On October 4, 2016, City Council gave consensus for staff to release the RFP with changes as directed. On February 14, 2017, City Council received a report on the next steps for the RFP selection process. On March 7, 2017, City Council received a report on the initial rate, alternatives, and contract modification results. BACKGROUND: On November 17, 2014, the City entered into contracts for solid waste collection services with Waste Management of Washington, Inc. (WMW) and Sunshine Disposal, Inc. (SDI) to cancel their G -Certificates, extinguish any remaining rights to "measurable damages," and to allow the City to fully assume control of solid waste collection. These contracts maintain the prior services provided by WMW and SDI under their G - Certificates and terminate on March 31, 2018. With the termination date just under a year away, the City is in the process of procuring long- term solid waste collection services through a competitive process. This process will allow the City to seek competitive rates and possibly additional services from the selected provider or providers, while still maintaining conformity with the City's adopted Solid Waste Management Plan. At the March 7, 2017 meeting, staff presented the initial results from the RFP proposals. Preliminarily, one result was determined to be non-responsive, and so was not included in any further evaluation and is not one of the options for selection. For the remaining three options, staff presented the range of rates for each contract scenario, identified the range of rates for the alternatives, and explained that there were no contract modifications proposed that would impact rates. After discussing the range of rates, City Council gave consensus that no "best and final" round of submissions was necessary and to proceed with the "status quo" contract scenario that awards one exclusive contract for single-family residential, multifamily, and commercial collection services, and multiple non-exclusive contracts for drop box services. Further, City Council discussed several of the alternatives, focusing on (1) either of the two household clean- up options, (2) the special yard debris clean-up option, and/or (3) requiring universal carts. Ultimately, City Council determined to defer any decision on alternatives until the full proposals were presented for final City Council selection in order to weigh them to determine whether they are appropriate within the proposal that is ultimately selected. Page 1 1 Evaluation and Recommendation Pursuant to the RFP, staff has reviewed the proposals and prepared evaluations, scores, and a recommendation for City Council. Pursuant to the RFP, there are two parts to each evaluation and score: (1) Up to 75 points for rate scores, and (2) up to 25 points for qualitative scores. Rate Scoring The lowest overall residential, multifamily, and commercial rate revenue amount was given 75 points. The other proposals were then given scores lower than 75 that were proportional to the differences in overall rate revenue amounts. For example, if Hauler A had the lowest total rate revenue amount, it was awarded 75 points for rates. If Hauler B had rate revenue amounts that were 10% higher, it was awarded a score that was 10% lower (e.g., 7.5 points) than the maximum amount — for a rate score of 67.5. All rates submitted were competitive and represent a significant savings over the current rates. In addition to the savings represented by the rates submitted, there will no longer be a separate rental fee for solid waste carts, representing an additional savings of approximately $240, 000 annually. Qualitative Scoring For qualitative scoring, there are several criteria listed in the RFP, including but not limited to the ability of the hauler to provide the required service, the customer service, past history, and the hauler's ability to provide a seamless transition. Staff conducted interviews with each of the haulers and contacted several references for each hauler. Three staff members — Erik Lamb, Morgan Koudelka, and Henry Allen — conducted the qualitative scoring. The qualitative score shown represents the average from the scores of each of the members of the evaluation team. A copy of each of the proposals is available for City Council review in the City Clerk's office. All proposals submitted were very impressive and staff felt that all proposers are capable of providing the collection services at a high level. Page 1 2 Discussion of Evaluation: Waste Management of Washington, Inc. Rate Score: 75.0 ; Qualitative Score: 23.3 ; Total Score: 98.3 Waste Management of Washington, Inc. ("Waste Management") had the lowest proposal rate total of $12,051,951. Accordingly, they were given the maximum 75 points for rate scoring. In looking at the qualitative evaluation, staff identified several positive aspects for Waste Management and its proposal. Importantly, there will be no transition, as Waste Management is the current single family, multifamily, and commercial hauler. Waste Management has a strong history and reputation