requirement for the construction of a temporary cul-de-sac at the temlinus of that pomon of Nom
vvhich will be constructed in conjunction with the above-referenced project.

Section 3 17 of the Spokane County Standards for Road and Sewer Construcho» reads, in part:
"Public or private roads servulg more than one lot, parcel, or tract shall have a cul-de-sac
constructed at the end " This requirement was previously listed as a condihon of approval for the
Change of Con ''ons (7E-116-84A, dated May 23,1991) granted to this parcel. Based on these
documents, the County Engineers depa,rtment vuill requare the construction of a temporary cul-de-
sac at the end of Nora Avenue, at the eastern boundary of the parcel

feet. On paved rural roads, a paved cul-de-sac Hnth a 45 foot radius and a 5 foot ravel

Sprague Avenue, Spokane, Washington.
This assigmnent is made as secunty for the full and faithful performance by Stone
Development, L. L. C. , general contractor performing work for the benefit of Cornerstone
Aparmlents, Inc., for certain roads, monumenLs aad drainage faciliaes for Union Road
Improvemeats as speGified in the typical seccion and roadway improvement specifications for
said project dated April 169 1996, and on file in the Office of the Spokane County Engineer.
Any interest benefits accruing under said savings certifiicaLe shall remaia the property
of Rea1 Holdings, Inc. Said savuigs certificate sball be released to Stone Development,
L.I. C., as general contractor, or to Real Holdings, Inc., only with the pnor writtea consent
and agreement of Spokane County.
PROVIDED that the undersigned does hereby authorize Washingtan Trust Bank to
pay over to Spokane County all or a sufficient pomon of the monies in the savings certificate
referenced hereinabove upon written documentation being received from the Spokane County
Engiaeer indicating that the purposes for which a savings certificate was assigned have not
been fully and faithfiilly perfornaed as required and a statem,ent of that amount of money
which the Spokane County Engine,er has required and a statement of that amournt of money
which the Spokane County Engia+eer deems necessary to complete such obligation. Upon
receipt of such written documentation, Real Holdings, Inc., and Cornerstone Apartaaents,
Inc., hereby autharize Washington Trust Bank to release to Spokane County that amount of

GENERAL
This development consists of 114 apartments on approximately 5 6 acres The project ts located
ui the Spokane Valley north of Mission Avenue between Wilbur and Union Roads, a few blocks
west of Pines Road wrttun Spokane County, Washulgton The site is currentiy an open field
containing only construction fill and debns and haviqg no structures upon it The current zoning
is UR 22 for the entire project UR 22 is consLscent with the development proposed A soils
map with the proposed developments location is provided
PURPOSE
The purpose of this report Ls to determine the extent of storm dramage facilities whicb will be
requued to dispose of stormwater runoff created by the development of the apartments. The
storm drauiage facilrties on this project wiU be designed to dispose of runoff from the ten year
design storm This development n within the Aquifer Sensitive Area of Spokane County and
is subject to '208' requuements For this project the 10-year curve from the Spokane, Medical
Lake, Reardon, Cheney and Rockford intensiry, durauon and frequency (IDF) curves were used
ANALYSIS METHODOLOGY
The Rational Method, which is recommeaded for basins less thaa ten acres in size, will be used
to determine the pealc discharges and runoff volumes for all of the project basins
PROJECT DESCRIPTION
' The Stone Apartments is a development consistmg of 114 muln-family units on 5 6 acres. Tims
project is located in the SE 1/4 of SecUon 9, T 25 N, R 44 E., W.M in Spokane County,
Washington
TOPOGRAPHY
The existiag ground slopes gradually away from Mission towards I-90 to the north where the
ground drops down sharply for about 15 feei over the side of an old fill There is a relaavely
flat area approximately an acre in size in the northwest corner that will be utilized for the entire
project's '208' area For development purposes, the natural sloping was used for design and is
mamtained as possible throughout the project

SOILS
As can be seen from the accompanying soils map from the Spokane County Soils Survey as
performed by the SCS, ihe site consists of the Gamson Senes of soils, prunanty Gamson
Gravelly Loam (GgA) on 0 to 5-percent slopes and Gamson Gravelly Loam (Ggb) on 5 to 20-
percent slopes. These sods as defined, are excessively druned and have moderately rapid
permeability. Withm this area, due to soil types and slopes, this type of sail can be expected
to drain slowly with a minunum potenual for erosion As defined within the Spokane County
Drainage Guideline, this type of soil has been pre-approved for the installation of drywells.
DRAINAGE NARRATIVE
Offsite
Based upon the topography of the site the only offsite basws to be considered were those formed
by unprovements to Union Road, identified as Road Basxns B, C and D Road Basin B for this
project was ihe portion of Union Road west of the R O W. centerline and adjacent to the
property as well as the eatire cul-de-sac Road Basm C encompasses the portion of Union Road
east of the R O W centerline excludmg the cul-de-sac, none of which is curbed. Road Basin
C has a pond to intercept the runoff flowuig down the chtch Road Basm D is the portion of
Umon Road west of the R O. W. centerhne and south of the proposed curb and gutter. A
drywell is to be placed at the end of the dhtchline just before the curb and guttrer begins to
receive the runoff flowuig along the ditch that does aot ufiltrate Please see the attached basin
map for specific basm locations

