As per our phone call concerning the aaovc referenced project, I
have reviewed my original drainage ca2culation5 and have revised
them as -fol lows: Evergreen Road has been removed due to fihe client's
agreement tcs participate fn an R.I.D..
Only the short plat area is being cor►sidered foT drainage.
have propased the attached drainage design.
I have completed my analysis of the on-site and have these
commentss
The 1.26 acre parcel before condition is dryland grasses in
pasture land with a Runoff Cvefficient of 0.30.
The afLer project condition is proposed for 3.1 DU/GA or a
Runoff Coefificient of 0.30.
With both runofi-f coefficients being equal, no increase in
runof f i s ex pec ted f rom the proposed proj ec t
and no drainage facilities will be required.

12. Recognizing the recarrmended conditions and 5pokane County development standards,
the proposed short subdivision makes appropriate pravisions for the public health,
safcty and general welfare and that the public use and interest will be served by platting
the subdivisiDn.
The subdivision pzoposal is genexally consistent with RCW 58.17 and t~~ County
subdivision regulations, pTornating the-pubZic healCh, safety and general welfa-re in

accordance with standards established by the state and Spokane County. The Planning
Department has considered the provision of public facilities as cited in RCW 58.17.114
(2). More specifically:
a. open spaces
b . drainage ways
c. public and/or private rights-of-way
d. transit
e. potable water .
f. sani.tary waste disposal
g. parks and recrearion facilities
h . playgrounds
i. schools and schoolgrounds j sidewalks _
The above improvements are either existing faciliues and services or will be provided
by the applicant upon finalization of this short subdivision as conditioned by the
Planning Department and implemented by the various County agencies.
13. The Spokane County Arterial Road Plan idenrifies Evergreen Road as a Principal
Arterial with an existing width of 60 feet. The County Engineer has requested
dedicarion of an addirional4 feet of right-of -way on Evergreen Road. In addition to
the requested dedication, the County Engineer has required a strip of property 16 feet in
width along Evergreen Road to be set aside as a future acquisition area for road
improvement purposes.
14. The proposed short plat will be served by a public water system. Waste water disposal
will be as authorized by the Drrector of Utiliries.
15. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-842-93 is hereby APPROVED until June 1, 1996, subject to conditions noted
below. Most of the conditions of appzoval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal proced.ures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assign.s or any successors-in-interest to property.
PLAIVNING DEPARTMENT CQNDITIONS
1. The proposal shall comply with the Urban'Residential-3.5 (UR-3.5) zone as amended.
2. The final plat shall be designed substantially in conformance with the preliminary plat
of record. No increase of density or number of lots shall occur without a change of
condition application submittal and approval. 3. T'he Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
4. Appropriate road name(s) shall be indicated.
5. The preliminary plat is given conditional approval for three (3) years, specif~ically to
June 1, 1996. The applicant may request an extension of time by submitting a written
request approximately forty-five (45) days prior to the above expiration date.
6. Appropriate utility easements shall be indi.cated on copies of the proposed final plat. Written approval of utility easements by appropriate utiLity companies shall be received
with the submittal of the final plat.

7. Three (3) current cemfxcates of title shall be furnished to the Planning Deparnnent prior
to filing the final plat.
8. The Owner shall negotiate with the Central Valley School District and submit a recorded
copy of the agreement making provisions for public schools prior to finalization and
recording of this short plat. The agreement shall provide a written description of the
subject property to which the agreement applies and also state the dollar amount and
any other agreed to mitigating measure(s).
The Owner shall also notify any potential purchasers who have made an agreement to
purchase property within said short plat pursuant to the Revised Code of Washington
(58.17.205), that adequate provisions for school facilities rnust be made conditioned on
a future agreement between the plattor and school district.
Voluntary agreements between the Owner and School District shall conform to the
Revised Code of Washington Chapter 82.02. ~
9. The Spokane County Planning Department shall prepare and record with the County
Auditor a Title Notice specifying a future land acquisition area for road right-of-way
and utilities. The reserved future acquisition area Title Notice shal.l be released, in full
or in part, by the Planning Deparnnent. The notice should be recorded within the same
time frame as an appeal and shall provide the followi.ng:
a. At least 16 feet of reserved future acquisition area for road right-of-way and
urilities, in addition to the existing and/or newly dedicated right-of-way along
Evergreen Road. NOTE: The County Engineer has required 4 feet of new
dedication.
b. Future building and other setbacks required by the Spokane County Zoning Code
shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allo,wed signs should
be located within the future acquisition area for road right-of-way and utiliti.es. If
any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made.
d. The future acquisition area, unril acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as landscaping,
parlang, surface drainage, drainfield, signs or others) shall be considered interim
uses.
e. The property owner shall be responsible for relocaring such "interim"
improvements at the time Spokane County makes roadway improvements after
acquiring said future acquisition area.
10. The final plat map shall indicate by a clear, dashed line the required yaXd setbacks from
al.l private, "Tract X" or public roads. The dedicarion shall contain the followi.ng
statement:
"Side yard and rear yard setbacks shall be deternuned at the time building permits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
11. No water plan is required, and a simple tap is needed at the time of building permit
release.
12. A survey is required prior to the filing of a final plat.
COUNTY ENGINEER'S DEPAIaTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedicarion of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
2. Drainage plans and design calcularions showing the alignment of drainage facilities
shall be submitted to the County Engineer for approval pnor to consmuction and/or the
filing of the final plat. Drainage plans to be prepared under the direction of a licensed
Professional Civil Engineer.

