THIS MATTER, an eppllcation from Spokane Industdal Park has been received and
decided upon,, pursuent to Spokane County Subdivision regulattons, on the 5th day
of May, 1988.
The Individual signing below has further been properiy delegated the
responsibillty for rendering the decision by the Spokene County Director of
Planning.
FlNDINGS OF FACT AND CONCUJSION
1. The proposal is to divide 160 acres into 46 lots for the development of industriai
lots.
2. The proposal Is located In ihe north half of Section 12, Township 25 North, Range
44 E.W.M., Spokane County, Washington, lying north of the raiiroad between
Suilivan and Flora Roads.
3. The current zoning of the property is Manufacturing, estebltshed In 1960. The
proposed bt sizes, frontage end tntended uses ere allowed wtthin this zone.
4. The Spokane County Comprehensive Plan designates this area as Industrial. The
lots and uses proposed ere generaity In acoord with thts planning category.
5. The required public notice was provided for ihis proposal and egencies heving a
potential interest In the project were notified and asked for reoommendations.
6. There was e reoommendaiion for a more detelled environmental review from the
Spokane County Engineers. The sponsor and the Spokane County Engineers have
agreed upon necessary road tmprovements and phasing of development to mitigate
potential Improvements and phasing of development to mitlgate potentlal adverse
trafflc Impacts. A mitigated DeterminaUon of Nonsigniilcanoe is substituted for the
original D.N.S.. The mitigating measures reoommended by the Spokane County
Enpineer's have been agreed upon by the sponsor to generally reduce anNcipated
traffic impacts of the proposal.
7. That In consideration of the recommended oonditions and Spokane County
development standards, ihe proposel Is not detrtmental to the public health, safety
and peneral welfere. 6. That the proJect is proposed to have phased development In three stages wtth
necessary improvements constructed to meet the needs ot each phase. Such phasing
is consistant with subdivision practices.
9. That the provistons of the Manufacturing Zone and other sections of the Spokene
County Zoning Ordinance apply to the use of the indhridual lots.

cansirucUon of the water system In soooniance with the approved WATER PLAN.
The Ume schedule for improvements will provlde for compledon of the weter
system end Inspectlon by the appropriate heatih authorities prior to application
for building permits within the finat binding site plan. The anangements or
egreements will include a provislon hokiing Spokane County and the purveyor
harmless from claims by eny lot purchaser refused a building pernnit due to ihe
failure of the sponsor to satistactorlly oomplete the approved water system.

13. The final plat dedtcation will oontein the following statement: 'The public water
system, pursuent ihe WATER PLAN approved by County end State Health
authorities, the local tire dtstrict, County Building & Satety Oepartment, and
water purveyor, will be installed within lhis binding site plan, and ihe
subdh►ider/sponsor will provide for indiridual domestic water service as well as
fire protection to each lot prior to sele of each lot and prior to issuance of a
building permit for each lot."
14. That no building permlt will be issued for any lot within the Final Blnding Site
Plan until certified by a Washtngton State Ilcensed engtneer "ihat the water system
has been installed pursuant the approved WATER PIAN for the Final Binding Site
Pian", signed and stamped by said engineer.
15. That a survey is required prior to the tiling of a flnal binding site plan.
COUNTY ENGINEER'S CONDtTtONS
1. The County EnOineer has examined this development proposal and has detennined
that the impact of this propossi upon the existing County Road System warrants the
dedication of additbnal Right of Way and ihe roadway improvements herein
specified. That conditions ot approval of the 8inding Site Plan by the County
Engineer is gfven subject to dedication of Right of Way and approval of the road
sytem. In oonjunctlon with phesing of the iinal Binding Site Pians, specific
conditions approprtate to each phase wlll be speclfled.
2. The proposed Binding Site Plan shall be improved to the standards set forth In
Spokane County 8oard oi Commissioners Resolution No. 80-1592, as amended,
which establishes regulations for roads, approaches, dratnege and fees In new
construction.
3. The appllcant shell deed to spokane County 14' feet of the subject propeny for Road
RiAht of Way along Sullivan Road end shaii construct an additional traffic lane along
Suilivan Road from Marietta Avenue nohhward to the intersectton of Euclid Avenue