Al.l onsite drauiage will be collected and treated using the "208" runoff inethod as descnbed in
the Spokane Caunty Guidelmes for Stormwater Management. Despite the project being oae
' targe basm to faclhtate this analysis the project was divided mto 8 subbasuis A1, A2, A3, A4,
AS, A6, A7, and A8 These subbasins are shown on the attached Basm Map The flows from
the various subbasins are collected in catch basuns and piped to the common pond in the
northwest corner of the project Please refer to the basm map for catch basm and concrete inlet
numberng

FINDINCS O FACT. CONCLUSIONS AND ORDER
INTRODUCTION
This matter has come before the Hearing E;xaminer Committee on May 23,1991.
The members of the Committee present are Veroaa Southem, Chairperson, Bud
Skadan and Harry Gibboas.
PROPOSAL
The sponsor, Robert L. Flory, requests approval of a Change of Conditions No. ZE-
116-84A, to allow maximum density allowed in the Urban Residennal-22 (UR-22)
Zone for apartment unit where the site was r+estricted to a total of 27 units.
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generally located at the end of Nora Avenue, 350 feet east of the
Wilbur Road and Nora Avenue intersection in tbe SW 1/4 of the SE 1/4 of Secrion 9,
Township 25 N., Range 44 E:WM, Spakane County, Washington.
2. The committee adopts the Planning Department Report as a part of this recor+d.
3. The exisdng land nse(s) in the area are single family homes, duplexes, and
undeveloped.
4. The Comprehensive Plan designates this site as Urban. The Urban category is for the
purpose of residential development, including residenrial densides of 1 unit/acre to 17
wnit/acre.
5. The A►rterial Road Plan designates Nora Avenue as a Local Access Street, with a
recommended right of way width of 50 feeL To serve the site, Nora will have to be
extended through the pmperty.
6. The existing zoning of the property described in the application is Urban Residential-
22 (UR-22), previously estab ' hed in 1991.
7. The property was previously rezoned to Multiple Family Suburban in 1981 aad based
on the origuial development proposed, was limited to a cotal of 27 attached units.
8. The provisions of RCW 43.21C (The State Environmental Policy Act) have been
complied vvith and a Determunation of Nonsignificance was issued.
9 The legal requirements for public notice have been fulfilled.
10. The owners of adjacent lands expressed disapproval of the pmposed use. A pedaon
and Ietter was submitted indicating that surnonnding property owners were opposed
to the change of conditions.
11. The proposed change of conditions is compatible with existing uses in the area.

12. The proposed change of conditions does unplement and conform to the
Comprehensive Plaua.
13. The applicant has demonstrated that conditions have substannally changed since the
original zoning of this area and accordingly, the praposed change of conditions is
justified.
14. The proposed change of condidons will be devimental to the public health, safety,
morals or welfare.
15. The Committee additionally finds/concludes:
a The County Engineer has recommended limiting the development to 36 units until a
second access is obtained for the site
b. The pennissible densiry for the site is approximately 51 units at 22 units per acre.
c. The proposed site plaA shows adequate setbacks to protect other sunounding
residential uses.
d. The Plaanuig Departmeat recommended approval of the proposed change of
conditions with restricting the development of the initial 36 units to the north side
of Nora Avenue extended which will reduce the initial ianpacts to the other
sunounding residendal uses.
CONDITIONS OR CONTINGENCIES APPLIED TO THIS A.PPROVAL
1. All Conditions imposed by the Hearing Examiner Committee shall be buiding on the
"Applicant," which term shall include the owner or owners of the property, heirs,
assigns, and successors-in-interest.
2. The following Conditions of Approval apply to the real property described below:

SPOKANE COUNTY PLANNING DEPARTMENT
1. Approval is reqwsed by the Plazining Director/designee of a specific hghting and
signing plan for the described property prior to the release of any btulding pennits.
2. A specific landscape plan, planang schedule and pmvisions for maintenance
acceptable tio the Plannung Ihrector/designee shall be submitted with a performance
bond for the project prior tio release of building pernits. Landscaping shall be
installed and maintained so that sight distance at accESS points is not obscured or
impaired.
3. The applicant shall develop subject property generally m accoTdance within the
concept presented to the Hearing Bady. Variations, when approved by the
Planning Director/designee, may be permitted, including, but not limited to buildi.ng
location, landscape plans and general allowable uses of the pernutted zone. All

