The spokane Valley Fire Department will re-examine this
project after the above information is received. We would
encourage the owners to employ the services of a certified
Fire Protection Engineer to review the above questions to
determine if a code supportable storage system can be
implemented that would not require fire sprinklers. -

l. Reimburse Spokane County for project review and inspection fees as specified in Chapter 9.14 of
the Spokane County Code. The fees will be based on actual salary costs incurred by Spokane
County for project reviews and / or inspections plus a ten percent aciministrative charge, and will
be bilted monthly as accrued. Any billing amounts due, including any expenses incurred in the
collection of an overdue account, must be paid prior to the County's acceptance of tlie project for
filing. If a project is approved and/or filed with a balance still owing, the unpaid baiance shall be
paid within 30 days of the invoice date.
2. The undersigned agrees that these fees are c3ue and payable upon receipt Qf the billing as specified
' above.
' 3. Any invoices not paid withtn 30 days of the invoice date will be considered delinquent. 1f any
outstanding balance on the account for this project is not paid within 30 days of the invoice ciate, no further reviews of the project documents will be conducted until the entire account balance is
paid. Any balance on the account for this project not paid witfiin 65 days of the invoice date may
result in tegal action or the initiation of other collection procedures, including referral to a
collection agency. The Sponsor wilt be liable for any and ali expenses incurred by tlie County for
the collection of overdue accounts.

covenants, conditions and restrictions affecting the property.
2. To pay before delinquent all lawful taxes, utilities and assessments upon
the property from and including the date hereof; to keep the property free and clear of .
all other charges, liens or encumbrances impairing the security of this Deed of Trust. ~3. To appear in and defend any suit, action or proceeding that might affect the value of this security instrument or the security itself or the rights and powers of
Beneficiary or Trustee, and should Beneficiary or Trustee elect also to appear in or
defend any such action or proceeding, be made a party to such action by reason of this
Deed of Trust, or elect to prosecute such action as appears necessary to preserve said
value, Grantor wilt, at all times, indemnify from and, on demand, reimburse Beneficiary
or Trustee for any and all loss, damage, expense or cost, including cost of evidence of
title and attorneys' fees, arising out of or incurred in connection with any such suit,

action or proceeding, and the sum of such expenditures shall be secured by this Deed of
Trust with interest as provided in the note secured hereby and shall be due and payable
on demand. To pay costs of suit, costs of evidence of title and a reasonable attorney's ,
fee in any proceeding or suit brought by Beneficiary to foreclose this Deed of Trust. _
4. To pay all debts and monies secured hereby, when from 2ny cause the _

of any l:ind. That no liens or encumbrances superior to this Deed of Trust will be created or suffered to be created by the Grantor during the life of this Deed of Trust, that

person whomsoever lawfully claiming or to claim the same or any part thereof.
B. IT IS MUTUALLY AGREED THAT: :
1. Beneficiary or ils agent may enter upon the premises at any reasonable
time, during business hours, to inspect the same. Grantor shail have the right to remodel
or improve the premises in any manner which does not materially reduce the market
valuc tfiereof. Grantor shall permit no waste on the prernises, nor make or permit any ,
unlawful, oCfensive or improper use of the premises or any part thereof. Grantor has inspected the real property and lhe improvements located thereon and accepts the •
premises "as is."
2. Grantor's and Beneficiary's representations and warrantics, as set forth in
the Commercial and Investment Real Estate Purchase and Sale Agreement dated March
20, 1995, with all Addendums thereto, regarding the condition of the property and the
hazardous waste materials, including any limitations thereof, are incorporated herein by
this reference and shall survive closing.

3. Should Grantor fail to pay when due any taxes, assessments, Iiens,
encumbrances or other charges against the property hereinabove described, Beneficiary ,
may pay the same, and the amount so paid, with interest at the rate set forth in the note '
secured hereby, shall be added to and become a part of the debt secured by this Deed of . Trust, and any payments made hereunder shall be immediately due and payable.
4. The subject real estate or any interest therein, or the rights, obligations and
benefits arising under this Deed of Trust shall not be sold, assigned, transferred or
delegated by Grantor, without the prior written consent of Beneficiary. Grantor shall
provide Beneficiary with at least thirty (30) days' written notice of their intent to sell,
assign, delegate or otherwise transfer their interest in the real estate, rights and/or
obligations under this Deed of Trust. Such consent shall not be unreasonably withheld. If such consent is given, Grantor shall remain fully obligated for the performance of this
Deed of Trust, incIuding the obligation to make the payments under the promissory note. - In the event Grantor selis, assigns or otherwise transfers its interest in the real property
and improvements located thereon, or any portion thereof without Beneficiaries consent, .
then all unpaid installments of principal and accrued interest shall become immediately
due and payable at option of Beneficiary.
5. Should Grantor fail to make any payment or to do any act as herein
provided, then Beneficiary or Trustce, but without obligation so to do and without notice to or demand upon Grantor and without releasing Grantor from any obligation hereof,
may make or do the same in such manner and to such extent as either may deem
JM'necessary to protect the securily hereof. 6. Should the property or any part or appurtenance thereof or right or interest
therein be taken or damaged by reason of any public or private improvement,
condemnation proceeding, fire, earthquake or other casualty, or in any other manner,
Beneficiary may, at its option, commence, appear in and prosecute, in its own name, any 4

