RE: USE OF TEMPOR.ARY ROCK SUMPS
The use of a temporary rock sump to provide disposal of runoff
rates up to .3 cfs was recently encountered on one of my projects.
In Spokane County, rock sumps have been used in limited cases as a
temporary drainage method, in the past. The following gui-delines
are important to the proper application of a rock sumo:
1) Rock sumps should be used f or disposal of up to .3 cf s runof f.
For .3 cfs and higher flows, it is typically appropriate to
use drvwells.
2) Typical application is in rural locati-ons where soils are
suitable for 72 inch / hr. percolation rates.
3) Rock backf ill f or the sumps shall be 1" to 3" washed natural
gravel s( same spec as drywell backf ill
4) The following is an example calculation for sizing a temporary
rock sump:

of a RID by the reeolution method pursuant to 'Chapter 36.88 RCW, which
resolution includes the owner(s) property.,If a RID is formed by either

' l. Drainage easements, as platted and shown hereon, which are for the purpose of
installing, operating and maintaining drainage swales and-drainage facilities, as conditions
of plat approval, are hereby granted to the public.
Spokane County and its authorized agents are hereby granted the right of ingress and
egress to, over. and from said easements for the purpose of inspection and emergency
maintenance of water quaiiry treatment swales ("208 swales") and othec drainage
tacilities, if noc properly maintained by the property owner. Spokane County does not
accept the responsibiliry to inspect or maintain the drainage easements or drainage
swales, nor *does the County accept any liability for any failure by the lot owner(s) to
properly mainmin such areas.
.
The properry owners within this Plat shall be held responsible for keeping open and
maintaining the surface path of natural or man-made drainage flow over and across their
respective propenies.
The property owners within this Plat sha11 mainmin all war.er quality treatment swales
("?OS swales and drainage ditches situated on their respective properties, and any
portion of a?08 swale situated in the public right-of-way adjacent to cheir respective
propenies, with a permanent ground cover as speciried on the current approved plans on
file at the County Engineer's Office. The properry owners may install approved
shrubbery and/or trees which do not obstruct the flow and percolation of storm drainage
water in the 208 swale and drainage ditches, as indicated by the current approved plans
on file with the County Engineer's Office.
5. The property owner or his representative shall inform each succeeding purchaser of all
drainage easements on the properry and or his responsibiliry for maintaining surface
drainage paths and swales within said easements.
6. Spokane Councy does not accept the responsibility ot maintaining the drainage course on
private lots within drainage easements or floodplain areas, nor the responsibilicy for any
damage whatsoever, including, but not limited to, inverse condemnation to any properties
due to deticient construction and or maintenance of drainage courses in drainage
easements on private properry. '

7• If the property owner fails to maintain the surface path of nanual or man-made drainage
flow, or the drainage swale, a notice of such failure may be given to the properry owner.
If not corrected within the period indicated on said notice, Spokane Counry has the right
to correct the maintenance failure, or have it corrected, at the expense of the properry
owner.

as to provide positive drainage away from any drainage entry point to the bui4ng

DECLARATION OF COVENAN7'
In consideration of the approval by Spokane County of
(liereinafter referred to as the "Developnient"), the undersigned covenants and agrees that:
1. The subdivider/sponsor will construct the private 1•oads and associated drainage facilities in
conformance with the approved plans on file in the County Engineer's Office.
2. A lot is served by a private road when: a. the only road frontage for the lot in the Development is
on the private road, or; b. a lot having frontage on more than one road (public or private) constructs
an approach to the private road.
3. The owner(s) of any lot created by the Development or alternation tliereof and served by a private
road shall be responsible for maintenance of said private road, including associated drainage facilities
in conformance with approved plans on file with the County Engineers office.
4. Maintenance financing of the private roads anci associated drainage facilities shall be in a manner
cietermined by the owners of:
a. the majority of lots seived by such private road;
b. the majoi-ity of frontage of lots served by such private road;
c. the majority square footage of lots served by such private road; or
d. .
5. In the event such private road, including associated drainage facilities is iinproved to Spokane County
standards for public streets, and the County is willing to accept tlle dedication of such road and
facilities, each lot owner shall execute any documents necessary to accomplish such dedication.
6. Owners of lots within the Development who are served by such road, may sue and recover damages
and attorney's fees fi-om any owner of any lot within the Development which is similarly served who
refused to participate in the road and drainage facilities, construction, financing, and nlaintenance.
7. WARNING: Spokane County has no responsibility to build, improve, or maintain or otherwise service
the private roads, including associated drainage facilities, contained within or providing seivice to the
property described in this Development. By accepting this Development or subsequently by allowing
a building permit to be issued for property on a private road, Spokane County assumes no obligation
for said private road and ttie owners hereby acknowledge that the County has no obligation of any
kind of nature whatsoever to establish, examine, sulvey, construct, alter, repair improve, maintain,
provide drainage or snow removal on a private road, or associated drainage facilities.

DECISION
THIS MATTER, an application for subdivision of land, from William Rizzuto has been
received and decided upon, pursuant to Spokane County Subdivision regulations, on the
t24*i day of April, 1993.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide approximately 1.5 acres into 2 lots for single family
residences and those uses permitted in the underlying zone.
3. The proposal is generally located at the terminus of Baldwin Avenue approxirnately 135
feet south of Indiana Avenue and 346 feet west of Vista Road in the SW 1/4 of Section
7, Township 25 North, Range 44 E.W.M., Spokane Counry, Washington.
4. The existing zoning of the property described in the application is Urban Residential-3.5
(UR-3.5), previously established as Agricultural Suburban (AS) zoning and reclassified
to Urban Residential-3.5 (UR-3.5) on January l, 1991 consistent with the Program to
Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal
generally conforms to the requirements of the existing Urban Residential-3.5 (UR-3.5)
zone.
5. The accessory agricultural structures located on Parcel "B" of the preliminary plat shall
not be used for agricultural purposes until primary residential use of the lot is
established.
6. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed are generally in -accord with this category.
7. Surrounding uses are primarily single and multi-family residential. There is currently
large animal keeping occurring on the proposed site.
8. The required public notice was provided for this proposal and agencies having a
potenrial interest in the project were noefied'and recommendarions solicited.
9. Written comments were received from adjoining property owners. The chief concern
was that Parcel "B" of the preliminary plat could only be accessed by creating an
easement through one of the adjacent property owner's parcels. A 30 foot wide private
road easement extending easterly from Baldwin Avenue, across Parcel "A", will
provide access to Parcel "B". .
10. The proposal is located within the Fublic Transit Benefit Area (PTBA). Route #10
provides downtown and connecting service. The nearest Spokane Transit park and ride
facility is the Pines Road Park and Ride.
11. The Spokane County Parks and Recreation Plan indicates that Park Road swim_.ming
pool is located approxunately 1/2 mile south of the proposal.
12. Recognizing the recommended conditions and Spokane County development standards,
the proposed short subdivision makes appropriate provisions for the public health,
safety and general welfare and that the public use and interest wi11 be served by platting
the subdivision.
7'he subdivision proposal is generally consistent with RCW 58.17 and the
subdivision regulations, promoting the public health, safetY and general weL~E VED
accordance with standards established by the state and Spokane County. The Plan T1993

