l. Drainage easements, as platted and shown hereon, which are for the purpose of
installing, operating and maintaining drainage swales and drainage facilities, as conditions
of plat approval, are hereby granted to the pubiic.
Spokane County and its authorized agents are hereby crranted the right of ingress and
egress to, over, and from said easements for the purpose of inspection and emercrency
maintenance of water qualiry treatment swales ("208 swales") and other drainage
facilities, if not properly maintained by the oroperty owner. Spokane County does not
accept the responsibiliry to inspect or maintain che drainage easements or drainage
swales, nor does the County accept any liability for any failure by the lot owner(s) to
properly maintain such areas.
0 j 3. ` The property owners within this Plat shall be heid responsible for keeping open and
~ maintaining the surface path of natural or man-made drainage flow over and across their
respective properties.
4. The property owners within [his Plat shall maintain ail water quality creatment swales
("208 swales and drainage ditches situated on cheir respective properties, and any
portion of a?08 swale situated in the public right-or-way adjacent to cheir respective
properties, with a permanent crround cover as speciried on che current approved plans on
file at the County Engineer's Office. The propertv owners may install approved
shrubbery and/or trees which do not obstruct the flow and percolation of storm drainage
water in che 208 swale and drainage ditches, as indicaced by the current approved plans
on file with the County Engineer's Office.
5. The property uwner or his representative shall inform each succeeding purchaser of all
dr3inage easements on the properry and of llis responsibility for maintaining surface
drainage paths and swales within said easements.
6. Spokane Counry does not accept the responsibility of maintaining the drainage course on -
private lots within drainage easements or floodplain areas, nor the responsibiliry for any
damagre whatsoever, including, but not limited co, inverse condemnation to any properties
due co deticient construction and or maintenance of drainage courses in drainage
easements on private property. .

7. If the property owner fails to maintain the surface path of natural or man-made drainage
flow, or the drainage swale, a notice of such failure may be given to the property owner.
If not corrected within the period indicated on said notice, Spokane County has the right
to correct the maintenance failure, or have it corrected, at the expense of the property
owner.
8 Any building that is constructed on a lot in this Plat shall be set at such an elevation so
as to provide positive drainage away from any drainage entry point to the building
(including but not limited to a window well, a window unprotected by a window well,
or a doorway). Said positive drainage shall consist of a minimum slope of 3% away from
the building for a distance of at least 10 feet from the building. The lots shall be arraded
so that either a) all runoff is routed away from the building, and conveyed over the lot
to a natural drainage swale or approved drainage facility, or b) drainage intercepted on
the lot is disposed of on che lot in an approved drainage facility. The approved drainage
facility shall be constructed in accordance with che approved plans on tile at the Counry
Engineer's Office. Any revisions to the approved drainage plans must be approved by
the Counry Engineer's Office prior to construction of said revisions.
If there are continuous swales for water quality treatment (ZOS sfrip swales) on the Parcel:
9. Driveway access permits for driveway approaches eo the County road system are required
prior to issuance of a building permit. This approacn shall be constructed in accordance
wich the approved plan on zile in the County Engineer's Office.
If a floodplai.n occurs oa the Parcel:
10. Development within this Plat shall conform the requirements of the National Flood
Insurance Program, and Chapter 3.20 of the Spokane Counry Code. The lowest floor,
including basement tloor, tor any structure shall be constructed in accordance with the
requirements of the Spokane Counry Flood Zone Regulations in etfect at the time a
building permit is issued. Purchasers of property in this subdivision are warned ot
possible flooding or ponding and the of the potential requirement to purchase Flood
Insurance. This warning shall be carried in each and zvery deed co transfer ownership
of any and all properry within this plat in the Area of Special Flood Hazard.
11. An approved grading plan exists for Lot(s) , , of Btock . Grading