action or proceeding, or mal:e any compromise or settlement, in connection with such
tal;ing or damage, and obtain all compensation, awards or other relief therefor. All such
compensation, awards, damages, rights of action and proceeds, including the proceeds :
of any policies of insurance affecting the property, are hereby assigned to Beneficiary,
which may, after deducting therefrom atl its expenses, including attorneys' fees, release
any monies so received by it, or apply the same on any indebtedness secured hereby or
apply the same to the repair or restoration of the property, as it may elect. 7. Time is of the essence hereof in connection with all obligations of Grantor
herein or in said note. By accepting payment of any sum secured hereby after its due date, Beneficiary does not waive its right either to require prompt payment when due of
all other sums so secured or to declare default for failure so to pay.
8. All sums secured hereby shall become immediately due and payable, at the
option of Beneficiary without demand or notice, after any of the following occur, each : .
of which shall be an event of default: (a) default by Grantor in the payment of any
indebtedness secured hereby or in the performance or observance of any agreement
contained herein; or (b) any assignment made by Gcantor or the then owner of said property for the benefit of creditors; or (c) any sale, transfer, assignmcnt or delegation
of title made by Grantor to a grantee or successor in interest without the assumption of .
all of the terms and conditions herein contained or without compliance with Paragraph
B.3 hereof. No waiver by Beneficiary of any default on the part of Grantor shall be
construed as a waiver of any subsequent default hereunder. In event of such default and
upon written request of Beneficiary, Trustee may sell the trust property, in accordance
with the Deed of Trust Act of the State of Washington, RCW Ch. 61.24 as existing now,
or hereafter amended, at public auction to the highest bidder. Any person except Trustee .
may bid at Trustee's sale. Trustee shall apply the proceeds of the sale as follows: (1) to
the expense of sale, including a reasonable Trustee's fee and attorney's fee; (2) to the : ' S ,

obligation secured by this Deed of Trust; (3) the surplus, if any, shall be distributed in '
accordance with said Deed of Trust Act. Trustee shall deliver to the purchaser at the .

property which Grantor had or had the power to convey at the time of its execution of : -
this Deed of Trust, and such as they may have acquired thereafter. The power of sale
conferred by this Deed of Tn,st and by the Deed of Trust Act of the State of Washington ,
is not an exctusive remeciy and when not exercised, Beneficiary may foreclose this Deeci :of Trust as a mortgage. In the event of the incapacity or resignation of the Trustee,
Beneficiary may appoint in writing a successor trustee, and upon rerording of such
appointment in the mortgage records of the county in which this Deed of Trust is recorded, the successor trustee shall be vested with alt powers of the original Trustee.
9. In the event that this Deed of Trust is foreclosed as a mortgage and the
property sold at a foreclosure sale, the purchasers may, during any redemption period
?-ilowed, make such repairs or alterations on said property as may be reasonably
necessary for the proper operation, care, presecvation, protection and insuring thereof.
Any sums so paid together with interest thereon from the time of such expenditure at the
highest lawful rate shall be added to artd become a part of the amoune required co be paid
for redemption from such sale. •
10. Trustee shall reconvey atl of the property covered by this Deed of Trust '
to the person entitled thereto, upon satisfaction of the obligation secured and/or written
request for reconveyance made by Beneficiary or the person entitled thereto.
11. This Deed of Trust applies to, inures to the benefit of, and is binding not
only on the pariies hereto, but on their heirs, devisees, legatees, administrators, executors
and assigns. The term "Beneficiary" shall mean the holder and owner of the note .
secured hereby, whether or not named as Beneficiary herein.

Drainage Report
Dear Mr. Neraas:
This letter summarizes the drainage analysis pcrfurmed on the above retcrenced project. ('he pruject
consists of a new 7,692 square foot building, the associated parking, drive aisle, landscaping, and
drainage structures all located on 0.902 acres. The zoning is I-2, light industrial. The soil type in this
area is Garrison Gravelly loam on 0 to 5 percent slopes. This soil is excessively drained and pre-
=roved for drywells by Spokane County. Please see the attached vicinity and soils maps for reference.
The rational method was used for the basins shown on the attached basin map (since the basins were less
than 10 acres in size). This project was analyzed using the 10 & 50 year rainfal l I DF curves for the
Spokane area.
For purposes of analysis the site was divided into two basins, the West Basin and the East Basin. These
basins are delineated on the accompanying basin map. The following table summarizes the
characteristics of the two basins:
