The County Engineering Department has completed a review of
the above referenced project. The following information must be
provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainage plan
for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
1. Drainage calculatians for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
thP 208 swale.
5. A typical cross section of the 208 swale.
6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
8. Copy of the proposed landscape plan.
B) The subiect property is affected by the "Findings and
Order" and the "Conditions of Approval" for the following
land use action:
Spokane County Zone Change No. ZE 35-94C
C) The following improvements within ad3acent Right of Way
are required prior to the release of a building permit:
1. Yflu must submit road and drainage plans for street
improvements. These must be prepared by an
engineer. Plans must be prepared for the following
streets:
a. Bolivar Rd
b. Sprague Ave
Al1 required construction (sidewalk/curbing/pavement) within
the Public Road Right of way is to be completed prior to the
release of a building permit or a financial guaranty in an amount
estimated by the County Engineer to cover the cost of
construction or improvements shall be filed with the County
Engineer. Requi•red plans are to be submitted prior ta estimating
the amount of the financial guaranty or permit release.
2. As an alternatine to the required road improvements

the County will accept an RID/CRP agreement
'rNotice to Public No. 6" on the property.
3. Applicant shall dedicate 5 feet for Right of Way on
Bolivar Road and a 20' radius on the northwest
corner of Bolivar and Sprague. The applicant shall
also set aside in reserve a 10' strip along Sprague
Avenue, all per the conditions of ZE 35-94C.
4. Please submit a copy of a recorded property deed
from the Auditors office for the subject property.
Upon receipt of the deed aur staff will prepare the
right of way deed and/or the RID/CR.P agreement.
5. Approach permits must be obtained, after a site
plan has been approved, and before the issuance of
a building permit, from the County Engineering
Department for any new or improved driveway
approaches to the following streets:
a. Bol ivar Rd
b. Sprague Ave
D) Insufficient information was submitted with the proposal.
We are unable to proceed with our review. We will need
the following before we can proceed:
.
1. Site Plan.
2. Drainage plan as specified.
3. Other information:
a. A pa=king and traffic circulation plan shall
be submitted and approved by the Spokane County Engineer. The
design, location and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving as
required by the County Planning Ordinance, will be required for
any portion of the project which is to be occupied or traveled by
vehicles. It is illegal to back out onto the Right of Way.
E) Utility Condition: Pernuttee is responsible for arranging
for all necessary utility adjustments or relocation as
required for completion of the i.mprovement.
F) The owner of the property or the authorized
representative must complete and sign Spokane County
Engineers "Agreement to Pay Fees". This document must be
returned to the County Engineers Office. Plan review will
not be completed until this document is executed. This
document is attached to these comments. Please return
the completed Agreement to your contact person at the
Enqineers Department.
The applicant or their representative is responsible for
including each item that is marked "Required By This Project" in
their submittal in accordance with the checklist descriptions.
Each item subnutted that is to meet the checklist shall be
checked off by the applicant or their representative. Submittals
which do not conform to the above requirements will be returned
for further items with no review being accomplished. This will
prolong the review process. If changes occur in the xequirements
for the project because of further conversations with Spokane

County representatives, please attach a note explaining the
agrEed upon change in requirements. When the applicants'
submittal is finally approved, the Engineers department will
release their portion of the Building Perm.it.

the bottom of the swales.
2. Call out 5.5' sidewalk construction on Sprague and Bolivar.
3. Relocate the landscaping on Sprague out of the exiating R/W.
4. Five feet of R/W must be dedicated on Bolivar. The Contractor
is currently pursuing this.
5. A$2500.00 performance bond must be poated for the sidewalk
and agproach construction. The Contractor is also pursuing this
item.
Please correct the site and landscape plane, and re-submit 6
copies of each to the Building Department. Your contact at the
County Engineers Department is Doug Busko, 456-3600.

1. Reimburse Spokane County for project review and inspection fees as specified in Chapter
9.14 of the Spokane County Code. The fees will be based on actual salary costs incurred
by Spokane County for project reviewa and / or inspections plus a ten percent
administrative charge, and will be bilied moathly as accrued Any billing amouats due,
incfuding any expenses irncurred in liie colle.ction of an overdue account, must be paid
prior to the County's acceptance of the project for filing If a proJect ia approved and/or

FINDINGS OF FACT, CONCLUSIONS AND ORDER
INTRODUCTION
This matter has come before the Hearing Fxaminer Commiuee on August 22,1994,
continued fr4m the August 18,1994 Hearing Examiner Commiaee. The membdrs
of the Committee present are: Hany Gibbons, Chair, Marshall Tamsick (absent)
and Frank Yuse.
PROPOSAL
The sponsor, Gail Mornow, requests approval of a Zone Reclassification, ZE-35-94,
from Urban Residential-3.5 (UR-3.5) to Regional Business (B-3) for retail sales and
those uses allowed in the proposed Regional Bnsiness (8-3) zone.
FINDINGS OF FACT AND CONCLUSIONS
i, IMe pmperty is generally located at the northwest vomer of the intersecrion of
Sprague Avenue and Bolivar Road in the SW 1/4 of Section 14, Township 25
North, Range 44 EWM, Spokaae County, Washington.
2. The Committee adopis the Planning Department Report as a part of this reconi.
3. The existing land uses in the area ulclade commercial and residential uses.
4. The proposed use is compatible with existing uses in the area.
5. The Comprehensive Plan designates this site as Major Commencial. The Major
Commercial caiegory is intended to provide the opportunity for development of
conamercial uses direcdy related to major throughways. Highway and arterial strip
conamercial aneas will usually be made up of busiaesses or individual parcels
clustiered along a heavily traveled smeet or highway, eacb providing off-smet
parking. Sbopping is not done by walking Som one stior+e to aaother, but mther is
single purpose in natme. The proposed zone reclassifiicatioa from Urban
Residentiai-3.5 (UR 3.5) to Regional Business (B-3) is consistent with and
irnplements the Goals, Objectives and Dacision Guideliaes of the Major
Commercial category of the Coinprehensive Plan.
6. The proposed zoniag does implement and cvnform oo the Comprehensive Plan.
7. The Artnal Road Plan designates Spregne Avenue as a Priacipal Arocrial, with a
recommended right of way width of 130 fe,et. In order to unplement the Arerial
Road Plan, the County Engineer has requested dedicadon of a 10 foot wide strip of
land alang Sprague Avenue be set aside as a future acquisidon area.
8. The existing zoning of the property descnbed ia the apphcation is Urban
Residential-3.5 (UR 3.5) previously established as Agricultiuil Suburban (AS)
zoning in 1958 and redesignated to Urban Residential-3.5 (UR-3.5) on January 1,

1991 pursuaat to the Prograzn to Implement the Spokane County Zoning Code.
The proposal does conform to the requiretnents of the proposed Regional Business
(B-3) zone.
9. The provisions of RCW 43.21C (The State Enviranmental Folicy Act) haae been
camphed with and a Deternaination of Nonsignificance (DNS) was issued. The
Cornmittee, after independent r+eview, hereby adopts the DNS.
10. The legal requirements for public nodve have been fulfilled.
11. The owners of adjacxnt lands expressed neither appmval nor disapproval of the
proposed use.
12. The apphcaat has demonsaated that conditions have substantiay cbanged since the
original zoaing of dis area and accordingly, the proposed zone reclassification is
justified. Specif'ically, changed conditions include the eadsting mix of oomrnercial
uses along Sprague Avenue.
13. The proposed use will not be detrrimental to the public health, safety, morals or
welfare especially in light of the conditions recommended by the reviewing
agencies.
CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1. All Conditions imposed by the Hearing Examiner Conanruuee shall be binding on
the "Applicant," which term shall iaclude the owner or owners of the property,
heirs, assigns, and successors-in-interest.
2. The following Condidons of Appmval apply to the real property described below:
Lot 7 of the Plat of Zeiglees Subd.ivision, as recorded in Plat Book 2, Page 8, Recor+ds
of Spokane County, Washington.
SPOKANE COUNTY PLANNING DEPARTMENT
1. The propasal shall comply with the Regional Business (B-3) zone and the Aquifer
Sensitive Area (ASA) overlay zone, as amended. Modificatians to the site plan at
building permit stage appear Lo be necessary to comply with all Regional Busmess
(B-3) development standands.
2. The applicant shall develop subject property generally in accondance within the
concept presented to the Hearing Body. Variations, when appmved by the
Planning Dmctar/designee, may be permitted, inclnding, but not limitei to building
locarion, landscape plans aad general allowable uses of the percnitted zone. All
variaaons must conform to regulations set forth in the Sgokane Counry Zoning
Code, and the onginal intent of the develapment plans shall be maintaiaed
3. Approval is required by the Planning Director/designee of a specific lightinng and
signing plan for the described property prior to the release of any builchng permits.
4. A specific Iandscape plan, planting sochedule and provisions for maintenance
acceptable to the Planmng Diroctor/designee shall be submitted with a perforniance