SHQRT PLAT NO. SP-850-93 ) CONCLUSIONS AND
DECISION
THIS MATTER, an application for subdivision of land, from Daisy Smith has beer~ rhceived
and decided upon, pursuant to Spokane County Subdivision regulations, on the
day of August, 1993.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for .
rendering the decision by the Spokane County Director of Planning.
2. The proposa.l is to divide approximately 13,000 square feet into 2 lots for single family
dwellings and those uses permitted in the underlying zone.
3. The proposal is generally located north of and adjacent to Fourth Avenue approximately
350 feet west of Sullivan Road in the NE 1/4 of Section 23, Township 25 North,
Range 44 E.W.M., Spokane County, Washington.
. 4. The existing zoning of the property described in the application is Urban Residential-7
(UR-7) previously established as Agricultural (A) zoning in 1942 and reclassified to
Urban Residential-3.5 (UR-3.5) on January l, 1991 consistent with the Program Co
Implement the Spokane County Zoning Code. Pursuant to RCW 58. ].7.195 the
proposal does conform to the requirements of the existing Urban Residential-7 (UR-7)
zone.
5. The Spokane County Hearing Examiner Committee approved a zone reclassification
(ZE-18-93) from Urban Residential-3.5 (UR-3.5) to Urban Residenrial-7 (UR-7) for
the subject property on July 22, 1993.
6. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed are generally in accord with this category.
7. The site is flat with one existing single family residence and accessory structure loc;ated
on the Fourth Avenue frontage. Surrounding uses are primarily residential.
8. The required public notice was provided for this proposal and agencies having a
potential interest in the project were notified and recommendations solicited.
9. No written comments were received from adjoining property owners.
10. The proposal is located within the Public Transit Benefit Area (PTBA) boundary.
Route No. 21, Valley/24 th Avenue provides service near the site.
11. Recognizing the recommended conditions and Spokane County development standards,
the proposed short subdivision makes appropriate provisions for the public health,
safety and general welfare and that the public use and interest will be served by platting
the subdivision.
. 12. The subdivision proposal is generally consistent with RCW 58.17 and the County
- subdivision regulations, promoting the public health, safety and general welfare in
accordance with standards established by the state and Spokane County. The Planning
Department has considered the provision of public facilities as cited in RCW 58.17.110
(2). More specifically:

g. parks and recreation facilities

13. The Spokane County Arterial Road Plan identifies Fourth Avenue as a Collector
Arterial with an exisring right-of-way width of 40 feet and a future right-of-way width
of 70 feet. The County Engineer has requested 10 feet of de,dication for right-of--way
and that a strip of property 5 feet in width be set aside as a Future Acquisition Area
(FAA) along Fourth Avenue. Third Avenue is designated as a Local Access Street on
the .Spokane County Arterial Road Plan with a future right-of-way width of 60 feet. In
order to implement the Arterial Roaci Plan, the Spokane County Engineer is requesring
5 f.eet of dedication for right-of-way along Third Avenue.
14. The proposed short plat will be served by a public water system. Waste water disposal
will be as authorized by the Director of Utilities.
15. The Central Valley School District No. 356 has commented on the proposed short plat.
The District has indicated that existing school faciliries are inadequate to serve che
proposed short plat and has requested a voluntary agreement to provide adequate capital
facilities as required by Revised Code of Washington (RCW) 58.17.110. The
Planning Deparmient must assume that the agency of jurisdiction, in this case the
Central Valley School District, has made a reasonable request. Approval of this short
plat should include conditions requiring that provisions for adet]uate facilities be in
place prior to recording this final plat in the form of a written agreement between the
owner and the school district.
16. The Spokane County Parks Department has commented on the proposed short plat.
The Parks Department has requested a voluntary agreement be completed between the
Parks Department and property owner to mitigate impacts to the County Park system.
County legal counsel has indicate,d such agreements can be required. The Spokane
County Planning Department recommends the property owner negotiate with the
Spokane County Parks Department to provide appropriate facilities as required by the
Revised Code of Washington (RCW) 58.17.110. Approval of this short plat should
include conditions requiring that provisions for appropriate facilities be in place prior to
recording this final plat in the form of a written agreement between the owner and the
Spokane County Parks Department
17. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a). Note: An Envi.ronmental ChecklYst was
submitted for the subject property by the sponsor for zone reclassification ZE-18-93
subsequent to which the Planning Department issued a Determinarion of .
Nonsignificance ("DiVS No comments were rECeived to alter rhe "DNS".
DECISit)N
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-850-93 is hereby APPROVED until September 1, 1996, subject to conditions noted
below. Most of the conditions of approval shall be accomplished by the applicant anci/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval appl_y to applicant(s), owner(s) of the
' property, heirs, assigns or any successvrs-in-interest to property.
PLANNING DEPA,RTMENT CONDI'I,IONS
1. All conditions imposed by the Planning Department shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns and successors.
2. The short plat proposal shall comply with all conditions of approval as conrained in
Planning Department file No. ZE-15-93.
3. The proposal shall comply with the Urban Residential-7 (UR-7) and Aquifer Sensitive
Area (ASA) Overlay zones as amended.

