HEARING EXAMINER COMMITTEE
F I ND(I NGS AND ORDER
A. INTRODUCTION
This matter having came before the Zoning Hearing Examiner Commlttee on
Noveinber 16, 1963, and' the members of the Commi ttee present bei ng
Richard L. Skalstad, Chairman, Jane E. ~*ers and Jerry Williams.
B. PROPOSAL
The sponsors, K. G. and J. L. Redlin, are requesting approval of a zone
reclassificatlon, File No. iE-80-83,. Local Business to Comnercial, for the
purpose of devel opi ng a Retai'0 Store 1 n,the future.
C. FIIdDINGS OF FACT
1. That the ezi sti ng 1 and use i n the areat i s resl dent,i al , churches,
conmercial, tree farm, and vacant.
2. Thatthe Camprehensive Plan designates this area as appropritte for
' Major Coaenercial development.
3. That the exi sti ng zoni ng of the property desc ri bed i nthe app11 cati on
is Local 8usiness.
0 4. That the provlsions of RCa 43.21C (The State Envirornnental Policy
Act) have been camplied with, and the Caemittee concurs M1th the
Oecl°aration of Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda
Item have been ful f i l l ed,.
6. That the land in this area is suitable for the proposed use, or uses
within the proposed Zone Classiflcation.
7. That the applicant has demonstrated that conditions have
substantially changed slnce the original zoning of this area and
accordingly, the proposed rezone is Justified.
8. That the, proposea use,i s compatl b1 e wi th exi st1 ng uses i n the area.

C. FINDINGS OF FACT (contlnued)
9. That the owners of adjacent lands expressed both approval and
disapproval of the proposed use.
10. The Hearing Examiner Conmittee finds the proposed use to be in
harmorLy with the general purpose and will not be otherwise
detrimental to the public health, safety, and welfare.
11. The following are addltional findings of fact considered by the
Hearing Examiner Conmittee:
a) That the necessary right of way for Su11 ivan Road was dedicated
as a result of the past zone change in 1981 (See File #ZE-1-81).
Q. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
a) COUNTY PLANNING DEPARTMENT
1. The Zoning Administrator shall approve a specific exterior
lighting plan for the approved area prior to installation of
such lighting. (Such plan sha11 attempt to confine illumination
to the area with fu11 consideration to adjacent properties).
2. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokene County Zoning
Administrator shall be submitted with a performance bond for the
project prior to release of building permits.
3. The applicant shall develop subject property generally 1n
accordance within the concept presented to the Hearing Examiner
Conani ttee. Yari ati ons when approved by the Zoni ng Admi ni strator
w111 be permitted, including, but not limited to the following
changes: Building location, landscape plans, and general
allowable uses of the permitted zone. all variations must
conform to regulations set forth in the Spokane County Zoning
Ordinance. The original intent of the development plans she11
be maintained.
4. The specific developnrent plan will be submltted for Planning
Department review and approval prior to issuance of building
permi ts.
5. A11 current standards of the Conmercl al Zone, as amended, sha11
be complied with in the development of this site.

a) COUNTY PLaNNING DEPARTMENT (continued)
6. Applicant shall comply with '208' recomnendations concerning
stormwater runoff and provide necessary landscaping for runoff.
7. The applicant shall comply with RCW 58-17 and the Spokane
County Platting Ordinances prior to issuance of building permits.
8. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the 6oard of Spokane County
Conmissioners Resolution #77-1392 be initiated by the project
applicant within thirty (30) days of f1na1 disposition of this
application, and prior to aNr on-site improvements, or file
appropriate documents to the effect that the NOTICE OF ACTIOH is
walved in accordance with Spokane County Cortmissioners'
Resolution #82-0458 dated May 4, 1982.
9. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA
Guidelines (WAC 197-10) and the Spokane County Enviromnental
Ordinance (SCEO), a proposed declaration of non-significance has
been issued at least fifteen (15) days prlor to this date; the
official file, written comments and/or public testimony contain
lnformation regarding assessment of the proposal's adverse
impacts to the piysical environment; a finding is hereby made
that no potentially significant adverse impacts upon the
ptUrsi cal envi ron ment are antic i pated as a resul t of the
pro3ect; and a f1na1 declaration of non-significance is hereby
to be issued.
b) COUNTY ENGINEERING OEPARTMENT
Prior To The Issuance Of A Bu9lding Permit:
1. Access permits for approaches to the County Road System shall be
obtained from the Spokane County Engineer.
2. Applicant shall submit for approval by the Spokane County
Engineer road, drainage, and access plans prior to the issuance
of a building permit on the property.
3. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Nealth Oistrict a detalled
canbined on-site sexage system plan and surface water disposal
pl an for the enti re project pri or to the i ssuance of artiy
building permit on the property.