drainage fecfiities be submitted for approval. Dralnege plans to be prepared under
the direction of a licensed professtonal Civil Englneer.
7. The applicent shail submit for approval by the Spokane County Engineer prior to
the release of a buiiding permit a surface water disposal plan for the buildinp site
or ponlon thereof if the development Is phased.
8. Prior to the release of a building permit, a parking plan and traffic circulation
plan for each site shall be submitted and approved by Ihe Spokane County Engineer.
The design, location and arrangemeni of parCing stalls shall be In acoordance with
standard engineedng practices. Paving or surtacing as approved by ihe County
Engineer will be requlred for any portion of the project which is to be occupied or
traveled by vehicles.

10. No consiruction work is to be performed within the existing or proposed public
right of way untii a pemnit has been issued by the County Engineer. Ail work is
subject to inspection and approvai by the County Engineer.
11. All construction within the existing or proposed public right of way is to be
completed prior to filing the tinal binding site plan or a bond In the amount
estlmated by the County Engtneer to oover the oosi of oonstrucnon of

16. That the minimum curb radii at all street intersections withtn the proposal shall
be 30' feet. Minimum radii at Sullivan Road intersections shall be 40' feet.
17. To oonstruct the road improvements etated therein, the epplicant may, with the
approval of the County Engtneer, joln In and be a willing participant In any
petiilon or resolution which purpose ts the formation ot a Road Improvement
Dlstrtct (RID) for sald tmprovements pursuant to RCW 36.881 as amended. At
such Ume as an RID is crested or any road tmprovement project ts sanctioned by
Spokane County, the tmprovements required (curbs, pathways, dreinage control,
paving, traffic slgnal systems, etc.) wili be at the sole expense of ihe undersigned
owner, their heirs, granlees end assigns.
18 Should an RID be pursued, it shall be the responsibllity of the applicant to provide
road and drainage ptans sufficient for the creatton of a Road Improvement District.
These plens shafl be prepared by e Iicensed professfonal civil engineer and shail be
prepared In oompliance with Spokane County road standards and drainage
guidellnes.
In order to oonstruct requtred roadway improvements on Sullivan Road, Marietta
Avenue and Euciid Avenue the applicant may petition the Board of County
Commissloners to create a Roed Improvement District R.I.D. ' The RID must be
created by the 6oard of County Commisstoners prior to the flitng of the binding site
plan.
19. The following slaiement shall appear on the binding slte plan document "Perking
will be prohibited along Euclid Avenue".
20. A statement shall be placed on the binding slte pian doucment which prohibits
dfrect access from lots to Sullivan Road or Flora Road

21. Direct ea:ess from lots to Merietta Avenue and Euclid Avenue shall be limited to the
access polnts approved by the County Engineer and as shown on the prellminery
binding site plan.
22. A mintmunn 20' foot wide easement shall be provided along the east side of Sullivan
Road and each side of the pubiic road right of way on Euclid Avenue end Marietta
Avenue. The purpose of the easement ts to aooommodete pethways, landscaping, and
drainage irom roadways.
23. A sysiem of pathways, aa:essible to the publlc, be oonstrucied along Sullivan Road,
Euclid Road and Marietta Avenue. The pathway Is to be located within the oommon
pathway, drainage and landscape easement area. That e statement shall be placed on
the binding site plan permitting Spokane County to enter within the easement for
the purpose of drywell and sign maintenance. Snow removed from the pubiic
roadways shali be permitted with the easement. Maintenance of pathways, drainage
swales and landscaping areas shail be the responsibfity of the applicant.
24. The propased private roads as shown on the preliminery btnding site plan are
approved by the County Engineer.
25. The following statement must appear on the binding stte plan document: "The
private roads as shown hereon ere easements which provide a meens of ingress and
egress for those tots within the bindtnD site plen havtnA frontage thereon."
26. Privete road plans with connectfons to a public road are the responsibtlity of the
developer and are required prior to the release of a buildtng permit. A statement to
thts effect shalt be placed tn the btnding site plan document.
27. Private roads be improved to a minimum improved surface wtdih of 30' feet with a
minimum 20' foot wide lendsc.aptng end dratnege easement on etther side of the
roedway. Subject to approval under section 10.207 of the Spokane County Fire
Code.
28. Ail vested owners shall sign and reoord private road documents as prescribed by
the Spokane County Engineer. These documents shail be reviewed and epproved by
the Spokane County Engineer prior to recording wiih the Spokane County Auditor.
Recordtng numbers shall be referenced on the bindin8 stte ptan document.
29. The toitowing statement shall be pieced on the binoing stte plan document:
"WARNING: Spokane County hes no responsibility to build. improve, malntaln or
other wtse service the private roads oontatned within or providing servtce to the
property described in this btnding site plan. By accepting ihis binding site pian or
subsequently by allowing a building permit to be issued on property on a private
road, Spokane County assumes no obllgation for said private road end the owners
hereby acknowledge ihat the County has no obligation of any kind or nature
whatsoever to establlsh, examine, survey, construct, alter, repair, improve,
maintain,, provide drainage or snow removal on a private road. This requirement
is and shall run with the land and shall be binding upon the owner, lheir heirs,

30 The following statement shall be piaced on each phase of the binding site plan: "The
owner(s) or successor(s) In interest egree to suthorize the County to place their
neme(s) on a petitlon for the iormetlon of a Road Improvement 0lstrict (RID) by
the petiUon method pursuant to Chapler 36.88 RCW, which petition inciudes the
owner(s) property, and funher not to object, by the stgning of a ballot, the
formation of a RID by the resolution meihod pursuant to Chapter 36.88 RCWI
which resolution tnciudes the owner(s) property. If a RID 1s formed by either the
petition or resolution method, as provided for In Chapter 36.88 RCW, the
owner(s) or successor(s) turther agree: (1) that the improvements or
construction contemplated within the proposed RID is feasible. (2) that the

COUNTY HEALTH DISTRICT CONDITIONS
1. A combined surtace water snd sewege dlsposel deteiled plen shall be approved by

any on-stte sewage disposel permit or buildlng permit for this project.
2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
3. Water service shall be ooordinated throuoh the Oirector of Utilities, Spokane
County.
4. Water servtce shell be by an existin8 publtc water supply when approved by the
Regional Engineer (Spokane). State Department of Soctel & Health Servtces.
5. Prlor to flling the flnal plat, the sponsor shall present evidence that the plat Iles
withln the reoorded servlce area of the water system proposed to serve the piet.
6. A pubiic sewer system will be made availabte for the project and tndividuel service
will be provided to each lot prior to sale. Use of individual on-site sewage disposal
systems shall not be authorized.
7. A statement shetl be placed In the dedicetion to the effect that: "A public sewer

BUlLDiNG & SAFETY DEPARTMENT CONDITIONS
1. The required flre flow for any building or property devetopment Is deternnined by
building stze, type of oonstructfon, and proximlty of exposures. Required fire
flows shail be based on an evaluation of each buiiding at the time of bufiding permit
application.
2. Projeci is bcated within Flre District No. 1. The requtred flre flow is determined
by the district.

3. Fire hydrants for oommercial and industrial bulldings shall be Iocated so thai no
portion of the bullding exterlor is more than 175' feet from the hydrant.
4. Fire hydrants shall be located so as to be accessible to fire apparatus and not be
obstructed by any structure or vegetation or have the vfsibility tmpaired for a
dlstance of flfty feet in the direction of vehicular approach to ihe hydrant.
5. Specific location of hydrants shall be determined by the Fire Dlstrict.
6. The appltcant shall provide veriticatton from the Fire Disirict to the Department
of 8uilding and Safety that provisions have been made for adequate flre protection
prior to the release of bullding pernnits.