FI.NDINGS AND DECTSION SP-850-93 Page 3 4. The final plat shall be designed substantially in conformance with the preliininary plat
of record. No increase of density or number of lots shall occur without a change of
cond.ition application submittal and approval.
5. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
6. Appropriate road name(s) shall be indicated.
7. The preliminary plat is given condirional approval for thY-ee (3) years, specifically to September 1, 1996. The applicant may request an extension of time by submithng a
written request approximately forty-five (45) days prior to the above expiration date.
8. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of urility easements by appropriate utility companies shall be received
with the submittal of the final plat.
9. Three (3) current certificates of title shall be furnished to the Planning Department prior
to filing the final plat.
10. The Spokane County Planning Department shall prepare and record with the County
Auditor a Title Notice specifying a futLue land acquisition area for road right-of-way
and utilities. The reserved future acquisition area Title Notice shall be released, in full
or in part, by the-Planning Department. The notice should be recorded within the same
time frame as an appeal and shall pravide the following:
a. At least 5 feet of reserved future acquisition area for road right-of-way and
utilities, in addition to the existing and/or newly dedicated right-of-way along
Fo«rth Avenue. NOTE: The County Engineer has required 10 feet of new
dedication.
b. Future building and other setbacks required by the Spokane County Zoning Code
shall be measuxed from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs should
be located within the future acquisition area for road right-of-way and uCilities. If
any of the above improvements are made within this area, they shall be relocated
at the applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as landscaping,
parking, surface drainage, drainfield, signs or others) shall be considered interiin
uses.
e. The property owner shall be responsible for relocating such "interim"'
improvements at the time Spokane County makes roadway improvements after
acquiring said future acquisition area.
11. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. 7'he dedication shall contain the following
statemen t:
"Side yard and rear yard setbacks shall be deternuned at the time builciing perrnits are •
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
12. A plan for water facilities adequate for domestic service and fire proYection shall be
approved by the water purveyor, appropriate fire protecrion district, County Building &
Safety Department and County Health District. The agencies will certify on the Water
Plan, prior to the filing of a final plat, that the plwl is in conformance with their
respective needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor.
13. The water purveyor shall certify that appropriate contractual arrangements and schedule
of improvements have been made with the plat sponsor for construction of the water
- system in accordance with the approved Water Plan. The time schedule shall provide
for completion of the water system and inspection by the appropriate health authorities
, .

prior to application for building permits within the final plat. The anangements or
agreements shall include a provision holding Spokane County and the purveyor
harmless from claims by any lot purchaser refused a building permit due to the failure
of the subdivision sponsor to satisfactorily complete the approved water system.
14. The final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state
health authorities, the local fire protection district, County Building & Safety
Department and water purveyor, shall be installed within this subdivision, and the
applicant shall provide for individual domestic water service as well as fire protection to
each lot prior to sale of each lot and prior to issuance of a building permit for each lot."
15. No building permit will be issued for any lot within the final plat until certified by a
Washingtan state-licensed engineer that "the water system has been installed pursuznt
to the approved Water Plan for the final plat" including a signed license stamp. The
certification may be in the form of a letter, but is preferred to be certified on a copy of
the Water Plan as a schematic map showing the "as-built" water system.
16. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyor and fire protection district stating that simple connecrions to
an existing, approved water system will provide adequate donlestic and fire protection
water to ensure the public health, safety and general welfare.
17. A survey is required prior to the filing of a final plat.
18. The Owner shall negotiate with the Central Valley School District and the Spokane-
County Parks Department and submit a recorded copy of the agreement making
appropriate provisions for public schools and parks prior to finalization and recording
of this short plat. The agreement shall provide a written description of the subject
property to which the agreement applies and also state the dollar amount and any other
agreed to mitigaring measures.
The Owner shall also notify any potential purchasers who have made an agreement to
purchase praperty within said short plat pursuant to the Revised Code of Washington
(58.17.205), that adequate provisions for school facilities and parks must be made
conditioned on a future agreement between the plattor and school district and parks
department.
Voluntary agreements between the Owner, the School District and Parks Department
shall conform to the requirements of the Revised Code of Washington Chapter 82.02.
COUNTY ENGINEER'S DEPARTMENT CONDITIO`'S
1. The conditional approval of the plat is given by the County Engineer subject to dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
2. No construction work is to be performed within the existing or proposed public right-
of-way until a perniit has been issued by the County Engineer. A11 work is subject to
inspection and approval by the County Engineer.
3. Individual driveway access permits are required prior to issuance of a building permit
for driveway approaches to the county road system.
4. Dedication of 10 feet of additional right-of-way along Fourth Avenue is required.
5. Dedication of 5 feet of addirional right-of-way along Third Avenue is required.
6. Exisring county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
7. Sidewalks are required a.long the arterial on Fourth Avenue.
8. The word "applicant" sha11 include the owner or owners of the property, his heirs,

9. To construct the road improvements suited herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any petirion or resolution
which purpose is the formation of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Third and Fourth Avenue.
10. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required road improvements. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing .
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Third and Fourth Avenue.
11. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of a Road Improvement District (RrD) by the
petition method pursuant to Chapter 36.88 RCW, which petirion includes Che owner(s)'
property, and further not to object, by the signing of a ballot, to the formation of an
RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution
includes the owner(s)' property. If an RflD is formed by either the petition or resolution
method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further
agree:
(a) that the improvement(s) or construction contemplated within the proposed RTD is
feasible;
(b) that the benefits to be derived froin the formation of the RLD by the property
included therein, together with the amount of any County participation, exceed the
cost and expense of formation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as authorized
under RCW 36.88.090, to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the formation of an RID by either petition
or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court
the decision of the Board of County Commissioners affirming the final assessment roll.
It is further agreed that at such time as an RID is created or any Road Improvement
Project is sanctioned by Spokane County, the improvements required (curb, sidewalk,
drainage control and paving) will be at the sole expense of the undersigned owner(s),
their heirs, grantees and assigns without participation by Spokane County.
The RID waiver contained in this agreement sha11 expire after ten (10) yeaz-s from the
date of execution below. However, the owner(s) or successor(s) agree that if said RTD
waiver expires without construction of the requixed improvements, the owner(s) or
successor(s) agree to construct the required improvements at their own expense, pay to
Spokane County the then estimated cost of the required improvements to enable the
County to complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execution of another RTD waiver agreement) providing
for or securing to the County the actual construction of the improvements.
All of the requixements of this agreement shall i-un with the land and shall be binding
upon the owner(s), their successor(s) or assign(s)." This provision is applicable to
Third and Fourth Avenue. 12. The County Engineer has designated Typical Roadway Section Number Two, Collector
Arterial standard for the improvement of Fourth Avenue, which is adjacent to the
proposed development. This will require the addifion of approximately 10-12 feet of
asphalt along the frontage of the development. The construction of curbing and
sidewalk is also required.