bond for the project prior to release of building permts. Landscaping shall be
iastalled and maintained so that sight distanoe at acoess points is not obscured ar
imPaired.
5. Direct light ft+onn any exte,rior area lighting fixture shall aot extnd over the propezty
boundary.
6. The Spokane Couaty Plsnning Department shall prepare and revoord with the
County Auditior a Tide Notioe specifying a futune laad acquisition area for rQad
right-of-way and utilities. The resenred fatm aoqoWtion anea Title Notioe shall be
relea.sed, in full ar in part, bY the Planning Department The notioe should be
reooided witlrin the same time frame as an appeal and shall provide the following.
a. At least 10 feet of r+eseaved future acquisition area for road right-of•way and
u''ties, in addition m the existing andlor aewly dedicated right-of-way aloug
Sprague Avenue.
b. FuUme building and other setbacks roqnired by the Spokene Couaty Zoning
Code shall be mea,sured from the reserv+ed futmme acquisition area.
c. No required landscaping, parking, '208' areas, drainfield oF allowed signs
should be located withia the future acqvisition area for road right-of-way aad
utilities. If any of the above improvenaents are made within tbis area, they
shall be relocated at the applicant's expense when roadway improvements are
made.
d. The fumre acx~uisition area, until acquir+od, shall be private pmoperty aad may
be usel as aUowed in the zone,, except that any unprovements (such as
landscaping, parking, snrface drainage, drainfield, signs or others) sball be
oonsidered interim uses.
e. The property awner shall be responsible far relocating such "interiaa"
impruvements at the time Spokane Couaty makes roa,dway improvements
after aoquiring said future aoquisition area.
7. The Planning Department shall prepare and reoord with the Spokane County
Auditior a T'itle Notioe aoting that the prapercy in question is subject to a variety of
special conditions imposed as a result of approval of a land use action. This T'ide
Notioe shall seive as public notice of the aondidons of appraval affearng the
property in question. The T`itle Notice slwuld be rec.onded within the san~ time
frame as allowed far aa appeal and shall only be released, in fnll or in part, by the
Planning Departmcnt. The T"ide Notice shall genemlly provide as follows:

Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in accordance with staadard traffic engineermg practices. Paving or
surfacing as approved by the County Engtneer, will be requu-ed for any portion of
the projoct which is ta be occupied or tiaveled by vehicles.
7. The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engincer.
8. The County Engineer has desigaated Typical Roadway Secdon Number One, local
acve,ss standand for the improveaaent of Bolivar Road, which is adjacent to the
praposed developmenL Sidewalk must also be constructed.
9. All required impruvements shall confozm to the current State of Washington
Standard Specifications far Road and Bridge Construction and other applicable
Cowaty standards and/or adopted resoludons penaining to Road Standards and
Stonnwater Managenient in effect at the dau of construction, unle,ss othervvise
approved by the County Engineer.
10. Applicant shall oonstruct a paved and delineated appruach(es) to meet the exisdng
pavement on Sprague Avenue.

11. Roadway standar+ds, typical roadway sections and drainage plan requirements are
found ui Spokane Board of County Commissioners Resolution No. 80-1592 as

12. No construction work shall be perfarrm,ed within the existing or praposed public
right-of-way until a pernut has been issued by the County Engineer. All work
vathin the public road right-of-way is subject to inspection and approval by the
County Engineer.
13. All required construction within the existing or proposed pubhc right-of-way is tD
be completed prior to the release of a build.iag permit, or a bond in aa amount
estimated by the County Engiaeer to cover dle oost of constructioa of improvements
shall be filed with the County Engineer.
14. The Connty Arterial Road Plaa idcntifies Spragne Avenue as a Priacipal arterial.
The existing aght-of-way widdi of 110 feet is not consistent with that specified in
the Plan. In omderr to implement the Arterial Road Plan, a strip of gmperty 10 feet in
width along the Sprague Avenue frontag+e shall be set aside in reserve. This
groperty may be acquired by Spokane County at the time when arteTi,al
improvements are made to Sprague Avenue.
15. There may exrist ualities, either underground or overhead, affecting the subje+ct
pmperty, including pmperty to be dedicated or set aside for futune acquisitioa.
Spokane County assumes no financial obligation for adjustments or relocation
regarding these utilides. Applicant(s) should check with the applicable utility
purveyor and the Spokane County Engineer to dem-rmine whether applicant(s) or
the ntiiity is responsible for a,d.justment or relocation costs and to make
anmgements for any necessary work.
SPOKANE COUNTY DIVISION OF UTILITIES
1. Any water service for this project shall be provided in accordance with the
Coondinated Water System Plan for Spokane County, as amended
2. Applicant will make conaection to Public Sewer System. Sewer Connection Pemait
is required.
3. Applicant is required to anange for payment of possible additional general facilities
charges based on new usage.
SPOKANE COUNTY HEALTH DISTRICT
1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
Couaty.
2. Water Service shall be coordinated through the Director of Utilities, Spokane Caunty.
3. Water service shall be by an exisdng public water supply when approved by the
Regional Engineer (Spokane), State Departmeat of Health.