Department has considered the provision of public facilities as cited in RCW 58.17.110
(2). More specifically:
a. open spaces .
b. drainage ways
c. public and/or private rights-of-way
d. transit
e. potable water
f. sanitary waste disposal
g. parks and recreation facilities
h, playgrounds
i. schools and schoolgrounds
j . sidewalks
The ahove improvements are either existing facilities and services or will be provided
by the applicant upon finalization of this short subdivision as conditioned by the
Planning Department and implemented by the various County agencies.
13. The Spokane County Arterial Road Plan identifies Baldwin Avenue as a Local Access
Street with an existing width of 60 feet. The County Engineer has requested ded,ication
of an additional 30 feet of right-of -way on Baldwin Avenue.
14. The proposed short plat will be served by a public water system. Waste water disposal
will be as authorized by the Director of Urilities.
15. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-843-93 is hereby APPROVED until May 1, 1996, subject to conditions noted
below. Most of the condidons of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIONS
1. Prior to filing/recording of the final plat, applicarion shall be made to the Spokane
County Planning Department for a determination of nonconforming large animal
keeping rights on Parcel "B".
2. Any large animal keeping rights which may exist for Parcel "A" expire upon
~'inalization/recording of this plat.
3. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone as amended. .
4. A primary residential use shall be established on Parcel "B" prior to establishing any
recognized use of the existing accessory structures.
5. The final plat shall be designed substantially in confonnance with the preliminary plat
of record. No increase of density or number of lots sha11 occur without a change of
. condirion application submittal and approval.
6. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Find.ings and Conditions of Approval.
7. Appropriate road name(s) shall be indicated.

8. 'X'he preliminary plat is given conditional approval for three (3) years, specifically to
May 1, 1996. The applicant xnay request an extension of time by submitting a written
request approximately forty-five (45) days prior to the above expiration date.
9. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies shall be received
with the submittal of the final plat.
10. Three (3) current certificates of title shall be fumished to the Planning Department prior
to filing the final plat.
11. 1'he final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement: -
"Side yard and rear yard setbacks shall be determined at the time building permits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
12. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water purveyor, appropriate fire protection district, County Building &
Safety Department and County Health Dish-ict. The agencies will certify on the Water
Plan, prior to the filing of a final plat, that the plan is in conformance with their
respective needs and regulations. The Water Plan and certification shaU be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor.
13. The water purveyor shall certi.fy that appropriate contTactual arrangements and schedule
of improvements have been made with the plat sponsor for construction of the water
system in accordance with the approved Water Plan. The time schedule shall provide
for completion of the water system and inspecrion by the appropriate health authorities
prior to application for building pemiits with.in the final plat. The arrangements or
agreements shall include a provision holding Spokane County and the purveyor
harmless from claims by any lot purchaser refused a building permit due to the failure
of the subdivision sponsor to satisfactorily complete the approved water system.
14. The final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state
health authorities, the local fire protecrion district, County Building & Safety
Department and water purveyor, shall be installed within this subdivision, and the
applicant shall provide for indi-vidual domestic water service as well as fire protecrion to
each lot prior to sale of each lot and prior to issuance of a building permit for each lot."
15. No building permit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursuant
to the approved Water Plan for the final plat" including a signed license stamp. T'he
_ certification may be in the form of a letter, but is preferred to be certified on a copy of
the Water Plan as a schematic map showing the "as-built" water system.
16. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyor and fire protection district stating that simple connections to
an existing, approved water system will provide adequate domestic and fire protection
water to ensure the public health, safety and general welfare. 17. A survey is required prior to the filing of a final plat.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
Plans, profiles, and cross-sections as designed to County standards showing proPosed
street centerline and curb grades sha11 be submitted to the County Engineer for approval
prior to construction and/or the filing of each final plat; road plans to be prepared under
the direction of a licensed Professional Civil Engineer.