variations must confozm to regulations set forth in the Spokane County Zoning Code, and the original intent of the development plans shall be mai.ntained.
4 Conditioned for 36 units only. A secondary access shall require review and
approval at a public hearing before additional units can be approved. The 36 units
shall be locatied an the north side of Nora Avenue extended.
5. A specific development plan shall be submitted for Planning Department review and
approval prior to issuance of building permits. Construction must be judged as
proceeding according to the plan or constitute a zoning violation.
6. All standards of the Urban Residential-22 (UR 22) zone as amended, shall be
complied with in the development of this site.
7. Landscaping and buffering for this site shall confarm to the staadards of the Urban
Residential-22 (UR-22) zone (Secdon 14.622) and landscaping (Secrion 14.806) of
the Spokane County Zoning code.
8. The Planning Department shall prepare and recor+d with the Spokane County
Auditor a Tide Notice noting that the property w quesaon is subject to a variety of
special conciitions imposed as a result of approval of a land use action. This Title
Notice shall serve as pubhc notice of the condidons of approval affecting the
propertrty in question. The Tide Notice should be recorded within the same time
frame as allowed for an appeal and shall only be released, in fuli or in part, by the
Planning Department. The Title Notice shall generally provide as follows:
The parcel of property legally described as [ ] is the
subject of a land use action by a Spokaae Couuty Hearing Body or
Admfnistrative Official on April 18, 1991, imposing a variety of
special development conditions. File No. ZE-116-84A is availabie
for inspection and copying ia the Spokane County Planning
Department.
9. 1he project is subject to Secdon 14.706, the Aquifer Sensitive Area Overlay Zone
of the Zoning Code for Spokane County, which sets forth various me,asures for
aquifer protection; specifically, measures dealing with wastewater disposal, spill
protection measures and stormwater runoff.
SPOKANE COUNTY ENGINEER'S OFFICE
Prior to issuance of a building pemut or at the request of the County Engineer in
coajunction with a County Road Project/Road Improvement Disaict, whichever acdon
comes fust:
1. Applicant shall dedicate 50 feet on Nora Avenue for right-of-way.

proposed street oenterline and curb grades shall be submitted to the County
Engineer for approval prior to construction andlor the filing of each final plat; road
plans to be prepared under the direction of a licensed Professional Civil Engine,er.
,4. Drainage plans and desiga calculations showing the ahgrmaent of dramage facilities
shall be submitted to the County Engineer for appinval prior to construction andJor
the filing of the final plaL Drainage plans to be prepared nnder the direction of a
licensed Professional Civil Eagineer.
5. Appropriate provision shall be made that the followxng-described property be held
in trust until the continuation of the streets be dedicated or deeded: a one (1)-foot
strip at the ends or edges of all streets that termmate or border the subdivision
boundary. (Temporary cul-de-sacs are reqnired when streets temunate at the
subdivision boundanes.)
6. The applicant shall submit for approval by the Spokane County Engineer aad the
Spokane County Health Distnct a deta,iled combined on-site sewage system plan
and surface water disposal plan far the entire project, or portion thereof, if the
development ss to be phased.
7. A parldng plan and trafFic cinculation plan shall be submitoed and approved by the
Spokane Couaty Engineer. The design, location and anangemeat of parking stalls
shall be ie accordance with standard traffic engineeri.ng pracaces. Paving or
surfacing as approved by the County Engineer, will be reqwred for any portion of
the project wluch is to be occupied ar traveled by vehicles.
8. The construction of the road irnprovements stated herein shall be accomphshed as
approved by the Spokane County Enginoer.
A The County Engineer has designated Typical Roadway Section Number Two,
Local Access standard far the improvement of Nora Avenue, which is t,o be
constructed within the proposed development This will require the installation of
36 feet of asphalt. The constraction of curbing and sidewalk is also required.
10. All required unprovements shall conform to the curnent State of Washington
Standard Specifications for Road and Bridge Construction and other applicable
Connty standards aadlor adopted nesolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
11. Roadway standards, typical roadway secdons and drainage plan requirements are
found in Spokane Board of County Comnussioners Resolution No. 80-1592 as
amended and are applicable to this proposal.
12. This subdivision or development proposal is located within a drainage basin which
has been identified by the Spokane County Engineees office as having stormwater
runoff problems. Si.ace this plat or development propasal is affected by or is a
contnbutor to stiornnwater flows, properry owners should paracipate in the planning
and unplementadon of a future basi.nwide stomnwat,er management system.
The owner(s) ar successor(s) in interest agree to join in any County-approved

