The County Engineering Department has completed a review of
the above referenced project. The following information must be
provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainage plan
for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
✓l. Drainage calculations for stormwater volumes
generated on site.
~-v2. Calculations for total impervious surfaces
contained within the site.
~3. Finished grade elevations for structures to be
constructed on site.
'4. Finished grade elevations at the top and bottom of
the 208 swale.
./5. A typical cross section of the 208 swale.
--6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
~8. Copy of the proposed landscape plan.
B) The subject property is affected by the "Findings and
Order" and the "Conditions of Approval" for the following
land use action:
Spokane County Zone Change No. ZE-43-87 & ZE-64B-83
C) Insufficient information was submitted with the proposal.
We are unable to proceed with our review. We will need
the following before we can proceed:
1. Site Plan.
2. Drainage plan as specified.
3. Other information:
a. A parking and traffic circulation plan shall
be submitted and approved by the Spokane County Enqineer. The
design, location and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving as
required by the County Planning Ordinance, will be required for
any portion of the project which is to be occupied or traveled by
vehicles.
D) Utility Condition: Permittee is responsible for arranging
for all necessary utility adjustments or relocation as
required for completion of the improvement.

E) The owner of the property or the authorized
representative must complete and sign Spokane County
Engineers "Agreement to Pay Fees". This document must be
returned to the County Engineers Office. Plan review will
not be completed until this document is executed. This
document is attached to these comments. Please return
the completed Agreement to your contact person at the
Engineers Department.
Only after all the information and requirements listed above
are supplied or completed and the necessary review has been
accomplished will your building permit be released.

A review of the site/drainage plan recently submitted to this office has been
completed. The plan appears to meet the minimum requirements of this office and
we are ready to release our portion of the building permit. However, our sign-off
will be held until the issue with the Planning Department is resolved.
It has been brought to my attention that this addition exceeds the maximum
number of rooms allowed by the zone change. If your client decides go with the ,
maximum number allowed under the zone change, then the site plan will have to
be revised to reflect the number of rooms being added.

A. INTRODUCTION
This matter having come before the Zoning Hearing Examiner Cornmittee on
December 3, 1987, and the members of the Committee present being Phillip
D. Harris, Chairman, and Jim Schurra and Gary N. Anderberg.

for the purpose of developing a total of a 120-unit motel and restaurant (62
of a prior approval with 58 new units planned within this zone change).
Also, for a Change of Conditions, File No. ZE-6413-83, CHANGE OF
CONDITIONS IN A COMMERCIAL ZONE, for the purpose of reviewing a
new site development plan regarding an increase in the size of the
restaurant and moving the planned 62 unit motel to connect with the zone
change as described above.
C. FINDINGS OF FACT
1. That the existing land use in the area is single family residences, -
Interstate 90, Pizza Haven, Grey Hound Bus Terminal, vacant and other
retail uses.
2. That the Comprehensive Plan designates this area as appropriate for
Major Commercial development.
3. That the existing zoning of the property described in the application is
Agricultural.
4. That the provisions of RCW 43.21 C(The State Environmental Policy Act)
have been complied with, and the Committee concurs with the
Determination of Non-Significance.
5. That the proper legal requirements for advertisement of the Argenda Item
have been fulfilled.
6. That the land use in this area is suitable for the proposed use, or uses
within the proposed Zone Classification.
7. That the applicant has demonstrated that conditions have substantially
changed since the original zoning of this area and accordingly, the
proposed rezone is justified.

8. That the proposed use is compatible with existing uses in the area.
9. That the owners of adjacent lands expressed neither approval nor

to the public health, safety, and welfare.
11. The following are additional findings of fact considered by the
Hearing Examiner Committee:
a) That the five foot easement for future right of way, as identified in the
Arterial Plan, is needed to provide adequate circulation to the
intensity of land use anticipated by the Comprehensive Land Use Plan.

the signal pole and associated signal equipment at the time that
roadway improvements are constructed."
2. Change Planning Department's Condition #9 to read as follows:
"That Spokane County Planning Department be required to record
with the County Auditor a"Title Notice", as prepared by the applicant;
a right of way and utility easement to run with the land and shall not
be removed without prior approval by said Department. Said notice
shall be recorded prior to issuance of a building permit and shall
provide the following:
a) Five (5) feet of easement in addition to the existing and
conditional dedication along Mission Avenue.

within this area they shall be relocated at the applicant's expense
when roadway improvements are made."
b} COUNTY PLANNING DEPARTMENT
STANDARD:
.
1. Approval by the Zoning Administrator of a specific lighting and signing
plan for the described property prior to the release of any building
permits.
2. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning Administrator
shall be submitted with a performance bond for the project prior to
release of building permits. Landscaping shall be installed and
maintained such that sight distance at access points is not obscured
or impaired.
3. The applicant shall develop subject property generally in accordance
within the concept presented to the Hearing Examiner Committee.
Variations when approved by the Zoning Administrator will be
permitted, including, but not limited to the following changes: Building
location, landscape plans, and general allowable uses of the
permitted zone. All variations must conform to regulations set forth in
the ZONING CODE FOR SPOKANE COUNTY. The original intent of
the development plans shall be maintained.
4. The specific development plan will be submitted for Planning
Department review and approval prior to issuance of building permits.
5. All current standards of the Regional Business (13-3) Zone, as
amended, for the legal description of the zone change as described in
the application, shall be complied with in the development of this site.
6. That the present proposal is not detailed enough to determine
whether or not the use of or materials stored on the site are in
compliance with Section 7.06 (Aquifer Sensitive Area Overlay Zone)
of the ZONING CODE FOR SPOKANE COUNTY. Accordingly, as a
condition of approval, the sponsor/applicant shall be required to file

with the Spokane County Auditor, within thirty (30) days of the signing
of Findings and Order of the final decision in this matter, a"Notice to

