INTRODUCTIOPJ Thi s matter havi ng come before the Zoni ng Heari ng Exami ner Coneni ttee on November 16, 1983, and the members of the Committee present being Richard L. Skalstad, Chairman, Jane E. Myers and Jerry Williams. B. PROPOSAL The sponsor, Joseph G. Ward, is requesting approval of a zone reclassification, File No. ZE-79-83, Residential Office to Commercial, for the purpose of developing Retail and Office Uses. C. FINDItdGS OF FACT 1. That the existing land use in the area is residential, church, and office buildings. 2. That the Comprehensive Plan designates this area as appropriate for Major Commercial development. 3. That the existing zoning of the property described in the application is Residential Office. 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with, and the Committee concurs with the Declaration of Non-Significance, 5. That the proper 1ega1 requirements for advertisement of the Agenda Item have been fulfilled. 6. That the land in this area is suitable for the proposed use, or uses within the proposed Zone Classification. 7. That the applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the proposed rezone is Justified. 8. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROYAL a) COUNTY PLANNING DEPARTMENT 1. The Zoning Administrator shall approve a specific exterior lighting plan for the approved area prior to installation of such lighting. (Such plan shall attempt to confine illumination to the area with full consideration to adjacent properties). 2. Approval by the Zoning Administrator of a specific lighting and signing plan for the described property prior to the release of any building permits. 3. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Spokane Countty Zoning Administrator shall be submitted with a performance bond for the project prior to release of building permits. 4. The appl i cant shal l devel op subj ect property general ly i n accordance within the concept presented to the Hearing Examiner Conmtittee. Yariations when approved by the Zoning Administrator will be permitted, including, but not limited to the following changes: 6uilding location, landscape plans, and general allowable uses of the permitted zone. A11 variations must conform to regulations set forth in the Spokane County Zoning Ordinance. The original intent of the development plans shall be maintained. 5. The specific development plan will be submitted for Planning Department review and approval prior to issuance of building penni ts . 7. A11 current standards of the Commercial Zone, as amended, shall be complied with in the development of this site. 2 ZONE RECLASSIFICATION NO.: IE-79-83 a) COUNTY PLANNING DEPARTMENT (continued) 8. A 6-foot sight-obscuring fence shall be provided along the east and south boundaries of this proposal to provide a buffer for the existing residential use located immediately east and south of this site. A comparable substitute to the fencing may be approved by the Zoning Administrator. 9. Applicant sha11 comply with `208' recommendations concerning stormwater runoff and provide necessary landscaping for runoff. 10. The applicant shall comply with RCW 58-17 and the Spokane County Platting Ordinances prior to issuance of building pern►its. 11. That the provisions of SEPA's NOTICE OF ACTION pursuant to Chapter 43.21C.080 RCW and the 6oard of Spokane County Commissioners Resolut7on #77-1392 be initiated by the project applicant within thirty (30) days of final disposition of this application, and prior to any on-site improvements, or file appropriate documents to the effect that the NOTICE OF ACTION is waived in accordance with Spokane County Commissioners' Resolution #82-0458 dated May 4, 1982. 12. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA Guidelines (WAC 197-10) and the Spokane County Environmental Ordinance (SCEO), a proposed declaration of non-significance has been issued at least fifteen (15) days prior to this date; the official file, written comments andlor public testimony contain information regarding assessment of the proposal's adverse impacts to the physical environment; a finding is hereby made that no potentially significant adverse impacts upon the physical environ ment are anticipated as a result of the project; and a final declaration of non-significance is hereby to be issued. 13. Compliance with Planning Department's Conditions Nos. 1, 29 39 8 and 9 above will be required when application is made for a building permit which proposes a 50% or greater change in the building(s) or site use. The 50% figure shall be based upon current assessed valuation of the property. 3 . . ZONE RECLASSIFICATION NO.: ZE-79-83 b) COUNTY ENGINEERING DEPARTMENT Prior To The Issuance Of A Building Permit 1. Access permits for new approaches to the County Road System shall be obtained from the Spokane County Engineer. 2. Access permits for new approaches to Pines Road SR 27 must be approved by the Washington Department of Transportation. 3. Applicant shall improve 8th Avenue in a manner consistent with Spokane County TYPICAL roadway section No. 1 minimum paving width Access Standard. 4. Applicant shall submit for approval by the Spokane County Engineer road, drainage, and access plans prior to the issuance of a building permit on the property. 5. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal pl an for the enti re project pri or to the i ssuance of ary buil di ng permi t on the property. 6. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer prior to the . issuance of a building permit on the property. The design, location, and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving • or surfacing as approved by the County Engineer, will be requ i red for any porti on of the proj ect whi ch i s to be occupi ed or traveled by vehicles. 7. The word "applicant" shall include the owner or owners of the property, his heirs, assigns, and successors. 8. The construction of the road improvements stated herein shall be • accomplished as approved by the Spokane County Engineer. 9. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construction, and other applicable County standards and/or adopted resolutions pertaining to Road Standards and Starmwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 4 ~ . , . . Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Coneni ssi oners' Resol uti on No. 80-1592 as amended. 11. The roadway and drainage improvement specified in the "Conditions of Approval" must be constructed by the applicant when application is made for a building permit which proposes a 50% or greater change in the building(s) or site use. The 50% figure shall be based upon current assessed valuation of the property. c) COUNTY UTILITIES DEPARTMENT 1. Pursuant to Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health Distric t and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2. The owner(s) or Successor(s) in interest agree to authorize the to place their name(s) on a petition for the formation of , ULID petition method pursuant to RCW 36.94 which the pe ' includes the Owner(s) property and further not to objec t by the signing of a protest petition against the . formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROYIDED, this condition shall not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94. . 3. Each new unit sha11 be double-plumbed for connection to future areawide collection systems. 5 . ZONE RECLASSIFICATION NO.: ZE-79-83 d) COUNTY HEALTH DISTRICT 1. Appropriate utility easements shall be indicated. 2. A combined surface water and sewage disposal detailed plan shall be approved by the County Engineer and the Health District prior to the i ssuance of any bui 1 di ng permi t for thi s project. 3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 4. Subject to specific application approval and issuance of permits bythe Health Officer, the use of an individual on-site sewage system may be authori zed. 5. Water service shall be coordinated through the Director of Utilities, Spokane County. 6. Water service sha11 be by an exi sti ng publ i c water supply when approved by the Regional Engineer tSpokaney, State Department of Social and Health Services. 7. Disposal of sewage effluent beneath paved surfaces is currently prohibited. 8. Upon the expansion, modification, addition of any existing structure wherein the value of the modification will exceed the total combined value by 50%, it shall then be required to provide a site drainage plan which will be approved prior to , release of a building permit. (No site drainage plan is necessary at this time.) e) COUNTY BUILDING AND SAFETY DEPARITIENT 1. The site is located in Fire District # 1. . 2. Insta1lation of fire hydrants wi11 be installed in accordance wi th the requi rements of the Spokane County Department of Building and Safety. f) WATER PURVEYOR 1. Water Purveyor is Modern Electric Water Company, and they will supply the site with adequate water for domestic, fire and irrigation uses. 6 . ZONE RECLASSIFICATION NO.: ZE-79-83 g) STATE DEPARTMENT OF TRANSPORTATIOId 1. Improvements to Pines Road (SR 27) will be made in the Summer of 1985 which will require acquisition of 8 feet of additional right of way. Building setbacks with the additional width considerations will be required. 2. Future raised channelization at 8th Avenue and Pines will restrict turning movements in and out of the development. h) COUNTY AIR POLLUTION CONTROL AUTHORITY 1. Air po]lution regulations require that dust created as a result of excavation and construction activities be controlled. hieasures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces during transport of earthen material, measures must be taken inanediately to clean these surfaces. 2. All traveled surfaces must be paved and kept clean.
