SUBlEC"I': Standard DrainaQe Lanmiaee for the Dedica(ion on
1) Drainage easements, as platted and shown hereon, which are for the purpose of installing,
operating and maintaining drainage swales and drainage facilities to dispose of runoff, are hereby
granted. The County of Snokane is hereby grantecl the right of ingress and egress to all drainage
easements adjacent to the public right of way. 'Tlie property owner shall maintain the drainage
swale with apermanent live cover of lawn turf, with optional shrubbery and/or trees, which do
not obstruct the flow ancf percolation of storm drainage water in the drainage swale as inclicated
by (he approved plans.

construction and/or maintenance of drainage courses in drainage easements on private property.

• 5) The lowest builcling opening, including basement opening, for any builcling on ,
ftril3 IIlw* shall be high enough to allow a minimum slore of 3%
away fram the buil(ling in 10 feet. /111 drainage shall be routed away from the huilcling to natural
, cirainages or other lawful drainage features.
6) Development within this sub(livision shall eonform to the requirements of the National Flood
Insurance Program and Chapter 3.20 of the Spokane County Code. The lowest floor, inclucling
basement floor, for any strlicture shall be constructeti according to the requirements of the
Spokane County Flood Zone regulations in effect at lhe time a building permit is issuecl. .
Purchasers of property in tliis subdivision are warned of possible flooding or ponding and the
potential requirement to purchase Flood Insurance. Tliis warning shall be carried in each and
every deed drawn to transfer ownership of any and all property within this plat in the Area of
Special Flood Hazard.

SUBJECT: Standard Drainage Lanniage for the Dedication on
1) Drainage easements, as platted and shown hereon, which are for the purpose of installing,
operating and maintaining drainage swales and drainage facilities to dispose of runoff, are hereby
granted. The County of Spokane is hereby granted the right of ingress and egress to all drainage
easements adjacent to the public right of way. The property owner shall maintain the drainage
swale with a permanent live cover of lawn turf, with optional shrubbery and/or trees, which do
not obstruct the flow and percolation of storm drainage water in the drainage swale as indicated
by the approved plans.

keeping open and maintaining the path of the natural or man-made cirainage flow over and across

8) Spokane County shall not be responsible to maintain ingress or egress across the flood plain area.
9) The owner(s) or successor(s) in interest agree to join in any County approved Stormwater
Management Program and to pay such rates and charges as may be fixed through public hearings
for service or benefit obtained by the planning, design, constructing, maintaining, or operation

DECISION
THIS MATTER, an application for subdivision of land, from 1Vrike Henning has been
re~ ed and decided upon, pursuant to Spokane County Subdivision regulations, on the
4day of June, 1993
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has been properly delegated the responsibilicy far
rendering the decision by the Spokane County Director of Planning. 2. The proposal is to d.ivide approximately 2.34 acres into two lots for one existing single
family residence, one additional residence, and those uses pemutted in the underlying
zone.
3. The proposal is generally located west of and adjacent to Barker Road, approximately
500 feet south of Sprague Avenue in Section 19, Township 25 North, Range 45
E.W.M., Spokane County, Washington.
4. The existing zoru.ng of the property described in the application is Urban Residential-3.5,
previously established as Agricultural (A) zoning in 1958 (376-58) and redesignated to
UR-3.5 on January l, 1991 consistent with the Progzam to Implement the Spokane
County Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform to the
requirements of the existing UR-3.5 zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses pnoposed are generally in accord with this category.
6. The site contains an existing single family residence and accessory structures including
some agricultural buildings. The nonconforming status of agricultural uses has not
been determined by the Spokane County Planning Departcnent. Sunounding uses are
primarily single fami.ly residences and undeveloped. A church is located adjacent and
north of the site.
7. The required public notice was provided for this proposal and agencies having a
potential interest in the project were nodfied and recommendations solicited.
8. No wriCten corrunents were received from any adjoining property owners.
9. The site is located within the Public Transit Benefit Area (PTBA). Route # 9, East
Sprague, provides downtown and connecti.ng service. 10. The Spokane County Arterial Road Plan identifies Barker Road as a F'rincipal Arterial
with an existing right of way width of 60 feet and a proposed right of way width of 100
feet. The County Engineer has requested dedication of an additional2 feet of right-of
-way on Barker Road and, to itnplement the Plan, recommended an 18 foot wide strip .
of property along Barker Road be designated as a Future Acquisition Area. Sidewalks
are required on Barker Road. 11. The proposed short plat will be served by a public water system. Waste water disposal
wi11 be as authorized by che Director of Uti.lities.
12. The Central Valley School I?istrict No. 356 has commented on the proposed Short Plat.
The District has indicated that existing school facilities are inadequate to serve the
proposed short plat and wishes to negoriate with the owner to provide adequate capital
facilities as required by the Revised Code of Washington (RCW) 58.17.110. Review

requiring that provisions for appropriate facilities be in place prior to recording the final

13. The Spokane County Parks Department has commented on the proposed short plat.
The Parks Department has requested a voluntary agreement be completed between the
Parks Department and the property owner to mitigare impacts to the County Park
system. County legal counsel has indicated such agreements can be required. The
Spokane County Planning Department recommends the Property owner negotiate with
the Spokane County Parks Department to provide for appropriate capital facilities as
required by the Revised Code of Washington (RCW) 58.17.110. Approval of thrs
short plat should include conditions requiring that provisions for appropriate facilities
be in place prior to recording this final plat in the form of a written agreement between
the owner and the Spokane County Parks Department. '
14. Recognizing the recommended condirions and Spokane County development standards,
the proposed short subdivision makes appropriate provisions for the public health,
safety and general welfare and that the public use and interest will be served by plattulg
the proposed short subdivision.
The short subd.ivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safety and general welfare in
accordance with standards established by the state and Spokane County. The Planning
Department has considered the provision of public facilities as cited in RCW 58.17.110 (2). More specifically:
a. open spaces
b. drainage ways
c. public and/or private rights-of-way
d. transit
e. potable water
f. sanitary waste disposal
g. parks and recreation facilities
h. playgrounds
i . schools and schoolgrounds
j . sidewalks
15. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Ba.sed upon the above noted Findings of Fact annci Coilclusions, Short Plat Application
SP-845-93 is hereby APPROVED until July 1, 1996, subject to conditions noted
below. Most of the conditions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
PLANNING DEPARTMENT CONDXTIONS
1. All conditions shall be binding on the "Applicant", which term shall include the owner
or owners of the property, heirs, assigns and successors.
2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone as amended.
3. The final plat shall be designed substanhally in conformance with the preliminary plat
of rec;ord. No increase in density or number of lots shall occur without a change of
condition application submittal and approval.
4. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
5. Appropriate road name(s) shall be indicated.
6. The preliminary plat is given conditional approval for three (3) years, specifically to
July 1, 1996. The applicant may request an. extension of time by submitting a written
request approximately forty-five (45) days prior to the above expiration date.

7. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of ukility easements by appropriate utility companies sha11 be received
with the submittal of the final plat.
8. Three (3) current certificates of title shall be furnished to thc Planning Department prior
to filing the final plat.
9. The Spokane County Pldnning llepitrtment shall prepare a.nd record with the Counry
Auditor a Title Notice specifying a futtire land ac;quisirion area for road right-of-way
and utilitaes. The reserved future acquisition area Title Notice shall be released, in full
or in part, by the Planning Deparmient. The notice should be recorded withi.n the same
time frame as an appeal and shall provide the following:
a. At least 1$ feet of reserved future acquisition area for road right-of-way and
utilities, in addition to the existing and/or newly dedicated right-of-way along
Barker Road. NOTE: The County Engineer has required 2 feet of new
ded.ication.
b. Future building and other setbacks required by the Spokane County Zoning Code
shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, `208' areas, drainFeld or allowed signs should
be located within the future acquisition area for road right-of-way and utilities. If
any of the above improvements are made within this area, they shall be zelocated
at the applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as landscaping,
parking, surface drainage, drainfield, signs or others) shall be considered interim
uses.
e. The property owner shal.l be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements after
acquiring said future acquisition area.
10. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement: "Side yard and rear yard setbacks -shall be determined at the dme building permits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper xoning approvals are obtained."
11. A plan for water facilities adequate for domestic service and fire protection shall be
approve,d by the water pu.rveyor, appropriate fixe protection district, County Building &
Safery Department and Counry Health District. The agencies wil] certify on the VVater
Plan, prior to the filing of a final plat, that the plan is in conformance with their
respective needs and re,gulations. The Water Plan and cerrification shall be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor.
12. The water purveyor shall certify that appropriate contractual arrangements and schedule
of improvements have been made with the plat sponsor for c;onstx-uction of the water
syseem in accordance with the approveci Water .Ylan. "i he ume schedule shall provide
for compleaon of the water system and inspection by the appropriate health authorities
prior to application for building permits within the final plat. The arrangerrxents or
agrcements shall include a provision holding Spokane County and [he purveyor
harmless from claims by any lot purchaser refused a builduig permit due to the failure
of the subdivision sponsor to satisfactorily complete the approved water system.
13. The final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state
health authorities, the local fire protection district, County Building & Safety
Department and water purveyor, shall be installed within this subdivision, and the
applicant shall provide for individual domesric water service as well as Fire protection to
each lot prior to sale of each lot and prior to issuance of a building permit for each lot."

14. No building permit wi11 be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursuant
to thc approvcd Wfitcr Pltul for thc 1ina1 plat" including a sibnt;d liccrIsc sUin1p. I"hc
certif'ication may be in the form of a letter, but is preferred to be certified on a copy of
the Water Plan as a schematic map showing the "as-built" water system.
15. The Water Plan and the above conditions of approval regarding the Water Plan may be waived by the Pianning Director/designee upon receipt of letters from the appropriate
water purveyor and fire protection district stating that simple connections to an existing,
approved water system will provide adequate domestic and fire protection water to
ensure the public health, safety and general welfare.
16. A survey is required prior to the filing of a final plat.
17. The Owner shall negotiate with the Central Valley School District and the Spokane
County Parks Department and submit a recorded copy of the agreement making
provisions for public schocsls and parks prior to finalizarion and recording of this short
plat. The agreement shall provide a written description of the subject property to which
the agreement applies and also state the dollar amount and any other agreed to
mitigating measure(s).
The Owner shall also notify any potenrial purchasers who have made an agreement to
purchase property within said plat pursuant to the Revised Code of Washington
(58.17.205), that appropriate provisions for school facilities and public parks must be
made conditioned on a future agreement between the plattor, school district, and
County Parks Department. _
Voluntary agreements between the Owner, the School District and Spokane County
Parks Department shall confonn to the requi.rements of the Revised Code of
Washington Chapter 82.02.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
2. No construction work is to be performed within the existing or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
3. Individual driveway access permits are required prior to issuance of a building pemut
for driveway approaches to the county road system.
4. Dedicarion of 2 feet of add.itional right-of-way along Barker Road is required.
5: Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
6. Sidewal.ks are required along the arterial on Barker Road.
7. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
8. To construct the road improvements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any petition or resolurion
which purpose is the fonnation of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Barker Road.
9. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participabng in a County Road Project
(CRP) to the extent of the required road improvements. At such time as an RID is
created or any Road Ir~.aprovement Project is sanctioned by Spokane County, the

improvements required (curb, sideNvalk, drainage control and paving to existing
pavement) will be at the sole eapense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Barker Road.
14. The following statement shall be placeci in the plat dedication:
"The owner(s) or successor(s) in interest agrce to authorize the County to place
theix name(s) on a petition for the formation of a Road Improvement District
(RID) by the petition method pursuant to Chapter 36.88 RCW, which petition
includes the ownex(s)' pxoperty, and further not to object, by the signing of a
ballot, to the formation of an RID by the resolution method pursuant to Chapter
36.88 RCW, which resolution includes the owner(s)' property. If an RID is
formed by either the petition or resolution method as provided for in Chapter
36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the -improvement(s) or constructian contemplated within the proposed
RID is feasible;
(b) that the benefits to be derived from the fonnation of the RID by the property
included therein, together with the amount of any County participation,
exceed the cost and expense of formation of the RID; and
(c) that the property within the proposed RLD is sufficiently developed.
Pravided further that the owner(s) or succeSSOr(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessmeilt(s) on the
property as a result of the impzovements called for in conjunction with the
fonnation of an RX.-D by either petition or resolution medlod under Chapter
36.88 RCW, and to appeal to the .Superior Court the decision of the Roard
of County Commissioners a.ffirming the f-ina.l assessment roll.

from the date of execution bclow. However, the owner(s) oz successor(s)
agree that if said RI7D waiver expires without construction of the required
improvements, the owner(s) or successor(s) agree to constniet the required
improvements at their own expense, pay to Spokane County the then
estimated cost of therequired inzprovements to ena.ble the County ta
caii7p(ete the same, or ftirnish a bond or other secure method suitable to the
County (which may include the execution of another RID waiver agreement)
. providing for or securing to the County the actual construction of the
improvements.
All of the requirements of this agreement shall run with the land and shall be
binding upon the owner(s), their successor(s) or assign(s)." This provision

12. The proposed subdivision, shall be improved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes regulations for roads, approaches, dra.inage and fees in new
construction. '
13. 'I he County Engi.neer has examined this development proposal and has determined that
the impact of this proposal upon the existing county road system warrants the
dedication of aciditional right-of-way and the roadway improvements hereln specified.
14. The County Arterial Road Flan identifies Barker Road as a Principal arterial. The
existing z-ight-of-way width of 60 feet is not consistent with that speci~'ied in the Plan.

rn order to implement the Arterial Road Plan, in adclition to the required right-of-way
dedicarion, a strip of property 18 feet in width along the Barker Road frontage shall be
set aside in reserve. This property may be acquired by Spokane County at the time
when arterial improvements are made to Barker Road.
15. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocarion
regard.ing these utiliries. Applicant(s) should check with the applicable utility purveyor
and the Spokane County Engineer to determine whether applicant(s) or the utility is
responsible for adjustment or relocarion costs and to make arrangements for any
necessary work.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached shcets as noted.
2. Appropriate utility easements shall be indicated on copics of the prelirninaiy plat of
record for distiribution by the Planning Department to the utiliry conzpanies, Spokane
County Engineer and the Spokane County Health Distc-ict. Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat.
3. Sewage disposal method shall be as authorized by the Director of Utiliries, Spokane
County.
4. Water service shall be coordinated thrdugh the Director of Utilities, Spokane County.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is available
to each tract of the plat.
7. .Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
8. Prior to filing the final plat, the sponsor shall detnonstrate to the satisfaction of the
Spokane County Health District dlat a suitable site for on site sewage disposal systems
is available on Tract B.
9. Subject to specific application approval and issuance of permits by the health officer,
the use of an individual on-site sewage disposal system may be authorized.
10. The dedicatory language of the plat will state: "Subject to specific application approval
and issuance of pemlits by the Health Officer, the use of an on-site sewage system may
be authorized."
11. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
12. The final plat dedication shall contain the following statement: "The public water
system, pu.rsuant to the water plan approved by county and state health authorities, the
local fire protection district, County Building and Safety Department, and water
purveyor, shall be installed within this subdivision and the applicant shall provide for
individual domestic water service as well a.s fire protection to each lot/tract prior to sale
of each lotltract and prior to issuance of a building permit for each tract."
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Cornmissioners Resolufion No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is conditioned
on compliance with all rules and regulations of the Spokane County Health Disrrict and
is further conditioned and subject ta specific applicafion approval and issuance of
pemlits by the Hcalth District.

"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a perition for the formation of ULID by petition method pursuant to RCW

signing of a protest petition against the formarion of a ULID by resolution method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
this condition shall not prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the property as a result of improvements called for in conjunction
with the formation of a ULID by either petition or resoluaon method under RCW
Chapter 36.94."
3. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
4. The dedication shall state: "Each new dwelling unit shall be double-plumbed for
connection to future areawide collection systems."

