Plan review will
not be completed until this document is executed. This
document is attached to these comments. Please return
the completed Agreement to your contact person at the
Engineers Department.
Only after all the information and requirements listed above
are supplied or completed and the necessary review has been
accomplished will your building permit be released.

CALL TO ORDER: The meeting was called to order at approximately
11:00 a.m. by the Division of Buildings Special Projects

SCOPEIPROJECT DESCRIPTION:
I. General Overview - The owner Jim Miller is proposing the
construction of a 2,400 square foot storage building. The applicant
would like to begin construction as soon as possible.
Please Note: The address has been changed from East 7420 Indiana
Lane to North 1909 Park Road.
SUMMARY OF DEPARTMENTAL REQIIIREMENTS:
I. Planning Department (456-2205)
A. Discussion/Requirements
1. The proposed is located in a I-2 Zone.
2. The proposed must comply with the conditions of Zone
Change No. ZE-82-84.
3. The front yard requires heavy dense landscaping per
ZE-82-84. A 20 foot strip of Type I(sight obscuring)-
' landscaping is required along Park Road.

4. The zone requires a 35 foot front yard setback, please
illustrate on the site plan. ~

5. The parking as illustrated on the site plan is
adequate. A minimum of two spaces are required, three
spaces are shown.
6. If the fenced area is for outdoor storage, the fence
must be sight obscuring. Please specify on the site plan.

7. Discussion of a revised site plan illustrating
detailed landscaping, setbacks, and a legal access and a
practical access to the site were discussed.
8. The plans call for access through the adjacent
property to the north. Allan stated this would be ok
however, an easement through the adjacent property would
be required. Please submit a copy of the easement from
the owner. Allan deLaubenfels stated that the easement be
filed at the County Auditors Off ice.
9. Allan will verify if access from Park Road is possible
as per the condition of the re-zone and get back to the
applicant.
B. Permit Release Requirements
1. An estimate from a nursery including size, type, and
quantity along with a promissory letter from the owner
stating the landscaping will be installed shall be
submitted.
2. Please submit a revised site plan as described above
for review and approval.
II. Division of Engineering & Roads (456-3600)
A. Discussion/Requirement
1. Comments were given to the applicant and the Division
of Buildings by Bob Turner.
2. Please submit a drainage plan for the site that is in
conformance with Spokane County Guidelines for Stormwater
Management.
3. The proposed will have a metal roof, therefore
stormwater drainage from the roof may go directly into a
drywell.

4. The proposed must meet the conditions of Zone Change
` No. ZE-82-84.

, , . 5. Please submit road and drainage plans prepared by an
engineer for Park Road. Road improvements shall include
continuing the existing sidewalk and curb. All required
road construction shall be completed prior to the release
of the building permit or a bond in an amount estimated by
the County Engineer to cover the cost of construction
shall be submitted.
6. Approach permits shall be obtained for new driveway
approaches along county right of way.
7. Traff ic and circulation plan including the type of
vehicles and turning radiuses is required for review. The
plan should address the types of truck traffic.
8. Paving is required on all occupied areas and areas
traveled by vehicles including the easement extending from
Indiana Lane to and including the subject property.
9. Previous requirements for paving of the driveway and
area parking which were not completed for Kelly's Frame
Shop located on the adjacent property were discussed.
Because this was a condition of the zone change, and
should access be obtained through said adjacent property,
the paving requirements will be required to be completed
in conjunction with this current project. Bob voiced his
concerns on the previous project's lack of compliance and
requested that the Division of Buildings follow up on this
matter through continued inspections to verify completion
of the improvements.
10. An Agreement to Pay Fees was given to the applicant
during the meeting. The agreement is to be signed by the
owner and returned to the Division of Engineering & Roads.
Plan review will not be completed until this document is
executed.
B. Permit Release Requirements
1. Please submit a revised drainage plan as described
above for review and approval.
2. The proposed shall meet the conditions of Zone Change
No. ZE-82-84 which shall include the paving of the
easement from Indiana Lane. 3. Please submit road and drainage plans-prepared by an
engineer for Park Road.

III. Health District (456-6040)
A. Discussion/Requirements
1. Daryl Way advised the applicant to aggregate the
parcels of land and tie into the existing sewage disposal
system instead of installing a new system. If the parcels
are not aggregated the existing system may still be tied
into, but an easement for the sewer line must be obtained.
2. If the applicant decides to install a new on site
sewage disposal system a leach bed will be required
instead of a drainf ield because of the property size. The
address must be posted on the face of the structure for
emergency responses.
3. Please submit a critical materials list to the
Division of Buildings for review.
4. Daryl advised the applicant to check with the refuse
disposal company regarding the location of the dumpster.
B. Permit Release Requirements
1. Apply for a permit to either install a new on site
sewage disposal system or for a permit to tie into the
existing on site sewage disposal system.
IV. Fire District No. 1(928-2462)
A. Discussion/Requirements
1. Fire flow for the proposed is 2,000 g.p.m. Fire
hydrants located near the site are adequate.
2. The fire district requested that the address be
changed from an Indiana Lane address to a Park Road address.
3. If access is provided to the site by an easement the
fire district will require that a 50 foot turning radius
be provided for maneuvering fire fighting equipment. If
. access to the site is provided of f of Park Road the f ire
di'strict will have no problems accessing the site. - 4 -