3. No construction work is to be performed within the existing or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
4. Individual driveway access permits are required prior to issuance of a building pernut
for driveway approaches to the county road system.
5. Dedication of 4 feet of additional right-of-way along Evergreen Road is required.
6. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
7. Sidewalks are required along the arterial(s) on Evergreen Road.
8. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
9. To construct the road improvements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any petirion or resolurion
which purpose is the formation of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an R.ID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Evergreen Road.
10. As an alternarive method of constructing the road unprovements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
i.mprovements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required road improvements. At such tune as an R.ID is
created or any Road Improvement Project is sancrioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to e}cisting
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Evergreen Road
11. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a perition for the formation of a Road Improvement District (RID) by the
petirion method pursuant to Chapter 36.88 RCW, which petition includes the owner(s)'
property, and further not to object, by the signing of a ballot, to the formation of an
RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution
includes the owner(s)' property. If an RID is formed by either the petition or resolution
method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further
agree:
(a) that the improvement(s) or construction contemplated within the proposed RID is
feasible; .
(b) that the benefits to be derived from the fonnation of the RID by the property
included therein, together with the amount of any County participation, exceed the
cost and expense of formation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as authorized
under RCW 36.88.090, to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the formation of an RID by eithez petition
or resolurion method under Chapter 36.88 RCW, and to appeal to the Superior Court
the decision of the Board of County Commissioners affirming the final assessment roll.
It is further agreed that at such time as an RID is created or any Road Improvement
Project is sanctioned by Spokane County, the improvements required (curb, sidewalk,
drainage control and paving) will be at the sole expense of the undersigned ownez(s),
their heirs, grantees and assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the
date of execution below. However, the owner(s) or successor(s) agree that if said RID

DECISION
TI3IS MATTER, an application for subdivision of land, from Frank Reynolds has been
received. and decided upon, pursuant to Spokane County Subdivision regulations, on the
day of May,,1993. .
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planni.ng.
2. The proposal is to divide approximately 1.26 acres into 41ots for single family
residences and those uses pernutted in the underlying zone.

. The proposal is generally located east of and adjacent to Evergreen Road approximately
128 feet south of Eighth Avenue in the southwest 1/4 of Section 23, Township 25
North, Range 44 E.W.M., Spokane County, Washington.
4. The existing zoning of the property described in the application is Urban Residential-3.5
(UR-3.5), previously established as Agricultural (A) zoning and reclassified to Urban
Residenrial-3.5 (UR-3.5) on January 1, 1991 consistent with the Program to Implement
the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does
conform to the requirements of the existing Urban Residential-3.5 (UR-3.5) zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The _
development and uses proposed are generally in accord with this category.
6. Surrounding uses are primarily single fa.mily residential. .
7. The required public notice was provided for this proposal and agencies having a -
potential interest in the project were notified and recommendations solicited.
8. The Central Valley School District No. 356 has commented on the proposed short plat.
The District has indicated that existing school facilities are inadequate to serve the
- proposed short plat and has requested negotiarion with the owner to provide adequate
capital facilities as required by the Revised Code of Washington (RCW) 58.17.110.
The Planning Department must assume that the agency of jurisdiction, in this case the -
Central Valley School District, has made a reasonable request. Approval of this short
plat should include conditions requiring that provisions for adequate facil7ties be in
place prior to record.ing this final plat in the form of a written agreement between the
owner and the school district.
9. No written comments were received from adjoining property owners.
10. The proposal is within the Public Transit Benefit Area (PTBA). Spokane Transit Route
#22 provides downtown and connecting service. The nearest Spokane Transit park and
ride facility is the Pence-Cole Park and Ride located at Eighth Avenue and University
Road. 11. The Spokane County Parks and Recreation Plan indicates that Terrace View Park/Pool
is located approximately 1.5 miles southwest of the proposal. Terrace View Park/Pool
is designated as a Neighborhood Park.
12. Recognizing the recommended conditions and Spokane County development standards,
the proposed short subdivision makes appropriate provisions for the public health,,
safety and general welfare and that the public use and interest w11 be served by plattrng
the subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoting the public hea.lth, safety and general welfare in