13. The County Engineer has designated Typical Roadway Section Number Two Loc;al
Access standard for the improvement of Third Avenue, which is adjacent to the
proposed development. This will require the addition of approximately 8-10 feet of
asphalt along the frontage of the deve►opment. The construcdon of curbing is also
required.
14. The proposed subdivision shall be improved to the standards set forth in Spokane
C;ounty Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes regulations for roads, approaches, drainage and fees in new
construction.
15. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the exisring county road system wairants the
dedication of addirional right-of-way and the roadway improvements herein specified.
16. The County Arterial Road Plan identifies Fourth Avenue as a Collector arterial. The
existing right-of-way width of 40 feet is not consistent with that specified in the Plan.
Zn order to implement the Arterial Road Plan, in addition to the required right-of-way
dedication, a strip of property 5 feet in width along the Fourth Avenue frontage shall be
set aside in reserve. This property may be acquired by Spokane County at the time
when arterial improvements are made to Fourth Avenue.
17. There may exist utilities, either undergrourid or overhead, affecring the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocation
regarding these utilities. Applicant(s) should check with the applicable utility purveyor
and the Spokane County Engineer to detem-iine whether applicant(s) or the utiliry is
responsible for adjustment or relocation costs and to ma.ke arrangements for any
necessary work.
COUNTY HEALTH DISTRTCT CnNDITI()NS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies, Spokane
Caunty Engineer and the Spokane County Health District. Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water service shall be coordinated through the Director of Utilities, Spokane County. .
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonsrrate to the sabsfaction of the
Spokane County Health District that an adequate and potable water supply is available
to each lot of the plat.
7. Prior to filing the final plat, the sponsor shall present evidence thac the plat lies within
the recorded service area of the water system proposed to serve the plat.
. 8. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health Dist-ict that a suitable site for an on-site sewage disposal
• system is available on tract B.
9. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that the existing on-site sewage disposal system
serving the residence located on Tract A is wholly located within the boundaries of the
tract.
10. Subject to specific applicarion approval and issuance of permits by the 1 Iealth Off cer,
the use of an individual on-site sewage system may be authorized.

13. The final plat dedication shall contain the following statement: "The public water
system, pursuant to the water plan approved by county and state health authorities, the
local fire protection district, County Building and Safety Department, and water
purveyor, shall be installed within this subdivision and the applicant shall provide for
individual domesric water service as well as fire protection to each tract prior to sale of
each tract and prior to issuance of -a building permit for each tract."
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Bodr'd of County Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is conditioned
on compliance with all rules and regulations of the Spokane County Health District and
is further conditioned and subject to specific application approval and issuance of
permits by the Health District.
2. The dedication shall state:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of ULrD by petition method pursuant to RCW
36.94, which petition includes the owner(s)' property; and further not to object by the
signing of a protest petition against the formation of a UL.ID by resolurion method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVrDED,
this condition shall not prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the property as a result of improvements called for in conjunction
, with the formation of a ULID by either petition or resolution method under RCW
Chapter 36.94."
3. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended. .
4. The dedication shall state: "Each new dwelling unit shall be double-plumbed for
connection to future areawide collection systems."

1. The applicant shall contact the Department of Buildings at the earliest possible stage of

Attached is a copy of the application and proposed preliminary Short Plat map submitteri by
Daisy Smith for the subdivision of 13,5(}0 square feet into 2 lots for one existi.ng single
family residence and one new single family residence.
The applicant has submitted a zone reclassification request (ZE-18-93) for said property
frorn Urban Residenrial-3.5 (UR-3.5) to Urban Residenrial-7 (UR-7), which will be heard
by the Spokane Counry Hearing Examiner Committee on July 22, 1993. Subdivision
approval is contingent upon a zone reclassification.