4. Please submit a parking and traffic circulation plan
for review.
V. Division of Buildings (456-3675)
A. Discussion/Requirements
1. Plan review has been completed on the site plan only
and a letter was sent to the applicant by Ken Jeffrey.
2. Please identify what the proposed will be used for,
and if proposal is in conjunction with the existing
building located on the adjacent property. The Division
of Buildings is limiting the use of the proposed to
storage only. If use of the structure is to change, a
change of use permit would be required.
3. Submit a critical materials list to the Division of
Buildings for review and approval.
4. The proposed shall meet the minimum requirements of
the Regulations for Barrier Free Facilities.
B. Permit Release Requirements
1. Two complete revised sets of plans addressing the
items discussed during and after the meeting and other
items from the plan review letter needs to be submitted
for review and approval.
APPLICANT'S COMMENTS/ACRNOWLEDGEMENT:
The applicant acknowledged that all comments/requirements were
understood and had no further questions at this time regarding
permit requirements.
CORRECTIONB:
To minutes or changes from what appears in the minutes, we should be
notif ied within one day of your receipt of these minutes.

FINDINGS AND ORDER
A. INTRODUCTION
This matter having come bef ore the Zoning Hearing Examine r Committee on
September 6, 1984, and the members of the Committee present being
Kenneth Kennedy, Chairman, Kathleen M. Carstens and F. Lynn Tennican.
B. PROPOSAL
The sponsor, Brian T. Butler, is requesting approval of a zone
reclassification, File No. ZE-82-84, Residential Office to Restricted
Industrial, for the purpose of developing General Industrial Uses (No Site
Plan).
C. FINDINGS OF FACT
l. That the existing land use in the area is residential, commercial,
grain storage, railroad tracks, and vacant.
2. That the Comprehensive Plan designates this area as appropriate for
Industrial development.
3. That the existing zoning of the property described in the application
is Residential Office. '
4. That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with, and the Committee concurs with the
Declaration of Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda
Item have been fulfilled.
6. That the land in this area, especially along the west side of Park
Road, is suitable for the proposed use, or uses within the proposed
Zone Classification, but is not necessarily compatible with the
adjoining residences east of Park Road.
7. That the applicant has not demonstrated that conditions have
substantially changed since the original zoning of Residential Office
i n 1973 of thi s area and can only be j usti f i ed wi th si te speci f i c
mitigating measures.
8. That the proposed use can be made compatible with existing uses in
the area, if adequate buffering techniques are imposed. ~

9. That the owners of adjacent lands expressed strong disapproval of the
proposed use.
10. The Hearing Examiner Committee finds the proposed use may be in
harmony with the general purpose and will not be otherwise
detrimental to the public health, safety, and welfare, if
appropriately conditioned.
11. The following are additional findings of fact considered by the
Hearing Examiner Committee:
a) That this parcel serves as an unique transitional buffer between
existing industrial uses west of Park Road and residential areas .
to the east of Park Road. The residential area is well
established and predates most industrial development in the
area; including the several rezone attempts on this site.
Testimony f rom the applicant's representative indicated that
extensive buffering techniques and mitigating measures could be
very expensive in terms of material and loss of developable
land. However, the Comprehensive Plan, past land use actions,
and public testimony indicated the need to protect the
residential area f rom encroaching industrial development.
Approval of the zone change f rom Residential Office to
Restricted Industrial can only be justifiable if all mitigating
measures, as recommended by Staff, are imposed on the property.
D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
(Al1 Conditions imposed b, the Zoning Hearing Examiner Committee shall be
binding on the "Applicant", which term shall include the owner or owners
of the property, heirs, assigns, and successors.)
a) COUNTY PLANNING DEPARTMENT
l. Approval by the Zoning Administrator of a specific lighting and
signing plan for the described property prior to the release of
any building permits.
. 2. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for the
project prior to release of building permits. Landscaping shall
be installed and maintained such that sight distance at access
points is not obscured or impaired.