sLormwater management program and to pay such rates and charges as rnay be fixed
tlmough public hearings for service or benefit obtained by the planning, design,
constructing, maintaining ar operation of stormwater control facilities.
13. No construction work shall be perfonned withia the existing Qr proposed public
right-of-way until a penmit has been issued by the County Engineer. All work
within the public roaci right-of-way is subject to inspection auad approval by the
County Engineer.
14. All required construction within the exisang or proposed public right-of-way is to
be completed prior to the release of a building penmit, or a bond in an amount
estimated by the County Engineer to cover the oost of construcaon of improvements
shall be filed with the County Engiaeer.
15. Applicant shall sign and record Spoka,ne County Notice to the Public No. 6 which
specifies the folluwing:
The owner(s) or successor(s) in intesest agree to authorize the County to place theu
natne(s) on a petidon for the formation of a Road Improvement District (RID) by
the pedaan method pursuant to Chapter 36.88 RCW, which petirion includes the
owner(s) property, and further not to object, by the signing of a ballot, the
formation of a RID by the resolution method pursuant to Chapter 36.88 RCW,
which resolution includes the owner(s) property. If an RID is formed by either the
pehtion or resoluaoa method, as provided far in Chapter 36.88 RCW, the owner(s)
or successor(s) further agnee:
(a) that the unprovcment or construction contemplated within the proposed RID is
feasible;
(b) that the benefits to be derived fmm the formation of the RID by the property
included therein, together with the amount of any County participation,
exceeds the cost and expense of foimation of the RID; and
(c) that the property within the proposed RID is suff'iciently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as
authoritied under RC'W 36.88.090, to object to any assessment on the property as a
result of the improvements called for in conjuncdon with the formatiion of the RID
by either petition or resolution method under Chapter 36.88 RCW.
This requirement apphes to Union Road, from which the subject parcel takes
access.
16. There may exist ualities, either underground or overhead, affecting the subject
property, including property to be dedicated ar set aside for future acquisition.
Spokane County assnmes no financial obligation for adjustments or relocation
regarding these utthdes. Applicant(s) should chock with the apphcable utility
purveyar and the Spokane Gounty Engineer to determine whether applicant(s) or
the utility is responsible for adjustment or relocaaon costs and tio make
arrangements for any necessary work.

17. If the applicant is unable to obtaia a second means of access, no more than 36 units
would be permitted to use the existing roadway syst,em, Nora Avenue to V~'ilbur
Road. Subsequent bwlding pernnts would be approved for construction after a
secondary access extending Nora Avenue w Uaion Road and Mission Avenue is
constructed to County Standards.
18. The applicant shall be responsible for the full 50 fL nght of way dedicarion from the
existing termination of Nora Avenue, west of and adjacent to the proposed
development through the applicants property.
SPOKANE COUNTY UTILITIES DEPARTMENT
1. Pursuant to the Board of County Commissioners Resoludon No. 80-041 S, the use
of on-site sewer disposal systems is hereby authonzed. This authorization is
conditioned on compliance with all rules and regulations of the Spokane County
Health District and is fiu-ther condidoned and subject to specific application
approval and issuance of permits by the Health DistricL
2. The owneT(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petidon for the formation of ULID by petition method pursuant to
RCW 36.94, which petition includes the owner(s)' property; and further not to
object by the signing of a protest petition against the fornation of a ULID by
resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)'
property. PROVIDED, this condition shall not prolubit the owner(s) or
successor(s) from objecting to any assessment(s) on the property as a resnlt of
unprovements called for in conjunction with the fomsation of a ULID by either
petition or resolution method under RCW Chapter 36.94.
3. Any waoer service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended.
4. Each new dwelling unit shall be double-plumbed far connection to futime areawide
collection systems.
SPOKANE COUNTY HEALTH DISTRICT CONDITIONS
1. A oombined surface water and sewage disposal detailed plan shall be approved by
the Spokane County Engineer and the Spokane County Health District prior to the
issuance of any on-site sewage disposal penYUt or building pernut for this project.
2. Sewage disposal method shall be as authorized by the Director of Utilides, Spokane
County.
3. Subject to specific apphcation approval and issuance of permits by the health
officer, the nse of (an) individual on-site sewage disposal system(s) may be
authorized. Per plans, site restrictions may limit size of on-site sewage syscem;
this, impa,cting the number of aparnnents allowed. If the daily flow rate for the
system exceeds 3,500 gallons, but under 14,500 gallons per day, specific
application approval and issnance of pennits must be canducted by the Departinent
.

of Health. If the flow rate exceeds 14,500 gallons per day, the Department of
Frcology must be contacted.
4. Water servrvice shall be coordinated through the I?irectar of Utilities, Spokane
County.
5. Water service shall be by an existing pnblic water supply when approved by the
Regional Engineer (Spokane), State Departrnent of Health.
6. Disposal of sewage effluent beneath paved surfaces is cuirently prohibited.
7. Use of private wells and water systems.
SPOKANE COUNTY BUILDIlVG AND SAFETY DEPARTMENT
1. The applicant shall contact the Department of Building and Safety at the earliest
possible stage of design/development in order to be infanned of code requirements
administered/enforced by the department, e.g., State Building Code Act
regulauons, such as reqwrements for fire hydrant/flow, fire apparatus access roads,
street address assignmeat, barrier•free regulations, energy code regulations and
general coordinadon with other aspects of project implementation.
WATER PURVEYOR (MODERN ELECTRIC wATER COMPANY)
1. Modern Electcic Water CompanY will suPPIy the site with adequat,e watier for
domestic, fine and irrigation uses; however specific arrangements have not been
made tio serve this development.
2. That the water purveyor will require an approved engineered map with adequate fire
flows and domestic flows.
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. Air pollution regulations require that dust emissions during demolition, construcaon
and excavation projects be cantrolled. This may require use of water spays, tarps,
sprinklers or suspension of activity during certain weather coaditions. Haul roads
should be tneated, and enussions from the transfer af earthen material must be
controlled, as well as emissions from all other construction-related activities.
2. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved
and kept clean.
3. Measures must be taken to avoid the depasition of dirt and mud from unpaved
surfaces onoo paved surfaces. If tracking ar spills occur on paved surfaces,
measures must be taken immerliately to clean these sutfaces.
4. Debris generated as a result of this project must be disposed of by means other than
burning.

l. The proposaD is generally located east of Wilbur Raad, east of Nota Avsnue
(+extended) and soutb of Interstate 90 (I-90), in the SE 1/4 of Section 9, rownship
25 North, Range 44 EWM, Spokane County, Washin►gton
2. The proposal consists of a zone reclassification from Urban Residential-3.5 to
Urban Residential-22 on approxim.ately 2.9 acra for development of 62 multiple
famiIy residences.

shall be in accordance with standard traffic engineering practices. Paving or
sutfacing as approved by the Courtty Engincer, wilI be required for any nortion of

approved by the Spokane Caunty Engineer.
6. The County Engineer has designated Typical Roadway Section Local Access
standerd for the improvement of Union Road, which is adjacent to the proposed
development This will require the additton of approximately 27 feet of asphalt
along the $ontape of the development and extendung sovth to Mission Avenue.
Guncbing and sidewalk must also be constructed along the frontage only of the
paxrel.

Standard Specifications for Road and Bridge Construction aad other appticable
County standards and/or adopted re.solutions pertaining to Road Standards and
Stornnwater Mauagement in effect at the date of construcrion, unless otherwise

9. Roadway standards, typical roadway sections aad drainage plan requirements are

for the formation of a ULID bypetiaon method pursuaat to RCW 36 94
which the petition includes the CSwner(s) property and further not to ob'ect by
sigaiag of a protestrR 'n against tbe forznation of a ULID by resolution
method pursuant to 36.94 w hich includes the Owner(s) property.
Provided, this condition shail not prohibit the Owner(s) or Successor(s) from
objection to any assessinent(s) on the propexty as a result of improvements
called for in the conjunction with the fonnation of a ULID by eitber petitaan
or resolution under RCW 36.94.
2. A wet (live) sewer connection to the areawide Public Sewer System is to be
constructed. Sewer connection permit is required: T'his shall be en interim
connection ta the North Pines Sewer Distnct. It is doubtiW that there is

1. ,All air pollution regulations must be met.
2. Air pollution regulations require that dust emissions during demolition,
consticuction and excavation projects be controlled. Tbis msy require use of water
sprays, tarps, sprnklers or suspensian of activity during certain weather
conditions. Haul roads should be treated, aad emissions frorn the transfer of
earthen ataterial must be controlled, as well as emissions from aIl other
construction-related activities. '
3. SCAPCA strongly reeonuaeads that all tnaveted surfaces (Le , ingress, egress,
parking areas, access roa+ds) be paved and kept clean to Yninimize dust emissions.
4. Measures must be taken to avoid the deposi#ion of dirt and mud from unpavod
surfaces onto paved sunfaces. If bracking or spiIls occur on paved surfaccs,
measures must be taken immediately to clean these swrfaces.

than burning (i.e., conshvction waste, etc.).

WA►SHINGTON STATE DEPARTMENT OF ECOLOGY
1. Designed sawage flows are deterrruned by the nwnnber of bedroomslunit. One-
bedroom apartments are designed on the basis of 200 ga►llonsJunit/day. If 62 one-
bedroaan uruts are planned, design flows would be 12,400 gallons per day. A mix
of one-, two-, and three-bedroom units could amount co flows exceeding 14,500
gallons per minute aad fall within F.cology jun~sdiction. Area sewage loading
requirements for 2.9 acres arc limited to a maximurn of 4,560 gallons pet rninute
Dedicating the adjace»t 2.7 acres would a]low 4,240 addition gallons per mtnute
and re.strict future use. This design may not be acceptable.
WASRiNGTON STATE DEPART1ViENT OF TR.ANSPORTATION
l. Based on the remaining 78 apartiments aad mitigation totaling $8,892.00, tbe pro-
rata share shall be $114.00 per livin,g unit. Payment of this fee shall be made to
WSDOT prior to the issuance of the requested building permits.
2. Issusnce of aIl buildiug pettnits shall occur befotc June 34, 1999. Bullding
pe~rmits obta►iaed after June 30,1999 sha]I require the applicant to update the

This matter has come before the Hearing Examiner Committee on May 23, 1991.
The members of the Comrmttee present are Verona Southern, Chauperson, Bud
Skadan and Harry Gibbons.
PRG''POSAL
The sponsor, Robert L. Flory, requests approval of a Change of Condinons No ZE-
116-84A, to allow maximum density allowed in the lirban Residennal-22 (UR-22)
Zone for apartment unit where the site was restncted co a total of 27 units.
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generally located at the end of Nora Avenue, 350 feet east of the
Wilbur Road and Nora Avenue uitersectinn ui the SW 1/4 of the SE 1/4 of Secaon 9,
Township 25 N, R.ange 44 EWM, Spokane County, Washmgton.
2. The committee adopts the Planning Deparnnent Report as a part of ttus record.
3 The existing Iand use(s) in the area ane single family homes, duplexes, aad
undeveloped.
4. The Comprehensive Plan designates this site as Urban. The Urban category is far the
puipose of residential development, including residenaal densitLes of 1 unit/acr+e to 17
unidacre.
5. The Artenal Road Plan designates Nora Avenue as a Local Access Street, with a
recommended nght of way width of SO feeL To serve the site, Nora will have to be
extended dvrough the property.
6. The existmg zorung of the property described in the application is Urban Residendal-
22 (UR-22), previously established in 1991.
7. The property was previously rezoned to Multiple Fannfly Suburban uZ 1981 and based
on the onguial development proposed, was linuted to a total of 27 attached units.
8. The provisions of RCW 43.2I C(The State Envzonmental Pohcy Act) have been
complied with and a Determination of Nonsigmficance was issued
9. 1"he legal mquuements for public notice have been fulfilled.
10. The owaers of adjacent lands expressed disapproval of the proposed use. A petition
and letter was subnutted indhcadng thac surnowading property owners were opposed
to the change of conditions.
11. The proposed change of conditions is compatibte with existing uses in the area.

Comprehensive Plan.
13. The applicant has demonstrated that condiaons have substanaally changed since the
ongmal zoning of this area and accordingly, the proposed change of conditions is
justified.
14. The proposed change of cond.iaons will be detrimental to the pubiic health, safery,
morals or welfare.
15. The Committee additionally findslconcludes:
a. The County Engineer has recommended liraiting the development to 36 wmts unal a
second access is obtained for the site.
b, The permissible density for the site is appraxunately 51 unYts at 22 wruts per acre.
c The proposed site plan shows adequate setbacks to protect other surnoundzng
residenaal uses.
d. The Planning Department recommended approval of the proposed change of
conditions with restricti.ng the development of the inina136 umts to the north side
of Nora Avenue extended which will reduce the uuaal impacts to the other
surround.ing residential uses.
CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1. All Conditions imposed by the Hearing Examiner Committee shall be buichng on the
"Applicant," which term shall mclude the owner or owners of the property, heirs,
assigns, and successors-in-interest
2. The following Conditions of Approval apply to the real property descnbed below:

SPOKANE COUNTY PLANNIlYG DEPARTMENT
1 Approval is required by the Planning Dffector/designee of a specific lighting and
signing plan for the described property pnor to the release of any building pernuts.
2. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planrung Director/designoe shall be subnutted with a performance
hond for the project pnor to release of builduig permits. Landscaping shall be
insca►lled and maultamed so that sight distance at access points is not obscured or
impaired.
3. The applicant shall develop subject property generdlly in accondance within the
concept presented ro the Hearmg Body. Vanations, when approved by the
Planning Director/designee, may be perrutted, including, but not limited to building
location, landscape plans and general allowable uses of the penmtted zone. All

4. Coaditioned for 36 units only. A secondary access shall requue review and

shall be located on the north side of Nora Avenue extended.
5. A specific development plan shall be submitted for Planning Deparnnent review and
approval prior to issuance of building permits. Construction must be judged as
proceedmg acEOrd.ing to the plan or constitute a zoning violation.
6. All standards of the Urban Residential-22 (UR-22) zone as ameaded, shall be
complied with in the development of ttus site.
7 Landscaping and buffenrig for this site shall conform to the staodards of the Urban
Residential-22 (UR-22) zone (Secuon 14.622) and landscapuig (Section 14.806) of
the Spokane County Zoning code
8. The Plannuig Deparcment shall prepare and record with the Spokane County
Auditor a Tide Notice noang that the property in question is subject to a vanety of
special conditions imposed as a result of approval of a land use action. This Tide
Nodce shall serve as public noace of the condirions of approval affecting the
property in question. 1'he Tide Nodce should be recarded withia the same rime
frame as allowed for an appeal and shall only be relmsed, in full or m part, by the
Planning Deparmaent. The Tide Notice shall generally provide as follows:
The parcel of property legally described as [ ] is the
subject of a land use action by a Spokane County Hearing Body or
Administrative Official on April 18, 1991, imposing a variety of
special development conditions. File No. ZE-116-84A is available
for inspection and copying in the Spokane County Pianning
Department.
9 The project is sub1ect to Section 14.706, the Aqtnfer Sensitive Area 4verlay Zone
of the Zoniag Code for Spokane County, which ssts forth vanous measmes for
aquifer protection; specifically, measures deahng with wastewater disposal, spill
protection measures and stormwater runoff.
SPOKANE COUNTY ENGINEER'S OFFICE

