THIS MATTER, an application for subdivision of land, from Robert WrVQMK ~~UMENGlNEE$
rec ' ed and decided upon, pursuant to Spokane County Subdivision regulations, on the
ay of August, 1993.
FINDINGS OF FACT AND CUNCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning. 2. The proposal is to divide approximately 36,700 square feet into 21ots for one existing
si.ngle family dwelling and one duplex lot and those uses permitted in the underlying
zone.
3. The proposal is generally located north of and adjacent to Trent Road (SR-290)
approximately 158 feet west of Lillian Road, in Section l, Township 25 North, Range
44 E.W.M., Spokane County, Washington.
4. The existing zoning of the propcrty described in the application is Urban Residen6a1-3.5
(UR-3.5), previously established as Agricultural (A) zoning in 1942 and redesignated to
Urban Residential-3.5 on January l, 1991 consistent with the Progra.m to Implement the
Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform
to the requirements of the existing Urban Residential-3.5 zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed are generally in accord with this category.
6. The site currently contains an existing single family residence and an accessory
structure. Surrounding uses are primarily single family residential and undeveloped.
The Spokane Industrial Park is situated approximately 1/4 mile south of the site.
_ 7. The required publi'c notice was provided for this proposal and agencies having a
potential interest in the project were notified and recommendatians solicited.
8. No written comments were received from any adjoining property owners.
9. The site is located within the Public Transit Benefit Area (PTBA). Route #18,
Broadway Feeder (1/2 tnile east of the site) and Route 20, Valley/Trentwood Feeder -
(1/2 half mile west of the site), provides connecting service.
10. The proposed short plat will be served by a public/private water system. Waste water
disposal will be as authorized by the Director of Utilities.
11. The Spokane County Parks Department has commented on the proposed short plat.
The Parks Department has requested a voluntary agreement be completed between the
Parks Department and the property owner to mitigate impacts ro t1e County Park
system. County legal counsel has indicated such agreenlents can be required. The
Spokane County Planning Department recommends the property owner negotiate with
the Spokane County Parks Department +o provide for appropriate capital facilities as
required by the Revised Code of Washington (RCW) 58.17.110. Approval of this
short plat should include conditions requiring that provisions for appropriate facilities
be in place prior to recording this final plat in the form of a written agreement between
the owner and the Spokane County Parks Department.
12. Recognizing the recommended conditions and Spokane County development standards,
the proposed short subdivision makes appropriate provisions for the public health,
safety and general welfare and that the public use and interest will be served by platting
the proposed short subdivision.

indicated on this plat may be varied frorai if proper zoning approvals are obtained."
10. No water plan is required, and a simple tap is needed at the time of building permit
release.
11. A survey is required prior to the filing of a final plat.
12. The owner shall negotiate with the Counry Parks and submit a recorded copy of the
agreement making appropriate provisions for county parks prior to finalization and
recording of this short plat. The agreement shall provide a written description of the
subject property to which the agreement applies and also state the dollar amount per lot
and any other agreed to mitigating measure(s).
The Owner shall also notify any potential purchasers who have made an agrecment to
purchase property within said short plat pursuant to the Revised Code of Washington
(58.17.205), that adequate provisions for county parks must be made conditioned on a
future agreement between the plattor and county parks.
Voluntary agreements between the Owner and County Parks shall conform to the
requirements of the Revised Code of Washington Chapter 82.02.
COUNTY ENGINEER'S DEpARTyIENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
2. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
3. The proposed subdivision shall be iniproved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes regulation.s for roads, approaches, drainage and fees in new
J./ construcoion.
Access permits and improvements to Trent Road must be approved by the Washington
State Department of Transportation (WSDOT).
5. There may exist utilities, either underground or overhead, affecdng the subject
property, including property to be dedicated or set aside for future acquisirion.
' Spokane County assumes no financial ebligation for adjustments or relocation
regarding these utilities. Applicant(s) should check with the applicable utility purveyor
and the Spokane County Engineer to determine whether applicant(s) or the utility is
responsible for adjustment or relocation costs and to make arrangements for any
necessary work.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be ind.icated on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies, Spokane
County Engineer and the Spokane Counry Health District. Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat. 3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water seivice shall be coord.inated through the Director of Urilities, Spokane County.
5. Water service shall be by [an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.

6. Prior to filinb the final plat, thc sponsor shall demonstTatc to the salisfaction of thc
Spokane County Health District that an adequate and potable water supply is available
to each tract of the plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
8. Disposal of sewage effluent beneath paved surfaces is currently prohibited.
9. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that a suitable site for on-site sewage disposal system
is available on Tract B.
10. Prior to filing the final plat, the sponsor shall demonsrrate to the satisfaction of the
Spokane County Health District that the existing on-site sewage disposal system
serving the residence located on Tract A is wholly located within the boundaries of the
tract.
11. Subject to specific application approval and issuance of permits by the health officer,
the use of an individual on-site sewage disposal system may be authorized.
12. The dedicatory language of the plat will state: "Subject to specific application approval
and issuance of permits by the Health Officer, the use of an individual on-site sewage
system may be authorized."
13. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
. 14. The final plat dedication shall contain the following statement: "The public water
system, pursuant to the water plan approved by county and state health authorities, the
local fire protection district, County Building and Safety Department, and water
purveyor, shall be installed within this subdivision and the applicant shall provide for
individual domestic water service as well as fire protection to each tract prior to sale of
each tract and prior to issuance of a building pernut for each tract."
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorizafion is conditioned
on compliance with all rules and regulations of the Spokane County Health District and
is further coriditioned and subject to specific application approval and issuance of
permits by the Health District.
2. The detiication shall state: .
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formarion of ULTD by petiaon method pursuant to RCW
36.94, which petition includes the owner's)' property; and further not to object by the
signing of a protest petition against the .formation of a ULID by resoluaon method
pursuant to RCW Chapter 36.94- which includes the owner(s)' property. PROVIDED,
this condition shall not prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the properry as a result of improvements called for in conjunction
with the formation of a ULID by either petition or resolution method under RCW
Chapter 36.94."
3. Any water service for this project sha11 be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
4. The dedicadon shall state: "Each new dwelling unit shall be double-plumbed for
connection to future areawide collecaon systems."
BUILDING AND SAFETY DEPARTMENT CONDITIONS
1. The applicant shall contact the Department of Buildings at the earliest possible stage of
design/development in order to be infornied of code requirements
administered/enforced as authorized by the State Building Code Act.
