In consideration of the approval by Spokane County of Sh.o a 7 A- T
-7 4f) - 9 2 (hereinafter referred to as the
"Development"), the undersigned covenants and agrees that:
1. The subdivider/sponsor will construct the private roads and associated
drainage facilities in conformance with the approved plans on file in the
County Engineer's Office.
2. A lot is served by a private road when: a. the only road frontage for
the lot in the Development is on the private road, or; b. a lot having
frontage on more than one road(public or private) constructs an approach to
the private road.
3. The owner (s) of any lot created by the Development or alternation thereof
and served by a private road shall be responsible for maintenance of said
private road, including associated drainage facilities in conformance with
approved plans on file with the County Engineers office.
4. Maintenance financing of the private roads and associated drainage
facilities shall be in a manner determined by the owners of:
a. the majority of lots served by such private road;
. the majority of frontage of lots served by such private road;
c. the majority square footage of lots served by such private road; or

5. Sri the event such private road, including associated drainage facilities
is improved to Spokane County standards for public streets, and the County
is willing to accept the dedication of such road and facilities, each lot
owner shall execute any documents necessary to accomplish such dedication.
6. Owners of lots within the Development who are served by such road, may
sue and recover damages and attorney's fees from any owner of any lot within
the Uevelopment which is similarly served who refused to participate in the
road and drainage facilities, construction, financing, and maintenance.
7. WARNING: Spokane County has no responsibility to build, improve, or
.maintain._or__otherwise service- the private roads, including associated
drainage facilities, contained within or providinq service to the property
described in this Development. By accepting this Development or subsequently
by allowing a building permit to be issued for property on a private road,
Spokane County assumes no obligation for said private road and the owners
hereby acknowledge that the County has no obligation of any kind of nature
whatsoever to establish, examine, survey,'construct, alter, repair improve,
maiiltain, provide drainage or snow removal on a private road, or associated
drainage facilities.
8. This covenant and agreement shall run with the land and shall be binding
upon the owner, their heirs, successors or assigns, including the obligation
to participate in the maintdnance of the private road, and drainage
facilities as provided herein. . .

the property. The property owner or his representative shall inform each succeeding purchaser of all drainage
easements on the property and his responsibility for maintaining drainage facilities within said

4) Spokane County does not accept the responsibility of maintaining the drainage course on private
lots within drainage easements or floodplain areas, nor the responsibility for any drainage,
whatsoever, including but not limited to inverse condemnation to any properties due to deficient
construction and/or maintenance of drainage courses in drainage easements on private property.
5) The lowest building opening, including basement opening, for any building on ~6ZRA"-!s tA~ G
and J> BM- shall be high enough to allow a minimum slope of 2%
away from the building. All drainage shall be routed away from the building to natural drainages
or other lawful drainage features.
6) Development within this subdivision shall conform to the requirements of the National Flood
Insurance Program and Chapter 3.20 of the Spokane County Code. The lowest floor, including '
basement floor, for any structure shall be constructed according to the requirements of the
r' Spokane County Flood Zone regulations in effect at the time a building permit is issued.
Purchasers of property in this subdivision are warned of possible flooding or ponding and the
potential requirement to purchase Flood Insurance. This warning shall be carried in each and
every d:ed drawn to transfer ownership of any and all property within this plat in the Area of
Special Flood Hazard.
7) An approved lot grading plan exists for -Lots and

SHORT PLAT NO. SP-740-92 ) CONCLUSIONS AND
DECISION
THIS MATTER, an applicarion for subdivision of land, from John Lundin has been
received and decided upon, pursuant to Spokane County Subdivision regulations, on the
JJ day of March, 1992.
FINDINGS OF FACT AND CONCLUSIONS
1. The inclividual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane Counry Du-ector of Planning.
2. The proposal is to divide S acres into 4 lots for the development of single family
residences.
3. The proposal is located in the Ponderosa Area, south of and adjacent to Ferret Drive
approximately 1/4 mile west of Van Marter Road in Section 5, Township 24 North,
Range 44 EWM, Spokane County, Washington.
4. The current zoning of the property is Suburban Residential-1 (SR-1). The proposed lot
sizes, frontage and intended uses are allowed within this zone.
5. The Spokane County Comprehensive Plan designates this area as Suburban Plus (S+).
The development and uses proposed are generally in accord with this category.
6. The required public notice was provided for this proposal and agencies having a potential
interest in the project were notified and recommendations solicited.
7. A number of persons in the area commented on the proposal. The chief concern
expressed was that 41ots on 5 acres did not conform to the character of the existing
neighborhood.
The proposed short plat is within the Priority Sewer Service Area (PSSA) and the Urban
Impact Area (UTA) and is to be served by public sewer. Development of such areas to
the highest and best use, when practical, is encouraged to fund the utility improvements.
9. Recognizing the recommended condirions and Spokane County development standards,
the proposed subdivision makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
10. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISI4N
B ased upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-740-92 is hereby APPROVED until April 1, 1995, subject to conditions noted
below. Most of the condirions of approval sha11 be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procetiures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDI7'IONS
1. The prelimi.nary plat of record approval is for the property legally described in the
application for this proposal.

