I. Chair Graham called the meeting to order at 6:00 p.m. Commissioners, staff and audience stood for
the pledge of allegiance. Secretary Deanna Horton took roll and the following members and staff were
present:

Hearing no objections Commissioner Stathos was excused from the meeting.
II. AGENDA: Commissioner Johnson moved to accept the March 23,2017 agenda as presented. The vote
on the motion was five in favor,zero against and the motion passed.
III. MINUTES: Commissioner Johnson moved to approve the March 9, 2017 minutes as presented. The
vote to approve the motion was five in favor, zero against, the motion passes.
IV. COMMISSION REPORTS: The Commissioners had no reports.
V. ADMINISTRATIVE REPORT: There was no administrative report.
VI. PUBLIC COMMENT: There was no public comment.
VII. COMMISSION BUSINESS:
a) Public Hearing: STV-2017-0002, Street Vacation of a portion of McMillian Road and an
unnamed Right-of-Way on the City's border.
Chair Graham opened the public hearing at 6:04 p. m. Planner, Karen Kendall presented the
Commissioners an overview of a City initiated street vacation located in the northeast corner of the
City. The request is to vacate a portion of McMillian Road 30 feet in width and an unnamed ROW
16 feet in width along the City's eastern border. The parcels are located east of Barker and north
of the railroad ROW which runs north of Euclid Avenue. The surrounding parcels have the same
owner and are zoned Industrial. Currently the parcels are vacant. Ms. Kendall explained if the
vacation is approved,one of the conditions would be to make sure the parcels are reconfigured to
have access. It is recommended to approve the vacation with conditions.
Having no one who wished to testify, Chair Graham closed the public hearing at 6:10 p.m.
Commissioner Johnson moved to recommend approval of STV2017-002. This motion was
approved five in favor, zero against.
b) Findings of Fact: STV-2017-0002, Street Vacation of a portion of Wilbur between Pines and
Bowdish.
Ms. Kendall presented the staff report and the Planning Commission's Findings of Fact based on
the public hearing for STV-2017-0001, from the March 9,2017 public hearing.
Commissioner Johnson moved to approve the Planning Commission findings for STV-2017-0001.
The vote on this motion was five in favor, zero against, the motion passed.
c) Update on items to come: Senior Planner Lori Barlow gave a brief overview of items which staff
had recently given to the City Council. City Council would like to investigate the possibility of
allowing shipping containers as storage on residential property. Both Spokane and Spokane County
do allow them. Concerns which were raised where aesthetics,and the possibility of the containers
having had hazardous materials in them. Commissioner Graham clarified this would only be

considered for an above ground installation. There is a renewed interest in urban farming and
animal keeping. The some of the subjects which have come up are, reducing water usage by
collection of rain water and gray water for irrigation, this is regulated by the Dept. of Ecology.
Composting toilets cannot be substituted if you can connect to city sewer. Selling produce which
someone grows in their own yard is allowed by state statue. Council would like to allow smaller
animals to be allowed on smaller lots. Currently other than chickens, animals are only allowed on
lots consisting of one acre or more. The City of Spokane and Spokane County allow smaller
animals on some lots based on height and weight. Staff will be bringing forward discussion for
review by the Planning Commission.
VIII. GOOD OF THE ORDER: There was nothing for the good of the order.
IX. ADJOURNMENT: Commissioner Johnson moved to adjourn the meeting at 6:28 p.m. The vote on

PROPOSAL DESCRIPTION: Request to vacate 1,975 feet of McMillan Street in length by 30 feet
in width and 1,657 feet in length of unnamed right-of-way by 16 feet in width.

