I. General Overview - Proposed is the construction of a sinqle
dentist office, with a possible future expansion to the north of the
buildinq.
SIIMMRY OF D$PARTMENTAL RgQtTIREMSWS s
I. Planning Department (456-2205)
A. Discussion/Requirements
1. The site is zoned Urban Residential-22 (UR-22) and is
subject to zone change, ZE-1-89.
2. Conditions of the zone chanqe, ZE-1-89, that are
applicable to the proposal are as follows:
a) Specify critical materials. (A critical
materials list will be supplied by Buildinq and
Safety)
b) Al1 siqnaqe shall conform to the standards of
the UR-22 zone. A separate permit will be required
for any new sfqnaqe.

c) Title Notices are to be filed as per condition
Numbers 7 and 10 of zone change, ZE-1-89.
d) No required landscaping, parkfng, 11208" areas,
or signs are permitted within the future acquisition
area.
(A copy of the conditions were to be given to the
applicant after the meeting).
3. Any future expansion may be limited, dependinq on the
parkinq amount available.
4. Landscaping along the westerly property line shall
have Type 1 landscaping.
5. Parking for the site is adequate.
8. Permit Release Requirements
1. A detailed landscape plan and an estimate from a
nursery along with a promissory letter from the owner
stating the landscapinq will be installed shall be
' submitted for review and approval.
II. Engineering Department (456-3600)
A. Discussion/Requirements
1. Comments were qiven to the applicant and Buflding and
Safety by Bob McCann.
2. A drainaqe plan prepared in compliance with Spokane
County "Guidelines for Stormwater Management" shall be
submitted.
3. The property is aubject to the Enqineer's conditions
of zone chanqe.. ZE-1-89.
4. Construction of sidewalks along Second Avenue shall
be completed.
B. Permit Release Requiremerits
1. A drainaqe plan shall be submitted for review and
approval.
2. Construction of sidewalks or a bond in an amount
extimated by the County Engineer to cover the cost of
construction or improvements shall be filed prior to the
release of the building periait.

3. Approach permits for Sullfvan Road and Second Avenue
shall be obtained prior to the release of the building
permit.
III. Health District (456-6040)
A. Dfscussion/Requirements
1. The proposed project will connect to t.he existing
sewer system.
2. All construction debris shall be disposed of into a
licensed landfill.
IV. Building and Safety (456-3675)
A. Dfscussion/Requirements
1. Plan review has been completed and a letter was given
to the applicant, which was discussed prior to the
meetinq.
B. Permit Release Requirements

1. Two complete revised sets of plans addressing the
items discussed prior to the meeting and other items from
the plan =eview letter needs to be submitted for review
and approval.

A. INTRODCICTION
This matter haviag come before the Zoni.ng Hearing Examiner Committec
on Apnl 6. 1989, and the members of the Committee present being Jobn
Skadan, Chairman, and Phillip D. Harris.
B. PROPOSAL
The sponsor. CHARLES BERG. is requesting approval of a zone
reclassification, File No. ZE-1-89, AGRICULTURAL to URBAN RESIDEN'I'IAL-22
(UR-22) Zone. for the purpose of developiag offices.
C. FINDINGS OF FACT
1. T6at the eaisting land use in the area is single family residential,
daycare, apartments, department store, grocery store, retail, sewer
trunk line (old railroad rig6t of way) and open area,
2. That the Coinpr+ebensive Pian designates this area as appropnate for
URBAN development.
3. That the eaisung zoning af the property described in the application is
Agricultural.
" 4. That the provisions of RCW 43.21C (The State Envirunmental Policy Act)
bave been coanplied with, and the Comauttee concurs with the
Determination of Non-Signiricance.
5. That the proper legal requirements for advertisement of the Agenda
Item bave been fulfilled.
6. That the land use in this area is saitable for the proposed use, or uses
within the proposed Zoae Classiflication.
7. That the applicant has dcmonsuated that conditions have substantially
changed since the ongwal zoning of this area and accordingly, the
proposed rezone is justified.
8. That the proposed use is oompatible with existing uses in the area.
9. That the ownors of adjaceat lands expressed neither approval nor
disapproval of the proposed use.
10 The Heanng Examiner Committee finds the progosed use to be in
harmony with the general Qurpose and will not be otherwise
detrimental to the public health. safety. and wclfare

11. The following are additional findings of fact coasidered by the Hesnag
Examiner Coramittce:
a The proposal is consistent with the Urban Category of the
Comprchensive Plan in that it proposes office usage adjacent to a
pnncipal arterial and adjacent to a Major Commercial Category.
b. The applicant has indicated the intent to reserve an area for future
nght of way acquisition to comply with the long range goals of the
Arterial Road Plan for Sullivan Road.
c. The proposed site plan generally. with the exception of needed
parking, indicates compliance with the various standards of the
Zoning Code. The landscaping requircments for this site need to be
scaled back so it does not exceed the maximum fifteen (15%) percent
landscaping area required by the Zoning Code. Measores will be
taken to ensurc that adeqnatc landscaping for bnffering pwposes is
not eliminated in those areas along the west pr9operty line and
around the proposed parking areas.

Standard:
1. The applicant shall develop subject property generalty in
accordance within ihe concept presented to the Heariag Bxaminer
Conimittee. Variations when approved by the Zoning Administrator
will be permittcd, including, but not Lmited to the following
changes: Building location, landscape plans. and general allowable
nses of the permitted zone. All variaUons must confotm to
regulations set fott6 in tha ZONIIVG CODE FOR SPOKANE COUNTY. The
original intent of the development plans shall be maintained.
2 All current standards of the Urbaa Residential-22 (UR-22) Zone, as
amended, shall be complied with in the devetopment of this site.
3. That the project is subjoct to Section 7.06. the Aquifer Sensitive Area
Ovcrlay Zone of the ZONDNG CODE FOR SPOKANE COUNTY. which sets
forth various measures for Aquifer protection; specifically,
measures dealing with wastewater disposal, spill protection
measures, aad stormwater runoff.

4. That the present proposal is oot detailed enough to determinc
whether or not the use of or materials stored on the site are in
compliance with Section 7.06 (Aqwfer Sensiuve Area Overlay Zone)
of the ZONING CODE FOR SFOKANE COUNTY. Accordtngly. as a
condition of approvai, the sponsor/applicant shall be required to file
with the Spokane County Auditor. within thirty (30) days of the
S1gT11Dg of Findings and Order of the fmal decision in tlus matter. a
"Notice to the Public" wbich shall provide in material as follows:

5. Applicant shall comply witb 708' recommendations concerning
stormwater runoff and provide necessary landscaping for runoff.
6. Any division of lend for the purpose of sale. lease or transfer, sball
comply witb RCW 58-17 aad the Spokane County Plauing Ordinaaces
prior to issuance of building permits.

7. That Spokane County Plammng Department be required to record
with the County Auditor a"Title Notice", as prepared and signed by
the applica►at, for a future acquisition area for road right of way and
utilities to run with the land and said future acquisition anea
reservation shall not be removed without prior approval by the
Spokane County Planning DepartmenL Said notice shall be recorded
prior to the issoance of a building permit and shall provide the
following:
a. At least twenty (20) feet of future acquisition area for road nght
of way snd utilities, in addiiion to the existing right of way, along
Sullivaa Road.
b That building and other setbacks required by the Spokane County
Zoning Code shall be measured from the fulure acquisition area
reserved for road rigbt of way and utilities.
c. That no reauirgd. landscaping, parking, '208' areas, drainfield or
allowed signs shall be within the future acquisition area for road
right of way and utitities. If any of the above improvements are
made within this area, they shall be relocaled at lhe applicant's
expense when roadway improvements are made.

8. That according to Secdon 14.806.080 of the Spokane County Zoning
Code. no more than 159b of the enure site shall be mquired to be
landscaped. Accordingly. the required landscaping may be reduced
to the maximum 159b t+equired ganerally as indicated on the site plan
revicwed by the Hcaring Esamincr Committee on April 6, 1989.
Provided the sito is developed as preliminarily designed (building
toward west proparty line and parkiag, access, and building
entrance to the east) thon landscapiag w i d t h along. fi rst. the north
property line and, second, the west property line may be reduced in
width (but not eliminated). Other ad~ustsnents may be made
admiaistratively •s necessary provided the intent of the standards
(especially buffering aad screening) are maintained.
9. The site ptan rcviewed by the Hearing Examiner Committee on Apnl
6, 1989. lacks adequate parking area for the use and building area
proposed. The proposal must comply with parking standards of
Chapter 14.882 of the Spokane County Zoning Cvde.
10. The Spoksne County Planaing Department shall prepare and record
wit6 the Spokane County Auditor a"Title Notice" notiag t6at the
property in question is subject to a variety of special conditions
imposed as a result of aQprovai of a land use action. This "Title
Notice" sball serve as off'icial public notice regarding conditions of
approval sffecting the property in qnestion. The "Title Notice" shall
be rccorded within fifteen (15) days of final dtsposition of the
approved laad uso action and shall only be extlnquished by the
Spokane County Planning DepartmeaL The "Title Notice" shall