accordance with standards established by the state and Spokane Counry. The Planning
Department has considered the provision of public facilities as cited in RCW 58.17.110
(2). More specifically:
a. open spaces
b. drainage ways
c. public and/or private rights-of-way
d. transit
e. potable water
f. sanitary waste disposal
g. paxks and recreation facilities
h. playgrounds
i . schools and schoolgrounds
j . sidewalks The above improvernents are either existing facilities and services or will be provided
by the applicant upon finalization of this short subdivision as condirioned by the
Planning Department and implemented by the various County agencies.
13. The Spokane County Arterial Road Plan identifies Evergreen Road as a Principal Arterial with an existing width of 60 feet. The County Engineer has requested
dedication of an additional4 feet of right-of -way on Evergreen Road. In addirion to
the requested dedication, the County Engineer has required a strip of property 16 feet in
width along Evergreen Road to be set aside as a future acquisirion axea for'road
improvement purposes.
14. The proposed short plat will be served by a public water system. `VVaste water disposal
will be as authorized by the Dixector of Utilities. 15. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a). DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-842-93 is hereby A.PPROVED until rune 1, 1996, subject to cond.itions noted
below. Most of the conditions of approval shall be accomplished by the applicant andlor
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.

PLANNING DEPARTMENT 'CONDITIONS
1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone as amended.
2. The final plat shall be designed substanually in conformance with the preliminary plat
of record. No increase of density or number of lots shall occur without a change of
condition application submittal and approval.
.3. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
4. Appropriate road name(s) shall be indicated.
5. The preliminary plat is given conditional approval for three (3) years, specifically to
June 1, 1996. The applicant may request an extension of time by submitting a written
request approximately forty-five (45) days prior to the above expiration da.te.
6. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utiiiry easements by appropriate utility companies shall be received
with the submittal of the final plat.

7. Three (3) current certificates of title shall be furnished to the Planning Department prior
to filing the final plat.
8. The Owner shall negotiate with the Central Valley School District and submit a recorded
copy of the agreement making provisions for public schools prior to finalization and
recording of this short plat. The agreement shall provide a written descriprion of the
subject property to which the agreement applies and also sta.te the dollar amount and
any other agreed to mitigating measure(s).
The Owner shall also notify any potential purchasers who have made an agreement to
purchase properry within said short plat pursuant to the Revised Cod.e of Washington
(58.17.205), that adequate provisions for school facilities must be made conditioned on
a future agreement between the plattor and school district.
Voluntary agxeements between the Owner and School District shall conform to the
Revised Code of Washington Chapter 82.02.
9. The Spokane County Planning Deparnnent shall prepare and record with the County
Auditor a Tide Notice specifying a future land acquisirion area for road right-of-way
and utilities. The reserved future acquisiaon area Title Notice shall be released, in full or in part, by the Planning Departrnent. The notice should be recorded within the same
time frame as an appeal and shall provide the following:
a. At least 16 feet of reserved future acquisition area for road right-of-way and
utilities, in addition to the existing and/or newly dedicated right-of-way along
Evergreen Road. NOTE: The County Engineer has required 4 feet of new
dedication.
b. Future building and other setbacks required by the Spokane County Zoning Code
shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs should
be located within the future acquisition area for road right-of-way and utilities. If
any of the above improvements are made within this area, they shall be relocated
at the applicant's expense when roadway improvements are made.
d. The future acquisirion area, until acquired., shall be private property and may be
used as allowed in the zone, except that any improvements (such as landscaping,
parking, surface drainage, drainfield, signs or others) shall be considered interim
uses.
e. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements after
acquirulg said future acquisition area.
10. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement: I '
"Side yard and rear yard setbacks shall be determined at the time building pemvts are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
11. No water plan is required, and a simple tap is needed at the time of building permit
release.
12. A survey is requi.red prior to the filing of a final plat. .
COUNTY ENGINEER'S DEPARTMENT CONDITIONS ,
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
.2. Drainage plans and design calculations showing the alignment of drainage facilities
shall be submitted to the County Engineer for approval prior to construction and/or the
filing of the final plat. Drainage plans to be prepared under the direction of a Iicensed
Professional Civil Engineer.