PROPOSAL LOCATION: The area of vacation is located northeast of the intersection of Barker
Road and Euclid Avenue adjacent to five parcels (55053.0118, 55053.0119, 55053.0113, 55053.0114
and 55053.0115) and two parcels located in Spokane County (55054.9018 and one parcel with three
numbers 55055.9070, 55055.9071 and 55055.9072), further located in the SW quarter of Section 9,
Township 25 North, Range 45 East, Willamette Meridian, Spokane Valley, Washington
BACKGROUND: On February 21, 2017 the City Council passed Resolution 17-004 initiating the
vacation of two unimproved rights-of-way (ROW), appearing to have been dedicated by the West
Farms Irrigated Tracts No. 1 Plat in 1911. The ROW width is 30 feet on McMillan Street and 16 feet on
the unnamed secondary ROW. The vacation of McMillan Street is approximately 59,250 square feet
and approximately 26,512 square feet of ROW. The vacation will remove physical barriers that may
impede future development. The intent is to allow underutilized industrial land to be considered for
future development.
This request is being initiated as part of the City's Economic Development Program. The rights of
ways, as they currently exist, are not needed and limit the usability of the adjacent parcels.
The proposed vacation will eliminate public ROW access to parcel 55053.0114 Pursuant to Spokane
Valley Municipal Code (SVMC) 20.20.090.F states "Every lot shall have direct access to a paved
public street,private street, or an easement for a private driveway." The owner may consolidate the
parcels, reconfigure the parcels with a Boundary Line Adjustment, or create an easement for access
as proposed in the recommended conditions. Adequate vehicular access will be provided at the time
of development.

I. PROPERTY INFORMATION

II. STAFF ANALYSIS OF STREET VACATION PROPOSAL
A. COMPLIANCE WITH SPOKANE VALLEY MUNICIPAL CODE(SVMC)TITLE 22.140.030
Findings:
1. Whether a change of use or vacation of the street or alley will better serve the public?
The area proposed to be vacated is unimproved. The vacation is expected to have no impact
on the general public as surrounding parcels currently do not use ROW for access.
2. Whether the street or alley is no longer required for public use or public access?
The subject ROW is currently vacant land not being utilized for public access and is not
required for current or future public access.
3. Whether the substitution of a new and different public way would be more useful to
the public?
There is no need for a new and different public way.
4. Whether conditions may so change in the future as to provide a greater use or need
than presently exists?
It is not anticipated that changes would occur in the future which would require the use of
the subject right-of-way for public access. Future development may require improvements,
which will be reviewed and right-of-way needs assessed at such time.

5. Whether objections to the proposed vacation are made by owners of private property
(exclusive of petitioners) abutting the street or alley or other governmental agencies or
members of the general public?
No objections or public comment has been received.
Conclusions:
The findings confirm criteria set forth in SVMC 22.140.030 have been met.
B. COMPLIANCE WITH SVMC TITLE 21—ENVIRONMENTAL CONTROLS
The Planning Division has reviewed the proposed project and has determined that the project is
categorically exempt pursuant to WAC 197-11-800 and SVMC 21.20.040 from environmental
review under the provisions of the State Environmental Policy Act(SEPA).
III. PUBLIC COMMENTS
Findings: One public comment was received following the notice of public hearing issued, mailed
and posted on March 3, 2017.
A Notice of Public Hearing signs was posted on the property March 2, 2017 and public hearing
notices were mailed to all petitioners of the vacation the same as the three parcels abutting the two
ROW on the same day. Notices were posted in the Spokane Valley Public Library, City of Spokane
Valley main reception area and CenterPlace Event Center on March 3, 2017. Lastly, the notice was
published in the Spokane Valley Herald and Exchange on March 3, 2017 and March 10, 2017.
Staff received one public comment from the abutting property owner to the east(parcel
55055.9070), which noted no concerns.
Conclusion(s):
Staff concludes that adequate public noticing was conducted for STV-2017-0002 in accordance
with adopted public noticing procedures. No concerns were raised in public comment received.