2. The proposal shall comply with the Suburban Residential-1 (SR-1) zone(s) as .
amended.
3. The final plat shall be designed substantially in conformance with the preliminary plat
of record. No increase of density or number of lots shall occur without a change af
condirion application submirtal and approval.
4. The Planning Directorldesignee shall review any proposed final plat to ensure
compliance with these Findings and Condidons of Approval.
5. Appropriate road name(s) shall be indicated.
6. The preliminary plat is given conditional approval for three (3) years, specifically to
April 1, 1995. The applicant may request an extension of time by submitting a written
request approximately forty-five (45) days prior to the above expiration date.
7. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate urility compames shall be received with the submittal of the final plat.
8. Three (3) current certificates of title shall be furnished to the Planning Department prior
to filing the final plat.
f 9. The final plat shall indlcate yard setback arc lengths on cul-de-sac lots which meet or
exceed the minimum frontage of the underlying zone of the final plat.
10. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement:
"Side yard and rear yard setbacks shall be deterniined at the time building pemuts are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
11. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water purveyor, approgriate fire protection district, County Building &
Safety Department and County Health District. The agencies will certify on the Water
Plan, prior to the filing of a final plat, that the plan is in conformance with their
respective needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor.
12. The water purveyor shall certify that appropriate contractual arrangements and schedule
of improvements have been made with the plat sponsor for construction of the water
system in accordance with the approved Water Plan. The time schedule shall provide .
for completion of the water system and inspection by the appropriate health authorities
prior to application for building permits within the final plat. The arrangements or
agreements shall include a provision holding Spokane County and the purveyor
harmless from claims by any lot purchaser refused a building permit due to the failure
of the subdivision sponsor to satisfactorily complete the approved water system.
13. The final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state
health authorities, the local fire protection district, County Building & Safety
Department and water purveyor, sha11 be installed within this subdivision, and the
applicant sha11 provide for individual domestic water service as well as fire protection to
each lot prior to sale of each lot and prior to issuance of a building permit for each lot."
14. No building pemut will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursuant
to the approved Water Plan for the final plat" including a signed license stamp. The
certification may be in the fonn of a letter, but is preferred to be certified on a copy of
the Water Plan as a schematic map showing the "as-built" water system.
15. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyor and fire protection district stating that simple connections to

an existing, approved water system will provide adequate domestic and fire protecrion
water to ensure the public health, safety and general welfare.
16. A survey is required prior to the filing of a final plat.
17. Prior to approval of road and drainage plans, you are required to coordinate with the
United States Postal Service to deternvne type and locarion of central mail delivery
faciliries which may include applicable easements for developments of three or more
homes.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
D. 2. Plans, profiles, and cross-secrions as designed to County standards showing proposed
street centerline and curb grades sha11 be submitted to the County Engineer for approval
prior to construction andJor the filing of each final plat; road plans to be prepared under
the direction of a licensed Professional Civil Engineer.

~ 3.; Drainage plans and design calculations showing the alignment of drainage facilities
shall be submitted to the County Engineer for approval prior to construction and/or the
filing of the final plat. Drainage plans to be prepared under the direction of a licensed
Professional Civil Engineer.
4. No construction work is to be performed within the existing or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
5. Individual driveway access pernuts are required prior to issuance of a building permit
for driveway approaches to the county road system.
6. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
7. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
8. The County Engineer has designated Typical Roadway Section Number Two, Local
Access standard for the improvement of Ferret Drive, which is adjacent to the proposed
development.
9. The proposed private road(s) as shown on the preliminary plat serving 41ots with no
extension possible is approved by the County Engineer, provided that the private road
as shown is in compliance with all private road standards.
10. Private road(s) shall be improved to Spokane County standard for a private road
urban/standard serving 4 lots, and are subject to approval under Section 10.207 of the
Spokane County Fire Code.

11. All vested owners shall sign and record private road documents as prescribed by the
Spokane County Engineer. These documents shall be reviewed and approved by the
Spokane County Engineer prior to recording with the Spokane County Auditor.
Recording numbers shall be referenced in the dedicatory language of the plat
12. The following statement shall be placed in the plat dedication: "WARNING: Spokane County has no responsibility to build, improve, maintain or
otherwise service the private roads contained within or provide service to the property
described in this plat. By accepting this plat or subsequently by allowing a building
permit to be issued on property on a private road, Spokane County assumes no
obligation for said private road, and the owners hereby acknowledge that the County
has no obligation of any kind or nature whatsoever to establish, examine, survey,
construct, alter, repair, improve, maintain or provide drainage or snow removal on a
private road. This requirement is and shall run with the land and shall be binding upon
the owner(s), their heirs, successors or assigns, including the obligation to participate
in the maintenance of the private road as provided herein."