3. No construction work is to be performed withi.n the existing or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
4. Individual driveway access permits are required prior to issuance of a building permit
for driveway approaches to the county road system.
5. Dedication of 4 feet of add.itional right-of-way, along Evergreen Road is req.uired.
6. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane Counry standards.
7. Sidewalks are required along the arterial(s) on Evergreen Road.
8. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
9. To construct the road irnprovements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any petition or resolution which purpose is the fonmarion of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drai.nage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heus, grantees and assigns. This provision is applicable to Evergreen Road.
10. As an alternative method of constructing the road improvements stated herein, the applicant may, with the approval of the County Engineer, accomplish the road
i.mprovements stated herein by joining and pa.rticipating in a County Road Project
(CRP) to the extent of the required road improvements. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to exisring
pavement) wi11 be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Evergreen Road
11. The following statement sha11 be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a perition for the formation of a Road Improvement District (RID) by the
petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s)'
property, and further not to object, by the signing of a ballot, to the formation of an
RiD by the resolution method pursuant to Chapter 36.88 RCW, which resolution
includes the owner(s)' property. If an RID is formed by either the petition or resolution
method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further
agree: .

(a) that the improvement(s) or construction contemplated within the prbposed RID is
feasible; .
(b) that the benefits to be derived from the fonnation of the RID by the property
included therein, together with the amount of any County participation, exceed the
cost and expense of formation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as authorized
. under RCW 36.88.090, to object to any assessment(s) on the property as a result of the
improvements called for in, conjunction with the formation of an RID by either petition
or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court
the decision of the Board of County Commissioners aff'~uming the final assessment roll.
It is further agreed that at such tinae as an RID is created or any Road Improvement
Project is sanctioned by Spokane County, the improvements required (curb, sidewalk,
drainage control and paving) will be at the sole expense of the undersigned owner(s),
their heirs, grantees and assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the
date of execurion below. However, the owner(s) or successor(s) agree that if said RID

waiver expires without construction of the re,quired improvements, the owner(s) or
successor(s) agree to construct the required improvements at their own expense, pay to
Spokane County the then estimated cost of the required improvements to enable the
County to complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execution of another RID waiver agreement) providing
for or securing to the County the actual construction of the improvements.
All of the requirements of this agreement shall run with the land and shall be binding
upon the owner(s), their successor(s) or assign(s)." This provision is applicable to
Evergreen Road.
12. The County Engineer has designated Typical Roadway Section Number Two, Principal
A.rterial standard for the improvement of Evergreen Road, which is adjacent to the
proposed development. This will require the addition of approximately 13-15 feet of
asphalt along the frontage of the development. The construction of curbing and
sidewalk is also required. .
13. The proposed plat shall be improved to the standards set forth in Spokane County
Board of Commissioners Resolution No. 80-1592, as amended, which resolution
establishes regulations for roads, approaches, drainage and fees in new construction. 14. The Counry Engineer has examined thi.s development proposal and has determined that
the impact of this proposal upon the existing county road system warrants the
dedication of additional right-of-way and the roadway improvements hereitn specif'ied.
15. The County Arterial Road Plan identifies Evergreen Road as a Principal Arterial. The
existing right-of-way width of 60 feet is not consistent with that specif'ied in the Plan.
In order to implement the Arterial Road Plan, in addition to the required right-of-way
dedication, a strip of property 16 feet in width along the Evergreen Road frontage shall
be set aside in reserve. This property may be acquired by Spokane County at the time
when arterial improvements are made to Evergreen Road.
16. The applicant should be advised that there may exist utiliries either underground or
overhead affecting the applicants property, includ.ing property to be dedicated or set aside for future acquisinon. Spokane County will assume no financial obligation for
adjustments or relocation regarding these utilities. The applicant should check with the
applicable utilities and Spokane County Engineer to deternnine whethez the applicant or
utility is responsible for adjustment or relocation costs and to make arrangements for
any necessary work.
17. The two 12 foot driveway easements, as shown on the preliminary plat, are for lots "B"
and "C" exclusively. If lots "A" and "D" use the driveways for ingress and egress then
private roads shall be constructed to an urban private road standard within a 30 foot
access easement.

