P-8.63-93 ) CONCLUSIONS AND DECISION THIS MATTER, an application for subdivision of land, from Mark McManus has been rece1i~ed and decided upon, pursuant to Spokane County Subdivision regulations, on the day of August, 1993. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning. 2. The proposal is to divide approximately .68 acre into 21ots for one existing single fa.mily dwelling and one addirional single faznily dwelling and those uses permitted in the underlying zone. 3. The proposal is generally located at the northwest corner of Valley Way and Adams . Road in the SW 1/4 of Section 14, Township 25 North, Range 44 E.W.M., Spokane County, Washington. ~u- 4. The existing zoning of the property described in the application is Urban Residential-3.5 (UR-3.5), previously established as Agricultural Suburban (AS) (File # 166-58) zoning in 1958, and reclassified to UR-3.5 on January 1, 1991 pursuant to the Program to Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform to the requirements of the existing UR-3.5 zone. 5. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses proposed are generally in accord with this category. 6. Surrounding uses are primarily single family residences on urban size lots and open space. 7. The required public notice was provided for this proposal and agencies having a , potenrial interest in the project were notified and recommendations solicited. 8. No comments were received from any adjoining property owners. 9. The Spokane County Arteria] Road Plan identifies Adams Road as a Minor Arterial and Valley Way as a Collector Arterial with a future right of way width of 80 feet and 70 feet respectively. The existing right of way width of Adams Road and Valley Way is . 40 feet. The County Engineer has requested dedicarion of additional right of way along Valley Way equal to 30 feet from centerline and ded.ication of an additional 12 feet of right of way along Adams Road. 10. The site is located within the Public Transportation Benefit Area (PTBA), which the Spokane Transit Authority (STA) provides public transportation services. STA East Sprague Route 9 and Broadway Route 18 provides connecting services to the site. 11. The Central Valley School District No. 354 has commented on the proposed Short Plat. The District has indicated that existing school facilities are inadequate to seive the proposed short plat and wishes to negoriate with the owner to provide adequate capital - facilities as required by the Revised Code of Washington (RCV) 58.17.110. Review by County legal dounsel indicates the condition requested by the School District can be requ.ired for developments. Approval of this short plat should include cond.itions requiring that provisions for appropriate facilities be in place prior to recording the final short plat in the form of a written agreement between the owner and the school district. 12'. The Spokane County Parks Department has commented on the proposed short plat. The Parks Department has requested a voluntary agreement be completed between the Parks Department and the property owner ro mitigate impacts to the County Park system. County legal counsel has indicated such agreements can be required. The Spokane County Planning Department recommends the property owner negotiate with . the Spokane County Parks Department to provide for appropriate capital facilities as t T . 7 i FINDINGS AND DECISION SP-863-93 Page 2 required by the Revised Code of Washington (RCW) 58.17.110. Approval of this short plat should include conditions requiring that provisions for appropriate facilities be in place prior to recording this final plat in the form of a written agreement between the owner and the Spokane County Parks Department 13. Recognizing the recommended conditions and Spokane County development standards, the proposed short subdivision makes appropriate provisions for the public health, safety and general welfare and that the public use and interest will be served by platting the subdivision. The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision regulations, promoting the public health, safety and general welfare in accordance with standards established by the state and Spokane County. The Planning Department has considered the provision of adequate public faciliries as cited in RCW . 58.17.110 (2). More specifically: a. open spaces b. drainage ways c. public and/or private rights-of-way d . transit e. potable water f. sanitary waste d.isposal g. parks and recreation facilities h. playgrounds i. schools and schoolgrounds j . sidewalks ' 14. The proposed short plat will be served by a public water system. Waste watez disposal will be as authori.zed by the Director of Utilities. 15. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). 16. The following fact is also relevant: a. One storage structure, detached, private, is pernutted inside the Urban Impact Area (UTA) boundary, limited in area to 1,500 square feet and provided setbacks and maximum building coverage standards are met. DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-863-93 is hereby APPROVED until September 1, 1996, subject to conditions noted below. Most of the conditions of approval shall be accomplished by the applicant and/or sponsor prior to finalization of the short subdivision. This decision is final unless appealed in writing, consistent with adopted appeal procedures. CQUNTS' PLANNING DEPARTMENT CONDITIONS 1. All conditions imposed by the Planning Department shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns and successors. 2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone as amended. 3. The future acquisition area 'and right of way dedication may result in nonconfornung setbacks of existing structures. Additions to existing residential structure must comply with setback requirements of the Urban Residenrial-3.5 (UR-3.5) zone. 4. The final plat shall be designed substantially in conformance with the preliminary plat of record. No increase of density or number of lots shall occur without a change of cond.ition application submittal and approval. 5. Three (3) current certificates of title shall be fumished to the Planning Department prior to filing the final plat. ' 1 ► FINDINGS AND DECISION SP-863-93 Page 3 6. The Planning Directoridesignee shall review any proposed final plat to ensure compliance with these Findings and Conditions of Approval. . 7. The preliminary plat is given conditional approval for three (3) years, specifically to September 1, 1996. The applicant may request an extension of rime by submitting a written request approxunately forry-five (45) days prior to the above expiration date. 8. Appropriate road naxne(s) shall be ind.icated. 9. Appropriate utility easements shall be indicated on copies of the pxoposed final plat. Written approval of utility easements by appropriate utility companies shall be received with the submittal of the final plat. 10. The final plat map shall indicate by a clear, dashed line the required yard setbacks from all private, "Tract X" or public roads. The dedicarion shall contain the following statement: "Side yard and rear yard setbacks shall be determined at the time building pennits are requested unless these setbacks are specifically drafted on this final plat. The setbacks indicated on this plat may be varied from if proper zoning approvals are obtained." 11. The Spokane County Planning Department shall prepare and record with the County Auditor a Title Notice specifying a future land acquisltion area for road right-of-way and utilities. The reserved future acquisition area Title Notice shall be released, in full or in part, by the Planning Deparnnent. The notice should be recorded within the same time frame as an appeal and shall provide the following: a. At least 8 feet of reserved future acquisition area for road right-of-way and utilities, in addition to the newly dedicated right-of-way along Adams Road. NOT'E: The County Engineer has required 12 feet of new dedication. At least 5 feet of reserved future acquisition area for road right-of-way and utilities, in addition to the newly dedicated right-of-way along Valley Way. NOTE: The Counry Engineer has required up to 30 feet of new, dedication along the centerline. b. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisition area. c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be located within the future acquisition area for road right-of-way and uti.lities. If any of the above improvements are made within this area, they shall be relocated at the applicant's exgense when roadway improvements are made. d. The future acquisirion area, until acquired, sha11 be private property and may be used as allowed in the zone, except that any improvements (such as landscaping, . parking, surface drainage, drainf'ield, signs or others) shall be considered interim uses. e. The property owner shall be responsible for relocating such "interim" improvements at the time Spokane County makes roadway improvements after acquiring said future acquisition area. 12. No water plan is required, and a simple tap is needed at the time of building permit release. 13. A survey is required prior to the filing of a final plat, 14. The Owner shall negotiate with the Central Valley School District and the Spokane County Parks Department and submit a recorded copy of the agreement malcing provisions for public schools and parks prior to finalization and recording of this short plat. The agreement shall provide a written description of the subject property to which the agreement applies and also state the dollar amount and any other agreed to mirigating measure(s). The Owner shall also notify any potenrial purchasers who have made an agreement to purchase property within said plat pursuant to the Revised Cod.e of Washington (58.17.205), that appropriate provisions for school facilities and public parks must be . , FINDYNGS AND DECISION SP-863-93 Page 4 made conditioned on a future agreement between the plattor, school district, and County Parks Department. Voluntary agreements between the Owner, the School District and Spokane County Parks Department shall conform to the requirements of the Revised Code of Washington Chapter 82.02. COUNTY DIVISION OF ENGINEERING AND ROADS CONDITIONS 1. The conditional approval of the plat is given by the County Engineer subject to dedication of right-of-way and approval of the road system as indicated in the preliminary plat of record. 2. No construction work is to be performed within the existing or proposed public right- of-way until a permit has been issued by the County Engineer. All work is subject to inspection and approval by the County Engineer. 3. Individual driveway access perrruts are requu-ed prior to issuance of a building permit for driveway approaches to the county road system. , Dedication of additional right of way along Valley Way shall equa130 feet from centerline. S. Dedication of 12 feet of additional right-of-way along Adams Road is required. 6. Exisring county roads providing direct access to the plat shall be paved and/or curbed to Spokane County standards. 7. Sidewalks are required along the arterial(s) on Valley Way and Adams Road. 8. The word "applicant" shall include the owner or owners of the property, his heirs, assigns and successors. 9. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purpose is the fonnation of a Road Improvement District (RID) for said improvements, pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvennents requireti (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Adams Road and Valley Way. 10. As an alternative method of constructing the road improvements stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CR.P) to the extent of the required road improvements. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Adams Road and Valley Way. 11. The following statement shall be placed in the plat dedication: "The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formarion of a Road Improvement District (RID) by the petirion method pursuant to Chapter 36.88 RCW, which petition includes the owner(s)' property, and further not to object, by the signing of a ballot, to the formation of an RID by the resolution method pursuant to Chapter 36.88 RCW, which resolurion includes the owner(s)' property. If an RID is formed by either the petition or resolution method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: (a) that the improvement(s) or construction contemplated within the proposed RID is feasible; (b) that the benefits to be derived from the formarion of the RID by the property included therein, together with the amount of any County participation, exceed the cost and expense of formation of the RID; and . , FINDINGS AND DECISION SP-863-93 Page 5 (c) that the property within the proposed RID is sufficiently developed. Provided further that the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the formation of an RID by either petition or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court the decision of the Board of County Commissioners affirming the final assessment roll. It is further agreed that at such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns without participation by Spokane County. The RID waiver contained in this agieement shall expire after ten (10) years from the date of execution below. However, the owner(s) or successor(s) agree that if said RID waiver expires without construction of the required improvements, the owner(s) or successor(s) agree to construct the required improvements at their own expense, pay to Spokane County the then estimated cost of the requued improvements to enable the County to complete the same, or furnish a bond or other secure method suitable to the . County (which may include the execution of another RID waiver agreement) providing for or securing to the County the actual construction of the unprovements. All of the requirements of this agreement shall run with the land and shall be binding upon the owner(s), their successor(s) or assign(s)." This provision is applicable to Adams Road and Valley Way. 12. The County Engineer has designated Typical Roadway Section Number Two, Minor Arterial Standard for the improvement of Adams Road, which is adjacent to the proposed development. This will require the addition of approximately 11-13 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. 13. The County Engineer has designated Typical Roadway Section Number Two, Collector Arterial Standard for the improvement of Valley Way, which is adjacent to the proposed development This will require the addition of approximately 10-12 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. 14. The proposed subdivision shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80-1592, as amended, which resolution establishes regulations for roads, approaches, drainage and fees in new construction. 15. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing county road system warrants the dedication of additional right-of-way and the roadway improvements herein specified. 16. The applicant shall dedicate the applicable radius on Adams Road and Valley Way. 17. The Counry Arterial Road Plan identifies Adams Road as a Minor Arterial.
