APPLICANT: Norman Brooks )
WHEREAS, the Board of County Commissioners of Spokane County ("Board") has
received an application from Norman Brooks to alter the Final Short Plat, SP-859-93, by dividing
Lot "B" into 2 lots, vvhich will increase the original number of lots from 2 to a 3 lot short plat; and
WHEREAS, the application was signed by the owner, Norman Brooks, of the affected lot of
the final short plat requested to be altered, being greater than the majority of owners required by
RCW 58.17.215; and
WHEREAS, the Final Short Plat, SP-859-93, was recorded less than 5 years ago on
September 23, 1993 in Book 9 Page 77 of Short Plat, under Auditor File No. 9309230141.
Pursuant RCW 58.17.060 short plats cannot be further subdivided within 5 years of being
recorded except when filing an alteration within the 5 year period provided there are no more than 4
lots in the overall Final Short Plat. The existing Final Short Plat, SP-859-93, presently has 21ots
and the altered plat will create 1 additional lot for a total of 31ots; and
WHEREAS, on September 12, 1995, the Board held a public hearing on the application with
File No. SP-859-93 available after public notice of the proposal had been provided to all adjacent
property owners more than 10 days before the hearing; and
WHEREAS, there was no public testimony in opposition; and
WHEREAS, the Board, did fully consider the testimony and documents presented along with
the public record files relating to the proposal, and being familiar with the site; and
WHEREAS, the County Division of Engineering and Roads, Counry Division of Utilities,
County Health District, Counry Division of Building and Planning and Fire District No. 1 were all
notified and comments requested; and
WHEREAS, the County Division of Building and Planning recommends approval of the
requested short plat alteration as conditioned in the Planning Department's Findings of Fact,
Conclusions and Decision dated July 9, 1993 and the attached updated conditions; and
WHEREAS, the Board finds that the proposal is consistent with the Spokane County
Generalized Comprehensive Plan and the Spokane Counry Code; and
WHEREAS, the proposed alteration will not be detrimental to the public health, safety and "
general welfare; and
WHEREAS, this alteration will allow Lots "B" to be divided into 21ots , which will increase
the original number of lots from 2 to a 3 lot short plat.
NOW, THEREFORE, BE IT RESOLVED that the Final Short Plat, SP-859-93, as recorded
in Short Plat Book 9, Page 77, Spokane County Auditor's records, be altered by dividing Lot B into 21ots, which will increase the original number of lots from 2 to a 31ot short plat pursuant to
the attached updated Conditions of Approval.
BE IT FURTHER RESOLVED, in accordance with RCW 58.17.215, that the Board directs
Spokane County Division of Building and Planning ta work with the applicant to record an Altered
Final Short Plat in compliance with the attached conditions of approval.

THIS MATTER, an application for subdivision of land, frozn Cecil Harmon has been
' re ived and decided upon, pursuant to Spokane County Subdivision regulations, on the
day of July, 1993.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to d.ivide approximately 1.5 acres into 2 lots for an office building and
warehouse and those uses permitted in the underlying zone.
3. The proposal is generally located between Montgomery Avenue and Montgomery
Drive, approximately 600 feet east of Woodruff Road in the NE 1/4 of Section 8,
Township 25 North, Range 44 E.W.M. Spokane County, Washington.
4. The existing zoning of the property described in the applicarion is Light Industrial
previously established as Restricted Industrial (RI) (File # 177-55) zoning in 1955 and
reclassified to I-2 on 7anuary 1, 1991 pursuant to the Program to Implement the
Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does
conform to the requirements of the existing I-2 zone.
5. The Spokane County Comprehensive Pla-n designates this area as Industrial. The
development and uses proposed are generally in accord with this category.
6. The Spokane County Arterial Road Plan idenrifies Montgomery Drive as a Minor
Arterial with a future right of way width of 80 feet. The existing right of way width is
60 feet. In order to implement the Arterial Road Plan, the County Engineer has
requested that a strip of property 10 feet in width along Montgomery Drive frontage be
set aside as a Future Acquisition Area. Montgomery Avenue is a Local Access Road
with an existing right of way width of 40 feet. The County Engineer has requested a
dedication of an additional 5 foot right of way width along Montgomery Avenue.
8. Surrounding uses are primarily industrial and open space.
9. The required public notice was provided for this proposal and agencies having a
potenrial interest in the project were notified and recommendations solicited.
10. No comments were received from any adjoining property owners.
11. The site is located within the Public Transportation Benefit Area (PTBA), which the
Spokane Transit Authority (STA) provides public transportation services. STA Valley-
Millwood Route 19 provides connecting services to the site.
. 12. Recognizing the recommended conditions and Spokane County development standards,
the proposed short subdivision makes appropriate provisions for the public health,
safety and general welfare and that the public use and interest will be served by platting
the subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safety and general welfare in
accordance with standards established by the state and Spokane County. The Planning
Departnaent has considered the provision of adequate public faciliries as cited in RCW
58.17.110 (2). More specifically:
a. open spaces
b. drainage ways
c. public and/or private rights-of-way

d. transit
e. potable water
f. sanitary waste disposal
g. parks and recreation facilities
h . playgrounds
i. schools and schoolgrounds j . sidewalks
13. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-859-93 is hereby APPROVED until August 1, 1996, subject to conditions noted
below. Most of the conditions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
COUNTY PLANNING DEPARTMENT CONDITIONS
1. All conditions imposed by the Planning Department shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns and successors.
2. The proposal shall comply with the Light Industrial (I-2) zone as amended.
3. The final plat shall be designed substantially in conformance with the preliminary plat
of record. No increase of density or number of lots shall occur without a change of
condition application submittal and approval.
4. Three (3) current certificates of title shall be furnished to the Planning Department prior
to filing the final plat.
5. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
6. The preliminary plat is given conditional approval for three (3) years, specifically to
August 1, 1996. The applicant may request an extension of time by submitting a
written request approximately forty-five (45) days prior to the above expiration date.
7. Appropriate road name(s) shall be indicated.
8. Appropriate utility easements shall be indicated on copies of the proposed final plat. Written approval of utility easements by appropriate urility companies shall be received
with the submittal of the final plat.
9. The Spokane County Planning Department shall prepare and record with the County
Auditor a Title Notice specifying a future land acquisiaon area for road right-of-way
and utilities. The reserved future acquisition area Title Norice shall be released, in full
or in part, by the Planning Department. The nogce should be recorded within the same
time frame as an appeal and shall provide the following:
a. At least 10 feet of reserved future acquisition area for road right-of-way and
utilities, in add.ition to the existing right-of-way along Montgomery Drive.
b. Future building and other setbacks required by the Spokane County Zoning Code
shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs should
be located within the future acquisition area for road right-of-way and utilities. rf
any of the above improvements are made within this area, they shall be relocated
at the applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such as landscaping,

parking, surface drainage, drainfield, signs or others) shall be considered interim
uses.
e. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements after
acquiring said future acquisition area.
10. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
- all private, "Tract X" or public roads. The dedication shall contain the following
statement:
"Side yard and rear yard setbacks shall be detemiined at the time building permits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
11. The final plat map shall clearly show all exisring structures and their dimensional side
and rear yard setbacks.
12. No water plan is required, and a simple tap is needed at the time of building pennit
release.
13. A survey is required prior to the filing of a final plat.
COUNTY DIVISION OF ENGINEERING AND ROADS CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
2. No construction work is to be performed within the existing or proposed publie right-
of-way until a perrnit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
3. Dedication of 5 feet of additional right-of-way along Montgomery Avenue is required.
4. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane Caunty standards.
5. Sidewalks are required along the arterial(s) on Montgomery Drive.
6. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
7. To construct the road improvements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any petirion or resolution
which purpose is the formation of a Road Improvement Disrrict (RID) for said .
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Montgomery Avenue and curbing and
sidewalk on Montgomery Drive.
8. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the re,quued road improvements. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
i.mprovements required. (curb, sidewallc, drainage control and paving to existing
pavement) wi11 be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Montgomery Avenue and curbing and
sidewalk on Montgomery Drive.
9. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to autharize the County to place their
name(s) on a petition for the formation of a Road Improvement District (RID) by the
petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s)'
property, and further not to object, by the signing of a ballot, to the formation of an

RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution
includes the owner(s)' property. If an RID is formed by either the petition or resolution
method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further
agree:
(a) that the improvement(s) or construction contemplated within the proposed RID is
feasible;
(b) that the benefits to be derived from the formarion of the RID by the property
included ttierein, together with the amount of any County participation, exceed the
cost and expense of formation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as authorized
under RCW 36.88.490, to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the formation of an RID by either petition
or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court
the decision of the Board of County Commissioners aff'uming the final assessment roll.
It is further agreed that at such time as an RID is created or any Road Improvement
Project is sanctioned by Spokane County, the improvements required (curb, sidewalk,
drainage control and paving) will be at the sole expense of the undersigned owner(s),
their heirs, grantees and assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the
date of execution below. However, the owner(s) or successor(s) agree that if said RID
waiver expires without construction of the required improvements, the owner(s) or
successor(s) agree to construct the required improvements at their own expense, pay to
Spokane County the then estimated cost of the required improvements to enable the
County to complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execution of another R1D waiver agreement) providing
for or securing to the County the actual construction of the improvements.
All of the requirements of this agreement shall run with the land and shall be binding
upon the owner(s), their successor(s) or assign(s)." This provision is applicable to
Montgomery Avenue and curbing and sidewalk on Montgomery Drive.
10. The County Engineer has designated Typical Roadway Section Number One Local
Access Standard for the improvement of Montgomery Avenue, which is adjacent to the
proposed development. This will require the addition of approximately 32 feet of
asphalt along the frontage of the development. The construction of curbing and
sidewalk is also required. 11. The proposed subdivision shall be improved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes reguladons for roads, approaches, drainage and fees in new construction.
12. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing county road system warrants the
dedication of additional right-of-way and the roadway improvements herein specified.
13. The County Arterial Road Plan identifies Montgomery Drive as a Minor Arterial. The
existing right-of-way width of 60 feet is not consistent with that specified in the Plan.
In order to implement the Arterial Road Plan, in addition to the required right-of-way
dedication, a strip of properry 10 feet in width along the Montgomery Drive frontage
. shall be set aside in reserve. This property may be acquired by Spokane County at the
time when arterial improvements are made to Montgomery Drive.
14. There may exist utilities, either underground or overhead, affecting the subject
property, includ.ing property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocation
regarding these utilities. Applicant(s) should check with the applicable utility purveyor
and the Spokane County Engineer to detemsine whether applicant(s) or the utility is responsible for adjustrnent or relocation costs and to make arrangements for any
necessary work.

COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate urility easements shal.l be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies, Spokane
County engineer and the Spokane County Health District. Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat.
3. Sewage d.isposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water service shall be coordinated through the Director of Utilities, Spokane County.
5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is available
to each tract of the plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat
8. A public sewer system will be made available for the plat and ind.ividual service will be
provided to each lot/tract prior to sale. Use of individual on-site sewage disposal
systems shall not be authorized.
9. A statement shall be placed in the ded.icarion to the effect that: "A public sewer system
will be made available for the plat/project, and individual service will be provided to
each loutract prior to sale. Use of individual on-site sewage disposal systems shall not
be authorized."
10. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
11. The plat dedication shall contain a statement to the effect that: "The public water
system, pursuant to the Water Plan approved by counry and state health authorities, the
local fire protection district, County Building and Safety Department and water
purveyor, shall be installed within this plat, and the applicant shall provide for
individual domestic water service as well as fire protection to each tract prior to sale of
each tract and prior to issuance of a building permit for each tract."
COUNTY DIVISION OF UTILITIES CUNDITIONS 1. The dedication shall state:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of ULID by petition method pursuant to RCW
36.94, which perition includes the owner(s)' property; and further not to object by the
signing of a protest petition against the formation of a ULID by resolution method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
this cond.ition shall not prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the properry as a result of improvements called for in conjunction
. , with the formation of a UI,ID by either petition or resolution methai under RCW
Chapter 36.94."
2. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
3. Applicant shall make connection to public sewer system. Sewer connection permit is
required. Plans a.nd specifications are to be reviewed and approved by the Utiliries
Department.