Where necessary, comments have been incorporated into the recommended conditions of approval
in Section V.
V. OVERALL CONCLUSIONS AND FINDINGS
Staff concludes that STV-2017-0002 as proposed is generally consistent, or will be made
consistent, through the recommended conditions of approval based on the approval criteria stated
herein.
RECOMMENDATION:
Approve the request to vacate 1,975 feet of McMillan Street in length by 30 feet in width and 1,657
feet in length of right-of-way by 16 feet in width, subject to the following:
1. The vacated property shall be transferred into the abutting parcels ((55053.0118, 55053.0119,
55053.0113, 55053.0114 and 55053.0115) as shown on the record of survey created and
recorded with Spokane County Auditor's Office pursuant to condition 7.
2. Following the City Council's passage of the Ordinance approving the street vacation, a record
of survey of the area to be vacated, prepared by a registered surveyor in the State of
Washington, including an exact metes and bounds legal description, and specifying any and all
applicable easements for construction, repair and maintenance of existing and future utilities
and services, shall be completed.
3. The surveyor shall locate a monument at the intersection of the centerline of the vacated right-
of-way with each street or right-of-way in accordance with the standards established by the
SVSS.
4. The zoning district designation of the properties adjoining the street to be vacated shall be
automatically extended to the center of such vacation, and all area included in the vacation shall
then and henceforth be subject to all regulations of the industrial district. The adopting
Ordinance shall specify this zoning district extension inclusive of the applicable zoning district
designations.
5. The record of survey and certified copy of the Ordinance shall be recorded by the City Clerk in
the office of the Spokane County Auditor.
6. All conditions of City Council authorization shall be fully satisfied prior to any transfer of title
by the City.

The following findings are consistent with the Planning Commission's decision to recommend
approval of File No. STV-2017-0002, vacating McMillan Street and unnamed right-of-way.
A. Background:
1. Chapter 22.140 of the Spokane Valley Municipal Code (SVMC), governing street
vacations, was adopted in September 2007 and became effective on October 28,
2007.
2. The City-initiated street vacation, STV-2017-0002, proposes to vacate 1,975 by 30
feet of McMillan Street and 1,657 by 16 feet of unnamed right-of-way.
3. The Planning Commission held a public hearing on March 23, 2017 and
recommended conditional approval of the street vacation (STV-2017-0002) to City
Council.
B. Planning Commission Findings:

PREVIOUS PLANNING COMMISSION ACTION TAKEN: N/A
BACKGROUND: The City Council reviewed the Animal Keeping Regulations at the March
21, 2017 meeting and concluded that the current Animal Keeping Regulations should be updated
to meet current trends. The Council considered several sets of regulations and concluded that the
City of Spokane's regulations were noteworthy and advised they be considered during the update
process. Additionally, the Council requested that produce sales on private property in residential
areas be addressed in the zoning code.
In 2007 the City adopted Ordinance 07-015 that provided regulations for Animal Keeping on
large lots. In 2011 the City adopted Ordinance 11-004 that allowed chickens in residential areas,
and in 2015 the City adopted Ordinance 15-010 establishing regulations for hobby beekeeping.
Staff will present an overview of the City regulations pertaining to various urban agriculture
activities, highlight Spokane's regulations addressing animal keeping, and produce sales on
private property.

19.65.020 Agriculture and animal.
A.Animal Raising and/or Keeping.Where permitted,the keeping of poultry and livestock,excluding swine and
chickens,is subject to the following conditions:
1.Minimum Lot Requirements.
a.In residential zones,the lot shall equal or exceed one gross acre in area,except as set forth in SVMC
19.65.020(A)(7)and(9).
b.In mixed-use zones with legally established residential uses,the lot shall equal or exceed one gross acre
in area.
2.The keeping of swine is prohibited.
3.Any permanent or temporary structure housing poultry or livestock including,but not limited to,any stable,
paddock,yard,runway,pen,coop,hutch,or enclosure,or any manure pile,shall not be located within 75 feet
from any dwelling.
4.Permanent or temporary structure housing poultry or livestock including,but not limited to,any stable,
paddock,yard,runway,pen,coop,hutch,or enclosure,or any manure pile,shall not be located within the front
yard setback or be closer than 10 feet from any side property line.
5.The keeping of animals and livestock is limited as follows:
a.Not more than three horses,mules,donkeys,bovines,llamas,or alpacas shall be permitted per gross
acre;or
b.Not more than six sheep or goats shall be permitted per gross acre;or
c.Any equivalent combination of SVMC 19.65.020(A)(5)(a)or(b).
6. Small Animals/Fowl.A maximum of one small animal or fowl(excluding chickens),including duck,turkey,
goose,or similar domesticated fowl,or rabbit,mink,chinchilla,or similar animal,may be raised or kept per
3,000 square feet of gross lot area.In addition,a pen,shed,coop,hutch,or similar containment structure shall
be constructed prior to the acquisition of any small animal/fowl and shall be kept a minimum of 20 feet from
the front property line and five feet from side and rear property lines.
7.In residential areas,the keeping of chickens is subject to the following conditions:
a.A maximum of one chicken may be raised or kept per 2,000 gross square feet of lot area,with a
maximum of 25 birds allowed;
b.The keeping of roosters is prohibited;
c.Pens,coops,hutches,or similar containment structures shall be kept a minimum of 20 feet from the
front property line and five feet from side and rear property lines;
d.Pens,coops,hutches,or similar containment structures shall be kept a minimum of 25 feet from
dwellings on neighboring properties;and
e.All chickens shall be contained within the subject property.
8. Stables,paddocks,yards,runways,pens,coops,hutches,enclosures,structures,pastures,and grazing areas
shall be kept in a clean and sanitary condition.
9.In residential areas,hobby beekeeping is subject to the following conditions:
a.The number of beehives shall be limited to one beehive per 4,356 gross square feet of lot area;

b.Beehives shall be set back a minimum of five feet from a side or rear property line and 20 feet from the
front property line;
c.A flyaway barrier shall be provided that is at least six feet high and consists of a solid wall,solid
fencing material,dense vegetation,or combination thereof,that is parallel to the side or rear property
line(s)and extends beyond the beehive(s)in each direction that bees are forced to fly at an elevation of at
least six feet above ground level over the property lines in the vicinity of the beehives;
d.Beekeepers shall maintain an adequate supply of water for bees located close to the hives;and
e.The beekeeper shall be certified by the Washington State Beekeeper's Association.
B.Animal Shelter.In the CMU zone,animal shelters shall comply with the following conditions:
1.Not have outside runs;
2.Provide human supervision in any outdoor areas;
3.Be located along an arterial;and
4.Demonstrate compliance with noise standards for a commercial noise source as identified by WAC
173-60-040.
C. Community Garden.Produce may be sold pursuant to RCW 36.71.090 as adopted or amended.
D.Kennels,Doggie Day Care Facilities,and Kennels Associated with Veterinarian Clinics.Where permitted in
commercial and mixed-use zones,these uses shall comply with the following conditions:
1.Not have outside runs or areas;
2.Provide adequate soundproofmg for structures housing animals pursuant to Chapter 173-60 WAC;
3.Provide one parking space for every 10 animal confinement areas;and
4.Demonstrate compliance with noise standards for a commercial noise source as identified by WAC
173-60-040.(Ord. 16-018 §6(Att.B),2016).

A. Where Permitted.

2. Animal Enclosure Setbacks.
A structure or enclosure for animals shall meet the setback requirements for
accessory structures. A side yard waiver may be used to reduce the side yard
setback for covered accessory structures.
3. Animal Enclosure.
Animal enclosures must follow the development standards for accessory
structures in residential zones as stated in SMC 17C.110.225 Accessory
Structures.
4. The owner or keeper of a large domestic animals shall keep the animal in a
secure structure, enclosure or fenced lot or otherwise control the animal with
an appropriate harness or retraining device capable of safely controlling the
animal.
5. Breeding of large domestic animals shall comply with SMC 17C.190.500.

A. Where Permitted.
The keeping of small domestic animals is permitted outright in the RA, RSF, RTF,
RMF, and RHD zones and any zone that permits dwelling units. The definition of
small domestic animal is stated in chapter 17A.020.040 Al 2 SMC, Definitions.
B. Standards Applicable to Keeping of Small Domestic Animals
1. The following ratios of area to animals apply:
a. Small Domestic Animals
i. One animal or fowl, other than small livestock, per one thousand
square feet of lot area.
ii. One small livestock per two thousand five hundred square feet of
lot area. The calculation of the number of small domestic animals
shall be cumulative and the aggregate of total number of small
domestic animals shall not exceed the number permitted in this
section. For example, a ten thousand square foot lot may be
permitted for ten chickens (ten times one thousand) or four
miniature goats (four times two thousand five hundred) but not
both.
2. Owners of small domestic animals, including small livestock as defined in
SMC 17A.020.040(AI)(2)(c) but excluding chickens, shall obtain animal
keeping certification from Washington State University prior to keeping the
animal demonstrating that the owner has completed training relating to the
safe and proper care of a small domestic animal, including, but not limited to:
a. appropriate shelter, food, and veterinarian care (including rabies and
other vaccinations when appropriate),
b. breeding,