5. Appropnate provision shall be made that the follownng-descnbed property be held
in tivst until the continuation of the streets be ded.icated or deeded: a one (1)-foot
stnp at the ends or edges of all smeets that tenninate or bonier the subdivision
boundary. (Temporary cul-de-sacs are requmed when streets terminate at the
subdsvision boundaries.)
6. The applicant shall submit for approval by the Spokane County Enguieer and the
Spokane County Health Distnct a detailed cornbined oa-site sewage system plan
and surface water disposal plan for the enare project, or portion thereof, if the
development is to be phasetl.
7 A parknng plan and traffic circulanon pian shall be submitted and approv+ed by the
Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in acconiance with standard traffic engine.enng pra,ctices. Paving or
surfacing as approved by the County Engineer, will be reqwred for any poraon of
the project wluch is to be occupied or traveled by vehicles.
8. The construction of the road improvements stated hermn shall be accomplished as
approved by the Spokane County Engineer.
9. The Connty Engineer has designated Typical Roadway Section Number Two,
Local Access standard for the unprovement of Nora Avenue, which is to be
constructed within the proposed development Ms wlll reqwre the wstallarion of
36 feet of asphalL The construcnan of curbing and sidewalk is also required.
10. All required improvements shall confonri to the cuirent State of Washington
Standard Specifications for Road and Bridge Construcaon and other applicable
County standards and/or adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless othervvise
approved by the County Engineer.
11. Roadway standards, typical roadway sections and drainage plan requirements ar+e
found in Spokane Board of County Commissioners Resolunon No. 80-1592 as
amended and are appLcable to thls praposal.
12. This subdivision or development proposal is located within a drainage basin which
has been identified by the Spokane County EngLneer's office as having stonnwater
runoff problems. Since this plat ar development proposal is affected by or is a
contributor to stormwater flows, properry owners should parncipate in the planning
and implementation of a future basmwide stormwatier management system.
The owner(s) or successor(s) in interest agree to jain in any County-approved

stormwarer management program aad to pay such rates and charges as may be fixed

vnthin the public road right-of-way is subject to inspecuon and approva] by the
County Engineer.
14. A11 required construction within the exi.sang or pmposed pubhc nght-of-way is to
be completed prior to the release of a building peTmit, or a bond in an arnount
esamated by the County Engineer to cover the cost of construction of mprovements
shall be filed with the Couaty Bngmeer.
15. Applicant shall sign and record Spokane County Notice to the Public No. 6 which
specffies the followuig:
The owner(s) or successor(s) in interest agree to authonze the County to place theu
name(s) on a peaaon for the formaaon of a Road Impravement Dlstrict (RID) by
the petinon method pursuant to Chapter 36.88 RCW, wluch petiaon includes the
owner(s) property, and further not to object, by the signing of a ballot, the
fornianon of a RID by the resoloaon method pursuant to Chapter 36.88 RCW,
which resolunon includes the owner(s) property. If an R.ID is formed by either the
petinon or resolution method, as provided for in Chapter 36.88 RCW, the owner(s)
or successor(s) further agree:
(a) that the ungrovement or construction contemplated withui the proposed RID is
feasible;
(b) that the benefits to be derived from the fomnation of the RID by the property
included ther+ein, together with the amount of any County parnmpanon,
exceeds the cost and expense of formation of the RID; aad
(c) that the property vvithna the proposed RID is sufficiendy develaped.
Provided fiuther that the owner(s) or successor(s) shall retain the right, as
authonzed under RCW 36.88.090, to object to aay assessment on the property as a
result of the imprvvements called far in conjuncaon with the fonnation of the RID
by either pedtion or resolution method under Chapter 36.88 RCW.

purveyor and the Spokane County Engineer to detenune whether applicant(s) or
the utLhry is responsible for adjusmaent or relacation costs and to make
arrangements for any necessary work.

17. If the applicant is unable to obtaia a second means of access, no more than 36 units
would be perirntted to nse the existing raadway system, Nora Avenue to Wilbur
Road. Subsequent building pernuts would be approved for conslrucdon after a
secondary access extending Nora Avenue w tTnion Road and Mission Avenue is
constructed to County Standards.
18. The applicant shall be responsible for the full 50 fG nght of way dedication from the
existing teimination of Nora Avenue, west of and adjacent to the proposed
development through the applican.ts property.
SPOKANE COUNTY UTILTTIES DEPARTMENT
1. Purswant to the Board of County Commissioners Resolution No. 80-0418, the use
of on-site sewer disposal systems ls hereby audionzed, This authorization is
conditioned on compliance with all rules annd regulations of the Spokane County
Health District and is further condiuoned and subject to specific application
approval and issua.nce of pemcuts by the Health Ihstricc
2. The owner(s) or successor(s) in interest agree to authonze the County to place theu
name(s) on a peticion for the formaaon of ULID by peauon method pursuant to
RCW 36.94, which peation uicludes the owner(s)' pmperty; and further not to

