SP-735-91 ) DECISION
TIYIS MATTER, an application for alteration of a final short plat has been received fi-om
Gary McDonalci and decided upon, pursuant to Spokane County Subdivision regulations, on
the 15"' day of May, 1997.
TINDINGS OF FACT AND CONCLUSYONS
l. The individual signing below has fiirther been properly delegated the responsibility
i, for rendering ihe decision by the Spokane County Director of Building and Planning.
2. 7'his proposecl alteration to the original final short plat of SP-735-91 is to create an
additional residential tract by dividing Tract "B" of the original final short plat into 2
tracts (Tract "C" and "D").
3. Tl1e existing zoning of the property is Urban Residential-3.5 (UR-3.5). The proposed
alteratiotl contorm to the requirements of the existing UR-3.5 zone.
4. The Spolcane County Comprehensive Plan designates this area as Urban. The
proposed alteration is in compliance with this category.
5. The required public notice was provided for this proposal and agencies having a
potential interest in the project were notified and recommendations solicited.
6. Written comments were received from adjoiiling property owners who are concerned
about an additional lot on the property. In addition, they are concerned about sewage
disposal, the size of the proposed lots and a significanfi downgrade to the character
and vallie of the area.
7. In response to ihe above comments, the smallest lot area the applicant has proposed is
approximately 11,432 sq. ft., which exceeds the minimum 10,000 sq. ft. lot area for
single family residence in the existing UR-3.5 zone. Moreover, any additional
residential units will be required to connect to the public sewer system.
8. Additional conditions have been recommended by the various reviewing agencies and
departments, including the Spolcane County Division of Building and Planning, the
Spolcane County Division of Engineering and Roads and the Spol:ane County
Division of Utilities.
9. This proposal is exempt from environmental review under the State Environmentll
Policy Act pursuant to WAC 197-11-800 (6) (a).
10. A11 previous Findings of Fact and Conclusions specified in the Spolcliie County
1'lanning Department's Findings of Fact, Conclusion and Decision dated March 3,
1992 still apply.
llECISION
I3ased upon the above noted Findings of Fact and Conclusions, this alteration to the final ~
Sliort Plat of SP-735-91 is hereby AI'PROVED. All conditions imposed shall be binding on
the "Applicant," which term sllall include the owner or owners of the pi•operty, heirs, assigns ,
1nd successors.
CONDITIONS OI+ APPROVAL
Those previous Conditions of Approval specified in the Spokane County PlaIllllllg
Departrnent's Findings of Fact, Conclusion and Decision dated March 3, 1992, together with
the following updated conditions.