3. Direct light f rom any exterior area lighting fixture shall not
extend over the property boundary.
4. The specific development plan will be submitted for Planning
Department review and approval prior to issuance of building

5. A11 current standards of the Restricted Industrial Zone, as
amended, shall be complied with in the development of this
site.
6. That the project is subject to Section 4.16A.050, the Aquifer .
Sensitive Area Overlay Zone of the Spokane County Zoning
Ordinance, which sets forth various measures for Aquifer
protection; specifically, measures dealing with wastewater
disposal, spill protection measures, and stormwater runoff.
- 7. That the present proposal is not detailed enough to determine whether or not the use of or materials stored on the site are in
compliance with Chapter 4.16A (Aquifer Sensitive Area Overlay
Zone) of the Spokane County Zoning Ordinance. Accordingly, as a
condition of approval, the sponsor/applicant shall be required
to file with the Spokane County Auditor, within thirty (30) days
of the signing of Findings and Order of the final decision in
this matter, a"Notice to the Public" which shall provide in
mate ri al as f ol 1 ows :
PRIOR TO THE ISSUANCE OF ANY BUILDING PERMIT OR
CERTIFICATE OF OCCUPANCY FOR ANY BUILUING OR ANY USE
ON THE PROPERTY DESCRIBED NEREINAFTER, THE APPLICANT
SHALL BE RESPONSIBLE FOR COMPLYING WITH THE PROVISIONS
OF SPOKANE COUNTY ZONING ORDINANCE CHAPTER 4.16A
(AQUIFER SENSITIVE AREA OVERLAY ZONE). THE PROPERTY
WHICH IS THE SUBJECT OF THIS NOTICE IS h10RE PARTICULARLY
UESCRIBED AS FOLLOWS:....".
8. Applicant shall comply with '208' recommendations concerning
stormwater runoff and provide necessary landscaping for runoff.
9. Any division of land for the purpose of sale, lease or transfe r,
shall comply with RCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of building permits. 3

application, and prior to any on-site improvements, or file
appropriate documents to the effect that the NOTICE OF ACTIOPJ is
. waived in accordance with Spokane County Commissioners'
Resol uti on #82-0458 dated h1ay 4, 1982.
11. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA
Guidelines (WAC 197-10) and the Spokane County Environmental
Ordinance (SCEO), a proposed declaration of non-significance has
been issued at least fifteen (15) days prior to this date; the
official file, written comments and/or public testimony contain
information regarding assessment of the proposal's likely
significant adverse impacts to the physical environment; a
finding is hereby made that no probable significant adverse
impacts upon the physical environ ment are anticipated as a
resul t of the proj ect; and a f i nal decl arati on of
non-significance is hereby to be issued.
12. That all areas within the f ront yard setback off Park Road be
planted and maintained in dense landscaping, except access
point, as approved by the Zoning Administrator.
13. That no parking, storage, or loading dock be allowed on the Park
Road (eastern) portion of the site. Also, that all traffic and
activity be oriented to the weste rn portions of the site.
14. That only one access point be allowed from the site to Park
Road, to be as approved by the Zoning Administrator and the
County Engineer.

e) COUNTY BUILDING AND SAFETY DEPARTMENT
l. The site is located in Fire Uistrict # 1.
2. Fi re hydrants which meet the fi re fl ow are requi red to be
installed prior to construction. These hydrants shall be placed
so that no portion of the building exterior is more than 175
feet from the hydrant. The bottom of the 1 owest outl et of the
hydrant shall be no less than 18 inches above grade. A water
plan showing each fire hydrant (specifying the gallons per
minute for each fire hydrant) and meeting the requirements in
Chapter 10.04 of the Uni form Fi re Code i s requi red pri or to
construction of the water service.
3. Approved numbers or addresses shall be placed on all new and
existing buildings in such a position as to be plainly visible
and legible f rom the street or road fronting the property. Said
numbers shall contrast with their background.
4. Trash enclosures shall not be located adjacent to combustible
construction or underneath windows or nonprotected eaves.
f ) WATER PURYEYOR
l. Water Purveyor is Spokane Suburban Water Company, and they will
supply the site with adequate water for domestic, fire and
irrigation uses.

g) COUNTY AIR POLLUTION CONTROL AUTHORITY
1. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled.
This may require use of water sprays, tarps, sprinklers, or
suspension of activity during certain weather conditions. Haul
roads should be treated and emissions from the transfer of
earthen material must be controlled as well as emissions f rom
all other construction related activities.
2. Measures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
immediately to clean these surfaces. .
3. Al1 travelled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean.
4. Some objectionable odors will likely result during the
construction phase of a project and from motor vehicles using
the site following completion of the project and f rom occupants
of the proposed project.
5. SCAPCA Regulation I, Article IV requires registration with this
Agency.
6. SCAPCA Regulation I, Article V requires that a Notice of
Construction and Application for Approval be submitted to and
approved by our Agency prior to the construction, installation
or establishment of an air pollution source.
7. SCAPCA Regulation I, Article VT and SCAPCA Regulation II,
Article IV addresses emission standards. Al1 emission standards
must be met.
8. All air pollution regulations must be met.