SPOKArIE COUNTY HEALTH DISTRICT CONDITIONS
1 A combined surface water and sewage disposal detmled plan shall be approved by
the Spokane County Engineer and the Spokane County Health Distnct pnar to the
issuance of any on-site sewage disposal perinit or building pearnt for this project.
2 Sewage disposal method shall be as authorized by the Director of Udlities, Spokane
County.
3. Subject to specific application approval and rssuance af permits by the health
officer, the use of (an) uidividual on-site sewage disposal system(s) may be
autharized. Per plans, site restnctions may lunit size of on-site sewage system;
ttris, unpactmg the number of apartments allowed. If the daily flow rate for the
system exceeds 3,500 gallons, but under 14,500 gaUons per day, s~pecific
application approval and issuance of pwrnits must be conducted by the Departrnent

of Health. If the flow rate exceeds 14,500 gallons per day, the Department of
Ecology must be contacted.
4. Water service shall be coordinated through the I?irector of Utilities, Spokane
County.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Disposal of sewage effluent beneath paved suifaces is cunently prohibited.
7. Use of private wells and water systems.
SPOKANE COUNTY BUILDING AND SAFETY DEPARTMENT
1. The applicant shall contact the Depamment of Building and Safety at the earhest
possible stage of design/development m order to be infonned of code reqwrements
admuustered/enforced by the department, e g., State Btulding Code Act
regulations, such as reqwrements for fine hydrantlflow, fire apparatus access roads,
street address assignment, barrier-free regulations, energy code regulations aad
general coordination with other aspects of project unplementation.
WATER PURVEYOR (MODERN ELECTRIC WATER COMPANY)
1. Modmn Electric Water Company will supply the site with adeqaate water for
domestic, fire and in-igation uses; however specffic arrangements have not been
made tio serve this developmenL
2. That the water purveyor will require an appmoved engineered map with adequate fire
flows and domestic flows.
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. Air pollution regulations require that dust emissions during demolition, construction
aad excavation projects be controlled. This may require use of wataer sprays, tarps,
spmnklers or suspension of activity during certain weather conditions. Haul roads
should be treated, and eaussions fram the tra.nsfer of earthen matenal must be
controlled, as well as emissions from all other construction-related activiaes.
2. All traveled surfaces (i.ngress, egress, parking areas, access roads) must be paved
and kept clean
3. Measures must be taken tio avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracldng or spills occur on paved surfaces,
measures must be taken imnediately to clean these surfaces.
4. Debns generated as a result of this project must be disposed of by means other than
burning.

Spokane County has no responsibility to build, improve, maintain, or

private road, Spokane County assumes no obligation for said private
road and the owners hereby acknowledge that the County has no obligation
of any kind or nature whatsoever to establrsh, examine, survey, constriict
alter, repair, improve, maintain, provide drainage or snow removal on a

be binding upon the owner, their heirs, successors or assigns including
the obligation to participate in the maintenance of the private road as

95, The proposed plat shall be improved to the standards set forth in Spokane
County Board of County Commissioners Resolution #80-1592, as amencled,
which establishes regulations for raads, approaches, drainage, and fee-q

That a cul-de-sac turn-around acceptable to the local fire district shall
be constructed. If existing turn-around on Nora Avenue in WiIbur
Addition is acceptable to the Fire Oistrict, a letter to that effect shotild

That the praposed "Tract X" easement shall be 50 ft. in width firom lhe
easteriy plat boundary of Wilbur Addition to the easterly plat boundary

UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418,
the use of on-site sewer disposal systems is hereby authorized. This
authorization is conditioned on compliance with all rules and regulations
of the Spokane County Health District and is further condit+oned and
subject to specific application approvai and issuance of permits by the
Health District.
r2. The Owner, his heirs or successors shall join and participate in any
petition or resolutian which purpose is the formation of a utility local
improvement district (ULID) pursuant to RCW Chapter 36.94, as amended.
The owner, his heirs and successors shall further agree not to oppose
or protest ony legal assessments for any utility local improvement diskrict
( U L I D) establ ished pursuant to R CW Chapter 36. 94, as amended.
Any water service for this project shall be provided in accordance with
the Coordinated Water System Plan for Spokane County.
~.4. Each dwelling unit shall be double plumbed for connection to future
area-wide collection systems.
HEALTH DISTRICT CONDITIONS
41. The final plat shall be designed as indicated on the preliminary plat of
record and/or attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the prelimi-
nary plat of record for distribution by the Planning Department to ttle
utility companies, County Engineei•, and Spokane County Health District.
Written approval of the easements by the utility companies must be
received prior to the submittal of the final plat.
Sewage disposal method shall be as authorized by the Director of Utilitips,
Spokane County.
94. Water service shall be coordinated through the Director of Utilities,
Spokane County
S. Water service shall be by an existing public water supply when approved
by the Regronal Engineer (Spokane), State Department of Social & Healili
Services.
06. The plat dedication will contain a statement to the effect that• "The
pubiic water system as approved by County and State healfih authorities
and the Iocal f,re district and purveyor will be installed within this plat,
and the subdivider will provide for individuaf domesfiic water service as
well as fire protection to each lot prior to sale of each lot."

BUILDING SAFETY CONDITIONS
ti1. A plan for emergency equipment access is requjred to be submitted prior
to any land development.
~ 24 Recommend approval with condition that prior to developtnent of this
property than an engineered water distribution system plan shall be
submitted to the Spokane County Department of Building and Safety.
This distribution ptan shall include water main siie, flows, locatians, fit e
hydrant type and locations, water storage tanks size, and location and
design criteria.
FIRE DISTRICT #1
Adequate water for fire protection and distribution of such water is
required. A plan showing water distribution and emergency vehicle
access is required for submittal for approval by Fire District #1 prior to
finalization of this short plat.
