BEFORE THE SPOKANE COUNTY PLANNING DEPARTMENT ZN THE MATTER OF ) FINDINGS OF FACT, SHORT PLAT NO. SP-738-92 ) CONCLUSYONS AND DECISION THIS MATTER, an application for subdivision of land, from Phyllis Lamb has been received and decided upon, pursuant to Spokane County Subdivision regulations, on the 6th day of March, 1992. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning. 2. The proposal is to divide .95 acres into two (2) lots for residential uses and those uses perniitted in the underlying zone. 3. The proposal is generally located between Progress Road and St. Charles Road approximately 350 feet north of Sixteenth Avenue in the SE 1/4, SE 1/4 of Section 23, Township 25 North, Range 44 E.W.M. Spokane County, Washington. 4. The current zoning of the property is Urban Residential-3.5 (UR-3.5). The proposed lot sizes, frontage and intended uses are allowed within this zone. The Urban Residential-3.5 zone does allow duplexes for lots which are twice the minimum required for single family units, or 20,000 square feet. 5. The Spokane County Comprehensive Plan designates this area as Urban The development and uses proposed axe generally in aceord with this category. 6. Surrounding uses are primarily single family residences. 7. The required public notice was provided for this proposal and agencies having a potential interest in the project were notified and recommendations solicited. 8. Comments were received from an adjoining property owner. The chief concerns expressed were unscreened outdoor storage, unsanitary storage of horse manure, and possible building code violations for an existing outbuilding. The appropriate method of correcting the site deficiencies noted above is the the fornlal compltint process througll each ageney of jurisdiction. 9. Large animal keeping is an existing nonconforming use on the proposed Lot B of this preliminary plat. Division of this paxcel will tenninate those nonconforming rights to keep large animals. 10. Recognizing the recommended conditions and Spokane County development standards, the proposed subdivision makes appropriate provisions for the public health, safety and general welfare and that the public use and interest will be served by platting the subdivision. 11. The County Engineer has requested dedication of an additional 10 feet of right-of -way on Progress Road and 25 feet on St. Charles Road which are designated as Local Access Streets on Spokane County's Arterial Road Plan. 12. The proposed short plat will be served by a public water system. Waste water disposal will be as authorized by the Director of Urilities. 13. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). . ' DECISxON Based upon the above noted Findings of Fact and Conclusions, Short Plat Applicarion SP-738-92 is hereby APPROVED until April 1, 1995, subject to conditions noted below. Most of the conditions of approval shall be accomplished by the applicant and/or i f - • . , . FTNDINGS AND DECISION SP-738-92 Page 2 sponsor prior to finalization of the short subdivision. This decision is final unless appealed in writing, consistent with adopted appeal procedures. These Conditions of Approval apply to applicant(s), owner(s) of the property, heirs, assigns or any successors-in-interest to property. PLANNING DEPARTMENT CONDITIONS . 1. The preliminary plat of record approval is for the property legally described in the application for this proposal. 2. Upon finalization of the proposed short plat the nonconforming rights for large animal keeping shall expire. 3. All conditions imposed by the Planning Department shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns and successors. 4. The proposal shall comply with the Urban Residential-3.5 (UR3.5) zone(s) as amended. 5. The final plat shall be designed substantially in conformance with the preliminary plat of record. No increase of density or number of lots shall occur without a change of condition application submittal- and approval. 6. The Planning Director/designee shall review any proposed final plat to ensure compliance with these Findings and Conditions of Approval. 7. Appropriate rold name(s) shall be indicated. S. The preliminary plat is given conditional approval for three (3) years, specifically to March 1, 1995 The applicant may request an extension of time by submitting a written request approximately forty-five (45) days prior to the above expiration date. 9. Appropriate utility easements shall be indicated on copies of the proposed final plat. Written approval of utility easements by appropriate utility companies shall be received with the submittal of the final plat. 10. Three (3) current certificates of title shall be furnished to die Planning Department prior " to filing the final plat. 11. The final plat map shall ind.icate by a clear, dashed line the required yard setbacks from all private, "Tract X" or public roads. The dedication shall contain the following statement: "Side yard and rear yard setbacks shall be deternvned at the time building pernzits are requested unless these setbacks are specifically drafted on this final plat. The setbacks indicated on this plat may be varied from if proper zoning approvals are obtained." 12. No water plan is required, and a simple tap is needed at the time of building permit release. 13. A survey is requued prior to the filing of a final plat. COUNTY ENGINEER'S DEPARTMENT CONDITIONS 1. The conditional approval of the plat is given by the County Engineer subject to dedication of right-of-way and approval of the road system as indicated in the preliminary plat of record. 2. Plans, profiles, and cross-sections as designed to County standards showing proposed street centerline and curb grades shall be submitted to the County Engineer for approval prior to construction and/or the filing of each final plat; road plans to be prepared under the direction of a licensed Professional Civil Engineer. FINDINGS AND DECISION SP-738-92 Page 3 3. No construction work is to be performed within the exisring or proposed public right- of-way until a pez-mit has been issued by the County Engineer. All work is subject to inspection and approval by the County Engineer. 4. Road design, construction, and drainage control for one-half (1/2) rights-of-way and stub road connections are the responsibility of the owner, developer or applicant. 5. Appropriate provision shall be made tlat the following-described property be held in trust until ttle continuation of the streets be dedicated or deeded: a one (1)-foot strip at the ends or edges of all streets that terminate or border the subdivision boundary. (Temporary cul-de-sacs are required when streets terminate at the subdivision boundaries.) 6. Individual driveway access pennits are required prior to issuance of a building permit for driveway approaches to the county road system. 7. Dedication of 25 feet of addirional rigllt-of-way along St. Charles Street is required. 8. Dedication of 10 feet of additional right-of-way along Progress Road is required. 9. Existing county roads providing• direct access to the plat shall Ue paved and/or curbed to Spokane County standards. 10. The word "applicant" shall include ttie owner or owners of the property, his heirs, assigns and successors. 11. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purpose is the formation of a Road Improvement District (RID) for said improvements, pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Progress Road and St. Charles Road. 12. As an alternative method of constructing tie road improvements stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvements. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, cirainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Progress Road and St. Charles Road. 13. The following statement shall be placed in the plat dedication: "The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a Road Improvement District (RID) by the petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s)' property, and further not to object, by the signing of a ballot, to the formation of an RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution includes the owner(s)' property. If an RID is fonned by either the petition or resolution method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: (a) that the improvement(s) or construction contemplated within the proposed , RID is feasible; (b) that ttie benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceed the cost and expense of formation of the RID; and (c) that the property within the proposed RID is sufficiently developed. Provided further that the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the fonnation of an RLD by either petition or resolution method under Chapter FINDINGS AND DECISION SP-738-92 Page 4 36.88 RCW, and to appeal to the Superior Court the decision of the Board of Counry Commissioners affirming the final assessment roll. It is further agreed that at such time as an RID is created or any Road Ymprovement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns without participation by Spokane County. The RID waiver contained in this agreement shall expire after ten (10) years from the date of execution below. However, the owner(s) or successor(s) agree that if said RID waiver expires without construction of the required improvements, the owner(s) or successor(s) agree to construct the required improvements at their own expense, pay to Spokane County the then estimated cost of dle required improvements to enable the County to complete the same, or furnish a bond or other secure method suitable to the County (which may include the execution of another RID waiver agreement) providing for or securing to the County the actual construction of the improvements. All of the requirements of this agreement shall run with the land and shall be bind.ing upon the owner(s), their successor(s) or assign(s)." This provision is applicable to Progress Road and St. Charles Road. 14. The County Engineer has designated Typical Roadway Section Number Two, Local Access standard for the improvement of St. Charles Street which is adjacent to the proposed development. This will require the addition of approximately 30 feet of asphalt along the fronr.age of the development. The construction of curbing is also required. 15. The County Engineer has designated Typical Roadway Section Number Two, Local Access standard for the improvement of Progress Road, which is adjacent to the proposed development. This will require the addition of approximately 7-9 feet of asphalt along the frontage of the development. The construction of curbing is also required. 16. Private road(s) shall be improved to Spokane County standard for a private road standard serving two lots, and are subject to approval under Section 10.207 of the Spokane County Fire Code. 17. The following provisions shall be made on the final plat: The following-described property shall be held in trust until the continuation of the private road and the Tract "X" is deeded or dedicated: A one (1)-foot strip at the ends or edges of all private Tract "X" that terminate or border the plat boundary. 18. All vested owners shall sign and record private road documents as prescribed by the Spokane County Engineer. These documents shall be reviewed and approved by the Spokane County Englneer prior to recording with the Spokane County Auditor. Record.ing numbers shall be referencbd in the ded.icatory language of the plat. . 19. The following statement shall be placed in the plat dedication: "WARNIING: Spokane County has no responsibility to build, improve, maintain or otherwise service the private roads contained within or provide service to the property described in this plat. By accepting this plat or subsequently by allowing a building permit to be issued on property on a private road, Spokane Counry assumes no obligation for said private road, and the owners hereby acknowledge that the County has no obligation of any kind or nature whatsoever to establish, exaaline, survey, construct, alter, repair, improve, maintain or provide drainage or snow removal on a private road. This recJuirement is and shall run with the land and shall be binding upon the owner(s), their heirs, successors or assigns, including the obligation to participate in the maintenance of the private road as provided herein." 20. The proposed subdivision shall be improvecl to the standards set forth in Spokane County Board of Com.missioners Resolution No. 80-1592, as amended, which resolution establishes regulations for roads, approaches, drainage and fees in new construcrion. The County Engineer has examined this development proposal and has deternuned tllat the impact of this proposal upon the existing county road system warrants the dedication of additional right-of-way and the roadway improvements hexein specified. 22. This proposed subd.ivision or development proposal is located within a drainage basin which has been identified by*the Spokane County Engineer's office as having stormwater runoff problems. Since this proposed subdivision or development proposal is affected by or is a contributor to stormwater flows, property owners should participate in the planning and implementation of a future basinwide stormwater management system. The following statement shall be placed in the plat dedication: "The owner(s) or successor(s) in interest agree to join in any County-approved stormwater management program and to pay such rates and charges as may be fixed through public hearings for service or benefit obtained by the planning, design, constructing, maintaining or operation of stormwater control facilities." 23. The following statement shafl be placed in the final plat dedication: "The private road as shown hereon is an easement which provides a means of ingress and egress for those lots within the subdivision having frontage thereon." 24. There may exist utilities, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligation for adjustments or relocation regarding these uti.lities. Applicant(s) should check with the applicable utiliry purveyor and the Spokane County Engineer to deternzine whether applicant(s) or the utility is responsible for adjustment or relocation costs and to make arrangements for any necessary work. ~ 25. St. Charles Street is an unma.intauled County dedicated right of way, applicant shall execute a Notice to the Public #4 which allows the use of county right of way for a private road until such time as the right of way on St. Charles Street is constructed to C. 26.County Road standards and established as a County road. Applicant shall request either a vacation or license to cross Lot 12 Block 4, Sullivan Way Addition, a 1 foot strip. COUNTY HEALTH DISTRICT CONDITIONS 1. The final plat shall be designed as indicated on tie preliminary plat of record and/or any attached sheets as noted. 2. Approgriate utility easements shall be indicated on copies of the preliminary plat of record for dishibution by the Planning Department to the utility companies, Spokane County Engineer and the Spokane County Health District. Written approval of the easements by the utility companies must be received prior to the submittal of the final plat. 3. A combined surface water and sewage disposal detailed plan shall be approved by the Spokane County Engineer and the Spokane County Health District prior to the issuance of any on-site sewage disposal permit or building permit for this project. 4. Water service shall be coordinated through the Director of Utilities, Spokane County. 5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 6. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. 7. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that a suitable site for on-site sewage disposal system is available on Parcel B. 8. Subject to specific application approval and issuance of permits by the health officer, the use of an individual on-site sewage d.isposal systein may be authorized. . . . . . rIND1NGS AND DECISZON SP-738-92 Page 6 9. The dedicatory language of the plat wrll state: "Subject to specific application approval and issuance of pemii.ts by the Health Of~'icer, the use of an on-site sewage system may be authorized." 10. T'he dedicatory language on the plat shall state:. "Use of private wells and water systems is prohibited." 11. The plat ded.ication will contaul a statement to the effect that: "The public water system, as approved by county and state health authorities, the local fire district and purveyor, will be installed within this plat, and the subdivider will provide for individual domestic water service as well as fire protection to each lot/tract prior to sale of each lot/tract." COUNTY UTILITIES DEPARTMENT CONDITIONS 1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer d.isposal systems is hereby authorized for Lot B. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2. The dedication shall state: "The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of ULID by petition method pursuant to RCW 36.94, which perition includes the owner(s)' property; and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED, this condition shall not prohibit the owner(s) or successor(s) from objecting to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94." 3. All of the requirements of this agreement shall run with the land and shall be binding upon the owner(s), their successor(s) or assign(s)." This provision is applicable to Progress Road and St. Charles Road. 14. The County Engineer has designated Typical Roadway Section Number Two, Local Access standard for the improvement of St. Charles Street which is adjacent to the proposed development. This will require the addition of approximately 30 feet of asphalt along the frontage of the development. The construction of curbing is also required. 15. The County Engineer has designated Typical Roadway Section Number Two, Local - Access standard for the improvement of Progress Road, which is adjacent to the proposed development. This will require the addition of approximately 7-9 feet of asphalt along the frontage of the development. The construction of curbing is also requixed. 16.