3. Drainage plans and design calcularions showing the alignment of drainage facilities
shall be submittetl to the County Engineer for approval prior to construction and/or the
filing of the final plat. Drainage plans to be prepared under the direction of a licensed
Professional Civil Engineer.
4. No construction work is to be perfonmed within the existing or proposed public right-
of-way unti.l a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
5. Road design, construcrion, and drainage control for one-half (1/2) rights-of-way and
stub road connections are the responsibility of the owner, developer or applicant.
6. Appropriate provision shall be made that the following-described property be held in
trust until the continuation of the streets be dedicated or deeded: a one (1)-foot strip at
the ends or edges of all streets that terminate or border the subdivision boundary.
(Temporary cul-de-sacs are required when streets terminate at the subdivision
' boundaries.)
7. Individual driveway access pernuts are required prior to issuance of a building pernut
for driveway approaches to the county road system.
8. Dedication of 30 feet of addirional right-of-way along Baldwin Avenue is required.
9. A statement shall be placed in plat dedication that no di.rect access be allowed from lots
to Baldwin Avenue, located to the east of the short plat.
10. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
11. The word "applicant" sha11 include the owner or owners of the property, his heirs,
assigns and successors.
12. To construct the road improvements sta.ted herein, the applicant may, with the approval -
of the County Engineer, join in and be a willing participant in any petition or resolution
which purpose is the formation of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RYD is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewal.k, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Baldwin Avenue.
13. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required road improvements. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
. improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Baldwin Avenue.
14. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a perition for the formation of a Road Improvetnent District (RID) by the
petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s)'
property, and further not to object, by the sign.ing of a ballot, to the formation of an
RID by the resolution method pursuant to Chapter 36.88 RCW, which resolurion
includes the owner(s)' property. If an RID is formed by either the petition or resolution
method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further
agree:
(a) that the improvement(s) or construction contemplated within the proposed RID is
feasible;
(b) that the benefits to be derived from the fornlation of the RID by the property
included therein, together with the amount of any County participation, exceed the
cost and expense of formation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.

Provided further that the owner(s) or successor(s) shall retain the right, as authorized
under RCW 36.88.090, to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the formation of an RID by either perition
or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court
the decision of the Board of County Commissioners affirming the final assessment roll.
It is further agreed that at such time as an RID is created or any Road Improvement
Project is sancrioned by Spokane Counry, the improverxients required (curb, sidewalk,
drainage control and paving) will be at the sole expense of the undersigned owner(s),
their heirs, grantees and assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the
date of execution below. However, the owner(s) or successor(s) agree that if said RID
waiver expires without construction of the required improvements, the owner(s) or
successor(s) agree to construct the required improvements at their own expense, pay to
Spokane County the then estimated cost of the required improvements to enable the
Counry to complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execution of another RID waiver agreement) providing
for or securing to the County the actual construcron of the improvements.
All of the requu-ements of this agreement shall run with the land and shall be binding
upon the owner(s), their successor(s) or assign(s)." This provision is applicable to
Baldwin Avenue.
15. The County Engineer has designated Typical Roadway Section Number Two, Local
Access standard for the improvement of Baldwin Avenue, which is adjacent to the
proposed development. This will require the addition of approximately 30 feet of
asphalt along the frontage of the development. The construction of curbing is also
required.
16. The proposed private road as shown on the preluninary plat serving 2 lots is approved
by the County Engineer.
17. Private road shall be improved to Spokane County standard for a urban private road
standard serving 21ots, and is subject to approval under Secrion 10.207 of the Spokane
County Fire Code.
18. All vested owners shall sign and record private road documents as prescribed by the
Spokane County Engineer. These documents shall be reviewed and approved by the
Spokane County Engineer prior to recording with the Spokane County Auditor.
Recording numbers shall be referenced in the dedicatory language of the plat-
19. The following statement shall be placed in the plat dedication:
"WARNING: Spokane County has no responsibility to build, i.mprove, maintain or
. otherwise service the private roads contained within or provide service to the property
described in this plat. By accepting this plat or subsequently by allowing a building
permit to be issued on properry on a private road, Spokane Counry assumes no
obligation for said private road, and the owners hereby acknowledge that the County
has no obligarion of any kind or nature whatsoever to establish, examine, survey,
construct, alter, repair, improve, maintain or provide drainage or snow removal on a
private road. This requirement is and shall run with the land and shall be binding upon
the owner(s), their heirs, successors or assigns, including the obligation to participate
in the maintenance of the private road as provided herein."
20. The proposed plat shall be improved to the standards set forth in Spokane County
Board of Commissioners Resolurion No. 80-1592, as amended, which resolurion
establishes regulations for roads, approaches, drainage and fees in new construction.
21. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing county road system wairants the
detiication of additional right-of-way and the roadway improvements herein specified.
22. The following statement shall be placed in the final plat dedication: "The private road as
shown hereon is an easement which provides a means of ingress and egress for those
lots within the subdivision having frontage thereon."