4. A pariting plen and traffic ci rculation pl an shall be submi tted
and approved by the Spakane County Engi neer pri ar to the

lacatlon, and arrangement of paricing stalls shaYl be #n
actordance with standard traffic engineering practices. Ravfng
ar surfac i ng as approved by the County Engineer, wi 11 be
required for ary portion af th+e project which fs to be occupied
or traveled by vehicles.
5. The word "applicant" shal1 inc1 ude the +awtter or awtters of the
property, his heirs, assigns, and successors.
6. The cflnstructlon of the road improvements stated herein shal ) be
atcompi ished as approved by the Spokane Countjr Engf neer.
7. A11 requi red improvements shal1 eonfom to the current State af
Washingtan Standard Specificatians for Road and 8ridge
Gonstructian, and other appl icable Caunty standards and/or
adop#ed resal uti ons pertai ni ng to Raad Standards and St+armrrater
Martagement in effect at the date of c+onstruction, un]ess
oth+erwi se approved by the County Eng1 neer.
8. Roadway standards, typf cal raadway sectf ons and drai rtage plan
requi r+ements are faund i tt Spokane Baard of Caunty
Commissi oners' Resol ution No, 80-1592 as amended.
c) GOUNTY UTILITIES DEPARTMENT
1. Pursuant ta Board af County Cammissioners Resolution No.
80-0418, the use af on-site sewer disposal systems is hereby
au#.horized. This authorization is conditianed on compl iance
with al l rul es and regulati ons of the Spakane County Heal th
Distrfct and is further conditioned and subject to specific
appl icat1 on appraval and f s$uanee af permi ts by the Heal th
District.

2. The owner(s) or Successor(s) in interest agree to aut.horize the
County to place their name(s) on a petition for the formation of
a ULID by petition method pursuant to RCW 36.94 afiich the
petitlon includes the Owner(s) property and further not to
obJect by the signing of a protest petition against the
formation of a ULID by resolution method pursuant to RCW Chapter
36.94 which includes the Owner(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from
obJection to arLy assessment(s) on the property as a resul t of
improvements called for in conjunction with the formation of a
ULID by either petltion or resolution method under RCW Chapter
36.94.
3. Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County, as amended.
4. Each new unit shall be double-plumbed for connection to future
areawide collection systems.
d) COUNTY HEALTH DISTRICT
1. Appropriate utility easements shall be indicated.
2. A combined surface water and sewage disposal detailed plan shall
be approved by the County Engineer and the Health Distrfct prior
to the issuance of any building permit for this project.
3. Sewage disposal method shall be as authorized by the Director of
Ut11it1es, Spokane County.
4. Sub3ect to specific app1ication approval and issuance of permits
bythe Health Officer, the use of an individual on-site sewage
system may be authorized.
5. Water service shall be coordinated through the Director of
Utillties, Spokane County.
6. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Health Services.
7. Disposal of sewage effluent beneath paved surfaces is currently
prohibited.

e) COUNTY BUILDING AND SAFETY DEPARTMENT
1. The site is located in Fire District # 1.
2. Installation of fire hydrants w111 be installed 1n accordance
with the requirements of the Spokane County Qepartment of
Bu11d1ng and Safety.
f) WATER PURVEYOR
1. Water Purveyor is Vera Irrigation District No. 15, and they wi11
supply the si te with adequate water for domestic, fi re end
irrigation uses.
g) '208' STUDY
1. Applicant shall comply with '208' reconmendations concerning
stormwater runoff and provide necessary landscaping for runoff.
h) COUNTY AIR POLLUTION CONTROL AUTHORITY
1. Air pollution regulations require that dust created as a result
of excavation and construction activities be controlled.
Measures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracking or
spiils occur on paved surfaces during transport of earthen
material, measures must be taken immediately to clean these
surfaces.
2. All traveled surfaces must be paved and kept clean.
E. ORDER
The Heari ng Exami ner Comn1 ttee, pursuant to the aforementi oned, f i nds that
the appllcation of K. G. and J. L. Red11n, for a zone reclassificatlon as
described in the application should be APPROVED.