SPOKANE COUNTY DIVISION OF BUILDING ANn PLANNING (Ul'DATED) l. Prior to recording tlle altered final short plat, the applicant shall submit to the County
Division of Building and Planning Director/designee for review any proposed altered
final short plats to ensure compliance with these Findings and Conditions of
Approval.
2. The altei-ed final short plat shall show all of the land on the original final slloi-t plat
and shall bear the acknowledged signatures of all parties having an ownership interest
in the affected tracts within the original final short plat.
3. Appropriate road name(s) and street address for each tract shall be indicated on the
altered final short plat map.
4. A survey is required of all new tracts prior to recording the altered final short plat.
5. Prior to recording the altered final short plat, the applicant shall provide four (4)
current Certificates of Title to the Division of Building and Planning.
6. The altered final short plat dedication shall contain a statement which includes by
reference the dedicatory language of the original final short plat, as recorded in Short
Plat Boolc 9 Page 3& 4, under Spokane County Auditor's recording no. 9211190538.
7. The applicant shall contact the County Division of Building 1nd I'lanning at the
earliest possible stage in order to be informed of code requirements
administered/enforced as authorized by the State Building Code Act.
Desigii/development concerns include: acidressing, fire apparatus access roads, fire
hydrant/flow, approved water systems, building accessibility, construction type,
occupancy classiFcation, exiting, exterior wall protection, and energy code
regulations.
Sl'OICANE COUNTY DIVISION OF ENGINEERING AND ROADS (UPDATED)
l. That conditional approval of the short plat by the County Engineer is given subject to
lpproval of tlie road system as indicated in the preliminary plat of record.
2. No construction worlc is to be performed within tlle existing or proposed public right-
of-way until plans have been accepted by the County Engineer and a permit lias been
issued by the County Engineer. All work is subject to inspection and approval by tlle
County Engineer.
3. Approach Permits are required for any access to the Spolcane County road system. ,
4. The applicant shall grant applicable border easements adjacent to Spolcane County
right-of-way per Spol{ane County Standards.
5. To co»strucfi the road improvements stafied herein, the applicant may, with the
approval of the County Engineer, join in and be a willing participant in any petiiion or
resolution which purposes is the formation of a Road Improvement District (RID) for
said improvements pursuant to RCW 36.88, as amended. At such time as a RID is
created or any Road Improvement Project is sailctioned by Spolcane County, the
improvements required (curb, sidewalk, drainage control and paving fio existing
pavement) will be at the sole expense of the undersigned owner, their heirs, grantees
and assigns. This provision is applicable to 14''' Avenue.
6. As an alternative 111et110d of constructing the road improvement stated herein, tlle
applicant may, witll the approval of tlle County Engineer, accomplish the t-oad
improvemenis stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required road improvement. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, tlle
improvements required (curb, sidewallc, drainage control and paving to existing
pavement) will be at the sole expense of tlle undersigned owner, their heirs, grantees
and assigns. This provisioii is applicable to 14''' Avenue.
7. The following statement shall be placed in the plat dedication:
"In consideration of Mutual Benefits now or to be hereafter derived, do for
fihemselves, tlieir heirs, granfiees, assigns and successor-(s) in intec-est hereby

request and authorize Spolcane Cotuity to include the above described property
in a Roaci Improvement District (RID) and to support the formation of a RID
for improvement of the road(s) described below by requesting and authorizing
Spokane County to place their name(s) on a petition for the formation of a
RID pursuant to RCW 36.88.050, or by requesting and authorizing Spokane
Counly to cast their ballot in favor of a RID being furmed under the resolution
method pursuant to RCW 36.88.030, and/or by not filing a protest against the
formation of a RID being formed under the alternative resolution method
provided for in RCW 36.88.065 and Chapter 35.43 RCW.
"If a RID is pi•oposed for improvement of the road(s) described below, said
owner(s) and successor(s) fiirther a6ree: (1) that the improvemeiits or
construction conteinplated within the proposed RYD are feasible and (2) that
the beneFits to be derived from the formation of the R1ll by the property
included therein, together with the amount of any County participation,
exceeds fihe cost and expense of formation of the RID, and (3) that the
property within the proposed RID is sufficiently developed; provided,
themselves, their heirs, graniees, assigns and successor(s) sliall retain the right,
as authorized under RCW 36.88.0903- to object to any assessment(s) on the
'I property as a result of the improvements called for in conjunction with the
forniation of a RID by either the petition or resolution method under Chapter
36.88 RCW anci to appeal to the Sunerior Court the decision of the Board of
County Cominissioners confirming the final assessment roll; provided filrther,
it is recognized that actual assessments may vlry from assessment estimate so
long as they do not exceed a figure equal to the increased true and fair value
improvement(s) add(s) to the property.
'"It is fiirther aclcnowledged and agreed that at such time as a RID is created or
any County Road Improvement project is authorized by Spolcane County, the I
improvements required shall be at the sole expense of the owner(s) of property '
within the RID or served by the improvements withoufi any monetary
participation by Spolcane County.
"The RID waiver contained in this agreement shall expire after ten (10) years
fl'OIll the date of execution below. This provision is applicable to 14"'
Avenue."
8. The County Engineer has designated aLocal Access Roadway Section for the
improvement of 14"' Avenue which is adjacent to the proposed development. Ti11S
will require the addition of approximately 30 feet of asphalt along the frontage of the
development. Tlie construction of curbing and sidewalk is also required.
9. The proposed plat shall be improved to the standards set forth in Spolcane County
Baard of Commissioners Resolution No. 95-0498, as amended, which establishes
regulations for roads, approaches, drainage and fees in new construction.
10. The CoLmty Engineer has examined this development proposal and,has determined
that the impact of this proposal upon the existing County Road System warrants the
roadway improvements lierein specified.
SPOI{ANE RrCIONAL HEALTH DISTRICT
l. All previous imposed conditions of the Spolcane County Planning Department's
Findings of Fact, Conclusions and Decision dated March 3, 1992, shall confiinue to
apply.
SPOKANE COUNTY DIVISION OF UTILITIES (UPDATrD)
l. A wet (live) sewer connection to the existing area wide public sewer system is to be
constructed. Sewer connection pernlit is required.
2. The applicantlowner shall submit expressly to the Division of Utilities "under
separate cover," only those plan sheets showing sewer plans and specifications for:
public sewer connections and facilities for review.
3. Arrangements for payments of applicable sewer charges mLtst be made for prior to

4. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.

The Spokane County Engineering Department has reviewed the above referenced application. The following
"Conditions of Approval" are submitted to the Spokane County Planni.ng Department for inclusion in the
"Findings of Fact, Conclusions and Order/Decision" should the request be approved.
1. That conditional approval of the plat by the County Engineer is given
subject to approval of the road system as indicated in the preliminary
plat of record.
2. No construction work is to be performed within the existing or proposed
Public right-of-way until plans have been accepted by the County
Engineer and a permit has been issued by the County Engineer. All work
is subject to inspection and approval by the County Engineer.
3. Approach Permits are required for any access to the Spokane County road
system.
4. The applicant shall grant applicable border easements adjacent to
Spokane County Right of Way per Spokane County Standards.
5. To construct the road improvements stated herein, the applicant may,
with the approval of the County Engineer, join in and be a willing
participant in any petition or resolution which purposes is the

accomplish the road improvements stated herein by joining and
participating in a County Road Project (CRP) to the extent of the
required road improvement. At such time as an RID is created or any
Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned
owner, their heirs, grantees and assigns. This provision is applicable
to 14`h Avenue.
7. That the following statement shall appear within the dedicatory
language of the final plat:
That in consideration of Mutual Benefits now or to be hereafter
derived, do for themselves, their heirs, grantees, assigns and
successor(s) in interest hereby request and authorize Spokane County to
include the above described property in a Road Improvement District
(RID) and to support the formation of a Road Improvement District for
improvement of the road(s) described below by requesting and
authorizing Spokane County to place their name(s) on a petition for the
formation of a Road Improvement District pursuant to RCW 36.88.050, or
by requesting and authorizing Spokane County to cast their ballot in
favor of a RID being formed under the resolution method pursuant to RCW

said owner ( s) and successor (s) further agree :(1) that the improvements
or construction contemplated within the proposed RID are feasible and
(2) that the benefits to be derived from the formation of the RID by
the property included therein, together with the amount of any County
participation, exceeds the cost and expense of formation of the RID,
and (3) that the property within the proposed RID is sufficiently
developed; provided, themselves, their heirs, grantees, assigns and
successor(s) shall retain the right, as authorized under RCW 36.88.090,
to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the formation of a RID by
either the petition or resolution method under Chapter 36.88 RCW and to

it is recognized that actual assessments may vary from assessment

County, the improvements required shall be at the sole expense of the

years from the date of execution below. This provision is applicable
to 14th Avenue.
8. The County Engineer has designated a Local Access Roadway Section for
the improvement of 14th Avenue which is adjacent to the proposed
development. This will require the addition of approximately 30 feet
of asphalt along the frontage of the development. The construction of
curbing and sidewalk is also required.
9. The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 95-0498, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
10. The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the roadway improvements herein specified.