COUNTY DIVISION OF BUILDINGS CONDITIONS
1. The applicant shall contact the Division of Building at the earliest possible stage in order
to be informed of code requirements ad,ministered/enforced as authorized by the State
Building Code Act. Design/development concerns include: Fire apparatus access
roads; fire hydrant/flow; approved water systems; building accessibility; construction
type; occupancy classification; exiting; exterior wall protection; and energy code
regulations.
MODERN ELECTRIC WATER COMPANY CONDITIONS
1. Water service to parcel "A" shall be supplied from water main on Montgomery Avenue
with meter and meter vault installed north of Montgomery Avenue right of way.
2. Meter, meter vault, and service line to parcel "A" shall be installed in 12 foot easement
provided through parcel "B".
3. At time of construction or need of utility service to parcel "A" Modern Electric Water Company requires complerion of s Service Application and prepayment for costs and
other fees for water service.

The Border Easement as shown hereon is hereby granted to Spokane County and its authorized
agents, and to the Public for Road purposes, including but not limited to curbs, sidewalks,
drainage, signage and other usage deemed necessary by the Spokane County Division of
Engineering for the safety and welfare of the Public. No fence or portion thereof will be
constructed within said Easement without permission of the Spokane County Division of
Engineering, nor will any objects be placed in said Easement that would obstruct the sight
distance necessary for safe and efficient vehicular movement. Any other Easements granted or
dedicated within this Border Easement area will be subordinate to the rights created by this
Easement and are subject to Spokane County Division of Engineering permit process prior to

The Easement and the agreements and duties provided for herein shall run with the land and shall

SHORT PLAT N4. SP-859-93 ) CONCLUSIONS AND
DECISION
THYS MATTER, an application for subdivision of land, from Cecil Harmon has been
re ived and decided upon, pursuant to Spokane County Subdivision regularions, on the
1 day of July, 1993. ,
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Duector of Planning.
2. The proposal is to divide approximately 1.5 acres into 21ots for an office building and
warehouse and those uses pemutted in the underlying zone.
3. The proposal is generally located between Montgomery Avenue and Montgomery
Drive, approximately 600 feet east of Wood.ruff Road in the NE 1/4 of Section 8,
Township 25 N'orth, Range 44 E.W.M. Spokane County, Washington.
4. The existing zoning of the property described in the application is Light Industrial '(I-2),
previously established as Restncted Industrial (RI) (File # 177-55) zoning in 1955 and
reclassified to I-2 on January ~l, 1991 pursuant to the Program to Implement the
Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does
conform to the requirements of the existing I-2 zone. .
5. The Spokane County Comprehensive Plan designates this area as Industrial. The
development and uses proposed are generally in accord with this category.
6. The Spokane County Arterial Road Plan idenrifies Montgomery Drive as a Minor
Arterial with a future right of way width of 80 feet The existing right of way width is
60 feet. In order to implement the Arterial Road Plan, the County Engineer has
requested that a strip of property 10 feet in width along Montgomery Drive frontage be
set aside as a Future Acquisition Area. Montgomery Avenue is a Local Access Road
with an existing right of way width of 40 feet. The County Engineer has requested a
ded.ication of an add.itional S foot right of way width along Montgomery Avenue.
8. Surrounding uses are primarily industrial and open space.
9. The required public notice was provided for this proposal and agencies having a
potential interest in the project were notified and recommendations solicited.
10. No comments were received from any adjoining praperty owners.
11. The site is located within the Public Transportation Benefit Area (PTBA), which the
Spokane Transit Authority (STA) provides public transportation services. STA Valley-
Mi.llwood Route 19 provides connecting services to the slte:
12. Recognizing the recommended conditions and Spokane County development standards,
the proposed short subdivision makes appropriate provisions for the public health,
. safety and general welfare and that the public use and interest will be served by platting
the subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regularions, promoting the public health, safety and general welfare in
accordance with standards established by the state and Spokane County. The Planning
Department has considered the provision of adequate public facilities as cited in RCW 58.17.110 (2). More specifically: •

13. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
B ased upon the above noted Find.ings of Fact and Conclusions, Short Plat Application
SP-859-93 is hereby APPROVED until August 1, 1996, subject to conditions noted
below. Most of the conditions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
COUNTY PLANNING DEPARTMENT CONDITIONS
1. All conditions imposed by the Planning Department shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
as5igns and successors.
2. The proposal shall comply with the Light Industrial (I-2) zone as amended. 3. The final plat shall be designed substantially in conformance with the preliminary plat
of record. No increase of density or number of lots shall occur without a change of
condition application submittal and approval.
4. Three (3) current certificates of title shall be fumished to the Planning,Department prior
to filing the final plat. 5. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Find.ings and Conditions of Approval.
6. T'~e pre ' ary p t is given conditional approval for three (3) years, specifically to
Au st 1,19 6 e a licant ma r uest an extension of time by submitting a
~ request approxunately forty five (45) days prior to the above expiration date.
7. Appropriate road name(s) shall be indicated.
8. Appropriate utility easements shall be indicated on copies of the proposed final plat. -
Written approval of utility easements by appropriate unlity companies shall be received
with the submittal of the final plat.
9. The Spokane County Planning Department shall prepare and record with the County
Auditor a Title Notice specifying a future land acquisition area for road right-of-way
and utiliries. The reserveti future acquisition area Title Notice shall be released, in full
or in part, by the Planning Department. The notice should be recorded within the same
time frame as an appeal and shall provide the following:
a. At least 10 feet of reserved future acquisition area for road right-of-way and
utilities, in addition to the existing right-of-way-along Montgomery Drive.
b. Future building and other setbacks required by the Spokane County Zoning Code
shall be measured from the reserved future acquisition area.
c. No required landscaping, parlcing, '208' areas, drainfield or allowed signs should
be located within the future acquisinon area for road right-of-way and ualities. If
any of the above improvements are made within this area, they shall be relocated
at the applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as landscaping,

parking, surface drainage, drainfield, signs or others) shall be considered interim
uses.
e. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane Counry makes roadway improvements after
acquiring said future acquisition area.
10. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
staxement:
"Side yard and rear yard setbacks shall be determined at the time building permits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
ind.icated on this plat may be varied from if proper zoning approvals are obtained."
11. The final plat map shall clearly show all existing stnuctures and their dimensional side
and rear yard setbacks.
12. No water plan is required, and a simple tap is needed at the time of building pernut
release. 13. A survey is required prior to the filing of a final plat.
COUNTY DIVISION OF ENGINEERING AND ROADS CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
2. No construction work is to be performed within the existing or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
3. Dedication of 5 feet of additional right-of-way along Montgomery Avenue is required.
4. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
5. Sidewalks are required along the arterial(s) on Montgomery Drive.
6. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
7. To construct the road 'unprovements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any petirion or resolurion
which purpose is the formadon of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole-expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Montgomery Avenue and curbing and
sidewalk on Montgomery Drive. .
8. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the requued road improvements. At such time as an RID is
. created or any Road Improvement Project is sancrioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Montgomery Avenue and curbing and
sidewalk on Montgomery Drive.
. 9. The following statement shall be placed in the plat detiication:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of a Road Improvement District (RID) by the
petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s)'
property, and further not to object, by the signing of a ballot, to the formation of an

RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution
includes the owner(s)' property. If an RID is formed by either the petition or resolution
method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further
agree:
(a) that the improvement(s) or construction contemplated within the proposed RID is
feasible;
(b) that the benefits to be derived from the formation of the RID by the- property
included therein, together with the amount of any County participarion, exceed the
cost and expense of formation of the RID; and
,
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as authorized
under RCW 36.88.090, to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the formation of an RID by either petition
or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court
the decision of the Board of Counry Commissioners affirming the final assessment roll.
It is further agreed that at such time as an RID is created or any Road Improvement
Project is sanctioned by Spokane County, the unprovements required (curb, sidewalk,
drainage control and paving) will Ue at the sole expense of the undersigned owner(s),
their heirs, grantees and assigns without participadon by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the
date of execution below. However, the owner(s) or successor(s) agree that if said RID
waiver expires without construction of the required improvements, the owner(s) oi
successor(s) agree to construct the required improvements at their own expense, pay to
Spokane County the then estimated cost of the required improvements to enable the
Counry to complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execution of another RID waiver agreement) providing
for or securing to the Counry the.actual construction of the improvements.
All of the requirements of this agreement shall.run with the land and shall be binding
upon the owner(s), their successor(s) or assign(s)." This provision is applicable to
Montgomery Avenue and curbing and sidewalk on Montgomery Drive.
10. The Counry Engineer has designated Typical Roadway Section Number One Local
Access Standard for the unprovement of Montgomery Avenue, which is adjacent to the
proposed development. This will require the addition of approximately 32 feet of
asphalt along the frontage of the development. The construction of curbing and
sidewalk is also required.
11. The proposed subdivision shall be unproved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resoluaon establishes regulations for roads, approaches, drainage and fees in new construction.
12. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing county road system warrants the
dedication of additional right-of-way and the roadway improvements herein specified.
13. The County Arterial Road Plan identifies Montgomery Drive as a Minor Arterial. The
existing right-of-way width of 60 feet is not consistent with that specified in the Plan.
In order to implement the Arterial Road Plan, in addition to the required right-of-way
ded.icarion, a strip of property 10 feet in width along the Montgomery Drive frontage
. shall be set aside in reserve. This property may be acquired by Spokane County at the
time when arterial unprovements are made to Montgomery Drive.
14. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocation
regarding these utiliries. Applicant(s) should check with the applicable utility purveyor
and the Spokane Counry Engineer to deternune whether applicant(s) or the utility is
responsible for adjustment or relocation costs and to make arrangements for any
necessary work.

COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate urility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies, Spokane
County engineer and the Spokane County Health District. Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat.
3. Sewage d.isposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water service shall be coord.inated through the I?irector of Utilities, Spokane County.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the .
Spokane County Health District that an adequate and potable water supply is available to each tract of the plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
8. A public sewer system will be made available for the plat and individual service will be
provided to each lot/tract prior to sale. Use of ind.ividual on-site sewage d.isposal
systems shall not be authorized.
9. A statement shall be placed in the ded.ication to the effect that: "A public sewer system
will be made available for the platJproject, and individual service will be provided to
each lot/tract prior to sale. Use of individual on-site sewage disposal systems shall not
be authorized."
10. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
11. The plat dedication shall contain a statement to the effect that: "The public water
system, pursuant to the Water Plan approved by county and state health authorities, the
local fire protection district, County Building and Safety Department and water
purveyor, shall be installed within this plat, and the applicant shall provide for
individual domestic water service as well as fire protection to each tract prior to sale of
each tract and prior to issuance of a building permit for each tract."
COUNTY DIVISION OF UTILITIES CONDITIONS 1. The dedicarion shall state:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formarion of ULID by petition method pursuant to RCW
36.94, which petition includes the owner(s)' property; and further not to object by the
signing of a protest petition against the formation of a ULID by resolution method
pursuant to RCW Chapter 36.94 which includes the owner(s)' propeity. PROVIDED,
this condition shall not prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the property as a-result of unprovements called for in conjunction
. with the formation of a ULID by either petition or resolution method under RCW
Chapter 36.94." _
2. Any water service for this project shall be provided in accordance with the Caordinated
Water System Plan for Spokane County, as amended.
3. Applicant shall make connection to public sewer system. Sewer connection permit is
required. Plans and specifications are to be reviewed and approved by the Utilities
DepartmenL

COUNTY DIVISION OF BUILDINGS CONDITIONS
1. The applicant shall contact the Division of Building at the earliest possible stage in order
to be informed of code requirements administered/enforced as authorized by the State
Building Code AcL Design/development concerns include: Fire apparatus access
roads; fire hydrant/flow; approved water systems; building accessibility; construction
type; occupancy classification; exiting; exterior wall protection; and energy caie
regulations. MODERN ELECTRYC WATER COMPANY CONDITIONS
1. Water service to parcel "A" shall be supplied from water main on Montgomery Avenue
with meter and meter vault installed north of Montgomery Avenue right of way.
2. Meter, meter vault, and service line to parcel "A" shall be installed in 12 foot easement
provided through parcel "B".
3. At time of construction or need of utility service to parcel "A" Modern Electric Water
Company requires complerion of s Service Application and prepayment for costs and

the RID by the property included therein, together with the amount
of any County participation, exceeds the cost and expPnse of formation
of the RID, and (3) that the property within the proposed RID is
suff iciently developed. Provided, further, the owner(s) or
successor(s) shall retain the right, as authorized under RCW
36.88.090, to object to any assessment(s) on the property as a result
of the improvements called for in conjunction with the formation of
a RID by either petition or resolution method under Chapter 36.88 RCW,
and to appeal to the Superior Court the decision of the Board of
County Commissioners affirming the final assessment roll. It is
further agreed that at such time as an RID is created or any Road
Improvement project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving) will be at the .
sole expense of the undersigned owner, their heirs, grantees and
assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten
(10) years from the date of execution below. However, the owner(s)
or successor(s) agree that if said RID waiver expires withuut
construction of the required improvements, the owner(s) or
successor(s) agree to construct the required improvements at their own
expense; pay to Spokane County the then estimated cost of the required
improvements to enable the County to complete the same; or furnish a
bond or other secure method suitable to the County (which may include
the execution of another RID waiver agreement), providing for or
securing to the County the actual construction of the improvements.
Al1 of the requirements of this agreement shall run with the land and
shall be binding upon the owner(s), their successor(s) or assign(s).
This provision is applicable to Montqomery Avenue and curbinq and
sidewalk on Montcxomery Drive.
E24 The County Engineer has designated Typical Roadway Section Number Onei
Local Access Standard for the improvement of Montqomery Avenue which is
adjacent to the proposed development. This will require the addition of
approximately 32 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required.
E32 The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 80-1592, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
E33 The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the dedication of additional Right of Way and the
roadway improvements herein specified.
E61 The County Arterial Road plan identifies Montqomery Drive as a Minor
Arterial. The existing right of way width of 60 feet is not consistent
with that specified in The Plan. In order to implement the Arterial
Road Plan it is recommended that in addition to the required right of
way dedication, a strip of property 10 feet in width along the
Montqomery Drive frontage be set aside in reserve. This property may be
acquired by Spokane County at the time when Arterial Improvements are
made to Montqomery Drive.
E90 The applicant should be advised that there may exist utilities either
underground or overhead affecting the applicants property, including
property to be dedicated or set aside for future acquisition. Spokane
County will assume no financial obligation for adjustments or relocation
regarding these utilities. The applicant should check with the
applicable utilities and Spokane County Engineer to determine whether
the applicant or utility is responsible for adjustment or relocation
costs and to make arrangements for any necessary work.

The County Engineering Department has completed a review of
the above referenced project. The following information must be
provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainage plan
for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
1. Drainage calculations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of the 208 swale.
6. Calculations to justify the number and type of
drywells proposed.
.7. Elevation of drywell inlets where applicable.
8. Copy of the proposed landscape plan.
B) The following improvements within adjacent Right of Way
are required prior to the release of a building permit:
1. You must submit road and drainage plans for street
improvements. These must be prepared by an
engineer. Plans must be prepared for the following
streets:
a. Montgomery, Typical Roadway Section No. 1,
Collector Standard.
All required construction (sidewalk/curbing/pavement) within
the Public Road Right of Way is to be completed prior to the
release of a building permit or a financial guaranty in an amount
estimated by the County Engineer to cover the cost of
construction or improvements shall be filed with the County
Engineer. Required plans are to be submitted prior to estimating
the amount of the financial guaranty or permit release.
2. As an alternative to the required road improvements
the County will accept an RID/CRP agreement
"Notice to Public No. 6" on Montgomery.
3. Please submit a copy of a recorded property deed
from the Auditors office for the subject property.
Upon receipt of the deed our staff will prepare the
RID/CRP agreement.

4. Approach permits must be obtained, after a site
plan has been approved, and before the.issuance of
a building permit, from the County Engineering
Department for any new or improved driveway
approaches to the following streets:
a. Montgomery
C) Insufficient information was submitted with the proposal.
We are unable to proceed with our review. We will need
the following before we can proceed:
1. Site Plan.
2. Drainage plan as specified.
3. Other information:
a. A parking and traffic circulation plan shall
be submitted and approved by the Spokane County Engineer. The
design, location and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving as
required by the County Planning Ordinance, will be required for
any portion of the project which is to be occupied or traveled by
vehicles. It is illegal to back out onto the Right of Way.
D) Utility Condition: Permittee is responsible for arranging
for all necessary utility adjustments or relocation as
required for completion of the improvement.
E) The owner of the property or the authorized
representative must complete and sign Spokane County
Engineers "Agreement to Pay Fees". This document must be
returned to the County Engineers Office. Plan review will
not be completed until this document is executed. This
document is attached to these comments. Please return
the completed Agreement to your contact person at the
Engineers Department.
Only after all the information and requirements listed above
are supplied or completed and the necessary review has been
accomplished will your building permit be released.