CERTIFICATE OF OCCUPANCY FOR ANY BUILDING OR ANY USE
ON THE PROPERTY DESCRIBED HEREINAFTER, THE APPLICANT
SHALL BE RESPONSIBLE FOR COMPLYING WITH THE
PROVISIONS OF THE ZONING CODE FOR SPOKANE COUNTY
SECTION 7.06 (AQUIFER SENSITIVE AREA OVERLAY ZONE). THE
PROPERTY WHICH IS THE SUBJECT OF THIS NOTICE IS MORE
PARTICULARLY DESCRIBED AS FOLLOWS:....".
7. Applicant shall comply with '208' recommendations concerning
stormwater runoff and provide necessary landscaping for runoff.
8. Any division of land for the purpose of sale, lease or transfer, shall
comply with RCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of building permits.
9. That all those Conditions of Approval for the existing Commercial
Zone, File No. ZE-6413-83, except as modified by this change of
conditions for a new site plan, shall be complied with.
10. Amend Planning Condition S ecial #4 to reduce landscaping along
the west property line at the Regional Business (B-3) Zone to 10 feet.
11. That the sign standards as limited by ZE-64B-83 and the Regional
Business (B-3) Zone shall be complied with, however, the Zoning
Administrator may allow some flexibility as to sign locations.
c) COUNTY ENGINEERING DEPARTMENT
Prior To The Issuance Of A Buildina Permit Or Use Of The ProQertv As
Proposed:
1. Access permits for approaches to the County Road System shall be
obtained from the Spokane County Engineer.
2. Applicant shall submit for approval by the Spokane County Engineer
road, drainage, and access plans.

c) COUNTY ENGINEERING DEPARTMENT
3. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project or any portion thereof, if the development is
to be phased.
4. A parking plan and traffic circulation plan shall be submitted and
approved by the Spokane County Engineer. The design, location,
and arrangement of parking stalls shall be in accordance with
standard traffic engineering practices. Paving or surfacing as
approved by the County Engineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles.
5. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.
6. The County Engineer has designated Typical Roadway Section
Number One, Secondary Arterial standard for the improvement of
Mission Avenue which is adjacent to the proposed development. This
will require the addition of approximately 12 to 14 feet of asphalt
along the frontage of the development. Curbing and sidewalks must
also be constructed.
7. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge
Construction, and other applicable County standards and/or adopted
resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
8. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners'
Resolution No. 80-1592 as amended and are applicable to this
proposal. 9. No construction work is to be performed within the existing or
proposed public right of way until a permit has been issued by the
County Engineer. All work within the public road right of way is
subject to inspection and approval by the County Engineer.
10. All required construction within the existing or proposed public right of
way is to be completed prior to the release of a building permit or a
bond in the amount estimated by the County Engineer to cover the
cost of construction of improvements shall, be filed with the County
Engineer.

1. Pursuant to Board of County Commissioners Resolution No. 80-
0418, the use of on-site sewer disposal systems is hereby
authorized. This authorization is conditioned on compliance with all
rules and regulations of the Spokane County Health District and is
further conditioned and subject to specific application approval and
issuance of permits by the Health District.
2. The Owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of a ULID
by petition method pursuant to RCW 36.94 which the petition includes
the Owner(s) property and further not to object by the signing of a
protest petition against the formation of a ULID by resolution method
pursuant to RCW Chapter 36.94 which includes the Owner(s)
property. PROVIDED, this condition shall not prohibit the Owner(s) or
Successor(s) from objection to any assessment(s) on the property as
a result of improvements called for in conjunction with the formation of
a ULID by either petition or resolution method under RCW Chapter
36.94.
3. Any water service for this project shall be provided in accordance with
the Coordinated Water System Plan for Spokane County, as
amended.
4. A dry sewer connection to the future area-wide Sewerage System is
to be constructed. Plans and specifications for the dry sewer
connection are to be reviewed and approved by the Utilities
Department.
e) COUNTY HEALTH DISTRICT
STANDARD:
1. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.

may require use of water sprays, tarps, sprinklers, or suspension of

controlled as well as emissions from all other construction related
activities. -
2. Measures must be taken to avoid the deposition of dirt and mud from
unpaved surfaces onto paved surfaces. If tracking or spills occur on
paved surfaces, measures must be taken immediately to clean these

3. All travelled surfaces (ingress, egress, parking areas, access roads)

4. Some objectionable odors will likely result during the construction
