SP-739-92 ) CONCLUSYONS AND DECISION THIS MATTER, an application for subdivision of land, frozn Judy Wesslen has been received and decided upon, pursuant to Spokane County Subdivision regulations, on the _b~l"') day of March, 1992. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning. 2. The proposal is to divide 1.04 acres into 21ots for the development of single family residences. 3. The proposal is located ul the Spokane Valley on the northwest corner of the intersection of Wellesley Avenue and Keller Road in. Section 34, Township 26 North, Range 44 , EWM, Spokane County, Washington. 4. The current zoning of the property is Urban Residenrial-3.5 (LJR-3.5). The proposed lot sizes, frontage and intended uses are allowed within this zone. 5. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses proposed are generally in accord with this category. ' 6. The required public notice was provided for this proposal and agencies having a potential ' interest in the project were notified and recommendations solicited. 7. No one in the area commented on the proposal. 8. Recognizing the recommended conditions and Spokane County development standards, the proposed subdivision makes appropriate provisions for the public health, safety and general welfare-and that the public use and interest will be served by platting the subdivision. 9. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-739-92 is hereby APPROVED until April 1, 1995, subject to conditions noted below. Most of the conditions of approval shall be accomplished by the applicant and/or sponsor prior to finalization of the short subdivision. This decision is final unless . appealed in writing, consistent with adopted appeal procedures. These Conditions of Approval apply to applicant(s), owner(s) of the property, heirs, assigns or any successors-in-interest to property. PLANNING DEPARTMENT CONDITIONS 1. The preliminary plat of record approval is for the property legally described in the application for this proposal. 2. The proposal shall comply with the Urban Residential-3.5 (tJR-3.5) zone(s) as amended. 3. The final plat shall be designed substantially in conformance with the preliminary plat of record. No increase of density or number of lots shall occur without a change of condition application submittal and approval. ~ . ' . FINDINGS AND DECISION SP-739-92 Page 2 4. The Planning Director/designee shall review any proposed final plat to ensure compliance with these Findings and Conditions of Approval. - 5. Appropriate road name(s) shall be indicated. 6. The preliminary plat is given conditional approval for three (3) years, specifically to April 1, 1995. The applicant may request an extension of time by subrrumng a written request approximately forty-five (45) days prior to the above expiration date. 7. Appropriate utility easements shall be indicated on copies of the proposed final plat. Written approval of utility easements by appropriate utility companies shall be receive,d with the submittal of the final plat. 8. Three (3) current certificates of title shall be furnished to the Planning Department prior • to filing the final plat. 9. The Spokane County Planning Department shall prepare and record with the County Auditor a Title Notice specifying a future land acquisition area for road right-of-way and utilities. The reserved future acquisidon area Title Notice shall be released, in full or in part, by the Planning Department. The notice should be recorded within the same time frame as an appeal and shall provide the following: a. At least lb feet of reserved future acquisition area for road right-of-way and utilities, in addition to the existing and/or newly dedicated right-of-way along Wellesley Avenue. NOTE: The County Engineer has required 4 feet of new dedication. b. Future building and other setbacks required by the Spokane County Zoning Code , shall be measured from the reserved future acquisition area. c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be located within the future acquisition area for road right-of-way and utiliries. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are'made. d. The future acquisition area, until acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall be considered interim . uses. e. The property owner shall be responsible for relocating such "interim" improvements at the time Spokane County makes roadway improvements after acquiring said future acquisiaon area. 10. The final plat map shall indicate by a clear, dashed line the required yard setbacks from all private, "Tract X" or public roads. The dedication shall contain the following statement: "Side yard and rear yard setbacks shall be detemuned at the rime building pernuts are requested unless these setbacks are specifically drafted on this final plat. The setbacks indicated on this plat may be varied from if proper zoning approvals are obtained." 11. A plan for water facilities adequate for domestic service and fire protection shall be approved by the water purveyor, appropriate fire protection district, County Building & Safety Department and County Health District. The agencies will certify on the Water Plan, prior to the filing of a final plat, that the plan is in conformance with their respective needs and regulaaons. The Water Plan and certification shall be drafted on a transparency suitable for reproduction and be signed by the plat sponsor. 12. The water purveyor shall certify that appropriate contractual arrangements and schedule of improvements have been made with the plat sponsor for construction of the water system in accordance with the approved Water Plan. The time schedule shall provide for completion of the water system and inspection by the appropriate health authorities prior to application for building pernuts within the final plat. The arrangements or agreements shall include a provision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a building permit due to the failure of the subdivision sponsor to satisfactorily complete the approved water system. i . . FINDINGS AND DECISION SP-739-92 Page 3 13. T"he final plat dedication shall contain the following statement: "The public water system, pursuant to the Water Plan approved by county and state health authorities, the local fire protection district, County Building & Safety Department and water purveyor, shall be installed within this subdivision, and the applicant shall provide for individual domestic water service as well as fire protection to each lot prior to sale of each lot and prior to issuance of a builcling permit for each lot." 14. No building permit will be issued for any lot within the final plat until certified by a Washington state-licensed engineer that "the water system has been installed pursuant to the approved Water Plan for the final plat" including a signed license stamp. The certif'icarion 'may be in the form of a letter, but is preferred to be certified on a copy of the Water Plan as a schematic map showing the "as-bui.lt" water system. 15. The Water Plan and the above four (4) conditions of approval regarding the Water Plan may be waived by the Planning Director/designee upon receipt of letters from the appropriate water purveyor and fire protection district stating that simple connections to an existing, approved water system will provide adequate domestic and fire protection water to ensure the public health, safety and general welfare. 16. A survey is required prior to the filing of a final plat. 17. If, in the course of site alterarion connected with this proposal, prehistoric human remains or any archaeological artifacts which may indicate the presence of prehistoric . human remains are discovered on the site, the applicant shall immediately stop the site alteration and accomplish (1) and/or (2) below, as appropriate. (1) Apply for and receive a permit to proceed with site alteration from the State Historic Preservation Officer, in accord with the Indian Graves and Records Act (RCW 27.53). (2) Consult with and, if the site is designated by the City/Counry Historic Landmarks Cominission, apply for and receive a"Certificate of Appropriateness" from that Commission, in accord with the City/County Historic Landmarks Ordinance (Spokane County Commissioner's Resolurion No. 82-0038) before resuming site alteration. COUNTY ENGINEER'S DEPARTMENT CONDITIONS 1. The conditional approval of the plat is given by the County Engineer subject to dedication of right-of-way and approval of the road system as indicated in the preliminary plat of record. 2. No construction work is to be performed within the existing or proposed public right- of-way until a permit has been issued by the County Engineer. All work is subject to inspection and approval by the County Engineer. 3. Individual driveway access permits are required prior to issuance of a building permit for driveway approaches to the county road system. 4: Dedication of 4 feet of additional right-of-way along Wellesley Avenue is required. 5. Dedication of 10 feet of additional right-of-way along Keller Road is required.' 6. Existing county roads providing direct access to the plat shall be paved and/or curbed to Spokane County standards. 7. Sidewalks are required along the arterial(s) on Wellesley Avenue. 8. The word "applicant" shall include the owner or owners of the property, his heirs, assigns and successors. 9. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purpose is the formarion of a Road Improvement District (RID) for said improvements, pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road Improvement Project is sancrioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing . . , . FINDINGS AND DECISION SP-739-92 Page 4 pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Wellesley Avenue and Keller Road. 10. As an altemative method of constructing the road improvements stated herein, the applicant may, with the approval of the Counry Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CR.P) to the extent of the required road improvements. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns._ This provision is applicable to Wellesley Avenue and Keller Road. 11. The following statement shall be placed in the plat dedication: The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a Road Ymprovement District (R.ID) by the petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s)' property, and further not to object, by the signing of a ballot, to the formation of an RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution includes the owner(s)' property. If an RID is formed by either the petition or resolution method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: (a) that the improvement(s) or construction contemplated within the proposed RID is feasible; (b) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceed the cost and expense of formation of the RID; and (c) that the property within the proposed RID is sufficiently developed. Provided further that the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the formation of an RID by either petirion or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court the decision of the Board of County Commissioners affirming the final assessment roll. It is further agreed tFiat at such time as an RID is created or any Road - Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewallc, drainage control and paving) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns without parricipation by Spokane County. The RID waiver contained in this agreement shall expire after ten (10) years from the date of execution below. However, the owner(s) or successor(s) agree that if said RID waiver expires without construction of the required improvements, the owner(s) or successor(s) agree to construct the required improvements at their own expense, pay to Spokane County the then estimated cost of the required improvements to enable the County to complete the same, or furnish a bond or other secure method suitable to the County (which may include the execution of another RID waiver agreement) providing for or securing to the County the actual construction of the improvements. ' All of the requirements of this agreement shall run with the land and shall be binding upon the owner(s), their successor(s) or assign(s)." This provision is applicable to Wellesley Avenue and Keller Road. 12. The County Engineer has designated Typical Roadway Section Number Two, Major Arterial standard for the improvement of Wellesley Avenue, which is adjacent to the proposed development. This will require the addition of approximately 12 - 14 feet of asphalt along the frontage of the development. The construction of curbing and . sidewalk is also required. 13. The County Engineer has designated Typical Roadway Section Number Two, Local Access standard for the improvement of Keller Road, which is adjacent to the proposed ~ . ' FIlNDrNGS AND DECISION SP-739-92 Page 5 development. This will require the addition of approxirnately 30 feet of asphalt along the frontage of the development. The construction of curbing is also required. 14. The proposed subdivision shall be unproved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80-1592, as amended, which resolution establishes regulations for roads, approaches, drainage and fees in new construction. 15. The County Engineer has examined this development proposal and has deternuned that the impact of this proposal upon the existing county road system warrants the dedication of additional right-of-way and the roadway improvements herein specified. 16. This proposed subdivision or development proposal is located within a drainage basin which has been idenrified by the Spokane County Engineer's office as having ' stormwater runoff problems. Since this proposed subdivision or development proposal is affected by or is a contributor to stormwater flows, property owners should participate in the planning and implementation of a future basinwide stormwater management system. The following statement shall be placed in the plat dedicarion: "The owner(s) or successor(s) in interest agree to join in any County-approved I stormwater management program and to pay such rates and charges as may be fixed through public hearings for service or benefit obtained by the planning, design, constructing, maintaining or operation of stormwater control faciliries." ' 17. The County Arterial Road Plan identifies Wellesley Avenue as a Principal arterial. The existing right-of-way width of 60 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan, in addition to the required right-of-way dedication, a strip of property 16 feet in width along the Wellesley Avenue frontage shall be set aside in reserve. This property may be acquired by Spokane Counry at the time when arterial improvements are made to Wellesley Avenue. 18. There may exist utilities, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligation for adjustments or relocation regarding these utilities. Applicant(s) should check with the applicable utility purveyor and the Spokane County Engineer to determine whether applicant(s) or the utility is responsible for adjustment or relocation costs and to make arrangements for any necessary work. 19. Applicant shall dedicate the applicable radius on Wellesley Avenue and Keller Road. COUNTY HEALTH DISTRICT CONDITIONS 1. The final plat shall be designed as indicated on the preliminary plat of record and/or any attached sheets as noted. 2. Appropriate utility easements shall be indicated on copies of the preliminary plat of record for distribution by the Planning Department to the utility companies, Spokane County Engineer and the Spokane County Health Distr-ict. Written approval of the easements by the utiliry companies must be received prior to the submittal of the final plat. 3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 4. Water service shall be coordinated through the Director of Utilities, Spokane County 5. Water service shall be by- an existing public water supply when approved by the Regional Engineer (Spokane), State Department.of Health. 6. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. 7. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that the existing on-site sewage disposal system(s) serving the residence located on tract B is wholly located within the boundaries of the tract. , I . . Subject to specific application approval and issuance of permits by the health officer, the use of (an) individual on-site sewage disposal system(s) may be authorized. 9. The dedicatory language of the plat will state: "Subject to specific application approval and issuance of pernuts by the Health Officer, the use of (an) on-site sewage system(s) may be authorized," 10. The dedicatory language on the plat shall state: "Use of private wells and water systems is prohibited." 11. The plat dedication will contain a statement to the effect that: "The public water system, as approved by county and state health authoriries, the local fire d.istiict and purveyor, , will be installed within this plat, and the subdivider will provide for individual domestic water service as well as fire protection to each tract prior to sale of each tract." COUNTY UTILITIES DEPARTMENT CONDITIONS 1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane Counry Health District and is further conditioned and subject to specific application approval and issuance of pernuts by the Health District. 2. T'he dedication shall state: "The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of ULID by petition method pursuant to RCW 36.94, which petirion includes the owner(s)' property; and further not to object by the . signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED, . this condition shall not prohibit the owner(s) or successor(s) from objecting to any assessment(s) on the property as a result of improvements called for in conjuncrion with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94." 3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 4.