E 1 That conditional appraval of the plat by the County Engineer is given
subj ect to dedication of Right-of--Way and approval of the raad system as
indicated in the preliminary plat of record.
E3 That drainage plans and design calculations showing the alignment of
drainage facilities be submitted to the Cvunty Engi.neer for apprvval
prior to construction ancifvr the f31ing of the final plat. Drainage
plans to be prepared under the direction of a licensed Professivnal

Raad Improvement Project is sanctioned by 5pokane County, the

County to place their name (s) on a petition for the formation of a
Road Improvement District (RID) by the petition method pursuant to
Chapter 36.88 RCW, which petition includes the owner(s) property, and
further not to object, by the signing of a ballot, the formation of
a RID by the resolution method pursuant to Chapter 36.88 RCW, which
resolution includes the owner(s) property. If a RID is formed by
either the petition or resolution method, as provided for in Chapter
3 6. 88 RCW, the owner ( s) or successor ( s) further agree :(1) that the
improvements or construction contemplated within the proposed RID is
feasible, (2) That the benefits to be derived from the formation of
the RID by the property included therein, together with the amount
of any County participation, exceeds the cost and expense of formation
of the RID, and (3) that the property within the proposed RID is
sufficiently developed. Provided, further, the owner(s) or
successor(s) shall retain the right, as authorized under RCW
36.88.090, to obj ect to any assessment ( s) on the property as a result
of the improvements called for in conjunction with the formation of
a RID by either petition or resolution method under Chapter 36.88 RCW,
and to appeal to the Superior Court the decision of the Board of
County Commissioners affirming the final assessment roll. It is
further agreed that at such time as an RID is created or any Road
Improvement project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving) will be at the
sole expense of the undersigned owner, their heirs, grantees and
assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten
(10) years from the date of execution below. However, the owner(s)
or successor(s) agree that if said RID waiver expires without
construction of the required improvements, the owner_(s) or
successor(s) agree to construct the required improvements at their own
expense; pay to Spokane County the then estimated cost of the required
improvements to enable the County to complete the same; or furnish a
bond or other secure method suitable to the County (which may include
the execution of another RID waiver agreement), providing for or
securing to the County the actual construction of the improvements.
Al1 of the requirements of this agreement shall run with the land and
shall be binding upon the owner(s), their successor(s) or assign(s).
This provision is applicable to Everqreen Road.
E24 The County Engineer has designated Typical Roadway Section Number Twoc
Principal Arterial Standard for the improvement of Everqreen Road which
is adjacent to the proposed development. This will require the addition
of approximately 13-15 feet of asphalt along the frontage of the
development. The construction of curbing and sidewalk is also required.
E32 The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 80-1592, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
E33 The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the dedication of additional Right of Way and the
roadway improvements herein specified.
E61 The County Arterial Road plan identifies Everqreen Road as a Principal
Arterial. The existing right of way width of 60 feet is not consistent
with that specified in The Plan. In order to implement the Arterial
Road Plan it is recommended that in addition to the required right of
way dedication, a strip of property 16 feet in width along the Everqreen
Road frontage be set aside in reserve. This property may be acquired by
Spokane County at the time when Arterial Improvements are made to
Everqreen Road.
E90 The applicant should be advised that there may exist utilities either
underground or overhead affecting the applicants property, including
property to be dedicated or set aside for future acquisition. Spokane

County will assume no financial obligation for adjustments or relocation
regarding these utilities. The applicant should check with the
applicable utilities and Spokane County Engineer to determine whether
the applicant or utility is responsible for adjustmPnt or relocation
, costs and to make arrangements for any necessary work.
SPECIAL CONDITION:
The two 12 foot driveway easements, as shown on the preliminary plat,
are for lots "B" and "C" exclusively. If lots "A" and "D" use the
driveways for ingress and egress then private roads shall be cor_structed
to an urban private road standard within a 30 foot access easement.
SPECIAL CONDITION:
The driveway approaches for lots "A" and "D" shall be shown on the final
plat.