The followinq "Conditions of Approval" for the above referenced subdivision
are submitted to the Spokane County Planninq Department for inclusion in the
"Findings and Order" should the short plat be approved.
E 1 That conditional approval of the plat by the County Engineer is given
subj ect to dedication of Right-of-Way and approval of the road system as
indicated in the preliminary plat of record.
E 6 No construction work is to be performed within the existing or proposed
Public Right-of-Way until a permit has been issued by the County
Engineer. All work is subject to inspection and approval by the County
Engineer.
E12 The applicant should be advised that individual driveway access permits
are required prior to issuance of a building permit for driveway
approaches to the County road system.
E13 Dedication of two feet of additional Right-of-Way along Barker Road.
E16 Existing County roads providing direct access to the plat shall be paved and/or curbed to Spokane County standards.
E18 That sidewalks are required along the arterial(s) on Barker Road.

E20 To construct the road improvements stated herein, the applicant may,

pursuant to RCW 36.88, as amended. At such time as an RID is created or
any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainaqe control and paving to
existing pavement) will be at the sole expense of the undersigned owner,
their heirs, grantees and assigns. This is applicable to Barker Road.
E21 As an alternative method of constructing the road improvement stated
herein, the applicant may, with the approval of the County Engineer,
accomplish the road improvements stated herein by joining and
participating in a County Road Project (CRP) to the extent of the
required road improvement. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned owner,
their heirs, grantees and assigns. This is applicable to Barker Road.
E22 That the following statement shall appear within the dedicatory language
of the final plat:
The owner(s) or successor(s) in interest agree to authorize Spokane

the RID by the property included therein, together with the amount
of any County participation, exceeds the cost and expense of formation

suff iciently developed. Provided, further, the owner(s) or
successor(s) shall retain the right, as authorized under RCW
36.88.090, to obj ect to any assessment ( s) on the property as a result
of the improvements called for in conjunction with the formation of
a RID by either petition or resolution method under Chapter 36.88 RCW,
and to appeal to the Superior Court the decision of the Board of
County Commissioners affirming the final assessment roll. It is
further agreed that at such time as an RID is created or any Road
Improvement project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving) will be at the
sole expense of the undersigned owner, their heirs, grantees and
assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten
(10) years from the date of execution below. However, the owner(s)
or successor(s) agree that if said RID waiver expires without
construction of the required improvements, the owner(s) or
successor(s) agree to construct the required improvements at their own
expense; pay to Spokane County the then estimated cost of the required
improvements to enable the County to complete the same; or furnish a
bond or other secure method suitable to the County (which may include
the execution of another RID waiver agreement), providing for or
securing to the County the actual construction of the improvements.
All of the requirements of this agreement shall run with the land and
shall be binding upon the owner(s), their successor(s) or assign(s).
This provision is applicable to Barker Road.
E24 The County Engineer has designated Typical Roadway Section Number Twoi
Minor Arterial Standard for the improvement of Barker Road which is
adjacent to the proposed development. This will require the addition of
approximately 13-15 feet of asphalt along the frontage of the
development. The construction of curbing and sidewalk is also required.
E32 The proposed plat shall be improved to the standards set forth in -
Spokane County Board of Commissioners Resolution No. 80-1592, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
E33 The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the dedication of additional Right of Way and the
roadway improvements herein specified.
~ E61 The County Arterial Road plan identifies Barker Road as a Princiual
Arterial. The existing right of way width of 60 feet is not consistent
with that specified in The Plan. In order to implement the Arterial
Road Plan it is recommended that in addition to the required right of
way dedication, a strip of property 18 feet in width along the Barker
Road frontage be set aside in reserve. This property may be acquired by
Spokane County at the time when Arterial Improvements are made to Barker
Road.
E90 The applicant should be advised that there may exist utilities either
underground or overhead affecting the applicants property, including
property to be dedicated or set aside for future acquisition. Spokane
County will assume no financial obligation for adjustments or relocation
regarding these utilities. The applicant should check with the
applicable utilities and Spokane County Engineer to determine whether
the applicant or utility is responsible for adjustment or relocation
costs and to make arrangements for any necessary work.
