As requested in your letter of `!ay 19, 1981, and discussed in our meettng
of Mav 21, we have reviewed the possibility of allowing portions of County road
righ:-of-way, along Sprague Avenue and Adams Road, :o be used for landscaping
and "208" arainage in conjunc=ion wi:h the priva[e development on propertv at
the nor:hwest corner of Sprague Avenue and Adams Road.
There are no plans :o widen or change Sprague Avenue or Adams Road tha:
would necessitate the use of .he publLC right-of-way behind the sidewalk area, noW or in the foreseeable tuture. Consequently, the Coun:y Engineer's office
would be willing to gran: a permit for landscapiag and "208" drainage within
these righ;s-of-way, as proposed Ln your plan.
The other mat:er discussed ar our meeting was the proposed vacation of
portions of Riverside Avenue. We Will support the proposed vacation, as
discussed, tha: is, ZO feet along the south side of Riverside Avenue, retaining
:he 70-ioo: diameter cul-de-sac and a radius or cutoff at Adams Road, condi-
tioned upoa the construction of concrete curb along the frontage of your ,
client's property and necessary utili:y relocatioas.
To keep the process moving, we have scheduled the vacation hearing foc '
Tuesday, June 16, 1987, 5:30 p.m., at City liall Council Chambers. ~

STORM DRAINAGE EASEMENT
The Grantor(s) Alvin J. Wolff, Jr. and Eugenia E. Wolff of the County of Spokane,
State of Waehingtoa, for and in consideration cf Mutual Benefits, the receipt of
which is herebp acknowledged, grant to Spokane County, a politfcal subdivision of
the State of Washington, an Easement over, under, upon and across the hereinafter
deacribed lands situated in the County of Spokane, State of Washington:
That portion of Lot 3 in Block 3 of VERADALE HOMES SUBDIVISION OF TRACT 61
OF VERA, as per plat thereof cecorded in Volume 2 of Plats, Page 41;
TOGETHER WITH that portion of vacated Sprague Avenue, 40 feet wide, that
lies North of the old Great Northern Railroad right of way adjoining said
lot on the South; described as follows:
The North 55 feet of the South 135 feet of Che East 25 feet of the West SS
feet of the Southeast Quarter (SE 1/4) of Section 14, Township 25 Nortb,
Range 44 East, W.M., TOGLTHER WITH the North 15 feet of the South 95 feet
of the East 70 feet of the West 125 feet of the Southeast Quarter (SE 1/4)
of Section 14, Towaship 25 NorCh, Range 44 East, W.M.
Situated in the County of Spokane, State of Washington.
DRAINAGE EASEMENT, as shown hereinabove is for the purpoae of installing, operating
and maintaining drainage swales and drainage facilitiea to dispose of runoff, are
hereby granted. The County of Spokane is hereby granted the right of ingress and
egress to all drainage easements adjacent to the public right of way. The property
owaer shall maintain the drainage swale with a permanent live cover of lawn turf,
with optional shrubbery and/or trees, which do not obetruct the flow and
percolation of storm drainage water in the drainage swale as indicated bq the
approeed plans.
The Grantor(s) hereby release Spokane County, and all its officers, employees, and
agents from anp responsibility or liability for any damage whatsoever including
inverse condemnation by or to any and all persons or property arising out of or in
any way incident to or attributable to the storm drainage within said Easement.
The Eaeement described hereinabove ia to and shall run with the land. No
modification of the boundariee of said Easement can be made without the prior
approval of Spokane County.
