This property, because of special circumstances applicable to it, is deprived of privileges commonly enjoyed by other properties in the vicinity and in a similar zone classification. This adjustment remedies the difference in privileges. A variance shall not authorize a use otherwise prohibited in the zone classification in which the property is located. The following questions will help to determine the outcome of your request. Your request requires accurate and complete responses. First circle either the "yes" or the "no" answer(s) following the questions below as they apply to your situation and then explain as needed (in the space provided) to make your unique situation clear. Certain phrases from the Spokane County Zoning Code section on variances are included in these questions. They are underlined. If your request is a ROAD FRONTAGE VARIANCE please answer only questions A,B,C,D, and E. A. Will this variance permit a use which is otherwise prohibited in this zone? Yes Vo Explain: B. Are there special circumstances (lot size, shape, topography, location, access, surroundings, etc.) which apply to the subject property and which may not not apply to other properties in the vicinity? Yes (No1 Explain : C. Is the subject property deprived of privileges commonly enjoyed by other properties in the vicinity and in a similar zone classification? Ares) No Explain : All other houses(except one) have two car garages on 26th from Whipple to the point where it joins 25th. D. Will this variance be harmful to the public welfare or to other properties in the vicinity and a similar zone classification? Yes Nod Explain: E. Are there other similar si 'ons in the vicinity in a similar zone classification?4, No Are they permitted uses May No Are they "nonconforming" uses? Yes 'o Explain: 0/44- ,jp"),e.y 1•n !/i ci7 i- aos7s/-ee • F. Could the subject property be put to a reasonable and permitted use by you or another person without the requested variance? Yes No Explain: Most home owners have a minimum of two vehicles plus lawn ana yard. equipment. This property also has an above ground pool and desperately needs stora ;e. G. If this request is granted, will the subject property be more environmentally sensitive, energy conserving, or will it promote the use of an historic property? Yes No Explain: perhaps energy conserving because of the shade provided to the living space in the summer. Over please Rev: 5/22/90 Page 1 H. If this variance is granted, will the broader public need or interest be served? Yes No Explain: It will increase the value of the property and therefore help the neighborhood. Most single garage houses become rental property because home owners need and desire two,lo,r more garaes. I. Will this variance be inconsistent with the purpose of the zoning which applies to the subject property? Yes No Explain: J. Will approval of this variance grant to the subject property the privileges of a different zone classification (in other words would this be a "de facto" zone change)? Yes No Explain: K. Will this variance be inconsistent with the general purpose and intent of the Comprehensive Plan? Yes No Explain L. Is this variance required for a reasonable economic return from the subject property or is the existing structure too small? 'Yes. No Explain:This variance is necessary for economic return because a single car garage is not desirable or acceptable on a 130Jsq. ft. M Did the practical difficulty which caused you to apply for this variance exist before you owned the subject property? Yes No Explain: I was a first time buyer and had not anticipated how much "equipment" it takes and storage for that equipment , plus a freezer, patio and pool equipment, and lawn and garden supplies. N. If approved, would this variance affect land use density regulations which exist to protect the Rathdrum/Spokane Aquifer? Yes No Explain: The following space is for further explanation. Your application will get better consideration if what, how, and why you propose your application is clear. Attach an additional page(s)if needed. This property needs to have a two vehicle garage to -be compatible with otner single family dwellings in the neighborhood. It runs the risk of becoming a rental property with the small garage and narrow driveway. It would upgrade the property and have more curb appeal . as well. Tne backyard aboveground pool requires equipment that takes up storage space at least 8 months a year. The yard and garden equipment, snowblower, freezer etc. cause extreme overcrowding. Eventually I would like to bring the utilites upstairs into the existing garage for added convenience and resale value. This is a very well built house ( built in 1060 ) with hardwood (oak) floors and wooden Pella windows. I hope to put vinyl siding on the new garage and eventually the entire house. You are invited to present additional photographs, diagrams, maps, charts, etc. in support of this application (we have the equipment to display video tapes). No such additional material is required and in any case it must be BRIEF and descriptive of issues which need to be considered in relation to this requested variance. If you have questions about the procedure to be followed feel free to contact the Spokane County Planning Department (456-2205). Page 2 Continued on attached page. OPPONENTS OF RECORD: NONE PUBLIC HEARING AND DECISION: After consideration of all available information on file, exhibits submitted and testimony received during the course of the public hearing held on August 27, 1990,and the Zoning Adjustor rendered a written decision on September c20" , 1990 to APPROVE the application. FINDINGS OF FACT AND CONCLUSIONS 1. The proposal is generally described above. 2. The adopted Spokane County Comprehensive Plan designates the area of the proposal as Urban. The proposed uses are generally consistent with this category. 3. The site is zoned Agricultural Suburban, which allows the proposed use upon approval of this application. 4. The existing land uses in the area of the proposal include similar residential development, all of which are compatible with the proposal. Most houses in the area have double car garages; whereas, the applicant's house has only a single car garage. 5. The applicant's house was small, constructed originally (within three years of the subdivision's finalization)to the 40 foot front yard, 12 foot side yard and 20 foot flanking street yard requirements of the final plat dedication. These setbacks substantially exceed the CASE NO.VE-56-90 SPOKANE COUNTY ZONING ADJUSTOR PAGE 2 Zoning Ordinance requirements, both in 1956 and now. The 1956 file contains no hint as to why these setbacks were specified. With a drainfield at the rear of the dwelling and a previously constructed dwelling addition on the east side of the corner lot,no room exists for expansion. In order to have interior space comparable to other dwellings, front/side yard expansion is the only space left to consider. 6. Although only one variance is of record in the subdivision, numerous garages and portions of dwelling units are in the front yards of 26th Avenue. Most houses of the last 15-20 years also violate the dedication setbacks described in#5 above. 7. Granting these variances from provisions of the Zoning Ordinance does not grant relief from the setbacks set forth in the dedication of the plat. But,obviously few if any parties have been concerned about plat dedication language. 8. The proposal is exempt from the provisions of the Washington State Environmental Policy Act, Chapter 43.21C RCW pursuant to WAC 197-11-800(6) (b). 9. The applicant has been made aware of the recommendations of various County agencies reviewing this project and has indicated those recommendations are acceptable. 10. The proper legal requirements for advertising of the hearing before the Zoning Adjustor of Spokane County have been met. 11. No adverse testimony or written comments were received regarding the proposal. 12. With the conditions of approval set forth below, the variance will: a) not constitute a grant of special privileges inconsistent with limitations on other properties in the vicinity and similar zone;b)ensure that the intent and purpose of the Zoning Ordinance is achieved with regard to location, site design, appearance, and landscaping, etc; and c)protect the environment, public interest and general welfare.
