SHORT PLAT NO. SP-737-92 ) CONCLUSIONS AND
DECISION
THIS MATTER, an applicarion for subdivision of land, from David Hepton has been
receiy~d and decided upon, pursuant to Spokane County Subd.ivision regulations, on the
~ S'~day of February, 1992.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide .60 acres into 2 lots for the development of single family
residences.
3. The proposal is located at the northeast corner of the intersection of Dora Road and Rutter
Avenue in Secrion 12, Township 25 North, Range 43 EWM, Spokane County,
Washington.
4. The current zoning of the property is Urban Residential-3.5 (UR-3.5). The proposed lot
sizes, frontage and intended uses are allowed within this zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed are generally in accord with this category.
6. The required public notice was provided for this proposal and agencies having a potential
interest in the project were notified and recommendations solicited. -
7. No one in the area commented on the proposal.
. 8. Rutter Avenue located adjacent to the proposal is designated as a Minor Arterial in the
Spokane County Arterial Road Plan. The recommended future right of way width for
Rutter Avenue is 80 feet. The existing right of way width is 34.5 feet. In order to
implement the arterial road plan, the County Engineer has required dedication of a 14.75
foot wide strip of land along Rutter Avenue. In addition, the County Engineer has
required that a future acquisition area be reserved 8 feet in width along Rutter Avenue for
future roadway improvements.
9. Recognizing the recommended conditions and Spokane County development standards,
the proposed subdivision makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
10. The project is exempt from environmental review under the State Envuonmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-737-92 is hereby APPROVED unril March 1, 1995, subject to condirions noted
below. Most of the conditions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIONS '
1. The preliminary plat of record approval is for the property legally described in the
application for this proposal.

2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone(s) as
amended.
3. The final plat shall be designed substantially in conformance with the preliminary plat
of record. No increase of density or number of lots shall occur without a change of
condirion application submittal and approval.
4. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
5. Appropriate road name(s) shall be indicated.
6. A specific and detailed site improvement plan will be submitted for Planning
Department review approval as part of the final plat review and prior to the issuance of
a building permit, change of use permit or certificate of occupancy. Appropriate bonds
or pzoof of construction must be submitted at the time of final plat review to cover the
estimated cost of on-site improvements which were required as a part of the project
approval.
7. The preliminary plat is given conditional approval for three (3) years, specifically to
March 1, 1995. The applicant may request an extension of time by submitting a written
request approximately forty-five (45) days prior to the above expiration date.
8. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate urility companies shall be received
with the submittal of the final plat.
. 9. Three (3) current certificates of title shall be furnished to the Planning Department prior
to filing the final plat.
10. The Spokane County Planning Department shall prepare and record widi the County
Auditor a Title Notice specifying a future land acquisition area for road right-of-way
and utilities. The reserved future acquisition area Title Notice shall be released, in full
or in part, by the Planning Department. The notice should be recorded within the same
time frame as an appeal and shall provide the following:
a. At least 8 feet of reserved future acquisition area for road right-of-way and
utilities, in addition to the existing and/or newly dedicated right-of-way along
Rutter Avenue. NOTE: The County Engineer has required 14.75 feet of new
dedication.
b. Future building and other setbacks required by the Spokane County Zoning Code
shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs should
be located within the future acquisition area for road right-of-way and urilities. If
any of the above improvements are made within this area, they shall be relocated
at the applicant's expense when roadway improvements are made.
d. The future acquisirion area, unril acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as landscaping,
parking, surface drainage, drainfield, signs or others) shall be considered interim
uses.
e. The property owner shall be responsible for relocating such "interim"
unprovements at the time Spokane County makes roadway improvements after
acquiring said future acquisition area.
11. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement:
"Side yard and rear yard setbacks shall be determined at the time building pernuts are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
ind.icated on this plat may be varied from if proper zoning approvals are obtained."

12. A plan for water facilities adequate far dQmestic seMee and f'uae protecdan shall be
approved by the vvater purveyor, apprvpriate fire protectian distxict, Cvunty Bu-ilding &
Safety Departunent and Coun~ Health Distriet. The agencies will certify vn the Water
Plan, prior to the fi~ing of afinal pla~ that the plan is in canformance with their
respectiue neeis and regulations. The Water Plan arxd certification shall be drafted an a
transparency suitable for reprvduction and be signed by the plat sponsor.
13. The water purveyor sha11 cerLify that apgropriate contractual aYrangements and schedule
of improvements have, been ffiade rvith the plat sponsor for construction of the water
systern in accorda.nce with the approved V4'ater P1an. T'he time scheduie shall provide
far completion of the water s}rstem and inspection by the appmpriaCe health authonties
privr to applieatian for build.ing pernm'ts within the inal plat. 'I'he arrangements or
agreer,nents sha1l include a provision holding Spokane County and the purveyor
harrrless from clartrns by any Iot purchaser refused a building gez-rnit due to the failure
of the subdivisian sponsvr to satisfactarily ~omplete the approved vwater system.
14. The £inaT p1at dedication sha1l contain the fallvwing staternent:
"The pubEc water system, pursuant to the Water Plan approved by county and state
health authorities, the lvcal fire grotectian district, County Buiiding & Safety
Department and water purveyvr, shall be installed within this subdivision, a.nd the
applicant shall provide for individual domestic water service as weil as fize protection to
each lot piior ta sale of each lot and prior to issuance of a building per€nit for each lot."
15. No bvilding perrnit wi11 be issued far any Iot wittrin the final plat until certi~'~ed by a
Washington state-licensed eflgineer that "the water systern has been insta]Ted pursuant
to t.he approved Water Plan far the ~`inal glat" inciuding asigned license stamp. The

