General Overview - The owner, Banner Fuel, is proposing to construct a new concrete block building on an existing paved lot plus four (4) refueling islands. There will be no on-site employees. Proposed building will contain an equipment storage area and customer restrooms (access only with "cards"). The refueling islands will serve cars and trucks. The two (2) fuel tanks will be 20,000 gallons each, will be directly buried and have double containment. The existing fencing will remain, although portions of it will be relocated. No exterior storage is proposed. Proiect Note: The proposed comes under the authority of the State Environmental Policy Act (SEPA) which requires a threshold determination to be issued by the Department of Buildings. To assist the department in making it's determination, an Environmental Checklist is required - 1 - 3 ti- ~ - - ta be subrnitted for circulatian to agencies of jurisdictioa. The department shall nat act upon the proposal until the fifteen day public cornment period has endei. A feee of $75.00 is required to initiate the environrnental review. II. Spokane County Air Pollution Control Authority (456-4727) - Kelle Vigeland A. Discussion Items 1. Comments were given to the Department of Buildings by Kelle Vigeland and presented at the conference by Tom Davis. A copy of these comments was given to the applicant. 2. Proposed must meet all air pollution regulations, including those dealing with dust emissions during construction and excavation projects. 3. Any processing or equipment which produces air emissions may require a Notice of Construction and application for approval. 4. All traveled surfaces are required to be paved. 5. WAC Chapter 713-491 requires all new gasoline facilities with a storage capacity greater than 10,000 gallons to install Stage I vapor recovery equipment. A Notice of Construction and Application for Approval must be submitted to SCAPCA for their review and approval. The applicant was advised to make reference to this document on the SEPA checklist. B. Permit Release Requirements 1. Please submit A Notice of Construction and Application for Approval for review and approval. III. Division of Engineering & Roads (456-3600) - Bob Turner A. Discussion Items 1. Comments were given to the applicant and the Department of Buildings by Bob Turner. He handed the applicant the site plans containing his written comments. 2. Please submit a drainage plan for the site that is in compliance with Spokane County Guidelines for Stormwater Management as listed under Item A of the handout and attached to the applicant's copy of these minutes. Please submit road and drainage pians prepared by an engineer for road improvements to Bzoadway and Howe. Both Broadway and Howe shall be improved to Typical Roadway Section No. 1, Collector Standard. Alt required sidewalk, curbing, and pavement construction shall be completed prior to permit issuance or a bond in an amount estimated by the County Engineer to cover the cost of construction shall be submitted. The applicant was advised to submit the road and drainage plans as soon as possible so that permit issuance would not be delayed. The road improvements will be required for the entire length of the parcel for which the building permit is being applied for. It was suggested to the applicant that he may wish to segregate the parcel and only build on one (1) of the parcels to minimize the required road improvements. Please contact Bert Haight for any alternatives the Division of Engineering may have to these requirements. The applicant stated that a Certificate of Exemption has been prepared to segregate the parcel, but has not yet been submitted. Francine Shaw of the Planning Department stated that she wasn't sure of that would be allowable, but would verify with the applicant who they had been working with. 4. Approach permits sha11 be obtained for new driveway approaches along Broadway and Howe. 5. Broadway is currently 60 feet wide and the County Arterial Road Plan identifies it as 100 feet wide, therefore, an additional 20 foot wide strip of right of way needs to be set aside for this future acquisition. No 208 swales or landscaping will be allowed to be located within this set aside area unless the owner pays for relocation at the time of acquisition. 6. An Agreement to Pay Fees was given to the applicant during the meeting. The agreement is to be signed by the owner and returned to the Division of Engineering & Roads. The water purveyor for the proposed is the City of Spokane. Please contact the water purveyor to review requirements for back flow preventers. 2. A permit for an on-site sewage disposal system has been applied for. The inspector from the Health District noted on the inspection log "pressure bed". Please contact the Health District in regards to this. If a pressure bed is required to be installed, engineered plans must be submitted. A minimum of ten (10) feet is required between the end of the drainfield and 208 swales. An iron ring lid to grade for both chambers will also be required to be installed. 3. Please identify on the revised site plans where the proposed future replacement location for the drainfield or pressure bed would be located if needed. 4. Proposed has been identified as a critical materials user. Since the proposed is located within the Aquifer Sensitive Overlay Zone no on-site disposal of waste water will be allowed on the site. The owner is required to sign a Sampling Agreement. The agreement allows the Health District to sample the effluent of the septic tank an an annual basis. All costs for sample retrieval and analysis shall be paid by the owner. A copy of this Sampling Agreement was given to the applicant. 5. The oil water separator, used to wash the island area, is required to drain into a 208 swale and not into a drywell. Please identify this on the revised site plans. 6. Please contact Valley Garbage Service for any requirements they may have. 7. Proposed may be required to install double plumbing. Also, the Health District in conjunction with the Utilities Department and the Division of Engineering will determine if double containment will be required for the proposed. 8. All construction debris shall be taken to a licensed landfill. B. Permit Release Requirements 1. Please submit the Sampling Agreement signed by the owner. 2. The Health District will continue with the processing of the on-site sewage di sposal system permit. V. Fire District No. 1(928-2462) - Clyde Wisenor A. Discussion Items l. Fire flow for the proposed has been calculated for 1,250 G.P.M.. -5- , - 2. One (1) fire hydrant is required tG be installed on the south side of the curb cut at the entrance to the proposed site off of Howe. The fire hydrant shall be in- stalled as per an approved water plan. Prior to the preparation of the water plan, the applicant shall contact the City of Spokane at 625-6000 as soon as possible to obtain the purveyor requirements including specifications. The water plan shall contain the location of the hydrant, hydrant assembly detail, and plumbing detail. The water plan shall be submitted to the Fire Distnct and water purveyor for approval pnor to installation. The fire hydrant shall be installed prior to occupancy. 2. Proposed will have a central monitoring system for spills and/or overflows. A lock (Knox) box entry system for fire department personnel access is required to be installed. Forms for ordering was given to the applicant. The completed forms are to be returned to the Fire District prior to release of the building permit. The box shall be installed prior to occupancy. B. Permit Release Requirements 1. The order form for the lock (Knox) box entry system shall be submitted to the Fire District prior to release of the building permit. VI. Department of Buildings (456-3675) - Bobby Stone and Ken Jeffrey A. Discussion Items 1. Plan review has been completed on the site plan only and a letter sent to the applicant by Bobby Stone. The items listed in the letter were discussed at the meeting. 2. The proposed building is being classified as a B-l, Type IIN construction for the canopy and Type IIIN construction for the building. 3. Please refer to the requirements of 79.903 F2 of Article 79 of Uniform Fire Code, Division 9, relating to unmanned vehicle fueling stations. 4. Roof drainage and engineering calculations for the canopy over the island are required. Please illustrate connection detail, snow loads, and size of footings/foundations. It was noted that more than one subcontractor is working on the proposed, although only one building permit is being issued for the proposed. 5. If construction specifications require concrete with a design strength over 2,500 p.s.i., high strength bolting, or- structural welding, special inspections will be required on the proposed. Please indicate the name of the testing laboratory and submit copies of the inspection reports to the Department of Buildings for review. 6. The proposed shall meet the minimum requirement of the Regulations for Barrier Free Facilities. Proposed should also comply with the provisions of the American Disabilities Act. The Department of buildings will not be requiring compliance with this act until it is adopted as part of the Washington State Barrier Free Regulations, which is not expected to occur until July, 1992. A) For any new hard surface area, for an asphaltic roof, or ~ a roof containing HVAC machinery, a drainage plan for the site shall be prepared in compliance with Spokane County "Guidelines for Stormwater Management". These must be prepared by an engineer. Plans must be prepared for the following - streets: a. Howe, Typical Raodway Section No. 1, Collector ' Standard. b. Broadway, Typical Roadway Section No. l, Collector Standard. NOTE: This applies for the full length of the parcel you making a permit application for. All required construction (sidewalk/curbing/pavement) within the Public Road Right of Way is to be completed prior to the release of a building permit or a financial guaranty in an amount estimated by the County