INTRODUCTION This matter having come before the Examiner Committee on September 4, 1980, and the members of the Committee present being Jane Myers, Chairperson, Eldon Thomas and Kenneth Kennedy . B. PROPOSAL The sponsor, Curt Schimanski is requesting approvai of a change of conditions File No. ZE-9-80 for clarificatjon and possible removal of Local Business sign regulations placed on the site. C. FINDINGS OF FACT 1. That the existing land use in the area is residential, commercial, and un- developed. 2. That the Comprehensive Plan designates this area as appropriate for res- idential devetopment. 3. That the existing zoning of the property described in the application js Commercial. 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with. 5. That the proper legal requirements for advertisement of the Agenda Item have been fulfilled. 6. That the land in this area is suitable for the proposed use, or uses within the proposed Zone Classification. 7. That the applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the pro- posed request for a change from the orginial conditions attached to the rezoning approval, is justified. 8. That the proposed use is compatibie with existing uses in the area. 9. That the owners of adjacent lands expressed neither approval nor dis- approval of the proposed use. 10. That any signs which would be erected on the project would comply with the standards of the Local Business ione. a) COUNTY FIRE MARSHAL 1. The site is located in Fire District #1. 2. Adequate water for fire protection and distribution of such water shall be required for this project. A water plan is required to be submitted for approval prior to any land devetopment. b) COUNTY ENGINEER 1. Applicant shall dedicate 5 feet on Bannen Road and a 20 foot radius on Bannen Road and Sprague Avenue for right-of-way. 2. Applicant shall construct cement concrete sidewalk on Sprague Avenue. 3. Applicant shalt construct cement concrete curb, sidewalk and pave to existing pavement on Bannen Road. 4. A detailed combined on-site sewage system and surface water disposal plan for the entire project shall be approved by the Spokane County Engineer and the Spokane County Health District prior to the issuance of any building permit. 5. The design, location and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. (Any portion of the project which is to be) occupied or traveled by vehicles shall be maintained in hard surface paving. c) WATER PURVEYOR 1. Purveyor is Vera Water and Power Company and they are able to supply the site with adequate water for domestic fire and irrigation uses up to 2000 gpm from Sprague. d) COUNTY HEALTH DISTRICT 1. Water service shall be from Vera Water District only. 2. A combined sewage and surface water disposal plan shall be approved by the Spokane County Engineer and the Spokane County Health District prior to issuance of any building permits. 3. Sanitary plumbing shall be installed to facilitate connection to an area-wide sewerage system. 4. The owner, his heirs and assigns shall agree to participate in and not protect assessments for any local improvement district far sewering to serve this property. 5. Connection to area-wide sewer collection system shall be made when the system becomes available. 2 . • , , 'ile No. ZE-9-80 e) SEPA 1. That the provisions of SEPA's Notice of Action pursuant to 43.21C.080 RCW be initiated by the applicant within thirty (30) days of final action of the Responsible Administrative Body and be completed before any site improvements are made. 2. The request has proven to be environmentally non-significant. There- fore, a final declaration of non-significance shall be signed by the Chairman of the Hearing Examiner Committee. f) ZONING 1. Approval by the Zoning Administrator of a specific lighting and signing plan for the described property prior to the release of any building permits. 2. A specific landscape plan, planting schedule and provisions for maintenance acceptaple to the Spokane County Zaning Administrator shall be submitted with a performance bond for the project prior to release of building permits. 3. The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Examiner Committee. Minor variations when approved by the Zoning Administrator will be permitted, including, but not limited to the following changes: Building Iocation, landscape plans, and general allowable uses of the permitted aone. All variations must conform to regulations set forth in the Spokane County Zoning Ordinance. The original intent of the development plans shatl be maintained. 4. Direct Ilght from any exterior area lighting fixture shall not extend over the property boundary. g) That the Hearing Examiner Committee after hearing all testimony and a review of the staff analysis adopts the proposed declaration of non-signifi- cance and directs the chairman of the committee to sign the final declaration of non-significance.