for positive customer service, as evidenced by their proposal and the City's customer survey. They are an innovator in providing solid waste service and have moved to compressed natural gas trucks, use a range of technology in delivering service, and provide extensive use of a variety of types of real-time dispatch -to -driver communications. While some aspects of Waste Management's customer service are conducted from locations outside of the Spokane Valley area, they have designated customer service representatives to handle all Pacific Northwest calls and their customer service representatives are all educated extensively on the particularities of the City's contract. Further, Waste Management has a local walk-in office to address any citizen needs and their local employees are extensively involved in local community events. Their local management and operational team all live and work locally as well and are available for quick response in the event the City or one of its citizens has an issue with service. Waste Management may draw from extensive regional and national resources if necessary, and it owns the regional Spokane Materials and Recycling Technology ("SMaRT") Processing Center. The City has had a positive working relationship with Waste Management in the current collection contract. As evidenced by Waste Management's proposal, it clearly understands the unique needs of Spokane Valley and its citizens. Waste Management also provided one additional recycling challenge event to encourage recycling. As part of that event, Waste Management intends to invest $5,000 ($2,500 for residential competition and $2,500 for commercial/multifamily competition) into a local amenity, such as a park. Sunshine Recyclers, Inc. Rate Score: 72.3 ; Qualitative Score: 21.0 ; Total Score: 93.3 Sunshine Recyclers, Inc. ("Sunshine") had the 3rd lowest proposal rate total of $12,493,809. Accordingly, they were given a score of 72.3 points for rate scoring. In looking at the qualitative scoring, staff identified several positives for Sunshine. They are headquartered locally, with ownership, management, and employees all living and working within Spokane Valley. Sunshine ownership, management, and employees are very involved with local community events. The City would have regular contact with ownership and upper management in managing the contract. Sunshine also provides a local call center with designated Spokane Valley customer service representatives. They also utilize local vendors for their operations. Choosing Sunshine would require a transition, and while Sunshine has not managed a transition of a similar size for some time, they do conduct a multitude of operations throughout the region, including providing service to several nearby smaller cities. Further, Sunshine operates the City's contracted transfer station. The City has had a positive working relationship with Sunshine in the current collection contract and the City's transfer, transport, and disposal contract. As evidenced by Sunshine's proposal, it clearly understands the unique needs of Spokane Valley and its citizens. Sunshine provided several additional services as part of its proposal. These included (1) curbside collection of used motor/cooking oil, (2) voucher for 300 pounds of free disposal at the Spokane Valley University Road Transfer Station during one month of the year, (3) one annual curbside pick-up of bulky/white goods, (4) a certain senior low income rate relief in the form of a 25 percent rate reduction for 20 gallon can service up to 1500 Page 1 3 customers, and (5) comprehensive office recycling for the new City Hall. These services are included within the rates provided by Sunshine and were valued by Sunshine at a total value of $177,760.50. Waste Connections of Washington, Inc. Rate Score: 74.6 ; Qualitative Score: 19.3 ; Total Score: 93.9 Waste Connections of Washington, Inc. ("Waste Connections") had the 2nd lowest proposal rate total of $12,114,123. Accordingly, they were given a score of 74.6 points for rate scoring. In looking at the qualitative scoring, staff identified several positives for Waste Connections. While Waste Connections is a large national company, they operate with a decentralized local hub model. Accordingly, local management, customer service, and other operations would all be based and operated from a local office and facility and the City's and its citizen's contact would be with local personnel. Waste Connections has been through a number of similar types of transitions and its transition team members have experience with transitions similar to what would be required if they were selected. Waste Connections provided a very detailed transition plan. According to the proposal, Waste Connections has demonstrated and provides the best safety rating in the industry and requires extensive safety training from its employees. Waste Connections is also customer oriented, with a "servant leadership" company culture. Waste Connections also provides extensive technological resources for customers, allowing customers a range of options to access accounts and contact Waste Connections. Waste Connections and its employees are very involved in local community events in their service areas. Alternatives At the March 7, 2017, meeting, City Council discussed four possible alternatives. The first three involve additional clean-up services that would increase the base residential rates a minimal amount. These options are the two household clean-up options and the special yard debris clean-up option. Either of the household clean-up options results in a small increase to garbage rates (range of $0.09 up to $.43 per month per garbage customer) so customers would still see savings over the current rates with this alterative. Additionally, the total annual cost does not significantly increase the overall contract cost. For comparison purposes, the alternative (range of $1.08 up to $5.16 ($0.09-$0.43x12 months) per year for one pick-up) is less expensive than for a customer to pay a single extra bulky item pick-up ($20.001) and is also less expensive than self -hauling the bulky item to the transfer station ($15.00 minimum per visit). Residential rates for the recommended hauler decrease $8.76 to $59.04 per year, with the most popular cart size (32 gal) seeing an annual reduction of $29.16. The special yard debris clean-up (One event per year that allows 192 gallons, equivalent of two additional 96 gallon carts, to be collected without additional charge) could be beneficial to consider depending upon which proposal is ultimately selected. Under the recommended Waste Management proposal, the compostable rate is $1.62 lower per month than the current rate so the $.23 monthly increase for the one-time clean-up would still result in overall savings over the current compostable rates. However, under the other proposals, the base rates for subscription yard debris service increased, not allowing the cost of this alternative to be offset by savings. The final alternative that City Council also discussed was universal carts. Under any of the proposals, this alternative would further lower base single-family residential rates in the range of $0.05 to $0.70 per month, though customers would be required to use a hauler -provided cart rather than their own can. Currently there are 3,497 customers that use their own can. There Rate indicated is for one chair, solely for example purposes. Page 1 4 are some contributing factors to the high number of customers using their own can. Currently the rate is $1.04 less expensive per month for a customer to use his own 32 gallon can versus using the hauler's cart. Additionally, there is a $1/month rental charge for using the hauler's cart. Under the new contract, if we use the recommended hauler of Waste Management, there is no difference in the rates for using the customer's can or the hauler's cart and there is no rental fee for the cart. Many of the customer complaints that occur arise from problems with customer cans being damaged or lost, lids not being put back on correctly, cans being blown away by the wind, etc. Using the truck lift for the carts is more efficient and safer for the drivers and eliminating customer cans, of varying quality, will likely reduce the number of complaints fielded by the hauler and the City. Implementing this alternative with the recommended hauler would result in an overall annual savings of $47,063. Of special note, Waste Connections proposed a savings of $.70 per customer per month for single family residential service if the universal cart alternative was selected. This reduction was significantly greater than the reduction offered by the other two haulers. If this reduction was factored into the total revenue calculation under the status quo option, Waste Connection's total would be lower than Waste Management's total. Because the totals are still very close to each other, Waste Connection's advantage in the rate scoring would be 1/2 of a point, not enough to overcome Waste Management's advantage in the qualitative scoring. Additionally, under the status -quo option, rates are not fixed for drop boxes and there is no guarantee how much of the service each hauler would have, as it is not exclusive. For the portion of the service that is exclusive, single-family, multi -family, and commercial cart and detachable containers, Waste Management's total is still lower than Waste Connection's total when factoring in the universal cart alternative. As part of its decision, City Council should consider the possible alternatives and discuss or include any that it believes are appropriate. Additional Information Submitted by Sunshine On March 21, 2017, during its interview with the City, Sunshine provided an additional submittal to the City. The submittal offered a disposal rate reduction to the City if the City awarded the exclusive residential, multifamily, and commercial contract to Sunshine. The disposal rate reduction offered was to reduce disposal rates at the Spokane Valley University Road Transfer Station by $3.00 per ton and to hold the minimum charge at $15 for the next 36 months. Sunshine identified the value of this offering as $209,000 annually. With regard to this offering, the RFP provided for all proposals to be submitted by February 6, 2017. This offering was not included in the proposal submitted by Sunshine on February 6, 2017, and accordingly, staff have not included or considered it in the evaluation of Sunshine's collection proposal above. Secondly, the RFP was to solicit solid waste collection service proposals, not joint -collection and disposal proposals. Further, even if this offer were included with the proposal, it would not result in a change to staff's recommendation for two reasons: first, the recommended Waste Management rate proposal would still be lower than Sunshine's rate proposal, even with the disposal fee reduction, and second, it creates a practical effect of having subscription service subsidize reductions in the disposal rate for self -haulers. With regard to the first issue, Waste Management's proposal rate total was $12,051,951 in annual revenues. Sunshine's initial proposal rate total was $12,493,809 in annual revenues. After incorporating Sunshine's offered disposal reduction (valued at $209,000 annually by Sunshine), Sunshine's proposal rate total would be $12,284,809 in annual revenues. This is still $232,858 annually higher than the recommended proposal. Over the course of the 10 years of the contract, this results in a net Page 1 5 savings to customers of $2,794,296 if Waste Management is selected. If Sunshine is selected, subscription customers see a loss of possible savings in order for self -haulers to see the $3.00 disposal fee reduction benefit, which could encourage more customers to self -haul and potentially create more nuisance issues. Accordingly, even if this offering were considered, staff would not change its recommendation from Waste Management for the exclusive single-family residential, multifamily, and commercial contract. City Council Selection Tonight, City Council will be making two primary decisions. First, it will make its decision and selection of a hauler for the exclusive contract for single-family residential, multifamily, and commercial collection services and any alternatives it desires to include with the contract, and secondly, it will make its decision for the hauler or haulers for the non-exclusive contracts for drop box services. OPTIONS: Two motions: (1) Motion to select a solid waste hauler to provide exclusive single family, multifamily, and commercial solid waste, recycling, and compostables collection services, to select any desired alternatives, and to authorize the City Manager to finalize a contract with the selected hauler for City Council approval; and (2) Motion to select one or more solid waste haulers to provide non-exclusive drop box solid waste collection services and to authorize the City Manager to finalize a contract with the hauler or haulers for City Council approval; or take other action as deemed necessary or appropriate. RECOMMENDED ACTION OR MOTION: First Motion: Move to select as the solid waste hauler to provide exclusive single family, multifamily, and commercial solid waste, recycling, and compostables collection services, [to include the alternative as part of the contract], and to authorize the City Manager to finalize a contract with the selected hauler for City Council approval. Second Motion: Move to select , and , as the solid waste hauler(s) to provide non-exclusive drop box solid waste collection services and to authorize the City Manager to finalize a contract with the selected hauler(s) for City Council approval. BUDGET/FINANCIAL IMPACTS: Unknown with regard to Solid Waste Collection Services, however, the City will likely incur little direct cost other than staff time to manage the contract as the selected solid waste provider will be paid by customers. City has contracted with Epicenter Services, LLC, to assist with the competitive procurement process. The contract provides for the City to pay Epicenter up to $47,500 for services. Costs for the consultant will be paid from the City's solid waste administrative fee. BACKGROUND: The Pavement Management Program identified the segment of Indiana Avenue between Mirabeau Parkway and Evergreen Road as a priority project. The drive lanes have numerous areas of wheel -path cracking and potholes are starting to appear. The center turn lane pavement is in good condition. The Indiana Avenue Street Preservation Project will grind and inlay the drive lanes; update pedestrian ramps in the Mirabeau Parkway intersection; update signals at the Mirabeau Parkway and Evergreen Road intersections; and install ITS conduit between the intersections on the north side behind the curb. The City will fund the reconstruction of the roads impacted by the project. City staff designed the road plans. Bid advertising started on Friday, March 31, 2017, and the project bids are scheduled to be opened on Friday, April 14, 2017. Council consideration for the award of this bid is currently scheduled for April 25, 2017.