c. animal waste disposal and potential hazards related to the use of
domestic animal and livestock waste in composting,
d. potential sources of zoonotic and enteric diseases, routes of
transmission, and methods of preventing human illness diseases, and
e. noise and odor control.
Owners of small domestic animals whose ownership pre-date the requirement
of the certification shall have six months from the effective date of this section
to obtain the certification. The certification shall be specific to the species of
small domestic animal. Maintaining the animal under conditions that do not
satisfy the standards set forth in the certification shall be a violation of this
subsection and may require the owner to complete additional training through
WSU as a condition to maintaining the certification.
3. Roosters and peacocks are only allowed in RA zone within the City.
4. Male small livestock must be de-scented and/or neutered using humane
standards.
5. Animal Enclosure.
An animal enclosure in a zone other than RA shall only be allowed to be
constructed on a lot that contains a primary residential structure or on an
adjacent lot when the two lots are occupied by the same owner or tenant.
Animal enclosures must follow the development standards for accessory
structures in residential zones as stated in SMC 17C.110.225, Accessory
Structures.
6. Animal Enclosure Setbacks.
A structure or enclosure for animals or fowl shall meet the setback
requirements for accessory structures. A side yard waiver may be used to
reduce the side yard setback for covered accessory structures.
7. The owner or keeper of a small livestock shall keep the animal in secure a
structure, enclosure or fenced lot or otherwise control the animal with an
appropriate harness or retraining device capable of safely controlling the
animal.
8. The slaughter and processing of such an animal is subject to all city, state and
federal regulations regarding processing and sale of animals for human
consumption.

A. Where Permitted.
Beekeeping is allowed as an accessory use on any lot occupied by a single-family
residence that is in the RA, RSF, RTF, RMF and RHD zones. Beekeeping for
educational or research purposes by an institution such as college, high school or
agricultural extension office is allowed as a Type II conditional use permit in all
zones, subject to the requirements of subsection (B)(1) through (5) below.
B. Standards Applicable to Beekeeping.
Beekeeping is subject to the following standards:
1. Location, Density and Maintenance of Colonies.
a. The number of colonies is limited to one colony per four thousand three
hundred fifty square feet of lot area, up to a maximum of eight colonies;
and
b. Colonies shall be setback a minimum of twenty-five feet of any property
line, except that a colony may be situated within ten feet of a side lot line
or rear lot line provided the following provisions are met:
i. The beehives are isolated from public access by a security fence
as required under SMC 17C.110.230(F); and
ii. The beekeeper establishes and maintains a flyway barrier at least
six feet in height consisting of a solid wall, solid fencing material,
dense vegetation or combination thereof that is parallel to the
property line and extends ten feet beyond the colony in each
direction so that all bees are forced to fly at an elevation of at least
six feet above ground level over the property lines in the vicinity of
the colony; or
iii. The colony is situated ten feet or more above the grade of the
nearest adjoining property line.

2. Colonies shall be maintained in movable-frame hives with adequate space and
management techniques to prevent overcrowding and swarming.
3. In any instance in which a colony exhibits aggressive or swarming behavior,
the beekeeper must ensure that the colony is re-queened. Aggressive
behavior is any instance in which unusual aggressive characteristics such as
stinging or attacking without provocation occurs.
4. Every beekeeper shall maintain an adequate supply of water for bees located
close to each colony.
5. Registrations and Training.
a. All colonies shall be registered with the director of the state department
of agriculture pursuant to RCW 15.60.021 no later than April 1st of each
year.
b. The beekeeper shall have completed the requirements for
apprenticeship level of the Washington State Beekeeper's Association
master beekeeper certification program.