4. A public sewer system will be made available for the project and mdividual senrice will
be provided to each loL Use of individual on-site sewage disposal systems shall not be
audiorized.
5. Use of private wells and water systems is prohibited.
SPOKANE COUNTY DIVISION OF BUII.DINGS
1. The applicant shall coatact the Division of Buuldings at the earliest possible stage in
order m be inforaied of code raquirements a,dministered/enforoed as aRthorized by the
State Bnildings Code Act. Design/development concems iaclude: fire apparatus acoess
roads; fire hydrant/flow; approved water systems; building accesubility; oonstruction
type; occupancy classification; exiting, extmior wall protecdon; and energy c.ode
regulations.
SPOKA.NE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. All air polludon regulations must be met. This includes but is not limited to the
following.
2. Air polludon regalations rcquire that dust emissions during demohtion, construction
and excavation projects be controlled. This may require use of water sprays, taips,
sprinklers or suspension of acdvity during certain weather conditions. Haul roads
should be treated, and earissions from the aansfer of earthen matenal must bc
cantrolled, as well as emissions from all other construction-related activiaes.
3. SCAPCA strongly recoinmends that all traveled surfaces (i.e., ingress, egress, parking
areas, access roads) be paved and kept clean to minumize dnst emissions.
4. Measures must be taken to avoid the deposiaan of dut and mud from unpaved surfaces
onto paved sznfaces. If traclQng or spills occur on paved surfaces, measures must be
taken immed.iately to clean these surfaces.
5. Debris generated as a result of this project must disposed of by means other than
buniing (i.e., coastruction waste, etc.)

The proposed zone reclassification from Urban Residendal-3.5 (UR-3.5) to
Regional Bnsiaess (B-3) is consistent with and implem+ents the Goals,
objectives and Decision Guidelines af the Major Cornmerciai category of the
Comprehensive Plan.
2. Arterial Road Plaa: The site is adjacent to both Sprague Avenue and
Bolivar Road. The Spokane County Aroerial Road Plan identifies Sprague
Avenue as a Principal Arterial with an enistiag widdi of 110 feet aad a
future width of 130 feeL In order to implement the Plan, the County
Engineer has reques~ed that a strip of property 10 feet in width along
Sprague Avenue be set aside as a future aoquisition area far road
impr+~vement purposes. A 35 foot strucnu+e setbadc from the fvttire
acquisidon area is ~+eoommendeed by the Comprehensive Plan. Bolivar Road
is identified as a Local Access Street and will requue the dedication of 5 feet
of additional right-of-way.
C. Site Chsracteristics: The site is uadeveloped, flat and covered with native
vegetation.
D. Neighborhood Characteristics: There is typical cammercial strip
developmeat along Sprague Avenue including a wide varieiy of re;ail and office
uses. Immediatiely east, and north of the site, are residential lots.

Praposal: Urban Residential-3.5 (UR-3.5) established in 1991.
North: Urban Residential-3.5 (UR-3.5) established in 1991, previously
classified as Agricultural Suburban (AS) (ZE-166-58).
South: Regional Business (8-3) established in 1986 (ZE-15-86).
East Urban Residendal-3.5 (UR-3.5) established in 1991, previously
classified as Agricultural Suburban (AS) (ZE-166-58) and
Regional Business (B-3) established in 1991, previously classified
as Oommercial (C) (ZE 9-80).

standard Conditions of Approval, the Genmilized Qomprehensive Plan, and other
Co►nnty policies and guidelines. The Planni.ng Deparanent has deteenmin+od dat "No
probable significant adverse impacts" would result from the pmpasal being developed