COUNTY UTILITIES DEPAl2TMENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resolurion No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is conditioned
in compliance with all rules and regulations of the Spokane County Health District and
is further conditioned and subject to specific application approval and issuance of
permits by the Health District. 2. The Owner(s) or Successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of a ULID by petition method pursuant to RCW
36.94 which the petition includes the Owner(s) property and further not to object by
signing of a protest petition against the fonnation of a ULID by resolution method
pursuant to RCW 36.94 which includes the Owner(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from objection to any
assessment(s) on the property as a result of improvements called for in conjunction
with the formation of a UI;ID by either petition or resolution under ,
3. Any water service for this project sha11 be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
4. Each new dwelling unit shall be double plumbed for connection to future area-wide

DEPARTMENT OF BUIILDINGS CONDITIONS
l. . Fire flows are applicable for this proposal. The minimum fire flow and flow duration
will be based on a representative dwelling size for all floors not including the basement.
The maximum dwelling size needs to be submitted to the Department of Buildings. -
2. An approved water supply capable of supplying the required flow for fire protection
and domestic use shall be provided before any building pennits are issued. The water
system shall be installed in accordance with an approved Water System Plan on file
with the Department of Buildings. Certification from the Water Purveyor that the
installed system complies with the requirements of the plan and is operarional shall be
submitted to the Department of Buildings prior to pemut issuance.
3. Hydrant location, number and type capable of delivering the required flow for
residential development shall be provided in accordance with required design
specifications. The average distance between hydrants shall be 600 feet and shall not
exceed 700 feet.

The followinq "Conditions of Approval" for the above referenced subdivision
are submitted to the Spokane County Planning Department for inclusion in the
"Findinqs and order" should the short plat be approved.
E 1 That conditional approval of the plat by the County Engineer is given
subject to dedication of Right-of-Way and approval of the road system as
indicated in the preliminary plat of record.
E 2 That plans, profiles and cross sections as designed to County standards
showing proposed street centerline and curb grades be submitted to the
County Engineer for approval prior to construction and/or the filing of
a f inal plat; road plans to be prepared under the direction of a
licensed Professional Civil Engineer.
E 3 That drainage plans and design calculations showing the alignment of
drainage facilities be submitted to the County Engineer for approval
prior to construction and/or the filing of the final plat. Drainage
plans to be prepared under the direction of a licensed Professional
Civil Engineer.
E 6 No construction work is to be performed within the existing or proposed
Public Right-of-Way until a permit has been issued by the County
Engineer. Al1 work is subject to inspection and approval by the County

improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersiqned owner,
their heirs, grantees and assigns. This provision is applicable to

E22 That the following statement shall appear within the dedicatory language
of the final plat:
The owner(s) or successor(s) in interest agree to authorize Spokane

Chapter 36.88 RCW, which peicition includes the owner (s) property, and

either the petition or resolution method, as provided for in Chapter

the RID by the property included therein, together with the amount
of any County participation, exceeds the cost and expense of formation
of the RID, and (3) that the property within the proposed RID is
sufficiently developed. Provided, further, the owner(s) or
successor(s) shall retain the right, as authorized under RCW
36.88.090, to obj ect to any assessment ( s) on the property as a result
of the improvements called for in conjunction with the formation of
a RID by either petition or resolution method under Chapter 3 6. 88 RCW,
and to appeal to the Superior Court the decision of the Board of
County Commissioners affirming the final assessment roll. It is
further agreed that at such time as an RID is created or any Road
Improvement project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving) will be at the .
sole expense of the undersigned owner, their heirs, grantees and
assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten
(10) years from the date of execution below. However, the owner(s)
or successor(s) agree that if said RID waiver expires without
construction of the required improvements, the owner(s) or
successor(s) agree to construct the required improvements at their own
expense; pay to Spokane County the then estimated cost of the required
improvements to enable the County to complete the same; or furnish a
bond or other secure method suitable to the County (which may include
the execution of another RID waiver agreement), providing for or
securing to the County the actual construction of the improvements.
All of the requirements of this agreement shall run with the land and
shall be binding upon the owner(s), their successor(s) or assign(s).
This provision is applicable to Baldwin Avenue.
E24 The County Engineer has designated Typical Roadway Section Number Twoi
Local Access Standard for the improvement of Baldwin Avenue which is
adjacent to the proposed development. This will require the addition of
approximately 30 feet of asphalt along the frontage of the development.
The construction of curbing is also required.
E26 The proposed private road(s) as shown on the preliminary plat serving
2 lots is approved by the County Engineer.
E27 That private road(s) be improved to Spokane County standard for a urban
private road standard serving 2 lots. Subject to approval under section
10.207 of the Spokane County Fire Code.

E30 All vested owners shall sign and record private road documents as
prescribed by the Spokane County Engineer. These documents shall be
reviewed and approved by the Spokane County Engineer prior to recording
with the Spokane County Auditor. Recording numbers shall be referenced
in the dedicatory language of the plat.
E31 That the following statement be placed in the plat dedication: WARNING:
Spokane County has no responsibility to build, improve, maintain or
other wise service the private roads contained within or providing
service to the property described in this plat. By accepting this plat
or subsequently by allowing a building permit to be issued on property
on a rivate road, Spokane County assumes no obligation for said private
road and the owners hereby acknowledge that the County has no
obligation of any kind or nature whatsoever to establish, examine,
survey, construct, alter, repair, improve, maintain, provide drainage or
snow removal on a private road. This requirement is and shall run with
the land and shall be binding upon the owner, their heirs, successors or
assigns including the obligation to participate in the maintenance of
the private road as provided herein.
E32 The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 80-1592, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
E33 The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the dedication of additional Right of Way and the
roadway improvements herein specified.
E35 That the following statement must be placed in the plat dedication:
"The private road as shown hereon is an easement which provides a means
of ingress and egress for those lots within the plat having frontage
thereon."
E90 The applicant should be advised that there may exist utilities either
underground or overhead affecting the applicants property, including
property to be dedicated or set aside for future acquisition. Spokane
County will assume no financial obligation for adjustments or relocation
regarding these utilities. The applicant should check with the
applicable utilities and Spokane County Engineer to determine whether
the applicant or utility is responsible for adjustment or relocation
costs and to make arrangements for any necessary work.
SPECIAL CONDITION:
When dedicating the 30 feet of Right-Of-Way for Baldwin Avenue, the
applicant shall dedicate the applicable Right-Of-Way which will form a
portion of a"reverse S curve" which will serve as a future connection
to Baldwin Avenue to the East of the proposed short plat. The radius
for the "S curve" shall conform to Spokane County Public Road Standards. ,
SPECIAL CONDITION:
The applicant shall sign a"SPOKANE COUNTY NOTICE TO PUBLIC NO. 4" to
construct a private road with the dedicated right-of-way.
SPECIAL CONDITION:
The applicant shall provide written confimation to the County Engineer
that the local fire district has reviewed and approved the turn around
for the private road. The County Engineer shall also review and grant
final approval to the turn around.