13. The proposed subdivision shall be improved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes regularions for roads, approaches, drainage and fees in new
construction.
14. The County Engineer has examined this development proposal and has detennined that
the impact of this proposal upon the existing county road system warrants the
dedication of additional right-of-way and the roadway improvements herein specif'ied.
15. This proposed subdivision or development proposal is located within a drainage basin
which has been identified by the Spokane County Engineer's office as having
stormwater runoff problems. Since this proposed subdivision or development proposal
. is affected by or is a contributor to stormwater flows, property owners should
participate in the planning and implementarion of a future basinwide stormwater
management system. The following statement shall be placed in the plat de.d.ication:
"The owner(s) or successor(s) in interest agree to join in any County-approved
stonnwater management program and to pay such rates and charges as may be fixed
through public hearings for service or benefit obtained by the planning, design,
constructing, maintaining or operation of stonnwater control facilities."
16. The following statement shall be placed in the final plat dedicarion: "The private road as
shown hereon is an easement which provides a means of ingress and egress for those
lots within the subdivision having frontage thereon."
17. The private road as shown on the preliminary short plat does not comply with the
Spokane County Road Standards. A turnaround/cul de sac acceptable to both Spokane
County Engineer and the applicable Fire District shall be reviewed and approved by the
Spokane County Engineer prior to finalization of the short plat. It is the responsibility
of the applicant to provide written correspondence of the acceptance by the applicable
Fire District of the cul de sac.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the prelixninary plat of record andlor any
attached sheets as noted.
2. Appropriate utility easements shall be ind.icated on copies of the preliminary plat of .
record for distribution by the Planning Department to the utility companies, Spokane
County Engineer and the Spokane County Health District. Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat.
3. Sewage disposal method shall be as authorized by the Director of Utiliries, Spokane
County.
4. Water service shall be coordinated through the Director of Urilities, Spokane County
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
7. A plan for water faeilities adequate for domestic use, domestic irrigation use and fire
protection use shall be approved by the water purveyor. Said water plan must have
been approved by the fire protection district and the appropriate health authoriries. The
health authorities, water supplier (purveyor) and the fire protection district will certify,
prior to the filing of the final plat, on the face of said water plan that the plan is in
conformance with their requirements and will adequately satisfy their respective needs.
Said water plan and certification will be drafted on a transparency suitable for
reproduction.
8. The purveyor will also certify prior to filing the final plat on a copy of said water plan
that appropriate contractual arrangements have been made with the plat sponsor for
construction of the water system, in accordance with the approved plan and time
schedule. The time schedule will provide, in any case, for completion of the water

system and inspection by the appropriate health authorities prior to application for
building permits within the plat. The contractual arrangements will include a provision
holding Spokane County/City of Spokane, Spokane County Health District and the
purveyor harmless from claims by any lot/tract purchaser refused a building permit due
to failure of the plat sponsor to satisfactorily complete the approved water system.
9. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that a suitable site(s) for on-site sewage disposal
systems are available on tracts A- D.
10. The dedicatory language of the plat will state: "Subject to specific application approval
and issuance of permits by the Health Officer, the use of individual on-site sewage
system(s) may be authorized."
11. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
12. The plat dedication wi11 contain a statement to the effect that: "The public water system,
as approved by county and state health authorities, the local fire dismct and purveyor,
will be installed within this plat, and the subdivider will provide for individual domesric
water service as well as fi.re protection to each tract prior to sale of each tract"
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resolurion No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is conditioned
on compliance with all rules and regulations af the Spokane County Health District and
is further conditioned and subject to specific application approval and issuance of
permits by the Health District.
2. The dedication shall state:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of ULID by petition method pursuant to RCW
36.94, which petition includes the owner(s)' property; and further not to object by the
signing of a protest petition against the formation of a ULID by resolution method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
this condition shall not prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the property as a result of improvements called for in conjunction
with the formation of a UL7D by either petition or resolurion method under RCW
Chapter 36.94."
3. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane Counry, as amended.
4. The dedication shall state: "Each new dwelling unit shall be double-plumbed for connection to future areawide collection systems."
5. A dry sewer connection to the future areawide sewerage system shall be constructed.
Plans and specifications for the dry sewer connection shall be reviewed and approved
by the Utiliries Department
BUILDING AND SAFETY DEPARTMENT CONDITIONS
1 . Requirements of Fire District No. 8 need to be satisfied during the building permit
process.