Engineer to cover the cost of construction or improvements shall be filed with the County . East5g Our client is requesting to provide a 75' drive at Howe Street and a 50' drive at Broadway Avenue. The basis for this request stems from the owner's concern rGQ~nRd,~a~ for avoiding potential traffic problems at both driveways. Drawing from personal experience at other fueling stations of this kind now under his operation, the owner has witnessed problems with the large trucks using the opposite lane to 9ka~6 begin their turn into the site due to lack of space on the site as well as driveways sp . that are too small to accomodate these trucks large turning radius'. ash~~g~on This fueling station could potentially service truck and trailer combinations up to v~ seventy five feet in length on a regular basis. The primary entrance to the site is located at the Howe Street drive. We have made an effort to locate the facility on the site in such a way as to minimize the impact of both the area 99208 requirements for these trucks as well as the future Spokane County setback requirement. ~0~•4~~By providing a 75' drive at Howe street we can avoid the trucks having to pull into the southbound lane in order to make the required 180 degree turn. By providing a 50' drive at Broadway Avenue we can avoid the trucks pulling into the eastbound lane when exiting westbound. These turning radius requirements have been studied and we feel the proposed deviations are necessary in our attempt to avoid any potential traffic hazards in the interest of all involved. The Sponsor requested the County to purchase right-of-way and pay for aidewalks adjacent to his f, property. The County Engineer required the application of Board of County Commisaioners Resolution No. 80-1592 which requires improvement to County roads in conjunction with Building Permits. The Board received an appeal application from James Hayes and held a meeting on March 14, 1986 with the applicant and his representatives, including Attorney Paul Clausen. Notice of the date of such meeting was sent to the applicant. Having fully reviewed such matter and having individually acqusinted themselves with the vicinity and the site in question, the Board does reach a decision to deny the appeal and, in doing so, entera the following: FINDINGS OF FACT 1. That the October 8, 1985 DESIGN DEVIATION APPEAL of the eponeor was conaidered. 2. That Spokane County Resolution No. 80-1592 (County Road Standards) was conaidered by the Board. 3. That the sponeor's attorney, Mr. Paul Clausen, voluntarily, waived his client's right to appeal the Spokane County Engineer's denial of his I?esign Deviation to the Development Approach Board under Section 6.3 of Spokane County Resolution No. 80-1592, opting to go directly to the Board of County Commissioners under Section 6.7 of Spokane County Resolution No. 80-1592. 4. That the proposal is a mixed-use development on approximately 20 acres. Included are 11 buildings with a total proposed finiehed 370,000 square footage. The develop- ment will be accomplished in phases as building permits are obtained for portions of the property as shown on the applicant's site development plan. 5. That the proposal is located at the Northwest corner of Broadway Avenue and Fancher Road, which are principal arterials, on a site known locally as the "Old Carney Pole" property. The site is located in Section 14, Township 25 North, Range 43 E.W.M., ' Spokane County, Washington. . I Q~ •O s~ . v the agency or applicant will impliment. The Spokane County Environmental Ordinance in Section 11.10.160 specifically adopte the Spokane County Road Standards (Itesolution No. 80-1592) as a mitigating environmental policy. Additionally, in approving projecte, an approving agency has the ability to add conditions which relate to the protection of the public health, safety and welfare and are required as a result of concerna generat- ed by the project itself. The Board finds that the conditions of approval, including additional right-of-way and the construction of sidewalks, are not only permissable mitigating conditions authorized under the State Environmental Policy Act and neceasary se a result of the project itself or are conditions which could be imposed independent of SEPA under the geaeral ability of the Board and permit iasuing agencies to impose conditions in conjunction with permits necessary to protect the general health, safety and welfare. DECIS ION From the foregoing Findinga, the Board hereby DENIES the appeal in part and UPHOLDS the County Eagineer's denial of the Design Deviation in part as followe: 1. Dedication of sufficient right-of-way along Broadway Avenue and Fencher Road to provide a full five feet (5') f rom the existing curb lines to the revised prop- erty linea. Said right-of-way to be used for future Si-roa~ purposes. 2. The County in determining neceseary setbacks along Broadway and Fancher will include in such calculations the right-of-way-dedicated under thie provision as though it were owned by the applicant. 3.