76. The Water Plan and the above four (4) conditions of approval regarding the Water Plan .

an existing, aPprovW water system w-i11 p~ovide adeqiiate domestic and fire protection

17. A survey is required prior to the filing of a fina1 p1at.
COUNTY ENGINEER'S DEFAR'TMEN'T CONDITIONS
I . The conditional appr~val of the plat is given by the County Engineer subjeet to
dedicafion of nght-af-way and appraval of the road system as indicated in the
preliminary pTat of reeord.
2. No construction work is to be performed within the existing or propasw pubhc right-
of way until a permit has been issued by the County Engineer. All work is subject ta
inspection and approval by the County Engineer.
3. Individual driveway access perrrits are required pri,or to issuance of abuilding pernzit
for driveway approaches tv the county road system.

1.0. As an altemative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accornplish the road
improvements stated herein by joining and participating in aCvunty Rvad Praject
(CRP) to the e~xtent of the required road improvements. At such time as an RID is
created or any Raad Irnprrovennent Froject is san,ctioned by Spokane Cvunty, the
improvernents required (curb, s3dewalk, crai.nage contral and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assi,gns. This provision is applicable to Rutter Avenue and Dora Road.
11, The fQllowing staternent shail be placed xn the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petition for the formafion of a Road Improvement District
(RID) by the pedtion n.aethod pursuant to Chapter 36.58 RCW, whieh petition
includes rhe owner(s)' prapertyt and further not to abject, by the signing of a
6allot, to the fozxnation af an R.1D by the resolution methad pursuant to Chapter 36.88 RCW, which resalution includes the owner(s)" property. If an RDD is
forrned by either the petztion or resolution method as pravidexi far in Chapter
36.58 RCW, the Owner(s) or successar(s) furtner agree:
(a) that the uxxprovement(s) or construction coritemplate.d within fi.he proposed
RDD is feasible;
(b) that the 6enefits to be derived from the farrnation of the RiD by the property
inc3uded therein, together with the amautat of any County participatian,
exceed, the cost and expense of forrnation af the RID; and
(e) that the property within the prvpvsed RTrI is suff caently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as
authorized undeT-,~CW 36.88.090, to abject to any assessment(s) on the
property as a result af the improvements called for in conjunctian with the
farmation vf an RIID by either petitian ar resolution methvd under Chapter
36.88 RCW, and to appe.al to tkre Superior Court the decisian af the Board
of Caunty Comrnissioners af~'irming the final assessment rall.
It is further agreed that at such time as arY RID is cmated or any Road
Improvement Froject is sanctiane.d by Spokane County, the irnpravements
-required (curb, si~ewalk, drainage contro1 and paving) will be at the sole
expense of the undersigned owner(s), xheir heirs, ,grantees arxd assigns
wxthout participation by 5pokane County.
The R-ID waiver cantainel i-n this agreernent sha11 expire after ten (10) years
from the date of execution beXaw. HvwFever, the awner(s) or sraccessor(s)
agree that if said RED waiver expires without construction of the required
irr~provernents, the owner(s) or successor(s) agree to canstruct the required
improvements at their ovvn expense, pay to Spokane County the then
estimated cast of t.he required imprvvements to enable the County to
cvmplete the same, or fumish a bvnd or ather secure methol suitable to the
County (which may inelude the execution of another RID waiver agreement)
prvvxd-ing for or securing to the County the actual constmction of the
improvements.

12. The Cvunty Engineer has desig-nated Typical Roadway Sectian Nurnb~r Twa, Local
Access standard far the irnproveznent of Dora Road, vuhich is adjacent to the groposed
development. "This will require the addition of apprvxunately 9- 11 feet of asphalt
along the frontage of the development T'he construction of curbing is a1so required.
13. The County Engineer has designated Typical Roadway Section Number 7'wo, IVaar
Arterial stand,ard for t.he impravement of Rutter Avenue, which is adjacent to the
propased development. Th.is will require the additian of apprvxirmtely 12 - 14 feet of .

15. The County Engineer has exami.ned this development proposal and has determined that
the impact of this proposal upan the existing county road system warran.ts the
dedication of additional -righz-of-way and the roadway improvements hereYn specif'iedL
16. This pFOpose.d subdivision or development praposal is located within adrainage basin
urhich has been idenrified by the Spokane County Engineer's off'ice as having
starmwater runoff problems. Since this praposed subdivision or development proposal
is affected by or is a cnntributor to st~orrnwater flows, property owmers should
partzcxpate in the pla.nning and implernentation of a futu.re basinwide stormwater
rnanagement system. The following statement shall be placed in the plat dedicatian:
